REGULATIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE FISHERIES GENERAL DEPARTMENT UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to Decree No.123/2016/NĐ-CPD-CPdated September 1, 2016 of the Government regulating the functions, tasks, powers and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No.15/2017/NĐ-CPdated February 17, 2017, of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;irural areas;

At the proposal of the Minister of Agriculture and Rural Development;

The Prime Minister issues this Decision to regulate the functions, tasks, powers, and organizational structure of the Fisheries General Department under the Ministry of Agriculture and Rural Development.ngand Rural Development.

Article 1. Position and Functions

1. The Fisheries General Department is an organization under the Ministry of Agriculture and Rural Development, performing the function of advising and assisting the Minister of Agriculture and Rural Development in state management and enforcement of laws related to fisheries throughout the country; organizing the implementation of public service activities within the scope of state management of the Department as prescribed by law.

2. The Fisheries General Department has legal personality, a seal with the National Emblem, a separate account, and operational funds provided by the state budget.

3. The headquarters of the Fisheries General Department is located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Submit to the Minister of Agriculture and Rural Development:

a) Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees, resolutions of the Government; draft decisions, directives of the Prime Minister; policies and other documents within the scope of management of the Department;policies, policies, and other documents within the management scope of the General Department;

b) Strategies, plans, long-term, medium-term, annual plans, programs, projects, proposals, and important national works within the scope of management of the Department;

c) National standards, national technical regulations, technical norms, economic-technical quotas, and technological progress within the scope of management of the Department.

2. To provide professional guidance within the scope of management of the General Department.

3. Organize propaganda, dissemination, and education on laws within the fields under the management of the General Department.

4. Guide, inspect, and organize the implementation of regulatory documents, strategies, plans, programs, projects, and proposals within the scope of management of the Department.

5. On conservation and development of fishery resources:

a) Submit to the Minister of Agriculture and Rural Development:

Announce the list of aquatic species listed in the Red Book of Vietnam and those that need protection, restoration, and development; species prohibited from exploitation, prohibited from exploitation for a limited time; specify the time and areas prohibited from exploitation, areas prohibited from exploitation for a limited time, methods of exploitation, types of exploitation, fishing gear prohibited from use, minimum size and type of permitted exploited species, seasons of exploitation;of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsexploitation zones, prohibited exploitation zones with a time limit, exploitation methods, types of exploitation activities, fishing gear prohibited from use, species and minimum sizes of aquatic animals allowed to be exploited, seasons for exploitation;

Criteria for classification and announcement of inland water conservation zones, marine conservation zones; planning and hierarchical management of inland water conservation zones, marine conservation zones; management regulations of inland water conservation zones, marine conservation zones related to fishery resources as prescribed by law;ồinland waters, conservation areas;ồmarine areas; management regulations for conservation areas of inland waters and marine areas related to aquatic resources according to the provisions of the law;

b) Direct, guide, and inspect the implementation of regulations on protecting the living environment of aquatic species; conserve, restore, and develop fishery resources; measures to protect the environment of aquatic ecosystems; conserve genetic diversity and biodiversity of aquatic species;ồrestoration and development of aquatic resources; measures to protect the environment of aquatic ecosystems; conservation;ồc) Organize surveys and assessments of fishery resources in each sea area, fishing grounds, large water bodies, rivers, and lakes; forecast and announce fishing grounds, fishing areas; determine the annual stock and catch volume in each sea area, fishing ground;

d) Manage endangered, precious, rare aquatic species; export, import, temporary import for re-export, domestic import from abroad, transit, breeding, and artificial propagation of endangered, precious, rare aquatic species.

d) Management of aquatic species;In which, the adjustment rate for the monthly income already contributed to social insurance for the corresponding year shall be implemented according to Table 2 below: Table 2:endangered, precious, rare; export, import, temporary import for re-export, import from abroad;developmenttransit, breeding;ngand artificial breeding;n lof aquatic endangered, precious, rare species;iny products; procedures and conditions for issuing and revoking permits for exploiting aquatic resources; conditions for foreign fishing vessels operating in Vietnam's territorial waters and Vietnamese fishing vessels engaged in exploitation of aquatic resources;June 2024;both within and outside Vietnam's territorial waters;toc) Guide and inspect the implementation of regulations on planning for exploitation of aquatic resources, fish ports, fish wharfs, anchorage areas for fishing vessels to avoid typhoons;

6. On fishing activities:

a) Submit to the Minister of Agriculture and Rural Development on zoning for fishing activities; division of responsibilities and hierarchical management of fishing activities; management regulations for fishing activities; procedures for issuing and revoking fishing permits; conditions for foreign fishing vessels operating in Vietnam's exclusive economic zone and Vietnamese fishing vessels operating in Vietnam's and international waters;Deputy ministers of ministerial-level agencies,b) Guide and inspect the implementation of regulations on registration and inspection of fishing vessels; management of crew members of fishing vessels; inspection, evaluation, and recognition of inspection facilities meeting the conditions for fishing vessel inspections;Deputy ministers of ministerial-level agencies,8. On building new and modifying fishing vessels:n lb) Guide and inspect the implementation of regulations on building new, modifying, maintaining, and regular repair of fishing vessels;developmentc) Direct, guide, and inspect the implementation of regulations on planning, seasons for aquaculture; aquaculture seeds; feed, raw materials for feed production in aquaculture; chemicals, biological preparations, microorganisms, and environmental treatment substances in aquaculture according to the provisions of the law;

b) Guide the organization of production and occupational restructuring in fishing activities;

n salaries and incentive policies, commendation, rewards, and disciplinary measures; participate in training, and capacity building under the management of the General Department according to the classification of the Ministry of Agriculture and Rural Development;

7. On registration and inspection of fishing vessels:

a) Submit to the Minister of Agriculture and Rural Development on registration and inspection of fishing vessels; conditions for inspection facilities; safety conditions for people and fishing vessels engaged in fishing activities;

b) Guide and inspect the implementation of regulations on registration and inspection of fishing vessels; manage crew members of fishing vessels; inspect, evaluate, and recognize inspection facilities meeting the conditions;

The Minister of Agriculture and Rural Development, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees directly under the central government, and the Director of the Fisheries General Department are responsible for implementing this Decision./.

8. On construction and modification of fishing vessels:Family Planning) for consideration and resolution./.a) Submit to the Minister of Agriculture and Rural Development on technical requirements for fishing vessel design models; economic-technical quotas for regular maintenance and repair of fishing vessels; conditions for new construction, upgrading, and modification of fishing vessels;

b) Direct, guide, and inspect the implementation of regulations on the construction, conversion, maintenance, and regular repair of fishing vessels.

9. On aquaculture:

a) Submit to the Minister of Agriculture and Rural Development on planning concentrated aquaculture areas; lists of aquaculture breeds; banned chemicals and those allowed for use in aquaculture; recognition of aquaculture breeds and feed according to regulations;

c) Direct, guide, and inspect the implementation of regulations concerning the planning, seasonal cycles of aquaculture production; aquatic seedlings; feed and raw materials for aquaculture feed; chemicals, biological preparations, microorganisms, and environmental treatment substances in aquaculture as prescribed by law;

b) Guide and inspect the quality, issue permits for export and import of aquaculture breeds; feed, raw materials for aquaculture feed; biological preparations, microorganisms, and environmental treatment chemicals in aquaculture;

c) Direct, guide, and inspect the implementation of regulations on planning, seasonal aquaculture; aquaculture breeds; feed, raw materials for aquaculture feed; chemicals, biological preparations, microorganisms, and environmental treatment chemicals in aquaculture as prescribed by law;

e) Guide, inspect activities related to monitoring, warning, supervision, and environmental treatment in aquaculture; testing, inspection, and certification activities in aquaculture; prevention and mitigation of natural disasters in aquaculture.

10. On fisheries surveillance:

a) Implement state management of fisheries surveillance in accordance with the provisions of the law and the delegation of the Minister of Agriculture and Rural Development;

b) Organize patrols, inspections, control, investigation, detection, and handling of violations of laws on aquatic products;

c) Organize work to prevent and combat natural disasters and coordinate search and rescue operations for sudden and emergent issues in marine fishing; prevent and reduce the situation where fishing vessels and fishermen are detained by foreign countries, in accordance with the division of responsibilities assigned by the Ministry of Agriculture and Rural Development;

d) Participate in protecting national sovereignty, sovereign rights, and jurisdiction over maritime zones in accordance with the provisions of the law;

đ) Guide communication, disaster prevention, search and rescue operations for fishing vessels at sea;developmentn.

11. Implement state management tasks regarding the quality of products and input materials serving aquaculture and fishing activities in accordance with the provisions of the law.

12. Implement state management tasks concerning food safety in aquaculture and fishing activities in accordance with the provisions of the law and the division of responsibilities assigned by the Ministry of Agriculture and Rural Development.

13. Implement state management tasks concerning processing, development of the aquatic product market in accordance with the provisions of the law and the division of responsibilities assigned by the Ministry of Agriculture and Rural Development.

14. Manage planning projects and basic surveys on aquatic products in accordance with the division of responsibilities assigned by the Ministry of Agriculture and Rural Development.

15. Organize statistical work; establish, manage databases and specialized information systems in accordance with the provisions of the law.

16. Manage scientific research, technology transfer, and fishery promotion activities in accordance with the division of responsibilities assigned by the Ministry of Agriculture and Rural Development.

17. Implement international cooperation in accordance with the division of responsibilities assigned by the Ministry of Agriculture and Rural Development.

18. Implement administrative reform in accordance with the administrative reform program of the Ministry of Agriculture and Rural Development.

19. Manage organizational structure, civil servant quota, job positions, number of civil servants and employees; implement salary systems and policies, incentives, commendations, rewards, and disciplinary measures; participate in training and professional development for civil servants and employees under the management of the General Department in accordance with the division of responsibilities assigned by the Ministry of Agriculture and Rural Development.onremuneration and policies, benefits, incentive programs, commendations, rewards, and disciplinary measures; participate in training,ồb) Professional development for civil servants and employees under the management of the General Department in accordance with the division of responsibilities assigned by the Ministry of Agriculture and Rural Development.onmanagement of the General Department according to the分级授权的农业农村部。

20. Guide and inspect the activities of associations and non-governmental organizations in accordance with the division of responsibilities assigned by the Ministry of Agriculture and Rural Development.

21. Implement specialized inspection and supervision tasks in accordance with the provisions of the law; receive citizens; resolve complaints and denunciations; prevent and combat corruption and handle violations of the law; practice thrift and combat waste within the scope of authority.June 2024;22. Manage finance, assets, and other resources allocated in accordance with the provisions of the law.ử23. Manage investment construction in accordance with the division of responsibilities assigned by the Ministry of Agriculture and Rural Development and the provisions of the law.

24. Manage the Fisheries Resource Replenishment Fund of Vietnam and international financial support for the fisheries sector in accordance with the provisions.

25. Perform other tasks assigned by the Minister of Agriculture and Rural Development.

4. The Department of Conservation and Sustainable Development of Aquatic Resources.

Article 3. Organizational Structure

1. Department of Planning and Finance.

5. The Department of Aquaculture.policies.

3. Legal Affairs and Inspection Department.

6. The Department of Fisheries Exploitation.

8. The Fisheries Surveillance Agency.

9. The Testing, Inspection, and Certification Center for Aquaculture.

7. Office of the Water Resources Agency.

10. The Fishing Vessel Inspection Center.

11. The Fisheries Information Center.

Organizations specified from Clause 1 to Clause 8 of this Article assist the Director-General in performing state management functions; organizations specified from Clause 9 to Clause 11 of this Article are subordinate units under the General Department.

The Office of the General Department has four departments, the Fisheries Surveillance Agency has an office, four departments, and five Regional Fisheries Surveillance Bureaus.

1. The General Department of Fisheries has a Director-General and not more than four Deputy Director-Generals appointed and relieved of their duties by the Minister of Agriculture and Rural Development in accordance with the provisions of the law.

2. The Director-General of the General Department of Fisheries is responsible before the Minister and the law for all activities of the General Department. Deputy Director-Generals of the General Department of Fisheries are responsible before the Director-General and the law for the areas of work they are assigned to manage.

Article 4. Leadership of the General Department

3. The Director-General of the General Department of Fisheries submits to the Minister of Agriculture and Rural Development regulations on the functions, tasks, powers, and organizational structure of subordinate organizations; appoints and relieves leaders and managers of the General Department of their duties in accordance with the provisions of the law and the division of responsibilities assigned by the Minister of Agriculture and Rural Development.

Article 5. Effective Date

 issued on October 22, 2014 by the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Fisheries under the Ministry of Agriculture and Rural Development.57/20The Minister of Agriculture and Rural Development, Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairpersons of provincial People's Committees directly under the central government, and the Director-General of the General Department of Fisheries are responsible for implementing this Decision./.dated October 22, 2014, issued by the Prime Minister, stipulating the functions, tasks, authorities, and organizational structure of the Fisheries General Department under the Ministry of Agriculture and Rural Development.

Article 6. Responsibility for Implementation

The Minister of Agriculture and Rural Development, the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and the Director of the Fisheries General Department are responsible for implementing this Decision./.
