Pursuant to the Vietnam Maritime Code on November 25, 2015;
Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
1. Amending Clause 2 Article 2 as follows:
At the proposal of the Director of the Legal Department and the Director General of the Vietnam Maritime Administration;
The Minister of Transport hereby issues this Circular announcing the port waters area within the jurisdiction of Khanh Hoa Province and the port waters area of Ninh Thuan Province in Phan Rang Bay and the management area of the Nha Trang Maritime Port Office.
Article 1. Announcing the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in the Phan Rang Bay area
1. The port waters of Khanh Hoa Province within the jurisdiction of Khanh Hoa Province include the following areas:
a) The port waters of Khanh Hoa Province in the Van Phong Bay area;
b) The port waters of Khanh Hoa Province in the Nha Trang Bay area;
c) The port waters of Khanh Hoa Province in the Cam Ranh Bay area;
d) The port waters of Khanh Hoa Province in the Truong Sa area.
2. The port waters area of Ninh Thuan Province in Phan Rang Bay.
Article 2. Scope of the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in the Phan Rang Bay area
The scope of the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in the Phan Rang Bay area, measured according to the highest tidal level, is specified as follows:
1. Scope of the port waters of Khanh Hoa Province:
a) Scope of the port waters of Khanh Hoa Province in the Van Phong Bay area:
Seaward boundary: Limited by straight lines connecting the points in the following order: VP1, VP2, and VP3 with the following coordinates:
VP1: 12°33'36,0"N, 109°26'00,0"E (Cape Gan - Southern tip of Hon Gom Peninsula);
VP2: 12°28'00,0"N, 109°26'00,0"E;
VP3: 12°24'00,0"N, 109°20'30,0"E (Bàn Thang Cape). The landward boundary runs from point VP1 (Cape Gan) along the western coast of Hon Gom Peninsula northwards through Cape Co Co, Cape Da Son, and along the coastline to the northernmost point of Ben Goi Cove, then follows the coastline of communes in Van Ninh District through Cape Hon Giang, Cape Hon Khoi to point VP3 (Bàn Thang Cape).
b) Scope of the port waters of Khanh Hoa Province in the Nha Trang Bay area:
Seaward boundary:
Limited by straight lines connecting the points in the following order: NT1, NT2, NT3, and NT4 with the following coordinates:
NT1: 12°14'14,0"N, 109°16'00,0"E (Ba Co Cape - Northern Hon Tre Island);
NT2: 12°16'00,0"N, 109°13'42,0"E;
NT3: 12°16'00,0"N, 109°13'04,0"E (Cut Chim Islet);
NT4: 12°12'58,0"N, 109°12'32,0"E (Truong Tay, Vinh Nguyen Ward).
NT6: 12o09’17,0”N, 109o16’48,0”E;
NT5: 12°09'17,0"N, 109°13'21,0"E;

Scope of the port waters area in Bai Bang Beach, Hon Tre Island, Nha Trang City:
The seaward boundary is defined by straight lines connecting points M1, M2, M3, M4, M5, M6, M7 with the following coordinates:

The landward boundary runs from point C12 along the coastline northwards through Cape Ba Tien and Cape Sop, following the coastline of Cam Ranh Bay southwards through Cape Ong Dinh to the north of the bay, then along the safety zone of Long Ho Bridge to the midpoint of the safety zone of Long Ho Bridge and connecting to point C1.
Within the scope of the waters area in the protection zone and safety belt of the Cam Ranh Military Base, vessels must comply with the Regulations on Ensuring Security and Safety of the Cam Ranh Military Base issued together with Decision No. 44/2015/QĐ-TTg dated September 22, 2015 of the Prime Minister.
d) Scope of the port waters area of Khanh Hoa Province in Truong Sa:
The scope of the port waters area of Truong Sa in the area of Truong Sa Island is defined by straight lines connecting points TS1, TS2, TS3, TS4, TS5 (WGS84 coordinate system) with the following coordinates:
TS1: 08°03'8'10"N - 111°05'55'03"E;
TS2: 08°03'8'40.3"N - 111°05'55'35"E;
TS3: 08°03'9'19"N - 111°05'55'53.7"E;
TS4: 08°03'9'31.8"N - 111°05'55'11"E;
TS5: 08°03'8'18.5"N - 111°05'54'43"E
For other areas in Truong Sa, the scope will be announced to suit practical conditions, Vietnamese laws, and the United Nations Convention on the Law of the Sea 1982.
2. The scope of the Ninh Thuận coastal port waters in the Phan Rang Bay area:
a) The maritime boundary: is limited by straight lines connecting the following points in sequence PR1, PR2, and PR3, with the following coordinates:
PR1: 11°33'45,0"N, 109°07'42,0"E (Red Cape);
PR2: 11°29'09,0"N, 109°05'54,0"E;
PR3: 11°29'09,0"N, 109°00'48,0"E.
b) The boundary towards the mainland:
From point PR1, follow the coastline of Phan Rang Bay southwards to the entrance channel of Tri Hai Lagoon (entrance channel to Ninh Chữ Port), then follow the left bank of Tri Hai Channel to the safety zone downstream of the Ninh Chữ Road Bridge at point NC1 with coordinates 11°35'33,40"N, 109°02'52,20"E (as currently regulated for road safety zones), then follow the safety zone downstream of the Ninh Chữ Bridge across to the right bank of Tri Hai Channel to point NC2 with coordinates 11°35'29,90"N, 109°02'48,20"E, continue along the coastline to point SD1 with coordinates 11°32'16,10"N, 109°01'44,30"E (left bank of Dinh River mouth).
From point SD1, cross the Dinh River mouth to the right bank and connect to point SD2 with coordinates 11°32'05,0"N, 109°01'36,20"E (right bank of Dinh River mouth). From point SD2, continue along the coastline of Phan Rang Bay southwards to point PR3.
3. The boundaries of the port waters area of Khanh Hoa Province within the jurisdiction of Khanh Hoa Province and the port waters area of Ninh Thuan Province in Phan Rang Bay as stipulated in Clause 1 and Clause 2 of this Article are determined based on Hydrographic Charts No. I-1000-04 republished by the Vietnam Navy in 2001 and Hydrographic Charts Nos.: VN300021, VN4BN001, VN4NT001, VN300020, VN3KH001 published by the South Vietnam Marine Safety Assurance Corporation in its first edition in 2016. Coordinates of the points specified in this Circular are applied according to the WGS 84 Coordinate System and converted to the VN-2000 Coordinate System in the Appendix attached to this Circular.
Article 3. Pilot reception and delivery zones, quarantine zones, anchorage areas, cargo transfer areas, storm shelters, water areas, and other related water zones
The Director of the Vietnam Maritime Administration organizes the announcement of the pilot pick-up and drop-off zone, quarantine zone, anchorage area, cargo transfer area, and storm shelter for vessels entering and leaving the Khanh Hoa coastal port waters, the Ninh Thuan coastal port waters at the Phan Rang Bay area, and other designated waters as prescribed.
Article 4. Responsibilities of the Nha Trang Maritime Port Office
1. Carry out tasks and powers as stipulated by the Vietnam Maritime Code and relevant laws concerning maritime activities at the Khanh Hoa coastal port, Ninh Thuan coastal port, and their respective waters at the Phan Rang Bay area.
2. Based on actual conditions regarding weather, waves, wind, draft, vessel capacity, and nature of cargo, designate specific positions for vessels to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and avoid storms within the designated waters as prescribed, ensuring maritime safety, maritime security, and environmental pollution prevention.
Article 5. State Management Responsibilities for Maritime Affairs in the Sea Areas under Khánh Hòa Province and Ninh Thuận Province
Outside the waters of the ports specified in Article 2 of this Circular, the Nha Trang Marine Port Office is responsible for state management of maritime safety, maritime security, and environmental pollution prevention in the sea areas belonging to Khanh Hoa Province and Ninh Thuan Province from latitude 11°25'00,0"N northward to the northernmost part of Ninh Thuan Province's sea area.
Article 6. Effectiveness
1. This Circular takes effect from December 15, 2020.
2. Repeal Circular No. 20/2019/TT-BGTVT dated June 12, 2019 issued by the Minister of Transport announcing the waters of the Khanh Hoa coastal port, the Ninh Thuan coastal port waters at the Phan Rang Bay area, and the management area of the Nha Trang Marine Port Office.

The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, Directors of the Department of Transport of Khanh Hoa Province, Directors of the Department of Transport of Ninh Thuan Province, Directors of the Nha Trang Marine Port Office, Directors of the Binh Thuan Marine Port Office, Heads of related agencies, organizations, and individuals are responsible for implementing this Circular./.
