Regulations on the functions, tasks, powers, and organizational structure of the Heritage Agency

At the proposal of the Director of the Cinema Department.

Pursuant to the Law on Cultural Heritage dated June 29, 2001, and Decree No. 92/2002/NĐ-CP dated November 11, 2002 of the Government detailing certain provisions of the Law on Cultural Heritage;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Considering the proposal of the Director of the Heritage Agency and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Position and Functions

The Heritage Agency is an agency under the Ministry of Culture, Sports and Tourism with the function of advising the Minister in implementing state management over cultural heritage, assigned by the Minister to direct and guide activities for the development of the cultural heritage protection and valorization cause throughout the country in accordance with the Party's guidelines and State laws.

The Heritage Agency has its own seal and an account at the National Treasury.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Drafting legal normative documents for submission to the Minister, participating in drafting, negotiating international treaties on the protection and valorization of cultural heritage.

2. Drafting strategies, plans for development, long-term and annual plans on the protection and valorization of cultural heritage for submission to the Minister.

3. Implementing, guiding, and inspecting the implementation of legal normative documents, strategies, plans, and international conventions on the protection and valorization of cultural heritage to which Vietnam is a member.

4. Guiding the development of the cultural heritage protection and valorization cause for organizations and individuals nationwide.

5. Coordinating with relevant Departments and Bureaus to guide traditional festival activities, religious practices associated with historical sites and historical figures.

6. Regarding museums:

a) Reviewing and submitting to the Minister for decision on ranking, revoking ranking of Class I museums, and agreeing on ranking of Class II and III museums.

b) Reviewing and submitting to the Minister for confirmation of conditions for establishing national museums and specialized museums.

c) Reviewing and submitting to the Minister for approval or agreement within their authority on projects for constructing and operating specialized activities of national museums and specialized museums.

d) Reviewing and submitting to the Minister for decisions on exporting cultural relics, antiques, and national treasures from museums and making copies of such items from national museums and specialized museums.

đ) Reviewing specialized project proposals in the fields of operation of provincial and centrally-administered city museums according to the law.

7. Regarding historical sites:

a) Reviewing and submitting to the Minister for decision on proposing UNESCO to recognize outstanding Vietnamese historical sites as world cultural and natural heritage.

b) Reviewing and submitting to the Minister for decision on ranking, revoking ranking of national historical sites, adjusting protected areas for national historical sites, and ranking, revoking ranking of special national historical sites, adjusting protected areas for special national historical sites according to the law.

c) Submitting to the Minister for proposals on handling tangible cultural heritage assets according to the law.

d) Reviewing and submitting to the Minister for decision on transferring cultural relics, antiques, and national treasures obtained during archaeological surveys or discoveries and handed over to appropriate state museums.

đ) Reviewing and submitting to the Minister for approval or agreement on planning, projects for preserving, restoring, and revitalizing national historical sites, special national historical sites, and world heritage sites; projects for renovating and constructing buildings outside the protected areas of national historical sites, special national historical sites, and world heritage sites that may have adverse effects on these sites according to the law.

e) Reviewing and submitting to the Minister for decision on issuing permits for archaeological surveys and excavations.

g) Coordinating reviews and submitting to the Minister for agreement on planning, economic and social development projects related to cultural heritage.

h) Reviewing technical design files of projects for preserving, restoring, and revitalizing national historical sites, special national historical sites.

i) Serving as the permanent member of the National Relics, Antiques, and National Treasures Appraisal Council of the Ministry of Culture, Sports and Tourism, and the National Treasure Valuation Council; guiding professional operations for the Relics, Antiques, and Valuation Councils of Provincial and Centrally-Administered City Departments of Culture, Sports and Tourism.

8. Regarding intangible cultural heritage:

a) Reviewing and submitting to the Minister for decision on files for registering intangible cultural heritage with UNESCO for inclusion in the List of Intangible Cultural Heritage in Need of Urgent Safeguarding and the Representative List of the Intangible Cultural Heritage of Humanity.

b) Reviewing and submitting to the Minister for approval or agreement on projects for protecting and valorizing intangible cultural heritage.

c) Reviewing and submitting to the Minister for decision on conferring honors on individuals and collectives who have made contributions to preserving, performing, and transmitting intangible cultural heritage.

d) Submitting to the Minister for decision on allowing overseas Vietnamese citizens, foreign organizations, and individuals to research and collect intangible cultural heritage in Vietnam.

đ) Serving as the permanent member of the Advisory Council on Intangible Cultural Heritage.

9. Regarding information and documentation:

a) Building databases on cultural heritage to serve state management tasks and guide professional operations for protecting and valorizing cultural heritage.

b) Organizing the publication and distribution of the Cultural Heritage Development Magazine and developing the online website of the Heritage Agency.

c) Organizing promotional and public relations activities on cultural heritage.

d) Preserving scientific and legal documentation on cultural heritage.

10. Drafting and implementing preventive measures against violations of laws on cultural heritage for submission to the Minister; inspecting, coordinating inspections to prevent and handle violations of laws on cultural heritage within their authority; resolving complaints and denunciations according to the law.

11. Developing international cooperation programs on the protection and valorization of cultural heritage and organizing their implementation after approval.

12. Chair and coordinate with relevant Departments and Bureaus to prepare and submit to the Minister for promulgation the business standards for positions, scientific norms, and economic-technical standards for the protection and enhancement of cultural heritage values.

13. Chair and coordinate with related agencies and organizations to mobilize, manage, and utilize resources for the protection and enhancement of cultural heritage values.

14. Develop research plans, summarize practical experiences, apply science and technology in the protection and enhancement of cultural heritage values, and organize their implementation after approval.

15. Develop training plans for civil servants, public officials, and employees in the field of protecting and enhancing cultural heritage values, and organize their implementation after approval.

16. Propose rewards for organizations and individuals who have achieved success in protecting and enhancing cultural heritage values according to the provisions of the law.

17. Assist the Minister in managing state activities of Associations and non-governmental organizations concerning cultural heritage according to the provisions of the law.

18. Organize and implement administrative reform at the unit according to the program and plan of the Ministry.

19. Manage organizational structure and staffing; implement policies and systems for civil servants, public officials, and employees under the jurisdiction of the Department; manage and use financial resources, assets, and other resources allocated according to the provisions of the law.

20. Perform other tasks assigned by the Minister.

The Director of the Department of Cultural Heritage is responsible for arranging and organizing civil servants, public officials, and employees according to the position structure and business standards, defining specific functions and responsibilities of the rooms and affiliated organizations; developing and promulgating the Department's operational regulations.

Article 4. Effective date

This Decision takes effect fifteen days after its publication in the Official Gazette, replacing Decision No. 43/2004/QĐ-BVHTT dated June 28, 2004 of the Minister of Culture, Sports and Tourism on the functions, tasks, authorities, and organizational structure of the Department of Cultural Heritage.

Article 5. Responsibilities for Implementation

The Director of the Department of Cultural Heritage, the Head of the Office, the Heads of the Cadre and Civil Servant Organization Department, the Planning and Finance Department, the Heads of the Ministries' units, and related organizations and individuals are responsible for implementing this Decision./.
