Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Vietnamese Laborers Working Abroad Under Contract dated November 29, 2006;December 11, 2006;

On the basis of Decree No. 78/2002/NĐ-CP dated October 4, 2002 of the Government on credit for the poor and other target groups;with poor people and other policy targets;i với người lao động tại huyện nghèo đi làm việc ở nước ngoài theo hợp đồng đến năm 2020.list other;

On the basis of Resolution No. 30a/2008/NQ-CP dated December 29, 2008 of the Government on the program for rapid and sustainable poverty reduction in 61 poor districts;

At the request of the Minister of Labor, War Invalids and Social Affairs,Pursuant to the request of the Director General of the Department of Vocational Education;

The Prime Minister issues this Decision on credit for laborers from poor districts working abroad under contract until 2020.with workers in poor districts going to work abroad under contracts until the year 2020.

Article 1. Scope of Regulation and Applicability

Article 1. Scope of Regulation

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

This Decision stipulates credit for laborers from poor districts who have the need to work abroad under contract.

a) Laborers from poor districts who have the need to work abroad under contract;

b) Enterprises and public institutions permitted by the State to send Vietnamese workers abroad under contract (hereinafter referred to as enterprises and public institutions);

c) The Vietnam Bank for Social Policies;

d) Agencies, organizations, and individuals related to the contents regulated in Clause 1, Article 1 of this Decision.

Article 2. Loan Conditions

1. Laborers must have a permanent residence registration for at least 12 months in poor districts and have the need to work abroad under contract.

2. Laborers must be accepted for employment by the foreign side and have signed a contract with enterprises or public institutions in accordance with the law to send laborers abroad for work.

Article 3. Loan Amount

1. The maximum loan amount equals 100% of the costs that laborers pay according to the contract signed with enterprises or public institutions in accordance with the law to send laborers abroad for work.

2. Laborers can obtain loans under Clause 1 of this Article without having to provide collateral for the loan.

Article 4. Interest Rates on Loans

1. Poor households and ethnic minority laborers can borrow at an interest rate equal to 50% of the interest rate for loans to poor households as prescribed by the Government.

2. Other laborers in poor districts can borrow at the interest rate for loans to poor households as prescribed by the Government.

3. The overdue interest rate is 130% of the interest rate prescribed in Clauses 1 and 2 of this Article.

Article 5. Loan Period

The loan period shall not exceed the duration of work recorded in the contract signed between the laborer and the enterprise or public institution in accordance with the law.

Article 6. Preparation of Application Documents, Review, and Approval of Loan Capital

1. Laborers prepare loan application documents and submit them directly or through enterprises or public institutions to the Vietnam Bank for Social Policies at the district level where they have their permanent residence registration.

2. The loan application documents include:

a) One original copy of the Loan Request Form (Form No. 01 or Form No. 02 attached to this Decision), certified by the People's Committee of the commune regarding the eligibility for credit policy as stipulated in this Decision;

b) One notarized copy of the contract signed between the laborer and the service enterprise or public institution in accordance with the law to send laborers abroad for work;

c) One notarized copy of the laborer's passport still valid for the implementation of the contract signed with the enterprise or public institution in accordance with the law.

Article 7. Repayment of principal, interest on loans and handling of debts

1. The Social Policy Bank shall agree with workers on the repayment of principal, but not exceeding a maximum of 12 months per period. In cases where the worker cannot repay the debt upon maturity, the Social Policy Bank shall monitor it in the subsequent period.

2. Interest on borrowed funds shall be collected according to the agreed term in the Credit Contract or Loan Book. If the worker requests monthly interest payments, the Social Policy Bank shall collect accordingly.

3. The Social Policy Bank shall handle risks associated with loan capital for workers going abroad under contracts in accordance with the provisions of the law.

Article 8. Source of loan capital

The source of loan capital shall be allocated from the remaining capital of preferential credit policies for workers in poor districts as approved by Decision No. 71/2009/QĐ-TTg dated April 29, 2009 of the Government approving the Project to support poor districts in promoting labor export to contribute to sustainable poverty reduction during the period 2009-2020 (hereinafter referred to as Decision No. 71/2009/QĐ-TTg), which has been approved by the state budget, and transferred to implement lending under this Decision.

Article 9. Implementation Organization

1. The Ministry of Labor, Invalids and Social Affairs shall be responsible for:

a) Direct, urge, inspect, and supervise the implementation of the provisions of this Decision;

b) Monitor, guide, and resolve issues arising in the implementation of the provisions of this Decision.

2. Provincial People's Committees with poor districts shall have the responsibility:

a) To organize propaganda, guidance, and implementation of the provisions of this Decision;

b) To direct, urge, inspect, and supervise relevant agencies and People's Committees at the district and commune levels in implementing the provisions of this Decision.

3. The Social Policy Bank shall guide procedures and methods for implementing lending in accordance with the provisions of this Decision.

Article 10. Effective Date

1. This Decision shall take effect from October 25, 2019 and be implemented until December 31, 2020.

Decision No. 71/2009/QĐ-TTg dated April 29, 2009 of the Prime Minister approving the Project to support poor districts in promoting labor export to contribute to sustainable poverty reduction during the period 2009-2020 shall cease to be effective from the date this Decision takes effect.

2. Transitional Provisions

a) Workers who have borrowed capital from the Social Policy Bank in accordance with Decision No. 71/2009/QĐ-TTg before the date this Decision takes effect and are still within the borrowing period shall continue to implement their loan contracts.

b) In cases where workers have signed overseas employment contracts before the date this Decision takes effect but have not yet borrowed capital, they may be granted loans in accordance with the provisions of this Decision.

Article 11. Implementation Provisions

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees, and related agencies, enterprises, organizations, and individuals are responsible for implementing this Decision./.
