At the proposal of the Minister of Justice,
The Prime Minister issues this Decision to stipulate the composition and tasks, powers of the Steering Committee for Popularizing and Promoting Legal Education.
Article 1. Composition of the Steering Committee for Popularizing and Promoting Legal Education
1. The Central Steering Committee for Popularizing and Promoting Legal Education shall be established by the Prime Minister and shall consist of the following members:
a) Chairman of the Committee: Minister of Justice;
b) Vice-Chairman in charge of the Committee: Deputy Minister of Justice;
c) Vice-Chairmen of the Committee: Deputy Ministers of Information and Communications, Ministry of Education and Training;
Invite the Vice-Chairman of the Vietnam Fatherland Front Central Committee to serve as Vice-Chairman of the Committee,
d) Members of the Committee are representatives from the following agencies and organizations: Government Office, Ministry of National Defense, Ministry of Public Security, Ministry of Home Affairs, Ministry of Labor, Invalids and Social Affairs, Ministry of Culture, Sports and Tourism, Ministry of Transport, Ministry of Industry and Trade, Ministry of Agriculture and Rural Development, Ministry of Natural Resources and Environment, Ministry of Health, Ministry of Finance, State Committee for Ethnic Minorities, Vietnam Television, Voice of Vietnam Radio, Vietnam News Agency;
Invite representatives from the Central Propaganda Department, Vietnam Veterans Association, Vietnam General Confederation of Labor, Central Vietnam Farmers' Union, Central Vietnam Women's Union, Central Communist Youth Union of Ho Chi Minh, Central Vietnam Bar Association, Vietnam Bar Federation, Vietnam Chamber of Commerce and Industry (VCCI) to serve as members of the Committee.
2. The Provincial Steering Committee for Popularizing and Promoting Legal Education (referred to as the Provincial Steering Committee for Popularizing and Promoting Legal Education) and the District Steering Committee for Popularizing and Promoting Legal Education (referred to as the District Steering Committee for Popularizing and Promoting Legal Education) shall be established by the People's Committee at the same level and shall consist of the following members:
a) Chairman of the Committee: Leader of the Provincial People's Committee, District People's Committee;
b) Vice-Chairman in charge of the Committee: Director of the Department of Justice serves as Vice-Chairman in charge of the Provincial Committee, Head of the Justice Office serves as Vice-Chairman in charge of the District Committee;
c) The Committee shall have members who are leaders of the following agencies: People's Committee Office, Department of Education and Training, Department of Information and Communications, Military Affairs Department, Public Security Department, Home Affairs Department, Department of Labor, Invalids and Social Affairs, Department of Culture, Sports and Tourism, Department of Transport, Department of Industry and Trade, Department of Agriculture and Rural Development, Department of Natural Resources and Environment, Department of Health, Department of Finance, specialized agency under the provincial People's Committee, district People's Committee responsible for ethnic affairs, local radio and television station;
Invite leaders of the following organizations: Propaganda Department, Vietnam Fatherland Front Committee, Vietnam Veterans Association, Vietnam General Confederation of Labor, Vietnam Farmers' Union, Vietnam Women's Union, Communist Youth Union of Ho Chi Minh, Vietnam Bar Association, Vietnam Lawyers' Association, Business Association to serve as members of the Committee.
Article 2. Tasks and Powers of the Steering Committee for Popularizing and Promoting Legal Education
1. The Central Steering Committee for Popularizing and Promoting Legal Education shall advise the Government and the Prime Minister on directing and coordinating the implementation of the following tasks:
a) Improving the legal framework for popularizing and promoting legal education;
b) Developing, promulgating, and monitoring medium-term and long-term programs and plans for popularizing and promoting legal education by the Government;
c) Identifying key legal contents that need to be disseminated annually and during each period, linked to the country's economic and social development tasks, national defense, and security, as well as with the construction and enforcement of laws, inspection of regulatory documents, and administrative reform;
d) Measures to enhance the effectiveness of cooperation among ministries, sectors, and localities in popularizing and promoting legal education; coordination and guidance in selecting appropriate legal education content to address urgent issues and difficulties in the practical implementation of laws;
đ) Socialization of activities related to popularizing and promoting legal education; measures to mobilize the participation of organizations, businesses, and individuals both domestically and internationally in implementing legal education or supporting funding, infrastructure, and means for such activities;
e) Guidance on the content and form of organizing the National Law Day annually;
g) Evaluation and summary of nationwide legal education work before submitting to the Prime Minister; proposing cases for commendation for outstanding achievements in legal education within the Prime Minister's authority when requested;
h) Implementing other tasks assigned by the Prime Minister.
2. The Provincial Steering Committee for Popularizing and Promoting Legal Education and the District Steering Committee for Popularizing and Promoting Legal Education shall advise the People's Committee and the Chairman of the People's Committee at the same level on the implementation of the following tasks:
a) Developing medium-term and long-term programs and plans for popularizing and promoting legal education suitable for the target groups, areas, and socio-economic conditions of the locality; key legal contents that need to be disseminated, linked to the locality's economic and social development tasks, national defense, and security, as well as with the construction and enforcement of laws, inspection of regulatory documents, and administrative reform in the locality; organizing legal education for specific target groups;
b) Measures to enhance the effectiveness of legal education activities in the locality; coordination and selection of appropriate legal education content to address urgent issues and difficulties in the practical implementation of laws in the locality;
c) Measures to strengthen socialization of legal education activities; measures to mobilize the participation of organizations, businesses, and individuals both domestically and internationally in implementing legal education or supporting funding, infrastructure, and means for such activities;
d) Guidance on the content and form of organizing the National Law Day annually in the locality;
đ) Evaluation and summary of legal education work in the locality before submitting to the People's Committee at the same level;
e) Perform other tasks assigned by the People's Committee and the Chairman of the same level People's Committee.
Article 3. Duties, powers, and responsibilities of the Chairman of the Steering Committee for Popularizing and Promoting Legal Education
1. Issue the List of Steering Committee members and the Operating Regulations of the Steering Committee; approve the annual program and plan of activities of the Steering Committee, conclusions, and other documents of the Steering Committee.
2. Organize the implementation of the tasks of the Steering Committee for Popularizing and Promoting Legal Education and be responsible to the authority deciding to establish the Steering Committee for Popularizing and Promoting Legal Education regarding the activities of the Steering Committee.
3. Provide general direction for the activities of the Steering Committee, Deputy Chairmen of the Steering Committee, the Standing Office of the Steering Committee, and the Secretariat; manage, assign tasks to Deputy Chairmen and members of the Steering Committee; urge, inspect the implementation of assigned tasks.
4. Convene and chair sessions of the Steering Committee.
5. Propose to the authority deciding to establish the Steering Committee to supplement or replace members of the Steering Committee.
6. Manage the budget, material infrastructure, and working equipment according to the provisions of the law.
Article 4. Responsibilities of the Deputy Chairman of the Steering Committee for Popularizing and Promoting Legal Education
1. Carry out the tasks assigned by the Chairman of the Steering Committee; be responsible to the Chairman of the Steering Committee and the law for the performance of assigned tasks. In case the Chairman of the Steering Committee cannot chair the session of the Steering Committee, the Vice-Chairman in charge of the Steering Committee or another Vice-Chairman authorized by the Chairman of the Steering Committee shall chair the session of the Steering Committee.
2. Urge members of the Steering Committee to organize the implementation of popularization and promotion of legal education work according to the program and plan of activities of the Steering Committee.
3. Perform other tasks assigned by the Chairman of the Steering Committee.
Article 5. Responsibilities of Members of the Steering Committee for Popularizing and Promoting Legal Education
1. Members at all levels of the Steering Committee have the responsibility to fully participate in the activities of the Steering Committee; perform assigned tasks and be responsible to the Chairman of the Steering Committee for the performance of their tasks.
The opinions of members of the Steering Committee are the official opinions of the agencies and organizations where they work.
2. Members of the Steering Committee are provided with information and materials related to the activities of the Steering Committee.
Article 6. Budget for the Activities of the Steering Committee and the Secretariat of the Steering Committee for Popularizing and Promoting Legal Education
The budget for the activities of the Steering Committee and the Secretariat of the Steering Committee for Popularizing and Promoting Legal Education is guaranteed by the state budget; it is allocated in the regular expenditure budget of the Standing Office of the Steering Committee for Popularizing and Promoting Legal Education at all levels and used according to current financial regulations.
Article 7. Effective Date and Transitional Provisions
This Decision takes effect from July 5, 2013, and replaces Decision No. 03/1998/QĐ-TTg dated January 7, 1998, of the Prime Minister on the issuance of the Plan for Implementing Popularization and Promotion of Legal Education Work from 1998 to 2002 and the establishment of the Steering Committee for Coordinating Popularization and Promotion of Legal Education (referred to as Decision No. 03/1998/QĐ-TTg).
The Steering Committee for Popularizing and Promoting Legal Education established under Decision No. 03/1998/QĐ-TTg continues its operation and must be reorganized according to this Decision within the latest three months from the date this Decision takes effect.
2. Based on the requirements for directing and coordinating the implementation of popularization and promotion of legal education work within their respective fields of management, the Ministers, Heads of Ministries equivalent to Ministries decide on the establishment of the Steering Committee for Popularizing and Promoting Legal Education to advise and assist the Ministers, Heads of Ministries equivalent to Ministries in popularization and promotion of legal education work.
Article 8. Responsibility for Implementation
The Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of Provincial People's Committees, and heads of relevant agencies and organizations are responsible for implementing this Decision./.
