Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

At the proposal of the Director General of the Vocational Education Department,

The Minister of Labor, Invalids and Social Affairs issues this Circular to regulate inter-level vocational education training.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 2. Applicability

This Circular applies to secondary vocational schools, college-level institutions, higher education establishments that have registered for associate degree training programs (hereinafter referred to as "schools").

Article 3. Requirements for Joint Training Programs

Schools shall organize joint training programs when meeting the following requirements:

1. Having been granted a certificate of registration for vocational education activities at the intermediate and associate degree levels by the competent authority for the fields and trades that the school plans to offer joint training programs at corresponding levels.

2. Issuing a joint training program curriculum for the fields and trades that the school plans to offer joint training programs, which must be developed in accordance with Article 7 of this Circular.

3. For joint training programs in health-related fields, the school must also ensure that there has been at least one graduating class of students from regular intermediate and associate degree programs.

Article 4. Authority to Decide on Admissions for Joint Training Programs

1. The school principal shall issue a decision on admissions for joint training programs between different levels in vocational education when the requirements set forth in Article 3 of this Circular are met.

2. The admission decision for joint training programs must clearly state the name of the field, trade, level, method, and form of joint training; the target group and the form of admission.

Article 5. Admissions for Joint Training Programs

1. Admission targets for joint training programs at the intermediate level

a) Individuals holding a basic qualification certificate, a basic vocational qualification certificate in the same field or trade, and a secondary school completion certificate or higher;

b) Individuals holding an intermediate level graduation certificate or an intermediate vocational qualification certificate who wish to pursue further studies to obtain a second intermediate level graduation certificate.

2. Admission targets for joint training programs at the associate degree level

a) Individuals holding an intermediate level graduation certificate in the same field or trade and a high school completion certificate or equivalent;

b) Individuals holding an intermediate level graduation certificate but lacking a high school completion certificate must ensure they have completed and passed the required amount of general knowledge subjects as stipulated by the Ministry of Education and Training;

c) Individuals holding an associate degree or associate vocational qualification certificate who wish to pursue further studies to obtain a second associate degree.

3. The time and form of admissions for joint training programs shall be carried out in accordance with Circular No. 05/2017/TT-BLDTBXH dated March 2, 2017, issued by the Minister of Labor, Invalids, and Social Affairs, which regulates admissions procedures and determines enrollment quotas for intermediate and associate degree levels.

4. In addition to the provisions set forth in Clause 1, Clause 2, and Clause 3 of this Article, schools may establish additional conditions to ensure the quality of training, provided they do not contravene the provisions of this Circular.

5. The annual enrollment scale for joint training programs for each field or trade at each training level must fall within the enrollment scale specified in the certificate of registration for vocational education activities issued by the competent authority to the school.

Article 6. Duration of Concurrent Training

1. The duration of concurrent training is determined based on the volume of knowledge and skills prescribed for each program at each level and method of training.

2. The duration of concurrent training under the academic year system between intermediate and college levels ranges from 01 (one) to 02 (two) years of study depending on the field and profession for individuals holding a graduation certificate in the same field and profession.

3. The duration of concurrent training under the modular accumulation or credit system among different levels in vocational education is the time required for students to accumulate the necessary number of modules or credits for each training program.

4. The Rector of the school shall specify the duration of concurrent training for each field and profession and for specific categories of students.

Article 7. Concurrent Training Programs and Recognition of Transferable Learning Outcomes

1. Concurrent training programs are built according to the principle of inheritance and integration to minimize the time spent relearning knowledge and skills that students have already accumulated in other training programs.

2. Concurrent training programs must accurately reflect the objectives, content, and duration of training; teaching methods, learning methods, and assessment methods.

3. Concurrent training programs must ensure the provision of sufficient knowledge and skills that students still lack and update new knowledge and skills corresponding to the training level.

4. The Rector of the school shall decide on the modules, courses, or content that students do not need to relearn based on the training program.

Article 8. Organization of Concurrent Training

1. Regular concurrent training is implemented in accordance with Circular No. 09/2017/TT-BLDTBXH dated March 13, 2017, issued by the Minister of Labor, Invalids, and Social Affairs, which stipulates the organization and implementation of intermediate and college level training programs under the academic year system or the modular accumulation or credit system; examination rules, graduation recognition regulations.

2. Concurrent training through part-time study is implemented in accordance with the provisions of the Minister of Labor, Invalids, and Social Affairs.

Article 9. Graduation Certificates and Grade Sheets

1. Students participating in regular concurrent training are awarded a graduation certificate indicating regular training; students participating in concurrent training through part-time study are awarded a graduation certificate indicating part-time study.

2. The grade sheet of students must clearly record the results of their studies along with the credit hours of courses and modules during concurrent training and those of other courses and modules recognized.

Chapter III

IMPLEMENTATION

Article 10. Responsibilities of Ministries, Agencies Equivalent to Ministries, Government Agencies, People's Committees of Provinces and Central Cities, Political-Social Organizations

1. Direct, guide, and inspect concurrent training activities at schools under their management responsibility.

2. Coordinate with the Ministry of Labor, Invalids, and Social Affairs to implement this Circular.

Article 11. Responsibilities of Departments of Labor, Invalids, and Social Affairs

1. Direct, guide, and inspect concurrent training activities at schools under their management responsibility.

2. Summarize the situation of concurrent training between different levels in vocational education of schools within their jurisdiction annually up to December 31 and report in writing to the Ministry of Labor, Invalids, and Social Affairs (through the General Department of Vocational Education) before January 25 of the following year.

3. Report to competent authorities on the concurrent training activities of schools within their jurisdiction and related issues as prescribed by law or provide ad hoc reports when requested.

Article 12. Responsibilities of educational institutions

1. Issuing regulations on admissions and concurrent education programs, including provisions on criteria, procedures for recognizing the value of transferred learning outcomes and accumulated knowledge and skills of students exempted from concurrent education programs.

2. Within three (3) working days from the date of issuing the decision on admissions for concurrent education programs, colleges and higher education institutions shall report to the Ministry of Labor, Invalids and Social Affairs (through the General Department of Vocational Education); secondary vocational schools shall report to the provincial Department of Labor, Invalids and Social Affairs where the school is headquartered; the report shall include the following contents:

a) Fields, trades, levels of concurrent education; planned enrollment quotas; admission targets; methods and forms of education and commitments to ensure the quality of education according to the model attached to this Circular;

b) Admissions decision, concurrent education program (the decision promulgating the concurrent education program accompanied by the concurrent education program) and a copy of the certificate of registration for vocational education activities.

3. Publicly disclose information on: fields, trades of concurrent education; education programs; diplomas after graduation; regulations on admissions and concurrent education; student regulations; training plans; quality assurance conditions; tuition fees; amounts of knowledge and skills exempted for each student.

4. Implement requirements to ensure the quality of education.

5. Report in writing on the situation of concurrent education at the school annually up to December 31 of each year to the provincial Department of Labor, Invalids and Social Affairs where the school is headquartered before January 10 of the following year; the report shall include the following contents:

a) Fields, trades organizing concurrent education; results of admissions, organization of education; graduation results, issuance of graduation diplomas in the reporting year; situations of rewards and disciplinary actions against students; advantages, difficulties and proposals, recommendations (if any);

b) Copies of decisions approving lists of students admitted or assigned to classes; copies of lists of students recognized and not recognized for graduation in the reporting year (if any);

c) Report to competent authorities on concurrent education activities and other related issues as prescribed by law or report promptly when required.

6. Maintain training records in accordance with Circular No. 09/2017/TT-BLDTBXH dated March 13, 2017 of the Minister of Labor, Invalids and Social Affairs on the implementation of mid-level and college-level education programs under the academic year system or modular or credit accumulation method; examination and graduation recognition regulations.

Article 13. Effective Date

1. This Circular takes effect from November 5, 2017.

2. Ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally governed cities, Political-Social Organizations, the General Department of Vocational Education, provincial Departments of Labor, Invalids and Social Affairs, Schools and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.
