CIRCULAR

Rules on conduct for the People's Public Security

1. The Deputy Minister of Public Security responsible for the traffic police force shall be the head of the Criminal Police Investigation Department under the Ministry of Public Security.

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Political General Department of the People's Public Security;

The Minister of Public Security issues this Circular stipulating the conduct rules for the People's Public Security.

PART I

GENERAL PROVISIONS

Article 1.perioda) Clause 1 Article 15 regarding accountability;

This Circular stipulates the principles of conduct; general conduct rules for officers, soldiers, and public security workers; conduct rules when performing duties and tasks; conduct within the organization, in social relations, and with the natural environment.

Article 2. Applicability

This Circular applies to: Officers, non-commissioned officers, conscript soldiers, students from academies and schools, public security workers (collectively referred to as public security officers and soldiers).

Article 3. Principles of Conduct

1. Adhere to the Constitution, laws, and regulations of the People's Public Security.

2. Respect and protect the rights and interests of the state; the lawful rights and interests of individuals, agencies, and organizations.

3. Be consistent with the morals, culture, customs, and traditions of the nation and the tradition of the People's Public Security.

4. Public security officers and soldiers must strictly follow work procedures, conduct rules, and professional ethics while performing their duties.

Chapter II

CONTENT OF THE CODE OF CONDUCT

Article 4. General Code of Conduct

1. Speak and act in accordance with the Party's guidelines and policies, the State's policies and laws; Six Points taught by President Ho Chi Minh to the Public Security, Five Oaths of Honor, Ten Disciplines, and the regulations of the People's Public Security.

2. Respect and serve the people wholeheartedly; maintain close ties with the people, listen to their opinions, and be subject to their supervision.

3. Cultivate noble moral character and healthy lifestyle; be honest, straightforward, thrifty, clean, and upright.

4. Have a sense of organizational discipline and responsibility in work; strictly implement regulations on protecting state secrets, professional secrets, working rules, and work procedures.

5. Continuously study to improve professional knowledge and skills; take initiative, be creative, and cooperate in work to fulfill assigned tasks effectively.

6. Do not abuse the name of the agency or unit or the assigned responsibilities for personal gain or purposes; do not cover up or create conditions for organizations or individuals to commit illegal acts.

7. Do not accept money, property, or other benefits from agencies, organizations, or individuals related to the work they handle or under their management; do not use gift-giving or receiving as a means of bribery or other actions for personal gain.

8. Do not misuse information or documents of the unit; conceal, suppress, or distort the content reported by agencies, organizations, and citizens regarding matters related to their assigned functions and tasks.

9. Do not refuse to accept or resolve or intentionally delay the resolution time of legitimate requests from agencies, organizations, and citizens according to their responsibilities and tasks.

10. Do not evade or shirk responsibility when performing assigned tasks that result in consequences affecting the activities of their own unit or other agencies or organizations, or affecting the legitimate rights and interests, honor, and dignity of citizens.

Article 5. Ứ |||Internal Conduct

1. Conduct towards superiors

a) Obey directives, instructions, orders, and tasks assigned by superiors; respect and trust superiors;

b) Report truthfully, promptly, and fully to superiors about the situation and results of assigned tasks;

c) Proactively propose suggestions, recommendations, and contribute opinions to superiors on work methods, management, and unit operation; listen to and absorb superiors' opinions.

2. Conduct towards subordinates

a) Respect, be close to, help, share experiences, listen to, consider, and resolve the thoughts, aspirations, and reasonable proposals of subordinates;

b) Set an example in work, study, self-cultivation, and moral character training; do not have authoritarian, arrogant, bureaucratic, oppressive, abusive, or defamatory attitudes or behaviors towards subordinates;

c) Be democratic, impartial, and fair in assessing and classifying cadres; clearly assign tasks to subordinates, matching the person to the job;

d) Do not cover up violations by subordinates; protect the reputation of subordinates when they are falsely accused, complained about, or reported;

đ) Trust, encourage, and promote the strengths of subordinates; create conditions for them to study and improve their theoretical political knowledge, legal knowledge, professional skills, vocational skills, and cultural conduct.

3. Conduct among peers

a) Respect individual characteristics and private lives; protect the reputation and honor of comrades and colleagues;

b) Cooperate and support each other in fulfilling assigned tasks; be open-minded, learn from, and absorb correct opinions of comrades and colleagues; have a positive attitude towards the development and progress of comrades and colleagues;

c) Criticize oneself and others objectively, sincerely, and constructively; do not engage in actions or speech that undermine internal unity, slander, lie, or damage personal reputation.

Article 6. Conduct towards the People

1. Respectfully and courteously treat the People; closely connect with the People; enthusiastically and responsibly handle their legitimate work and requests.

2. Communicate and work with the people with a warm, enthusiastic, and responsible attitude; address them appropriately, behave politely, amicably, modestly, humbly, and be receptive to their constructive opinions; prioritize handling matters for the elderly, weak, disabled, sick, and pregnant women.

3. Shall not engage in behavior or speech that harasses, extorts, shows indifference or insensitivity towards the People's legitimate requests; shall not cause tension, frustration, or intimidate the People; shall not schedule meetings outside the office premises and working hours to resolve their affairs.

4. Regularly promote and mobilize the People to comply with the law and voluntarily and actively participate in the "All-People Safeguarding National Security" movement.

Article 7. Conduct towards individuals violating the law

1. Strictly implement the Party’s policies and guidelines, state policies and laws, and the regulations of the Public Security force in combating and dealing with criminals and other individuals who violate the law.

2. Firmly, intelligently, courageously, and skillfully perform duties; handle violations objectively and truthfully, ensuring political, legal, and professional requirements.

3. When interacting with individuals who have violated the law, Public Security officers must maintain proper posture, etiquette, and demeanor; their conduct should be appropriate, without insulting or discriminating against violators.

4. Shall not abuse assigned responsibilities and tasks to distort case files or cases leading to wrongful acquittals, wrongful convictions, or other purposes.

Article 8. Conduct towards foreign organizations and individuals

1. Strictly implement the Party’s policies and guidelines, state policies and laws, and the regulations of the Public Security force regarding interactions, relations, and work with foreign organizations and individuals, and implement foreign policy and international cooperation.

2. Respect the customs, traditions, beliefs, religions, and culture of foreigners, while adhering to Vietnamese law.

3. Shall not make statements or actions that harm the interests, image of Vietnam and its people, or the traditions, honor, and reputation of the Vietnamese Public Security force.

Article 9. Conduct within the family

1. Set a good example, mobilize, and educate family members to strictly follow the Party’s policies and guidelines, state policies and laws, and local regulations where they reside.

2. Serve as a model in daily life, practicing civilized living habits and building a cultured family; foster a healthy, harmonious, progressive, and happy lifestyle.

3. Shall not allow family members to participate in the work of the agency or unit or take advantage of their positions or ranks to violate the law and regulations of the Public Security force.

Article 10. Conduct at place of residence

1. Set a good example in fulfilling civic duties, actively participate in the "All-People Building a Civilized Lifestyle" movement; regularly maintain contact with the local party committee, government, and people according to regulations; respect community agreements; be close, united, and supportive of those around.

2. Promote and mobilize the people to strictly comply with regulations at their place of residence; actively cooperate in implementing preventive measures and combating crime, illegal acts, and social evils.

3. Shall not abuse influence from position or rank to improperly interfere in the activities of the local area.

Article 11. Conduct in Public Places

1. Serving as a model in complying with internal regulations, rules of public places, citizen moral standards prescribed by law or agreed upon by the community; behaving civilly, friendly, maintaining public order and cleanliness.

2. Not using speech or actions that violate customs, traditions, and ethnic cultural identity in public places.

Article 12. Conduct towards the Natural Environment

1. Protecting and preserving the natural environment; participating in building a green, clean, and beautiful environmental landscape.

2. Promoting education and mobilizing people to maintain hygiene, protect natural scenery, and respond to social movements for environmental protection.

Article 13. Conduct and Communication via Telephone and Other Electronic Means

1. When communicating via telephone, police officers must state their name, position, unit, and the content of the conversation clearly; communication language should be civilized, polite, concise, and easy to understand; not discussing confidential matters over the phone.

2. When using other electronic means, police officers shall not access, store, disseminate, comment on, or share information, documents, articles, images containing content contrary to customs and traditions; contrary to the Party's policies, State laws, and regulations of the Ministry of Public Security; nor shall they introduce or use the name, image, or insignia of their units on social media platforms.

Article 14. Use of Work Equipment and Devices

1. Regularly maintaining, protecting, and using provided assets and equipment economically and effectively; studying and skillfully using technical devices provided for work purposes.

2. Not using work assets and equipment for purposes other than intended or for personal use in any form.

Chapter III

IMPLEMENTATION

Article 15. Effective Date

This Circular takes effect from October 6, 2017; replacing Decision No. 893/2008/QĐ-BCA dated July 4, 2008, issued by the Minister of Public Security regarding the Code of Conduct for Officers, Non-Commissioned Officers, Soldiers, Workers, and Civil Servants in the People's Public Security and other regulations of the Ministry of Public Security that conflict with this Circular.

Article 16. Responsibility for Implementation

1. The Director-General, Commander, heads of subordinate units under the Ministry, Provincial Police Chiefs, Fire Prevention and Control Directors of centrally-administered cities and provinces are responsible for implementing and enforcing this Circular.

2. The Political Bureau of the People's Public Security is responsible for directing, guiding, inspecting the implementation of this Circular, and reporting to the Minister as prescribed.

3. The Code of Conduct of the People's Public Security shall be widely publicized and promoted so that agencies, sectors, and the public are aware and can supervise its implementation.

In the process of implementing this Circular, if there are any difficulties, local police units shall report to the Ministry of Public Security (through the Political Bureau of the People's Public Security) for timely guidance./.
