Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Thrift and Combating Wastefulness dated November 26, 2013;

Pursuant to the Law on Construction dated June 18, 2014; the Law Amending and Supplementing Certain Provisions of the Law on Construction dated June 17, 2020;

Pursuant to the Law on Public Investment dated June 13, 2019; the Law Amending and Supplementing Certain Provisions of the Public Investment Law, the Public-Private Partnership Investment Law, the Investment Law, the Housing Law, the Bidding Law, the Electricity Law, the Enterprise Law, the Special Consumption Tax Law, and the Civil Enforcement Law dated January 11, The Prime Minister issues this Decision to regulate the organization of groundbreaking ceremonies, commencement ceremonies, and completion ceremonies for projects. Pursuant to Decision No. 14/2025/NĐ-CP dated June 14, 2025, of the Government regarding decentralization and delegation of authority in the field of encouragement and reward; detailed implementation and guidance for certain provisions of the Law on Encouragement and Reward;

At the proposal of the Minister of Construction;

This Decision regulates the organization of groundbreaking ceremonies, commencement ceremonies, and completion ceremonies for projects as stipulated in Clause 1, Article 41 of the Law on Thrift and Combating Wastefulness 2013.

Article 1. Scope of Regulation

This Decision applies to agencies, organizations, and individuals related to the use of state budget funds, official development assistance (ODA) funds, and preferential loans from foreign sponsors to organize groundbreaking ceremonies, commencement ceremonies, and completion ceremonies for projects.

Article 2. Applicability

Within the scope of this Decision, the following terms shall be understood as follows:

In this Decision, the following terms shall be understood as follows:

1. National key projects are main projects under national key projects as defined by the Public Investment Law.

2. Projects with significant value and important significance in economy, politics, culture, and society at the local level are main projects under Group A projects as defined by the Public Investment Law and have significant importance in economy, politics, culture, and society at the local level.

Article 4. Conditions for organizing groundbreaking ceremonies, commencement ceremonies, and completion ceremonies for projects

1. Groundbreaking ceremonies for projects shall be carried out when the project owner or the agency or organization entrusted with preparing the project (hereinafter referred to as the project owner) receives the land handover from the competent authority or receives phased land handovers and the project has been approved according to the prescribed authority and regulations.

2. Commencement ceremonies for projects shall be conducted when the conditions for commencement as stipulated in Clause 1, Article 107 of the Construction Law, amended and supplemented in Clause 39, Article 1 of Law No. 62/2020/QH14, are met.

3. Completion ceremonies shall be carried out after the project has been inspected and accepted by the competent state authority and meets the required standards.

4. Each project shall organize one groundbreaking ceremony or one commencement ceremony and one completion ceremony.

Article 5. Authority to decide on organizing ceremonies

1. The Prime Minister decides to organize ceremonies for projects specified in Clause 1, Article 3 of this Decision based on the proposal of the competent state authority or the project owner.

2. The head of ministries, central agencies leading and coordinating with the Chairman of the People's Committee of the province shall decide to organize ceremonies for projects they invest in as stipulated in Clause 2, Article 3 of this Decision.

3. The Chairman of the People's Committee of the province shall decide to organize ceremonies for projects they invest in as stipulated in Clause 2, Article 3 of this Decision.

4. The project owner shall prepare a plan for organizing the ceremony, specifying the content, time, location, participants, costs, and implementation methods; and submit it to the competent authority for approval.

Article 6. Costs for organizing the ceremony

1. The costs for organizing the ceremony are included in the total investment amount of the project.

2. Based on the permission to organize the ceremony granted by the authorized person as stipulated in Article 5 of this Decision, the investor shall establish and approve the budget estimate for the costs of each ceremony. The budget estimate for organizing the ceremony must be consistent with the content and scale of the construction project, in accordance with the current state regulations on norms and standards. The investor shall not require contractors to pay for the costs of organizing the ceremonies.

Article 7. Responsibilities of relevant organizations and individuals

1. The heads of central agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for supervising and urging investors to implement ceremonies in accordance with this Decision.

2. Organizations and individuals who are responsible for organizing ceremonies as prescribed in this Decision, when they violate, will be required to compensate material losses, be subject to administrative disciplinary action, or other measures as provided by law depending on the severity of the violation.

3. Investors shall cooperate with local authorities where the construction project is located to ensure security and safety during the ceremony.

4. Investors shall organize ceremonies in accordance with local customs and traditions and economic and social conditions, ensuring frugality and avoiding wastefulness and ostentatious displays.

5. The Ministry of Construction shall be responsible for guiding the implementation of the provisions of this Decision.

Article 8. Implementation clause

1. This Decision takes effect from December 25, 2023.

2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Decision.
