ISSUING REGULATIONS ON SPEAKING AND PROVIDING INFORMATION TO THE MEDIA

THE MINISTER OF CONSTRUCTION

Pursuant to Decree No. 36/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Pursuant to Decision No. 77/2007/QĐ-TTg dated May 28, 2007 of the Prime Minister on Regulations on Speaking and Providing Information to the Media;
Upon the proposal of the Director of the Office and the Head of the Cadre and Civil Servant Department,

DECISION:

Article 1. Attached hereto with this Decision is the "Regulation on Spokespersonship and Provision of Information to the Press".

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Director of the Office, Heads of units under the Ministry of Construction's Agency, and Heads of related units are responsible for implementing this Decision./.

 

 

REGULATIONS

PUBLIC STATEMENTS AND PROVISION OF INFORMATION TO THE PRESS

(Issued together with Decision No.: 27/2007/QĐ-BXD dated October 29, 2007 of the Minister of Construction)

Chapter 1:
GENERAL PROVISIONS

Article 1. Scope and Objects Regulated

1. These regulations govern speaking and providing information to the press; rights and responsibilities of spokespersons and information providers, and responsibilities of units and individuals in speaking and providing information according to current laws on the press.

2. These regulations apply to all cadres and civil servants, units, and organizations under the Ministry of Construction.

Article 2. Interpretation of Terms

In this Regulation, the following terms shall be understood as follows:

1. The Minister and Deputy Ministers are collectively referred to as Ministry Leaders.

2. The Office, Bureaus, Departments, Institutes, Construction Inspection... are collectively referred to as units. The Director of the Office, Deputy Directors of the Office, Bureau Chiefs, Deputy Bureau Chiefs, Department Chiefs, Deputy Department Chiefs, Chief Inspectors, Deputy Chief Inspectors, Directors, Deputy Directors of the Computer Center, Management Boards, Construction Publishing House; Editors-in-Chief, Deputy Editors-in-Chief of Construction Newspapers and Magazines... are collectively referred to as Unit Leaders. All other subjects are collectively referred to as Civil Servants.

Article 3. Spokesperson and Information Provider for the Press

1. The Director of the Office is assigned by the Minister of Construction to be the Spokesperson of the Ministry of Construction (hereinafter referred to as the SpokespersonThe activities of the Spokesperson shall comply with the regulations of the Party and the State in the field of ideological work, press and information, and the provisions of this Regulation.

2. The Spokesperson has the duty to speak and provide information to the press; maintain regular relations and create favorable conditions for mass media organizations to provide accurate and timely information about events occurring in the industry and sector.

3. The content of the Spokesperson's speech to the press is official information about the activities and viewpoints of the Ministry of Construction.

4. In cases where necessary, the Minister of Construction may directly or authorize a Deputy Minister to speak or provide information to the press on specific issues.

5. Unit Leaders and civil servants of the Ministry of Construction who are not assigned the task of speaking or providing information to the press shall not represent the Ministry of Construction to speak or provide information to the press; they shall not disclose investigative secrets, official secrets, false information, or untruthful information when providing information to the press.

6. When Unit Leaders or civil servants are requested by the press to give interviews, the person requested must report to the Minister about the interview content and only answer the interview after obtaining the Minister's approval.

Chapter 2:
PUBLIC STATEMENTS AND PROVISION OF INFORMATION TO THE PRESS

Article 4. Public Statements and Regular Information Provision

1. Organize regular information provision to the press on the activities of the Ministry of Construction, on the fields under the State management of the Ministry of Construction, through the following forms:

a. Provide daily information to the press about the activities and directive management work of the Ministry and its leadership; the production and business situation of enterprises under the Ministry by publishing on the Ministry of Construction's electronic news website.

b. At least once every three months, organize press conferences to provide regular information to the press. The organization of press conferences shall be carried out in accordance with current regulations.

c. When deemed necessary, organize regular information provision to the press in writing or directly at weekly meetings chaired by the Ministry of Information and Communications, in coordination with the Central Propaganda Department and the Vietnam Journalists Association.

d. Provide timely and accurate information to the Government's electronic news website in accordance with current regulations.

Article 5. Press Conferences and Interviews

1. During the press conference, the Spokesperson provides the press with information on:

a. The main activities of the Ministry's leadership.

b. The management and directive work of the Ministry of Construction.

c. The viewpoints and opinions of the Ministry's leadership on important and urgent issues that have been of concern to the media and society.

2. The Spokesperson is responsible for answering questions from reporters attending the press conference. In cases where the Spokesperson finds the content of the question exceeds their authority or is unclear and requires further consultation, they may defer answering and agree to respond to these contents at a suitable time.

3. The information provided during the press conference will be fully published on the Ministry of Construction's electronic information website.

Article 6. Public Statements and Provision of Information in Emergency and Unusual Circumstances

The Spokesperson is responsible for promptly and accurately providing statements and information to the press in the following extraordinary and unusual situations:

1. When it is necessary to inform the press about significant events and issues within the scope of the Ministry of Construction's State management to guide public opinion; about the viewpoints and handling methods of the Ministry of Construction regarding those events and issues.

In cases where an incident occurs requiring an immediate initial statement from the Ministry of Construction, the Spokesperson is responsible for proactively providing statements and information to the press within the latest two (02) days from the date of the incident.

2. When the press agency or the State management agency for the press requests statements or information about events and issues of agencies and sectors under the scope of the Ministry of Construction's State management mentioned in the press.

3. When the press publishes false or inaccurate information about areas under the scope of the Ministry of Construction's State management, it is necessary to promptly request the press agency to publish feedback and corrections according to the law.

Article 7. Rights and Responsibilities of the Spokesperson

1. The Spokesperson represents and speaks on behalf of the Ministry of Construction to the press. Only information provided by the Spokesperson is considered official information of the Ministry of Construction.

2. The Spokesperson has the right to request units and individuals related within the Ministry of Construction to provide information, collect information for statements and regular or emergency information provision to the press as stipulated in Articles 4 and 6 of this Regulation.

3. The Spokesperson has the right to refuse to make statements and provide information to the press in the following cases:

a) Matters involving state secrets; matters involving principles and regulations of the Party that are confidential; matters not within the scope of speaking authority.

b) Criminal cases under investigation or yet to be tried, except when administrative state agencies or investigative agencies require information on the press that benefits the investigative work and anti-crime efforts.

c) Policy documents and proposals still in the drafting process that, according to the law, have not been authorized by competent authorities to be widely disseminated or solicited for public opinion.

4. The Spokesperson is not only responsible before the law for the content of statements and information provided to the press but also must be accountable to the Minister of Construction for the accuracy and truthfulness of the content of statements and information provided to the press.

Chapter 3:
ASSIGNMENT OF RESPONSIBILITIES

Article 8. Responsibilities of the Office

- Assist the Ministry's Leadership in drafting programs and plans to disseminate information and promote awareness about legislative work; the dissemination, guidance, and inspection of law enforcement; the inspection of policy implementation, strategies, planning, and activities of subordinate units within the Ministry of Construction; and the operations of units directly under the Ministry.

- Organize regular or special press briefings.

- Organize information dissemination for special events on significant holidays or anniversaries of the Construction Industry.

- Organize press conferences and handle journalists' questions.

- Arrange interviews and meetings between the press and the Ministry's Leadership.

- Advise the Ministry's Leadership and leaders of subordinate units on relations with the media and responses from the media regarding industry policies and unit activities (if applicable).

- Establish a communication channel with the press to provide and receive regular feedback from society on activities related to the Construction Industry.

- Provide information to the Government’s electronic news site according to current regulations.

Article 9. Responsibilities of the Information Technology Center

- Continuously update information on the Ministry's activities, leadership directives, and business operations of enterprises under the Ministry on the Ministry of Construction's electronic news site to promptly and accurately provide official information to national news agencies. Coordinate with the Office to organize press conferences to regularly provide information to the press.

- Ensure security, safety, and uninterrupted technical operation of the Ministry's electronic news site 24 hours a day, seven days a week.

- Proactively coordinate with relevant units to timely reflect the activities, achievements, and contributions of the Industry in the country's industrialization and modernization process for domestic and international readers on the Ministry's electronic news site.

Article 10. Responsibilities of the Construction Newspaper (Print and Online)

Proactively coordinate with the Office and functional units to update information and publish articles on issues raised by National Assembly deputies and voters at National Assembly sessions; activities of the Ministry's Leadership; Industry activities; innovation in human resource training for the Construction Industry; patriotic emulation movements in the Industry; exemplary individuals and deeds in the Construction Industry... Simultaneously, reflect positive aspects and limitations in construction management and urban development activities in localities; activities of Construction Industry enterprises. Strengthen and enhance promotional efforts about the Construction Industry, helping domestic and international readers to better understand the role of the Construction Industry in the country's development.

Article 11. Responsibilities of Heads of Units

- Regularly monitor articles published in newspapers concerning issues related to the Ministry's areas of state management to check and resolve any inconsistencies (if any); for articles with viewpoints or assessments inconsistent with the Ministry's stance or not in compliance with legal provisions, it is necessary to coordinate with the Spokesperson to promptly provide correct information to guide public opinion. Proactively participate in regular press conferences and special press briefings organized by the Office; provide and compile information as required by the Spokesperson.

- Proactively submit information to the Ministry of Construction's electronic news site; exchange and respond to interviews from central and local news agencies, and provide legal clarifications on social issues within the unit's management functions; write articles for newspapers to introduce new regulatory legal documents; promptly explain and guide any difficulties encountered during the implementation of state management in the Construction Industry at the local level.

- Take the lead in coordinating with the Office to organize press conferences to introduce new regulatory legal documents of the Construction Industry such as Laws, Resolutions, Decrees, Circulars, Directives, Decisions...

Chapter 4:
IMPLEMENTATION

Article 12. Responsibilities of units and individuals

1. The Office shall be responsible for disseminating, monitoring, inspecting, compiling the situation of implementing the Regulation, reporting to the Ministry's Leadership, and announcing at the monthly coordination meeting.

2. Unit leaders shall be responsible for disseminating and ensuring understanding of this Regulation among their civil servants; they shall bear joint liability if individuals within their unit violate it, and simultaneously reflect and propose amendments if deemed necessary.

3. Civil servants must strictly comply with the Regulation on public statements and information provision to the press, and encourage others to do the same.

Article 13. Awards and Disciplinary Measures

1. Units and individuals who effectively implement the Regulation on public statements and information provision to the press shall be periodically or exceptionally rewarded.

2. Units and individuals who violate the provisions of the Regulation on public statements and information provision to the press, particularly by disclosing investigation secrets, official secrets, providing false or untruthful information to the press, shall be subject to disciplinary measures according to the level of violation as stipulated by the Civil Servant Law./.
