Chapter

I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the conditions for conducting environmental monitoring services; the dossier and procedures for issuing, extending, amending contents, reissuing, temporarily suspending the effect, revoking, and canceling the Certificate of Eligibility for Environmental Monitoring Services.

Article 2. Applicability

This Decree applies to environmental management agencies, organizations conducting environmental monitoring services (hereinafter referred to as organizations) within the territory of the Socialist Republic of Vietnam., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Environmental monitoring activities include field monitoring activities and environmental analysis activities.

Article 3. Explanation of Terms

In this Decree, the following terms shall be understood as follows:

1. Field monitoring activities include sample collection, measurement, testing, and analysis of parameters at the site or sample preservation and transportation back for analysis in the laboratory.

2. Environmental analysis activities include sample processing and parameter analysis in the laboratory.No. Organizations conducting environmental monitoring services include:

3. Enterprises established under the Enterprise Law;.

4. Scientific and technological organizations established under the Law on Science and Technology;

a) Environmental public service organizations established and operating under Decree No. 55/2012/NĐ-CP of the Government dated June 28, 2012 on the establishment, restructuring, and dissolution of public service units.

b) Article 4. Prohibited Acts

c) Conducting environmental monitoring services without a Certificate of Eligibility for Environmental Monitoring Services or when the issued Certificate has expired.

Altering, forging, borrowing, renting, and exchanging Certificates of Eligibility for Environmental Monitoring Services.

1. Operating outside the scope and fields specified in the issued Certificate.

2. CONDITIONS FOR ISSUING THE CERTIFICATE OF ELIGIBILITY FOR ENVIRONMENTAL MONITORING SERVICES

3. Article 5. Certificate of Eligibility for Environmental Monitoring Services

Chapter

II

The Certificate of Eligibility for Environmental Monitoring Services is issued to organizations conducting field monitoring activities when they meet the conditions stipulated in Article 9 of this Decree.

The Certificate of Eligibility for Environmental Monitoring Services is issued to organizations conducting environmental analysis activities when they meet the conditions stipulated in Article 10 of this Decree.

1. The Certificate of Eligibility for Environmental Monitoring Services has a validity period of 36 months from the date of issuance and may be extended multiple times, with each extension not exceeding 36 months.

2. Article 6. Contents of the Certificate The Certificate of Eligibility for Environmental Monitoring Services includes the following main contents:

3. Name of the organization, address, and head of the organization;

Scope and fields covered by the Certificate;

a) The Ministry of Natural Resources and Environment shall specify the specific format of the Certificate.

b) Article 7. Competence of State Agencies in Determining Conditions for Conducting Environmental Monitoring Services; Issuing, Extending, Amending Contents, Reissuing, Temporarily Suspending Effectiveness, Revoking, and Canceling the Certificate of Eligibility for Environmental Monitoring Services

c) The Ministry of Natural Resources and Environment has the authority to issue, extend, amend contents, reissue, temporarily suspend effectiveness, revoke, and cancel the Certificate of Eligibility for Environmental Monitoring Services.

d) The Ministry of Natural Resources and Environment shall provide detailed regulations on determining conditions for conducting environmental monitoring services in accordance with Articles 9 and

2. 10 of this Decree.

7. The authority of state agencies in determining conditions for environmental monitoring service activities; issuing, extending, amending the content, reissuing, temporarily suspending the effect, revoking and invalidating the Certificate of Eligibility for Environmental Monitoring Service Activities.

rime Minister cThe Ministry of Natural Resources and Environment has the authority to issue, extend, amend the content, reissue, temporarily suspend the effect, revoke and invalidate the Certificate of Eligibility for Environmental Monitoring Service Activities.

1. The Ministry of Natural Resources and Environment shall provide detailed regulations on the assessment of conditions for environmental monitoring service activities as stipulated in Article 9 and Article 10 of this Decree.

2. Laboratory managers, analytical group leaders, and quality assurance and control staff must have at least a college degree, trained in the field of environmental analysis and propose certification.onThey must have sufficient equipment and facilities to carry out environmental analysis activities as follows:

Article 8. Fees and

lservice fees for requesting certification of eligibility to operate environmental monitoring services

1. Organizations requesting certification of eligibility to operate environmental monitoring services must pay the eligibility assessment fee for environmental monitoring service activities and must pay the service fee when being issued, extended, amended, and reissued the Certificate of Eligibility for Environmental Monitoring Service Activities in accordance with the provisions of the law.

2. The Ministry of Finance shall take the lead and coordinate with the Ministry of Natural Resources and Environment to stipulate the eligibility assessment fee for environmental monitoring service activities and the service fee for issuing, extending, amending, and reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities in accordance with the provisions of the law.Article 9. Conditions for Issuing the Certificate of Eligibility for Environmental Monitoring Service Activities in the Field of On-site Monitoringof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsThere is a Decision on Establishment or a Certificate of Scientific and Technological Activity or a Business Registration Certificate or an Investment Certificate issued by the competent state management agency which includes environmental monitoring activities.

Satisfy the conditions regarding human resources for conducting on-site monitoring activities as follows:

Organizations that are issued the Certificate of Eligibility to Operate Environmental Monitoring Services in the field of on-site monitoring must meet the following conditions:

1. The head of the organization must have a bachelor's degree or higher;

2. Have sufficient number of staff to conduct on-site monitoring activities according to the components of the environment and environmental monitoring parameters requested for certification; trMust have a person directly responsible for the on-site monitoring team who has a bachelor's degree or higher in one of the following fields: environment, chemistry, biology, forestry, soil science, nuclear physics, radiation, geography, geology, and at least 24 months of experience in the field of environmental monitoring;

a) Staff conducting on-site monitoring activities must have at least a basic level corresponding to the junior environmental resource monitoring officer grade. Among them, the number of staff with a basic level does not exceed 30% of the on-site monitoring staff.

b) Satisfy the conditions regarding equipment and infrastructure for conducting on-site monitoring activities as follows:

c) Have equipment, tools, and chemicals sufficient to collect samples, preserve samples, measure, test, and analyze on-site environmental components and environmental monitoring parameters requested for certification in accordance with the methods prescribed by the Ministry of Natural Resources and Environment;

For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;Have procedures for storing, safely using, maintaining, and calibrating equipment in accordance with the regulations of the competent state authority or the manufacturer's regulations;

3. Have procedures for operating all sampling, sample preservation, measurement, testing, and analysis equipment on-site;

a) Equip staff with full protective and occupational safety equipment when performing on-site monitoring tasks;

b) Article 10. Conditions for Issuing the Certificate of Eligibility for Environmental Monitoring Service Activities in the Field of Environmental Analysis

c) Satisfy the conditions regarding human resources for conducting environmental analysis activities as follows:

d) Have sufficient number of trained staff to perform tasks within the scope of environmental analysis requested for certification;

đ) Having a workplace with sufficient special area to ensure the quality of on-site monitoring work and manage monitoring data and results.

The laboratory manager must have a bachelor's degree or higher in one of the following fields: chemistry, environment, biology, soil science, nuclear physics, radiation, geography, geology, and must have at least five years of experience for those with a bachelor's degree, three years of experience for those with a master's degree, and two years of experience for those with a doctoral degree in the field of environmental analysis;

The head of the environmental analysis group must have a bachelor's degree or higher in one of the following fields: chemistry, environment, biology, soil science, nuclear physics, radiation, and must have at least 18 months of experience in the field of environmental analysis requested for certification or be proficient in using at least one specialized device of the laboratory;

An organization must meet the following conditions to be issued a Certificate of Eligibility to Operate Environmental Monitoring Services in the Field of Environmental Analysis:

1. The head of the organization must have a bachelor's degree or higher;

2. Laboratory quality assurance and control staff must have a bachelor's degree or higher in one of the following fields: chemistry, environment, biology, soil science, nuclear physics, radiation, and must have at least three years of experience in the field of environmental analysis;

a) Staff conducting on-site monitoring activities must have at least a basic level corresponding to the junior environmental resource monitoring officer grade. Among them, the number of staff with a basic level does not exceed 30% of the on-site monitoring staff.

b) Laboratory staff, except for the laboratory manager, head of the analysis group, and quality assurance and control staff, must have a secondary level or higher education, trained in the field of environmental analysis requested for certification.

c) Satisfy the conditions regarding equipment and infrastructure for conducting environmental analysis activities as follows:nationalHave equipment, tools, and chemicals sufficient to perform environmental analysis of the components of the environment requested for certification to ensure accuracy according to the analytical methods prescribed by the Ministry of Natural Resources and Environment;nationalHave procedures for storing, safely using, maintaining, and calibrating analytical equipment in accordance with the regulations of the competent state authority or the manufacturer's regulations;

For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;Have procedures for using and operating all environmental analysis equipment;

Equip staff with full protective and occupational safety equipment when performing environmental analysis tasks; vHave a workplace with sufficient special area to ensure the quality of environmental analysis work and must maintain good laboratory environmental conditions (lighting, power supply, humidity, temperature, sterilization, ventilation) as required by the analytical method prescribed by the competent state authority or the manufacturer's requirements;

e) Ensure industrial hygiene measures, fire prevention and firefighting measures, and strictly comply with the collection and treatment of laboratory waste in accordance with the provisions of the law.This Resolution takes effect from the date it is adopted by the National Assembly.Having equipment, tools, and materials sufficient to conduct environmental parameter analysis of the proposed certified environmental components ensuring accuracy according to the analysis method prescribed by the Ministry of Natural Resources and Environment;

3. Having procedures for storing, safely using, maintaining, and calibrating analytical equipment according to the regulations of competent state agencies or manufacturer's regulations;

a) Having procedures for operating all environmental analytical equipment;a Having all necessary safety and labor protection equipment for staff performing environmental analysis tasks;

b) Having a workplace with specific area to ensure the quality of environmental analysis work and must maintain good laboratory environmental conditions (lighting, power supply, humidity, temperature, sterilization, ventilation system) as required by the analysis method prescribed by competent state agencies or manufacturer's requirements;

c) g) Having measures to ensure industrial hygiene, fire prevention and firefighting safety, and strictly comply with the collection and treatment of laboratory waste according to the relevant laws and regulations;

d) k) From the date of receiving the application file. If it exceeds six months,

đ) Having procedures for storing, using chemicals, standards, reference samples, and processing and preserving analytical samples in accordance with regulations of competent state agencies or manufacturer specifications;

e) when applying for issuance, extension, amendment of content, reissuance of the Certificate, a new application file must be established.

Article 13. Extension of the Certificate of Eligibility for Environmental Monitoring Service Activities limport quotas and raw material and component quotas for imported goods before they enter the domestic market.

Article 11. Changing Conditions for Environmental Monitoring Service Operations

1. When there is any change related to the conditions stipulated in Article 9 and Article 10 of this Decree, the organization must notify in writing to the Ministry of Natural Resources and Environment within 60 days from the date of the change., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPWithin 15 working days from the date of receipt of the organization's notification, the Ministry of Natural Resources and Environment shall be responsible for reviewing; if the organization no longer meets the required conditions, the Ministry shall revoke and cancel the Certificate issued according to Clause 2, Article 17 of this Decree.

2. ISSUANCE, EXTENSION, AMENDMENT OF CONTENT, REISSUANCE, TEMPORARY SUSPENSION, REVOCATION AND CANCELLATION

III

ENVIRONMENTAL MONITORING SERVICE OPERATIONS QUALIFICATION CERTIFICATE

Article 12. Issuance of Qualification Certificate for Environmental Monitoring Service Operations

An organization wishing to participate in environmental monitoring service operations must submit an application for issuance of the Qualification Certificate for Environmental Monitoring Service Operations.

The application dossier for the Qualification Certificate for Environmental Monitoring Service Operations consists of two sets, each set including: vOne original copy of the application form for the Qualification Certificate for Environmental Monitoring Service Operations as prescribed in Form No. 1, Appendix attached hereto;

1. One original copy of the organization's capability dossier as prescribed in Form No. 2, Appendix attached hereto.

2. Procedures for issuing the Qualification Certificate for Environmental Monitoring Service Operations:

a) The organization applying for the certificate sends the dossier as prescribed in Clause 2 of this Article directly or through postal service to the Ministry of Natural Resources and Environment;FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSWithin three working days from the date of receipt of the dossier and the fee for assessing the conditions for environmental monitoring service operations, the Ministry of Natural Resources and Environment will send a receipt of the dossier to the organization applying for certification via postal service if the dossier is complete as prescribed. In case the dossier is incomplete and invalid, the Ministry of Natural Resources and Environment has the responsibility to notify the organization to be aware and complete the dossier; lWithin forty-five working days from the date of receipt of the dossier, the Ministry of Natural Resources and Environment is responsible for assessing and issuing the Qualification Certificate for Environmental Monitoring Service Operations to the organization applying for certification. The assessment includes reviewing the dossier and evaluating and inspecting the actual situation at the organization. If the Qualification Certificate for Environmental Monitoring Service Operations is not issued, the Ministry of Natural Resources and Environment has the responsibility to notify the organization applying for certification in writing and specify the reasons;ealth Processing time: From the date the Ministry of Health receives valid application documents from the requesting entity until the issuance of the permit is thirty days.

b) d) The application dossier for the Qualification Certificate for Environmental Monitoring Service Operations is only valid for six months from the date of receipt of the dossier. If more than six months have passed, the organization must prepare a new dossier when applying for issuance, extension, amendment of content, reissuance of the Qualification Certificate.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSArticle 13. Extension of the Qualification Certificate for Environmental Monitoring Service Operations

3. An organization wishing to extend the Qualification Certificate for Environmental Monitoring Service Operations must submit an application dossier for extension before the certificate expires by at least three months.

a) The application dossier for extending the Qualification Certificate for Environmental Monitoring Service Operations consists of two sets, each set including:

b) One original copy of the application form for extending the Qualification Certificate for Environmental Monitoring Service Operations as prescribed in Form No. 3, Appendix attached hereto; lOne original copy of the organization's capability dossier as prescribed in Form No. 2, Appendix attached hereto;

c) Procedures for extending the Qualification Certificate for Environmental Monitoring Service Operations:, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP The organization applying for extension sends the dossier as prescribed in Clause 2 of this Article directly or through postal service to the Ministry of Natural Resources and Environment;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Step 4: Within seven working days, traders and organizations will receive feedback from the Ministry of Industry and Trade via the registered email address regarding one of the following contents:

d) If a level crossing meets the conditions for signal connection as stipulated in Clause 1, Point c of Article 4 of this Circular but cannot achieve signal connection, the organization managing traffic lights on roads and the project investor implementing investment, construction, and upgrading of roads and railways in the area of the level crossing must report to the Ministry of Transport for consideration and decision.nationalWithin three working days from the date of receipt of the dossier and the fee for assessing the conditions for environmental monitoring service operations, the Ministry of Natural Resources and Environment will send a receipt of the dossier to the organization applying for certification via postal service if the dossier is complete as prescribed. In case the dossier is incomplete and invalid, the Ministry of Natural Resources and Environment has the responsibility to notify the organization to be aware and complete the dossier;amendWithin thirty working days from the date of receipt of the dossier, the Ministry of Natural Resources and Environment is responsible for assessing and extending the Qualification Certificate for Environmental Monitoring Service Operations. The assessment includes reviewing the dossier and evaluating and inspecting the actual situation at the organization;

In case the extension of the Qualification Certificate for Environmental Monitoring Service Operations is not accepted, the Ministry of Natural Resources and Environment has the responsibility to notify the organization applying for certification in writing and specify the reasons.6 Organizations wishing to extend the Certificate of Eligibility for Environmental Monitoring Service Activities must submit an extension application before the validity period of the previously issued Certificate expires by at least three months.development The application file for extending the Certificate of Eligibility for Environmental Monitoring Service Activities consists of two sets, each set including:, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP One original copy of the extension request document for the Certificate of Eligibility for Environmental Monitoring Service Activities as specified in Form No. 3, Appendix promulgated together with this Decree;

Procedure for extending the Certificate of Eligibility for Environmental Monitoring Service Activities:of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsOrganizations requesting an extension send the application file as stipulated in Clause 2 of this Article directly or through postal service to the Ministry of Natural Resources and Environment;

Within three working days from the date of receipt of the application file and the fee for assessing the conditions for environmental monitoring service activities, the Ministry of Natural Resources and Environment will send a receipt of the application file to the organization requesting certification via postal service if the file is complete as prescribed. In case the file is incomplete and not valid, the Ministry of Natural Resources and Environment has the responsibility to notify the organization to be aware and complete the file;

a) Within thirty working days from the date of receipt of the application file, the Ministry of Natural Resources and Environment is responsible for assessing and extending the Certificate of Eligibility for Environmental Monitoring Service Activities. The assessment includes reviewing the file and conducting practical evaluation at the organization; trIn case the extension of the Certificate of Eligibility for Environmental Monitoring Service Activities is not accepted, the Ministry of Natural Resources and Environment has the responsibility to notify the organization requesting certification in writing and specify the reasons.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSConditions for environmental monitoring service activities.

b) d) The application dossier for the Qualification Certificate for Environmental Monitoring Service Operations is only valid for six months from the date of receipt of the dossier. If more than six months have passed, the organization must prepare a new dossier when applying for issuance, extension, amendment of content, reissuance of the Qualification Certificate.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSOne original copy of the application for reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities as specified in Form No. 5, Appendix promulgated together with this Decree; one original copy of the organization's capability file as specified in Form No. 2, Appendix promulgated together with this Decree; a copy of the previously issued Certificate (if available).

3. Procedure for reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities:

a) Organizations requesting a reissue send the application file as stipulated in Clause 2 of this Article directly or through postal service to the Ministry of Natural Resources and Environment;

b) Within five working days from the date of receipt of the reissue application document of the organization specified in Point a of Clause 2 of this Article and the fee for assessing the conditions for environmental monitoring service activities, the Ministry of Natural Resources and Environment is responsible for assessing and reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities for the organization requesting certification. The assessment includes reviewing the file of the organization;

c) Within five working days from the date of receipt of the application file of the organization specified in Point b of Clause 2 of this Article and the fee for assessing the conditions for environmental monitoring service activities, the Ministry of Natural Resources and Environment sends a receipt of the application file to the organization requesting certification via postal service if the file is complete as prescribed. In case the file is incomplete and not valid, the Ministry of Natural Resources and Environment has the responsibility to notify the organization to be aware and complete the file. Within twenty working days from the date of receipt of the application file, the Ministry of Natural Resources and Environment is responsible for assessing and reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities for the organization requesting certification;rime Minister cIn case the reissuance of the Certificate of Eligibility for Environmental Monitoring Service Activities is not granted, the Ministry of Natural Resources and Environment has the responsibility to notify the organization requesting certification in writing and specify the reasons;

d) d) In case the Certificate is lost, when, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP function to request certification and clearly state the reasons.

Article 14. Amendment of Content of Certificate of Eligibility for Environmental Monitoring Service Activities

An organization wishing to amend the scope and field of environmental monitoring at the site and environmental analysis compared to the content of the Certificate of Eligibility already issued or when organizations merge or integrate and continue to operate in the field of environmental monitoring services must go through procedures to amend the content of the Certificate of Eligibility for Environmental Monitoring Service Activities.

1. The content of the Certificate of Eligibility for Environmental Monitoring Service Activities shall not be amended if the Certificate only remains valid for a period of six months.iConditions for operating environmental monitoring services.

The application dossier for amending the content of the Certificate of Eligibility for Environmental Monitoring Service Activities shall be prepared in two sets, each set including:nationalOne original copy of the request for amending the content of the Certificate of Eligibility for Environmental Monitoring Service Activities according to Model No. 4 attached as an appendix to this Decree; hProcedures for amending the Certificate of Eligibility for Environmental Monitoring Service Activities:

2. The organization requesting the amendment sends the dossier in accordance with Clause 2 of this Article directly or via postal service to the Ministry of Natural Resources and Environment;

a) Within three working days from the date of receipt of the dossier and the fee for assessing the eligibility conditions for environmental monitoring service activities, the Ministry of Natural Resources and Environment will send a receipt of the dossier to the organization requesting the amendment via postal service if the dossier is complete as prescribed. In cases where the dossier is incomplete or invalid, the Ministry of Natural Resources and Environment has the responsibility to notify the organization to be aware and perfect the dossier;FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSWithin thirty working days from the date of receipt of the dossier receipt, the Ministry of Natural Resources and Environment is responsible for reviewing and amending the content of the Certificate of Eligibility for Environmental Monitoring Service Activities for the organization requesting the amendment. The content of the amendment

b) d) The application dossier for the Qualification Certificate for Environmental Monitoring Service Operations is only valid for six months from the date of receipt of the dossier. If more than six months have passed, the organization must prepare a new dossier when applying for issuance, extension, amendment of content, reissuance of the Qualification Certificate.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSOne original copy of the application for reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities as specified in Form No. 5, Appendix promulgated together with this Decree; one original copy of the organization's capability file as specified in Form No. 2, Appendix promulgated together with this Decree; a copy of the previously issued Certificate (if available).

3. In case the amendment of the content of the Certificate of Eligibility for Environmental Monitoring Service Activities is not accepted, the Ministry of Natural Resources and Environment has the responsibility to notify the organization in writing and specify the reasons.

a) Article 15. Reissue of Certificate of Eligibility for Environmental Monitoring Service Activities

b) The Certificate of Eligibility for Environmental Monitoring Service Activities may be reviewed and reissued in the following cases:

c) The Certificate of Eligibility has been lost;rime Minister cIn case the reissuance of the Certificate of Eligibility for Environmental Monitoring Service Activities is not granted, the Ministry of Natural Resources and Environment has the responsibility to notify the organization requesting certification in writing and specify the reasons;

d) The Certificate of Eligibility has been torn, damaged and cannot be used.

Application dossier for reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities:

lIn case the application dossier for certification of eligibility for environmental monitoring service activities that the organization has submitted to the Ministry of Natural Resources and Environment still has validity (within six months from the date of receipt of the dossier receipt), the organization prepares and submits one original copy of the request for reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities according to Model No. 5 attached as an appendix to this Decree; a copy of the previously issued Certificate of Eligibility (if available);

1. In case the application dossier for certification of eligibility for environmental monitoring service activities that the organization has submitted to the Ministry of Natural Resources and Environment has expired (more than six months from the date of receipt of the dossier receipt), the organization requesting certification prepares two sets of dossiers, each set including: one original copy of the request for reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities according to Model No. 5 attached as an appendix to this Decree; one original copy of the organization's capability dossier according to Model No. 2 attached as an appendix to this Decree; a copy of the previously issued Certificate of Eligibility (if available).

a) Procedures for reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities:

b) The organization requesting the reissue sends the dossier in accordance with Clause 2 of this Article directly or via postal service to the Ministry of Natural Resources and Environment;

In cases where the dossier is incomplete or invalid, the Ministry of Natural Resources and Environment has the responsibility to notify the organization to be aware and perfect the dossier. Within twenty working days from the date of receipt of the dossier receipt, the Ministry of Natural Resources and Environment is responsible for reviewing and reissuing the Certificate of Eligibility for Environmental Monitoring Service Activities for the organization requesting certification;FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDS2. Communes, villages, districts, provinces where the project is implemented. 5, In case the Certificate of Eligibility for Environmental Monitoring Service Activities is not reissued, the Ministry of Natural Resources and Environment has the responsibility to notify the organization requesting certification in writing and specify the reasons;

3. The organization applying for reissuance shall submit the dossier as prescribed in Clause 2 of this Article directly or via postal service to the Ministry of Natural Resources and Environment;

a) Within five working days from the date of receipt of the organization's application for reissuance of the Certificate as specified in Point a of Clause 2 of this Article and the fee for eligibility assessment,

b) for environmental monitoring services, the Ministry of Natural Resources and Environment shall be responsible for assessing and reissuing the Certificate of Eligibility for Environmental Monitoring Services to the requesting organization. The content ofonthe assessment includes reviewing the dossier of theorganization. Within five working days from the date of receipt of the dossier of the organization as specified in Point b of Clause 2 of this Article and the fee for eligibility assessment for environmental monitoring services, the Ministry of Natural Resources and Environment shall send a receipt of acceptance of the dossier to the requesting organization via postal service if the dossier is complete as required. In case the dossier is incomplete and invalid, the Ministry of Natural Resources and Environment shall notify the organization to be aware and complete the dossier. Article 16. Temporary suspension of the effect of the Certificate

1. The organization participates in environmental monitoring activities beyond the scope and field specified in the Certificate;

2. The organization uses the Certificate for purposes other than those intended;

3. The organization does not comply with certification regulations;

4. The organization does not fully comply with technical regulations on monitoring procedures and methods prescribed by the Ministry of Natural Resources and Environment; fails to maintain a quality assurance program in environmental monitoring;ìđảm bảo chấtof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairslượng trong quantrắc môi trường.

Article 17. Revocation and cancellation of the Certificate certifying eligibility to operate environmental monitoring services

The Certificate of eligibility for environmental monitoring services shall be revoked and cancelled in the following cases:

1. The organization is prohibited from operating, declared bankrupt, dissolved, divided, or split;

2. The organization no longer meets one of the conditions stipulated in Article 9 and Article 10 of this Decree;

3. The organization does not fulfill its commitment to comply with technical regulations on environmental monitoring and does not implement or maintain a quality assurance program in environmental monitoring.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairslượng trong quan trắc môi trường.

IV

IMPLEMENTING PROVISIONS

Article 18. Effective Date

This Decree takes effect from June 5, 2013.

Article 19. Responsibility for Implementation

1. The Ministry of Natural Resources and Environment is responsible for guiding, organizing the implementation, and supervising the enforcement of this Decree; resolving any difficulties arising during the implementation of the Decree within its authority.

2. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons DECREES:of People's Committees at all levels and related organizations are responsible for enforcing this Decree./.
