Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 89/2015/ND-CP dated October 7, 2015 of the Government amending and supplementing certain articles of Decree No. 67/2014/ND-CP dated July 7, 2014 of the Government on some policies for developing fisheries;

The Minister of Agriculture and Rural Development stipulates the contents and maintenance and repair quotas for steel-hulled fishing vessels supported under Decree No. 67/2014/ND-CP dated July 7, 2014 of the Government on certain policies to develop fisheries.

Article 1. Scope of Regulation

This Circular stipulates the contents and maintenance and repair quotas for steel-hulled fishing vessels with a total main engine power of 400 HP or more supported under Decree No. 67/2014/ND-CP dated July 7, 2014 of the Government on certain policies to develop fisheries.

Article 2. Applicability

This Circular applies to organizations and individuals related to the activities of maintaining and repairing steel-hulled fishing vessels with a total main engine power of 400 HP or more.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

1. Maintenance and repair of steel-hulled fishing vessels include regular maintenance levels including: Maintenance, minor repairs, intermediate repairs, major repairs to address damages to ensure that the fishing vessel meets operational requirements until the next repair cycle.

2. Maintenance involves bringing the vessel for small repairs, rust removal, cleaning surfaces, touch-up painting from the waterline upwards, and deck equipment to ensure the fishing vessel meets operational requirements until the next repair cycle.

3. Minor repairs aim to eliminate minor damages by replacing or restoring worn-out parts. Minor repairs must ensure the fishing vessel meets operational requirements until the next repair cycle.

4. Intermediate repairs involve inspecting the entire technical condition of the vessel, replacing or repairing component parts, worn-out parts, and hull structures to ensure the fishing vessel can meet operational requirements until the next major repair. Intermediate repairs require lifting the vessel onto a slipway to measure the thickness of the hull plating and repair underwater sections, and are conducted concurrently with the periodic inspection by the registration authority.

5. Major repairs involve surveying all parts of the vessel, replacing or repairing components including the hull. Major repairs may also include modernization and improvement of equipment to enhance the technical quality, exploitation efficiency, economic technical indicators, labor productivity, and living conditions for crew members. Major repairs are conducted concurrently with the periodic inspection by the registration authority.

Article 4. Contents and maintenance and repair quotas for steel-hulled fishing vessels

1. Contents of maintenance and repair for steel-hulled fishing vessels

a) Levels of maintenance and repair as specified in Appendix 1.

b) Contents of maintenance and repair for the hull, vessel machinery, and equipment as specified in Appendix 2.

2. The subjects, funding levels, conditions for support, and application procedures for support shall be implemented according to the provisions of Circular No. 117/2014/TT-BTC dated August 21, 2014 of the Minister of Finance guiding the implementation of certain articles of Decree No. 67/2014/ND-CP dated July 7, 2014 of the Government on certain policies to develop fisheries.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. Responsibilities of the Fisheries General Department:

a) Organizing the dissemination and promulgation of this Circular to relevant units, organizations, and individuals.

b) Guiding and organizing inspections of the implementation of regulations on the maintenance and repair of steel-hulled fishing vessels as stipulated in this Circular.

2. Responsibilities of the Departments of Agriculture and Rural Development:

a) Organizing the dissemination and promulgation of this Circular to relevant units, organizations, and individuals within their province.

b) Organizing inspections of the implementation of regulations on the maintenance and repair of steel-hulled fishing vessels as stipulated in this Circular at the local level according to the management hierarchy.

c) Regularly reporting the implementation situation of this Circular at the local level to the Ministry of Agriculture and Rural Development (through the Fisheries General Department).

3. Responsibilities of shipbuilding, upgrading, conversion facilities, and fishing vessel owners:

Implementing the provisions of this Circular during the maintenance and repair of steel-hulled fishing vessels with a total main engine power of 400 HP or more.

Article 6. Implementation Provisions

1. This Circular takes effect from August 25, 2014.

2. The Director of the Fisheries General Department, Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, and organizations and individuals involved in the maintenance and repair of steel-hulled fishing vessels with a total main engine power of 400 HP or more are responsible for implementing this Circular.

In the course of implementation, if any issues arise, organizations and individuals should promptly report them to the Ministry of Agriculture and Rural Development (through the Fisheries General Department) for review and adjustment as appropriate./.
