DECREE
Regulations on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs
Pursuant to the Law on Government Organization No. 63/2025/QH15;
||| Based on the proposal of the Minister of Home Affairs;
The Government issues this Decree to stipulate the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs.
Article 1. Position and Functions
The Ministry of Home Affairs is an agency of the Government, performing state management functions over the following sectors and fields: Administrative organization, public service units; local administrative organizations; civil servants, public officials, and civil service; labor, wages, social insurance; employment; occupational safety and health; associations, social funds, charitable funds, non-governmental organizations; persons with meritorious service; youth; gender equality; state archival affairs; commendation and reward (hereinafter referred to collectively as the home affairs sector) and state management of public services within the home affairs sector in accordance with the provisions of the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Home Affairs performs tasks and powers as prescribed in the Law on the Organization of the Government, the Government's regulations on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and implements specific tasks and powers as follows:
1. Submitting to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft decrees, and resolutions of the Government according to the annual legislative construction program of the ministry that has been approved, and other projects, programs, plans, and resolutions assigned by the Government and the Prime Minister; submitting to the Government and the Prime Minister strategies, plans, long-term, medium-term, and annual development plans, and important national projects and works in the home affairs sector.
2. Submitting to the Prime Minister draft decisions, directives, national target programs, national programs, national action programs, and other documents concerning the home affairs sector or as assigned.
3. Issuing circulars, decisions, directives, and other documents within the home affairs sector.
4. Directing, guiding, and organizing the implementation of functions, tasks, regulatory legal documents, strategies, plans, national target programs, national programs, national action programs, and important national projects and works that have been issued or approved; disseminating information, promoting, educating about laws related to the home affairs sector in accordance with the provisions of the law.
5. Administrative organization, public service units:
a) Submitting to the Government proposals for the organizational structure of the Government during the term of the National Assembly; proposals for establishing new, merging, consolidating, dividing, separating, dissolving ministries and ministerial-level agencies; draft decrees stipulating the organization of specialized agencies under provincial People's Committees (hereinafter collectively referred to as provincial level) and commune-level People's Committees (hereinafter collectively referred to as commune level).
b) Reviewing draft decrees of the Government stipulating the functions, tasks, powers, and organizational structures of ministries and ministerial-level agencies; draft decisions of the Prime Minister stipulating the functions, tasks, powers, and organizational structures of organizations under the Prime Minister's decision-making authority; proposals and draft decisions of the Prime Minister regarding the establishment, restructuring, and dissolution of administrative organizations, public service units, and inter-ministerial advisory and coordination organizations submitted by ministries, ministerial-level agencies, and provincial-level People's Committees to the Prime Minister.
c) Taking the lead, coordinating with the Office of the Government and ministries and ministerial-level agencies in reviewing final drafts of decrees of the Government stipulating the functions, tasks, powers, and organizational structures of ministries and ministerial-level agencies before submitting them to the Prime Minister for signature and issuance.
d) Guiding the review of the functions, tasks, powers, and organizational structures of ministries and ministerial-level agencies; compiling and reporting to the Government for decision-making on adjustments to the functions, tasks, powers, and organizational structures of ministries and ministerial-level agencies.
đ) Guiding the ranking of public service units in accordance with the provisions of the law.
6. On local administration:
a) Advising and assisting the Government and the Prime Minister in directing the implementation of elections for National Assembly deputies and representatives of all levels of People's Councils; guiding and urging People's Councils at all levels to implement legal provisions on elections and guidance documents of the National Election Council and central agencies; reporting to the Government and the Prime Minister in accordance with election work regulations.
b) Assisting the Government in guiding and inspecting People's Councils in implementing documents from higher-level state agencies within their jurisdiction; directing, guiding, and inspecting People's Councils at all levels in implementing tasks and work within their jurisdiction or as assigned by the Government and the Prime Minister in accordance with the law; participating in meetings of People's Councils and provincial-level People's Councils when necessary to discuss matters related to local government construction and administrative boundary management.
c) Submitting to the Government regulations on the number of Deputy Chairpersons of People's Councils; the number and structure of People's Council members; procedures and formalities for requesting approval of the results of People's Council elections for Chairpersons and Deputy Chairpersons; procedures and formalities for transferring, dismissing Chairpersons and Deputy Chairpersons of People's Councils and delegating the Chairperson's authority.
d) Submitting to the Government regulations on the organization and operation of villages and residential wards and policies for non-professional workers in villages and residential wards.
đ) Submitting to the Prime Minister documents stipulating criteria, conditions, procedures, and formalities for recognizing island communes and safe area communes; monitoring, inspecting, and reporting to the Prime Minister on the recognition of island communes and safe area communes by provincial-level People's Councils.
7. Regarding administrative boundaries and classification of administrative units:
a) Submitting to the Government for consideration and submission to the Standing Committee of the National Assembly for issuance of documents stipulating standards for administrative units.
b) Submitting to the Government for consideration and submission to the National Assembly for decision on the establishment, dissolution, merger, division, and adjustment of administrative boundaries at the provincial level; the Standing Committee of the National Assembly deciding on the establishment, dissolution, merger, division, and adjustment of administrative boundaries at the commune level.
c) Submit to the Government for issuance of documents regulating the classification of administrative units; decide on the resolution of overlapping and unclear boundaries of provincial administrative units according to the provisions of the Land Law and other relevant regulations;
d) Issue documents within its authority regarding the establishment and management of boundary files for all levels of administrative units; review and recognize boundary files for all levels of administrative units;
đ) Take the lead and coordinate with relevant ministries and agencies to organize reviews of project proposals for establishing, dissolving, merging, dividing administrative units, adjusting administrative boundaries, and renaming administrative units;
e) Take the lead and coordinate with relevant ministries and agencies to organize reviews of project proposals and decide on the classification of provincial, ward, and special zone administrative units within their authority;
8. On personnel management:
Implement personnel management for civil servants, the number of people working and receiving salaries from the state budget of ministries, ministerial-level agencies, and Vietnamese representative offices abroad according to the law and authorized agencies;
9. Regarding cadres, civil servants, public officials, and public service:
a) Submit to the Government and the Prime Minister for issuance or issue within its authority normative legal documents, research topics, projects, strategies, and guidance on implementing regulations concerning recruitment, placement, and utilization of civil servants and public officials based on job positions; evaluation and classification of quality of civil servants and public officials; qualification standards; appointment, reappointment, transfer, rotation, secondment, resignation, dismissal, disciplinary action, termination of employment, retirement of cadres, civil servants, and public officials; training and development of cadres, civil servants, and public officials (except where specialized laws provide otherwise) and about creating sources of female cadres and the proportion of women to be appointed to positions in state agencies and other management contents for cadres, civil servants, and public officials as prescribed;
b) Submit to the Prime Minister for consideration and to the National Assembly for decision on the structure of the number of members of the Government, appointment, dismissal, and removal of Deputy Prime Ministers, Ministers, and Heads of ministerial-level agencies during the term of the National Assembly. Review qualifications, conditions, procedures, formalities, and personnel files for leadership and management positions under the authority of the Prime Minister to decide and approve according to the law;
c) Guide, inspect, and implement legal provisions on civil servant job positions and public official job positions;
d) Guide the establishment and management of cadre, civil servant, and public official files; civil servant and public official cards;
đ) Develop, issue, and manage training programs for civil servants and public officials within its authority;
e) Develop, issue, guide, and implement strategies, projects, plans for training and developing cadres, civil servants, and public officials using state budget funds within its authority;
g) Monitor, compile, and publish the results of training and development of cadres, civil servants, and public officials of state agencies, the Central Committee of the Vietnam Fatherland Front (including central political-social organizations), and provincial People's Committees;
10. Regarding administrative reform of the state:
a) Submit to the competent authority for decision on the program, plan, and project on administrative reform of the state in each phase. Serve as the permanent body for administrative reform work of the Government;
b) Submit to the Government and the Prime Minister for decision on policies and solutions to promote administrative reform of the state;
c) Review pilot administrative reform projects submitted by ministries, ministerial-level agencies, and provincial People's Committees to the Prime Minister;
d) Lead the implementation of organizational and institutional administrative reform and civil service system reform;
đ) Develop, issue, and guide methods for monitoring, evaluating, and determining administrative reform indices for ministries, ministerial-level agencies, and provincial People's Committees; methods for measuring citizens' satisfaction with administrative services;
e) Organize the implementation, determination, and publication of annual administrative reform indices for ministries, ministerial-level agencies, and provincial People's Committees; citizens' satisfaction indices with administrative services;
g) Guide ministries, ministerial-level agencies, and provincial People's Committees in building, implementing programs, projects, plans, and reports on administrative reform work as prescribed;
11. Regarding labor, wages, and social insurance:
a) Guide and implement legal provisions on labor contracts, labor discipline, material responsibility, workplace dialogue, collective bargaining, collective labor agreements, and labor dispute resolution;
b) Guide the implementation of legal provisions on labor for female workers, underage workers, elderly workers, disabled workers, domestic workers, and other types of workers;
c) Guide the registration and state management of activities of worker representative organizations according to labor law;
d) Guide the implementation of legal provisions on wage policies, allowances, living expenses, and bonuses for cadres, civil servants, and public officials from central to commune levels and contractual workers in state agencies and public institutions;
đ) Guide the implementation of legal provisions on minimum wage levels and wage policies for workers in enterprises, agencies, organizations, cooperatives, households, and individuals who hire workers according to the Labor Code;
e) Guide wage, bonus, and remuneration for workers and managers in state-owned enterprises and enterprises with state capital investment;
g) Take the lead and coordinate with relevant ministries and agencies to advise on the construction, issuance, and enforcement of policies and laws on social insurance (excluding social insurance finance, social insurance fund finance, and specialized inspections on social insurance contributions) according to the law;
h) Study and advise the competent authority on implementing salary policy reforms and social insurance policies;
12. Regarding employment:
a) Direct and organize the implementation of legal provisions on employment; unemployment insurance; recruitment and management of Vietnamese workers; unified management of foreign workers working in Vietnam;
b) Guide the registration of labor; build, manage, operate, and exploit the labor market information system; manage the central labor market information system according to the provisions of the law;
c) Guide the implementation of legal provisions on the organization and operation of employment services; build and manage the National Employment Exchange Platform;
d) Take the lead and coordinate with the People's Committee of Ho Chi Minh City and the People's Committee of Da Nang City to implement unified state management over recruitment and management of Vietnamese and foreign workers working in the International Financial Center;
13. On skill development:
a) Take the lead and coordinate with relevant ministries, sectors, and agencies to guide and organize the implementation of legal provisions on skill development; the national skill level framework; national skill standards; assessment and issuance of national skill certificates; material conditions and equipment serving national skill assessment activities; skill councils according to the provisions of the law;
b) Propose and sign bilateral and multilateral agreements on mutual recognition of national skill certificates between Vietnam and other countries within their authority;
14. On occupational safety and health:
a) Guide and organize the implementation of legal provisions on occupational safety and health; work schedules, working hours, rest periods; the national program on occupational safety and health; establish the national file on occupational safety and health;
b) Specify compensation and allowances for occupational accidents and occupational diseases; provide physical benefits for workers working under hazardous and harmful conditions;
c) Issue a list of machinery, equipment, materials, and substances with strict requirements for occupational safety and health according to the provisions of the law; take the lead in implementing state management over occupational safety and health training activities and inspection of machinery, equipment, and materials with strict safety requirements;
d) Take the lead in issuing a list of jobs with strict requirements for occupational safety and health; a list of heavy, dangerous, and particularly heavy and dangerous occupations and trades. Specify classification criteria for workers based on working conditions; the system of personal protective equipment provision in labor;
đ) Implement state management over activities in the field of standards and technical regulations, develop national standards, and issue national technical regulations on occupational safety and health within the scope of management according to the provisions of the law;
e) Issue inspection procedures for machinery, equipment, materials, and management of substances with strict requirements for occupational safety and health within the scope of management according to the provisions of the law;
g) Implement state management over product quality, goods, and issue a list of products and goods with medium and high risk levels within the scope of management according to the provisions of the law;
h) Conduct investigations into occupational accidents within the scope of management according to the provisions of the law; organize and guide the implementation of data collection, storage, compilation, provision, publication, and evaluation of occupational accident situations and serious technical incidents causing loss of safety and hygiene;
15. On Vietnamese workers going to work abroad under contracts:
a) Guide and organize the implementation of legal provisions regarding Vietnamese workers going abroad to work under contracts;
b) Promote expansion, stabilization, and development of overseas labor markets;
c) Specify the program, content, duration of orientation education, model, and validity period of the certificate of completion of orientation courses for workers before going to work abroad;
d) Decide on the issuance, reissuance, adjustment of information, and revocation of licenses for service providers sending workers to work abroad under contracts according to the provisions of the law;
đ) Organize and guide the registration of contracts by enterprises and workers going to work abroad under labor contracts concluded after departure; supervise the implementation of contracts by enterprises;
e) Guide administrative staff working at overseas representative offices on labor management practices;
16. On associations, social funds, charitable funds, non-governmental organizations:
a) Appraise and submit to the Prime Minister for approval the charters of associations within the Prime Minister's decision-making authority according to the provisions of the law;
b) Resolve matters within their authority and according to the provisions of the law related to associations, social funds, charitable funds, and non-governmental organizations;
c) Guide the implementation of legal provisions on associations, social funds, charitable funds, and non-governmental organizations;
d) Reward or propose competent authorities to reward organizations and individuals with outstanding achievements in organizing the activities of associations, social funds, charitable funds, and non-governmental organizations;
17. On persons who have rendered meritorious service:
a) Guide and organize the implementation of policies and laws on preferential treatment for persons with meritorious service to the revolution;
b) Develop systems, norms, and methods for providing assistance tools, orthopedic devices, rehabilitation equipment, and facilities for persons who have rendered meritorious service to the revolution;
c) Specify the management of memorials for martyrs, and develop plans to determine memorials for martyrs in relevant planning schemes;
d) Guide and direct the reception of martyrs' remains, identification of martyrs' remains lacking information, and information about martyrs' graves.
18. On youth affairs:
a) Guide the integration of youth policies, targets, and indicators into the development policies, strategies, programs, and plans of economic and social sectors;
b) Guide ministries and sectors to integrate statistical indicators on Vietnamese youth into their respective indicator systems.
c) Chair and coordinate with ministries, ministerial-level agencies, the Central Committee of the Vietnam Fatherland Front, the Central Youth Union of Ho Chi Minh Communist Youth, relevant agencies and organizations, and localities to build and implement policies and laws concerning youth.
d) Chair and coordinate with relevant agencies to manage, exploit, and publish data on youth and youth development indices.
19. Regarding the implementation of democratic work and mass mobilization:
a) Build and submit to competent authorities for issuance, or issue within their authority, and guide the implementation of grassroots democracy in accordance with the law;
b) Guide the implementation of mass mobilization work of state administrative agencies and local governments at all levels in accordance with the regulations of the Party and the law.
20. Regarding gender equality:
a) Guide and organize the implementation of policies and laws on gender equality and measures to promote gender equality as prescribed by law;
b) Chair and coordinate with ministries, sectors, localities, political-social organizations, and relevant agencies to implement the Month of Action for Gender Equality and Prevention and Response to Gender-Based Violence as prescribed by law.
21. Regarding state archival affairs:
a) Guide and organize the implementation of legal provisions on archival affairs, archival business, and digital archival materials;
b) Manage archival materials at the central historical archives of the State; manage the archival reserve of the National Archives of Vietnam within their authority; recognize and revoke recognition of archival materials of special value within their authority;
c) Build, manage, and exploit digital infrastructure in the field of archival affairs in accordance with the law;
d) Promote the value of archival materials in accordance with the law.
22. Regarding commendation and reward:
a) Guide the implementation of legal provisions on organizing commendation activities, titles, and standards for commendation titles; forms, subjects, standards for rewards; authority to decide, present awards, procedures, and application files for rewards; rights and obligations of individuals and collectives receiving commendation titles and rewards; handling violations related to commendation and reward;
b) Organize and guide the implementation of commendation movements and reward policies of the Party and the State;
c) Review application files for rewards, submit to the Prime Minister for decision or submit to the Prime Minister for recommendation to the President for decision on rewards in accordance with the law;
d) Prepare accompanying items for commendation titles and reward forms presented by the President, Government, and Prime Minister. Implement the distribution, replacement, and reissue of reward items according to the decisions of competent authorities;
đ) Mobilize funding sources and manage and use the central commendation and reward fund; direct, guide, and inspect the management of commendation and reward funds at various levels and sectors;
e) Serve as the permanent member of the Central Commendation and Reward Council.
23. Regarding international cooperation:
a) Manage and organize international cooperation and integration in the field of internal affairs in accordance with the law;
b) Chair and coordinate with relevant agencies to implement cooperation with ASEAN countries in the field of internal affairs in accordance with the law;
c) Organize negotiations and sign international treaties in accordance with the law and authorization from competent state agencies; chair and coordinate the signing and implementation of international agreements in the name of the ministry in accordance with the law; participate in international organizations as assigned by the Government;
d) Perform the national focal point role in the labor sector during Vietnam's participation in international trade agreements.
24. Regarding public service provision:
a) Administer and organize the implementation of public services in the field of internal affairs; manage organizations and units providing public service activities under the ministry;
b) Guide the implementation of policies and laws and support organizations in implementing public services in the field of internal affairs in accordance with the law.
25. Organize training and capacity building for civil servants, public officials, and employees, and according to social needs for sectors and fields under their management in accordance with the law.
26. Direct and organize scientific research and the application of research results; information and communication; the application of information technology and data; digital transformation and specialized data management to serve the ministry's state administration functions in accordance with the law.
27. Manage organizational structure; job positions, civil servant quotas, the number of staff in public service units, and the number of workers under labor contracts of the ministry. Implement recruitment, utilization, and management of cadres, civil servants, public officials, and workers in accordance with regulations and decentralization by competent authorities.
28. Manage financial resources and assets allocated and organize the implementation of the budget allocated in accordance with the law.
29. Summarize, review, evaluate, report to the Government, Prime Minister, and competent authorities on the situation and results of the ministry's state administration functions in accordance with the law or as assigned and required by competent authorities. Develop and promulgate a system of statistical indicators and reporting systems for the internal affairs sector in accordance with the law.
30. Carry out inspection and specialized inspection work; handle complaints and denunciations; organize citizen reception; implement anti-corruption, thrift, and negative practices; and handle violations of law in the internal affairs sector in accordance with the law.
31. Perform other tasks and powers delegated by the Government and the Prime Minister and as prescribed by law.

In this Article, units specified from Clause 1 to Clause 17 are administrative organizations assisting the Minister in performing state management functions; units specified from Clause 18 to Clause 21 are public service units serving the state management functions of the ministry.
The Minister of Home Affairs shall issue a decision specifying the functions, tasks, powers, and organizational structure of units under the ministry; submit to the Prime Minister for issuance of a decision on the list of other public service units under the ministry as prescribed.
Article 4. Effective date
This Decree takes effect from July 8, 2026.
This Decree replaces Decree No. 25/2025/NĐ-CP dated February 21, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs.
Article 5. Responsibilities for Implementation
The Minister of Home Affairs, ministers, heads of ministerial-level agencies, Chairpersons of People's Councils of provinces and centrally governed cities, and Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree.
