Circular No. 27/2015/TT-BNNPTNT stipulates the standards for the titles of Director and Deputy Director of the Department of Agriculture and Rural Development under the People's Committees of provinces and centrally governed cities.

CIRCULAR

Regulations on the qualifications for the positions of Director and Deputy Director of the Department of Agriculture and Rural Development under the People's Committees of provinces and centrally governed cities.

The Government promulgates this Decree amending and supplementing certain provisions of the Decree No. 148/2016/NĐ-CP dated October 4, 2016 of the Government guiding the implementation of certain provisions of the Market Management Ordinance.

Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government;

At the proposal of the Director of the Cadre and Civil Servant Organization Department;

The Minister of Agriculture and Rural Development shall issue a Circular to stipulate the qualifications for the positions of Director and Deputy Director of the Department of Agriculture and Rural Development under the People's Committees of provinces and centrally governed cities.

 Article 1. Scope of Regulation and Applicability

1. This Circular sets forth general and specific qualifications for the positions of Director and Deputy Director of the Department of Agriculture and Rural Development under the People's Committees of provinces and centrally governed cities (hereinafter referred to as Director of the Department and Deputy Director of the Department).

2. This Circular applies to the People's Committees of provinces and centrally governed cities (hereinafter collectively referred to as Provincial People's Committee), and the Departments of Agriculture and Rural Development of provinces and centrally governed cities (hereinafter referred to as Department of Agriculture and Rural Development).

Article 2. Principles of Application

1. The qualifications for the positions of Director and Deputy Director of the Department stipulated in this Circular serve as the basis for competent authorities to implement and supervise the appointment, reappointment, rotation, removal, planning, training, and evaluation of civil servants holding the positions of Director and Deputy Director of the Department.

2. Cadres, civil servants, and public officials who are considered for appointment or reappointment to the position of Director or Deputy Director of the Department must meet the general and specific qualifications for each position as prescribed by the Party, State, and the qualifications set forth in this Circular.

ARTICLE 3. POSITION AND RESPONSIBILITIES

1. The Director of the Department is a civil servant heading the Department of Agriculture and Rural Development under the People's Committee of a province or centrally governed city, accountable to the Provincial People's Committee, the Chairman of the Provincial People's Committee, and simultaneously accountable to the Minister of Agriculture and Rural Development and the law regarding the functions and tasks of the Department and the authority delegated.

2. The Deputy Director of the Department assists the Director of the Department in overseeing and directing certain aspects of work according to the Director's assignment, accountable to the Director of the Department and the law regarding the assigned tasks.

 Article 4. General Qualifications Regarding Political Integrity, Morality, and Lifestyle

1. Patriotic, with firm political resolve, loyal to the Party's policies and the State's laws, resolute in the reform path, national independence, and socialism; devoted to serving the country and the people.

2. Work with a sense of responsibility and high efficiency; frugal, honest, impartial, dedicated, and unbiased; not opportunistic, not corrupt, firmly combating corruption and negative phenomena; practicing thrift and opposing waste.

3. Have a sense of organizational discipline; be truthful, objective, daring to think, act, and take responsibility; enthusiastic about learning, researching, innovating, and being dynamic; have a spirit of self-criticism and criticism.

4. Set a good example in morality and lifestyle; have a democratic and scientific style; be trusted by the collective of cadres, civil servants, public officials, workers at the workplace, and residents in the place of residence; implement office culture well, maintain administrative order and discipline.

Article 5. General standards for leadership and management capacity

1. Possess the ability to lead and manage the implementation of the Party's guidelines and state laws on agriculture and rural development within the province or centrally governed city.

2. Have a vision and innovative thinking, possess the ability to set directions for development, strategies, planning, and plans for agricultural and rural development within the province or centrally governed city.

3. Possess the ability to organize, direct, unite, and mobilize cadres, civil servants, public officials, and workers at the workplace, and coordinate with relevant agencies, organizations, and individuals to effectively perform assigned tasks.

Article 6. Specific standards for the position of Director of Department

1. Hold the rank of Senior Specialist or equivalent.

2. Hold a bachelor’s degree or higher in a field related to state management of agriculture and rural development.

3. Master one common foreign language at a level equivalent to Level 3 of the 6-level Foreign Language Proficiency Framework for Vietnam issued together with Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, by the Minister of Education and Training.

4. Hold a high-level political theory qualification.

5. Meet the basic information technology skill standard as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, by the Minister of Information and Communications regarding the Information Technology Skill Standard.

Article 7. Conditions for appointing the Director of Department

1. Have served in the position of Deputy Director of Department, bureau, or agency at the provincial level or equivalent, or as Deputy Secretary or Deputy Chairman of the People's Committee at the district level or equivalent, for at least three years; preference given to those who have served as Deputy Director of the Department of Agriculture and Rural Development.

2. The initial appointment age shall not exceed fifty-five years for males and fifty years for females.

3. Be in good health to fulfill assigned tasks.

4. Not be subject to any prohibition from assuming office as stipulated by law.

Article 8. Specific standards for the position of Deputy Director of Department

1. Hold the rank of Specialist or equivalent.

2. Hold a bachelor’s degree or higher in a field related to state management of agriculture and rural development.

3. Master one common foreign language at a level equivalent to Level 2 of the 6-level Foreign Language Proficiency Framework for Vietnam issued together with Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, by the Minister of Education and Training.

4. Hold a high-level political theory qualification.

5. Meet the basic information technology skill standard as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, by the Minister of Information and Communications regarding the Information Technology Skill Standard.

Article 9. Conditions for appointing the Deputy Director of Department

1. Have worked in the sector for at least three years, with preference given to those who have served as head or deputy head of departments or units under the Department of Agriculture and Rural Development.

2. The initial appointment age shall not exceed fifty-five years for males and fifty years for females;

3. Be in good health to fulfill assigned tasks;

4. Not be subject to any prohibition from assuming office as stipulated by law.

 Article 10. Effective Date

1. This Circular takes effect from October 1, 2015.

2. This Circular replaces Decision No. 68/2008/QĐ-BNN dated May 27, 2008, by the Minister of Agriculture and Rural Development on the standards and conditions for the positions of Director and Deputy Director of the Department of Agriculture and Rural Development.

Article 11. Responsibility for Implementation

1. Provincial People's Committees shall be responsible for:

a) Base on the standards prescribed in this Circular to develop training, upgrading, planning, and consider appointments, reappointments, transfers, dismissals, and evaluations of civil servants holding the positions of Director and Deputy Director of Departments.

b) Within ten days from the date the decision appointing the positions of Director and Deputy Director of Departments becomes effective, notify in writing to the Ministry of Agriculture and Rural Development along with the appointment decision and the resume of the appointed person for tracking, coordination in implementing training, upgrading, enhancing state management capabilities in agriculture and rural development, planning leadership positions of subordinate units, and the leadership of the Ministry of Agriculture and Rural Development.

2. Departments of Agriculture and Rural Development base on the standards prescribed in this Circular to implement cadre leadership training and planning work.

3. For those already appointed as Director or Deputy Director of Departments but not meeting the standards prescribed in this Circular, they must undergo training and upgrading to meet the prescribed standards.

During the implementation process, if there are difficulties or obstacles, agencies, units, organizations, and individuals should report to the Ministry of Agriculture and Rural Development (through the Cadre and Civil Servant Organization Department) for consolidation and reporting to the Minister for consideration and decision./.
