Regulations on criteria and indicators for evaluating the quality of services
public service activities related to providing weather forecast and warning bulletins

 Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government on the mechanism of autonomy for public institutions;

Decree No. 36/2017/NĐ-CP dated April 4 Article 2. The receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations shall be carried out in accordance with Decree No. 20/2008/NĐ-CP dated February 14, 2008 of the Government on the receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations (amended and supplemented by Decree No. 48/2013/NĐ-CP dated May 14, 2013 on amending and supplementing certain articles of decrees related to administrative procedure control and Decree No. 92/2017/NĐ-CP dated August 7, 2017 on amending and supplementing certain articles of decrees related to administrative procedure control).7 The Government promulgates the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

in the construction of national standards and national technical regulations under the responsibility of the Ministry of Natural Resources and Environment. for providing weather forecast and warning bulletins.

 PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the criteria and indicators for evaluating the quality of public service activities using budget funds for providing weather forecast and warning bulletins (hereinafter referred to as forecast and warning bulletins).

Article 2. Applicability

This Circular applies to state management agencies on meteorology and hydrology; public service units, organizations, and individuals engaged in service activities providing forecast and warning bulletins.

Article 3. Explanation of Terms

1. Quality of public services is the result of the synthesis of various indicators reflecting the level of satisfaction of users with the service.

2. Evaluation criterion are the contents and requirements that the service provider must meet to achieve the set goals. Each criterion has quality service evaluation indicators according to specific requirements and conditions in a particular aspect.

3. Evaluation indicators are the levels of requirement and condition regarding a specific aspect of the evaluation criterion.

Chapter II

CRITERIA AND INDICATORS FOR EVALUATING THE QUALITY OF SERVICES

PUBLIC SERVICE ACTIVITIES RELATED TO PROVIDING FORECAST AND WARNING BULLETINS

1. Criterion 1: Functions, tasks, material and technical foundations of organizations providing services to prepare national environmental status reports.

1. Criterion 1: Functions, tasks, or business registration.

2. Criterion 2: Technical infrastructure.

3. Criterion 3: Service personnel.

4. Criterion 4: Attitude towards service.

5. Criterion 5: Self-inspection and supervision.

6. Criterion 6: Compliance with regulations, standards, technical norms.

7. Criterion 7: Product quality.

8. Criterion 8: Reputation of the service provider organization.

Article 5. Indicators and bases for evaluating Criterion 1

1. Evaluation indicators:

a) Functions, tasks, powers, and organizational structure are appropriate and permitted to provide services in accordance with the law;

b) Experience in providing forecast and warning bulletins.

2. Evaluation bases

a) Legal documents stipulating functions, tasks or business licenses of the forecast and warning service provider organization;

b) Number of years providing forecast and warning bulletin services.

Article 6. Indicators and bases for evaluating Criterion 2

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Equipment, computing systems, data acquisition, processing, and information handling systems for meteorological and hydrological data;

b) Stable data supply sources;

c) List of technical standards, norms, and procedures for forecasting and warning; forecasting tools ensuring scientific, independent, and objective nature; management and quality assessment procedures for forecasting and warning.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Asset statistics, financial reports, annual audits of the public service organization providing forecast and warning bulletins;

b) Contracts and legal documents agreeing to provide data to the public service organization providing forecast and warning bulletins;

c) Technical standards, norms, procedures, regulations, technical documents serving forecasting and warning activities, forecasting tools, and reporting on forecasting and warning assessments.

Article 7. Indicators and bases for evaluating Criterion 3

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Number of direct staff involved in forecasting and warning;

b) Quality of direct staff involved in forecasting and warning.

2. Evaluation bases are statistics, personnel files, and labor contracts, contracts hiring experts for three months or more of the public service organization providing forecast and warning bulletins.

Article 8. Indicators and bases for evaluating Criterion 4

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Having plans or measures to respond when there is an urgent request for providing forecast and warning bulletins;

b) Being ready to serve according to urgent requests from ordering agencies regarding forecast and warning bulletins;

c) Implementation of conclusions and recommendations of ordering agencies on the provision of forecast and warning bulletins during inspection rounds;

d) Satisfaction level of ordering agencies and service users with the organization providing public service activities related to the provision of forecast and warning bulletins.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Plans or measures of the organization providing public services regarding the provision of forecast and warning bulletins;

b) Statistics on the number of times of response and readiness level to serve urgent requests from ordering agencies;

c) Reports on the adoption and explanation of implementation of conclusions and recommendations of ordering agencies compared to the present situation;

d) Reports, evaluation forms of agencies using forecast and warning bulletins.

Article 9. Indicators and bases for evaluating Criterion 5

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Implementation of self-inspection and supervision plans for building forecast and warning bulletins by the service-providing organization;

b) Implementation of conclusions and recommendations after self-inspection and supervision.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Reports on the implementation of self-inspection and supervision plans for building forecast and warning bulletins by the service-providing organization;

b) Reports, minutes, related documents on the implementation of conclusions and recommendations by the service-providing organization.

Article 10. Indicators and bases for evaluating Criterion 6

1. Evaluation indicator: Compliance with standards, technical regulations, and technical norms for forecasting and warning activities;

2. Basis for evaluation: Reports, inspection and acceptance records at various levels on the application of current technical regulations, standards, and technical norms in the process of building forecast and warning bulletins.

Article 11. Indicators and bases for evaluating Criterion 7

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Sufficiency in quantity of forecast and warning bulletins;

b) Reliability and timeliness of forecast and warning bulletins;

c) Quality of bulletins evaluated by service-using units, forecast and warning bulletin ordering units.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Basis for reports and statistics on the quantity of forecast and warning information provided by the public service-providing organization regarding the provision of forecast and warning bulletins;

b) Reports on the quality of forecast and warning bulletins provided by the public service-providing organization regarding the provision of forecast and warning bulletins;

c) Documents, evaluation forms of service-using units, ordering agencies, or competent management agencies.

Article 12. Indicators and bases for evaluating Criterion 8

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Ability to ensure and independently and accurately provide forecast and warning bulletin services as committed;

b) Quality of public service activities for providing forecast and warning bulletins in recent years.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Statistical reports of the public service-providing organization regarding the provision of forecast and warning bulletins;

b) Statistics and reports on quality evaluations in recent years.

Article 13. Comprehensive evaluation of the quality of public service activities for providing forecast and warning bulletins

1. The quality of public service activities for providing forecast and warning bulletins is evaluated through a scoring method. The evaluation scale is 100 points. The specific evaluation scale is determined for each criterion and indicator stipulated in Articles 5, 6, 7, 8, 9, 10, 11, and 12 of this Circular and detailed in the Appendix attached to this Circular.

2. Service quality by the public service-providing organization for providing forecast and warning bulletins is evaluated at four levels:

a) Excellent if the total score is 80 points or more and no criterion is less than 70% of the maximum score of that criterion;

b) Good if the total score is more than 70 points and no criterion is less than 60% of the maximum score of that criterion;

c) Pass if the total score is more than 50 points and no criterion is less than 50% of the maximum score of that criterion;

d) Fail if the total score is less than 50 points.

Chapter III

IMPLEMENTING PROVISIONS

Article 14. Effective Date

This Circular takes effect from November 1, 2017.

Article 15. Implementation Organization

1. The Science and Technology Department is responsible for organizing guidance, implementation, and monitoring the execution of this Circular.

2. Units under the Ministry and relevant organizations and individuals are responsible for implementing this Circular.

3. During implementation, if difficulties arise, agencies, organizations, and individuals are advised to promptly report them to the Ministry of Natural Resources and Environment for research, consideration, and resolution.
