Decree No. 27-CP provides temporary regulations on adjusting pension levels and allowances for social policy beneficiaries.

 DECREE

OF THE GOVERNMENT DECREE NO. 27-CP DATED MAY 23, 1993 ON TEMPORARY ADJUSTMENT OF PENSION LEVELS AND SUBSIDIES FOR SOCIAL POLICY BENEFICIARIES.

THE GOVERNMENT

Pursuant to the Law on Government Organization dated September 30, 1992;
Pursuant to the Resolution of the Second Session of the Ninth National Assembly;
At the proposal of the Minister of Labor, War Invalids and Social Affairs,

DECREE:

Article 1. - Now temporarily adjust pension levels and subsidies for social policy beneficiaries as follows:

1. The pension level for workers and civil servants shall be adjusted to 120% of the current pension level (including the pension according to Decision No. 203-HĐBT dated December 28, 1988, price subsidy, electricity cost subsidy, travel expenses, education expenses, housing expenses).

2. The disability allowance for those with work-related injuries or occupational diseases classified as Grade 1 or Grade 2 shall be adjusted to 120% of the current allowance (including the allowance according to Decision No. 203-HĐBT dated December 28, 1988, price subsidy, electricity cost subsidy, education expenses, housing expenses).

3. The subsidy levels for social policy beneficiaries as specified in the detailed table attached to this Decree.

For the main dependents of four or more martyrs, in addition to the monthly maintenance subsidy, they also receive a basic living allowance.

Article 2. - The preferential treatment regime for cadres who participated in revolutionary activities before 1945 according to Decision No. 128-HĐBT dated October 8, 1984 is stipulated as follows:

1. Monthly allowance at a unified rate of 100,000 VND/person for cadres participating in revolutionary activities before 1945 who are currently receiving salaries, pensions, or living expenses.

2. An additional allowance of 20,000 VND/month for each year of revolutionary activity before 1945.

3. The living expense allowance for cadres working in communes or wards from 1935 onwards is 120,000 VND/month, from 1936 to before 1945 is 85,000 VND/month.

The provisions in Article 2 of this Decree replace the previous provisions on years of service, living expense allowances, and other subsidies.

Article 3. - Workers and civil servants who retired or were granted disability benefits before September 1985, due to the unreasonable conversion of salary levels under Decree No. 236-HĐBT dated September 18, 1985 (a difference of one salary grade or more), now will be converted back to the salary level of active workers and civil servants of the same rank (same position, specialty, profession) according to Decree No. 235-HĐBT dated September 18, 1985 as the basis for recalculating pensions or disability allowances according to Article 1 of this Decree.

Article 4. - Teachers and lecturers who have retired or been granted disability benefits but have not yet received the educational seniority allowance according to Decision No. 309-HĐBT dated December 10, 1988 will now be included in their pensions and disability allowances.

Article 5.

1. The pension level for those who retired before April 1, 1993 is equivalent to the pension level of those who retired after April 1, 1993 (calculated based on the new salary scale) with the same position and degree of contribution, ensuring that the difference does not exceed 5%.

2. The one-time allowance for those injured or the families of martyrs is now uniformly set at 200,000 VND/month.

Article 6. - Abolish the annual electricity cost subsidy, education cost subsidy, housing cost subsidy, price subsidy, and travel expenses for retirees and additional subsidies for certain groups previously established.

Article 7. - This Decree takes effect from April 1, 1993.

For those confirmed as war invalids and military personnel who are granted disability benefits from April 1, 1993 onwards and receive subsidies based on salary or living expenses, they shall implement Point 3, Article 1 of this Decree.

Any previous regulations contrary to the provisions of this Decree are hereby abolished.

Article 8. - The Ministry of Labor, War Invalids and Social Affairs, together with the Ministry of Finance, are responsible for guiding the implementation of this Decree.

Article 9. - The Ministers, Heads of Ministries equivalent to Ministries, and Heads of Central Government Agencies, Chairmen of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
