CIRCULAR

1. Amend and supplement Point d of Clause 2 of Article 24 as follows: amending certain provisions of Circular No. 05/2020/TT-BTP dated August 28, 2020 issued by the Minister of Justice qetermining in detail certain provisions and measures to implement Decree No. 08/2020/NĐ-CP dated January 8 2020 of the Governmenton the organization and operation of Notaries

Pursuant to the Law on Enacting Regulatory Legal Documents No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;

Pursuant to Resolution No. 107/2015/QH13 dated November 26, 2015 of the National Assembly on implementing the Notary system;

Pursuant to Decree No. 08/2020/NĐ-CP dated January 8, 2020 of the Government on the organization and operation of Notaries;

Pursuant to Decree No. 39/2025/NĐ-CP dated February 26, 2025 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the Civil Execution Management Department;

The Minister of Justice issues this Circular amending and supplementing certain provisions of Circular No. 05/2020/TT-BTP dated August 28, 2020 issued by the Minister of Justice detailing certain provisions and measures to implement Decree No. 08/2020/NĐ-CP dated January 8, 2020 of the Government on the organization and operation of Notaries.

Article 1. Amending and supplementing certain provisions of Circular No. 05/2020/TT-BTP dated August 28, 2020 issued by the Minister of Justice detailing certain provisions and measures to implement Decree No. 08/2020/NĐ-CP dated January 8, 2020 of the Government on the organization and operation of Notaries

1. Amending and supplementing Clause 2 of Article 17 as follows:

“2. Forms of examination include two2 (formsof examination including computer-based multiple choice tests a) The first examination on the legal knowledge of Notaries and the Code of Professional Ethics for Notaries..

  b) The second examination on the professional skills of Notaries2. Amending and supplementing Clause 2 of Article 18 as follows:

  b) Within a period of(ten) working days from the date of expiration of the registration for the examination as announced by the Ministry of Justice, the Department of Justice shall submit to the Ministry of Justice a request letter accompanied”.

Chairmen of Provincial People's Committees, Heads of relevant units under the Ministry of Justice, Directors of Departments of Justice of provinces and cities, and related agencies, organizations, and individuals are responsible for enforcing the provisions of this Circular./. Article 2. Effectiveness of Implementation

1. This Circular takes effect from December 19, 2025.

2. The Chairmen of the People's Committees at provincial level, Heads of relevant units under the Ministry of Justice, Directors of Justice Departments of provinces and cities, and related agencies, organizations, and individuals shall be responsible for implementing the provisions of this Circular./.
