At the proposal of The Minister of Agriculture and Rural Development issues the National Technical Regulations on Wood Adhesive organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.This Circular stipulates the content and maintenance and repair quotas for steel-hulled fishing vessels with main engine power of 400 HP or more supported under Decree No. 67/2014/NĐ-CP dated July 7, 2014 of the Government on certain policies to develop fisheries.,

This Circular applies to organizations and individuals related to the maintenance and repair activities of steel-hulled fishing vessels with main engine power of 400 HP or more supported under Decree No. 67/2014/NĐ-CP dated July 7, 2014 of the Government on certain policies to develop fisheries.

Article 1. Scope of Regulation

1. Maintenance and repair of steel-hulled fishing vessels include regular maintenance levels including: minor maintenance, intermediate maintenance, major maintenance, and overhaul to address defects to ensure that the fishing vessel meets operational requirements until the next maintenance cycle.

Article 2. Applicability

2. Minor maintenance involves bringing the vessel in for small repairs, rust removal, cleaning the surface, repainting the hull above the waterline, and repairing deck equipment to ensure the fishing vessel meets operational requirements until the next maintenance cycle.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

Intermediate maintenance involves inspecting the entire technical condition of the vessel, replacing or repairing assemblies, parts worn out, and repairing the hull structure to ensure the fishing vessel can meet operational requirements until the next major maintenance. Intermediate maintenance requires lifting the vessel onto a slipway to measure the thickness of the hull plating and repair underwater sections, which must be carried out concurrently with the periodic inspection by the registration authority.

5. Major maintenance involves surveying all components of the vessel, replacing or repairing parts including the hull. Major maintenance may also include modernization and improvement of equipment to enhance the technical quality, exploitation quality, economic and technical indicators, labor productivity, and living conditions for crew members. Major maintenance is conducted concurrently with the periodic inspection by the registration authority.

3. Minor repairs aim to eliminate minor damages by replacing or restoring worn-out parts. Minor repairs must ensure the fishing vessel meets operational requirements until the next repair cycle.

The objects, funding levels, conditions for support, and application procedures shall be implemented according to the provisions of Circular No. 117/2014/TT-BTC dated August 21, 2014 of the Minister of Finance guiding the implementation of certain articles of Decree No. 67/2014/NĐ-CP dated July 7, 2014 of the Government on certain policies to develop fisheries.

2. The Director of the General Department of Fisheries, the Directors of Provincial Departments of Agriculture and Rural Development, and organizations and individuals involved in the maintenance and repair of steel-hulled fishing vessels with main engine power of 400 HP or more are responsible for implementing this Circular. In the process of implementation, if any issues arise, organizations and individuals must promptly report to the Ministry of Agriculture and Rural Development (through the General Department of Fisheries) for review and adjustment as appropriate.

Article 4. Contents and maintenance and repair quotas for steel-hulled fishing vessels

1. Contents of maintenance and repair for steel-hulled fishing vessels

a) Levels of maintenance and repair as specified in Appendix 1.

b) Contents of maintenance and repair for the hull, vessel machinery, and equipment as specified in Appendix 2.

In the process of implementation, if any issues arise, organizations and individuals must promptly report to the Ministry of Agriculture and Rural Development (through the General Department of Fisheries) for review and adjustment as appropriate./.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

a) Organizing the dissemination and promulgation of this Circular to relevant units, organizations, and individuals.

b) Guiding and organizing inspections of the implementation of regulations on the maintenance and repair of steel-hulled fishing vessels as stipulated in this Circular.

2. Responsibilities of the Departments of Agriculture and Rural Development:

a) Organizing the dissemination and promulgation of this Circular to relevant units, organizations, and individuals within their province.

b) Organizing inspections of the implementation of regulations on the maintenance and repair of steel-hulled fishing vessels as stipulated in this Circular at the local level according to the management hierarchy.

c) Regularly reporting the implementation situation of this Circular at the local level to the Ministry of Agriculture and Rural Development (through the Fisheries General Department).

3. Responsibilities of shipbuilding, upgrading, conversion facilities, and fishing vessel owners:

Implementing the provisions of this Circular during the maintenance and repair of steel-hulled fishing vessels with a total main engine power of 400 HP or more.

Article 6. Implementation Provisions

1. This Circular takes effect from August 25, 2014.

2. The Director of the Fisheries General Department, the Heads of the Departments of Agriculture and Rural Development of the provinces and centrally governed cities, and organizations and individuals involved in the maintenance and repair of steel-hulled fishing vessels with a total main engine power of 400 HP or more shall be responsible for implementing this Circular. During the implementation process, if any difficulties arise, organizations and individuals shall promptly report to the Ministry of Agriculture and Rural Development (through the Fisheries General Department) for review and adjustment to ensure appropriateness.
