Decision No. 270/2003/QĐ-TTG dated December 24, 2003 of the Prime Minister stipulates the functions, tasks, powers, and organizational structure of the National Reserve Agency under the Ministry of Finance.

The National Reserve Agency is an organization under the Ministry of Finance, implementing state management functions for national reserves and directly managing certain types of national reserve goods as prescribed by law.

1. Submit to the Minister of Finance draft regulatory legal documents concerning the field of national reserves.

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Finance;

At the proposal of the Minister of Finance and the Minister of Home Affairs,

DECISION:

Article 1. Position and Functions

2. Submit to the Minister of Finance strategies, planning, long-term plans, five-year plans, annual plans regarding national reserves.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

3. Submit to the Minister of Finance for issuance:

a) Regulations on financial management systems for national reserves;

b) Regulations on purchasing, selling, importing, and exporting national reserve goods;

c) Regulations on economic-technical norms, procedures, standards, and storage periods for national reserve goods.

4. Submit to the Minister of Finance the annual use of the national reserve fund and its use in emergency situations.

5. Provide professional guidance on national reserve management according to the分级管理权限的部长的指示。

6. Assist the Minister of Finance in coordinating with functional units under the Ministry of Planning and Investment to prepare budgets and allocation plans for additional central government budget funds for national reserves assigned to various ministries and sectors.

7. Review, consolidate, and settle accounts for the use of state budget funds in the activities of importing and exporting national reserve goods by agencies tasked with directly managing such goods by the Government and the Prime Minister.

8. Coordinate with relevant agencies to determine prices, price ranges for purchasing and selling, import and export costs, and preservation costs for national reserve goods, and submit these to the Minister of Finance for decision.

9. Organize inspections of compliance with management regulations for national reserve goods for ministries and sectors assigned to manage such goods by the Government; propose measures to handle violations of national reserve goods management according to the provisions of the law.

10. Directly manage certain types of national reserve goods assigned:

a) Direct and organize the implementation of purchasing, selling, exporting, importing, preserving, and ensuring the safety of assigned national reserve goods in accordance with the provisions of the law;

b) Organize the export of national reserve goods for relief, rescue, international aid, or other purposes as decided by the Prime Minister and directed by the Minister of Finance; organize sales to implement the exchange of national reserve goods according to the provisions of the law;

c) Guide, inspect, and supervise the organization of management of assigned national reserve goods at national reserve warehouses under the agency in accordance with the provisions; handle violations within their authority; resolve complaints according to the provisions of the law;

11. Organize research and application of scientific and technological progress to enhance management capabilities, modernize warehouse systems, technical equipment, and preservation technology for national reserve goods.

12. Implement international cooperation in the field of national reserves according to the division of labor by the Minister of Finance.

13. Implement statistical reporting systems and evaluate the effectiveness of national reserve goods management and usage according to state regulations.

14. Manage organizational structures, staffing, and officials within the agency's system; organize training, development, and implement personnel policies according to state regulations and the division of labor for personnel management by the Minister of Finance.

15. Manage finances and assets assigned according to the law and the division of labor by the Minister of Finance.

16. Perform other tasks assigned by the Minister of Finance.

1. The National Reserve Agency is organized vertically; following the principle of centralized and unified management. The organizational structure includes:

9. Thai Binh Regional National Reserve;

10. Ha Nam Ninh Regional National Reserve;

11. Thanh Hoa Regional National Reserve;

12. Nghe Tinh Regional National Reserve;

13. Binh Tri Thien Regional National Reserve;

14. Da Nang Regional National Reserve;

15. Nghia Binh Regional National Reserve;

16. South Central Coast Regional National Reserve;

17. Central Highlands Regional National Reserve;

18. Ho Chi Minh City Regional National Reserve;

19. Hau Giang Regional National Reserve.

The functions, tasks, powers, and organizational structures of the above units shall be implemented according to the regulations of the Minister of Finance.

2. The National Reserve Agency has legal personality, has a seal bearing the State Emblem, and is allowed to open an account at the State Treasury according to the law.

Regional National Reserves have legal personality, have separate seals, and are allowed to open accounts at the State Treasury according to the law.

2. The State Treasury has legal personality, bears a seal with the National Emblem, and is authorized to open an account at the National Treasury in accordance with the provisions of the law.

Each regional State Treasury has legal personality, bears its own seal, and is authorized to open an account at the National Treasury in accordance with the provisions of the law.

Article 4. Leadership of the National Treasury Agency

The National Treasury Agency consists of a Director and Deputy Directors. The Director of the National Treasury Agency is appointed and relieved from office by the Prime Minister upon the proposal of the Minister of Finance. The Director of the National Treasury Agency is responsible to the Minister of Finance for all activities of the National Treasury Agency.

The Deputy Directors of the National Treasury Agency are appointed and relieved from office by the Minister of Finance upon the proposal of the Director of the National Treasury Agency and are responsible to the Director for the tasks assigned to them.

Article 5. Effective Date

This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 6. Responsibility for Implementation

The Minister of Finance, ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and the Director of the National Treasury Agency are responsible for implementing this Decision.
