DECREE
Amending and supplementing certain articles of Decree No. 72/2025/NĐ-CP
dated March 28, 2025 of the Government on mechanisms and timeframes for adjusting average retail electricity prices
The Government promulgates this Decree amending and supplementing certain articles of Decree No. 72/2025/NĐ-CP dated March 28, 2025 of the Government on mechanisms and timeframes for adjusting average retail electricity prices.
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Enacting Regulatory Legal Documents No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;
BASED ON THE ELECTRICITY LAW NO. 61/2024/QH15;
At the proposal of the Minister of Industry and Trade;
Article 1. Amending and supplementing certain articles of Decree No. 72/2025/NĐ-CP dated March 28, 2025 of the Government on mechanisms and timeframes for adjusting average retail electricity prices
1. Amending and supplementing Points a and b of Clause 1 of Article 5 as follows:
“a) In cases where the calculated average retail electricity price decreases by less than 1% or increases by less than 2% compared to the current average retail electricity price, Vietnam Electricity shall be responsible for reporting to the Ministry of Industry and Trade about not adjusting the average retail electricity price and preparing a dossier to submit to the Ministry of Industry and Trade for inspection and supervision;
b) In cases where the calculated average retail electricity price decreases by 1% or more compared to the current average retail electricity price or the average retail electricity price needs to be adjusted to increase by 2% to less than 5% compared to the current average retail electricity price, Vietnam Electricity shall prepare a dossier on the pricing plan and report it to the Ministry of Industry and Trade for inspection, review, and comments. Within fifteen working days from the date of receipt of the full dossier on the pricing plan from Vietnam Electricity, the Ministry of Industry and Trade shall be responsible for providing written comments on the calculation results of electricity prices. Vietnam Electricity shall decide to adjust the average retail electricity price downward or upward after receiving written comments from the Ministry of Industry and Trade. Within five working days from the date of implementation of the adjustment, Vietnam Electricity shall be responsible for reporting to the Ministry of Industry and Trade for inspection and supervision;”

b) In cases where the calculated average retail electricity price decreases by 1% or more compared to the current average retail electricity price or the average retail electricity price needs to be adjusted to increase by 2% to less than 5% compared to the current average retail electricity price, Vietnam Electricity shall prepare a dossier on the pricing plan and report it to the Ministry of Industry and Trade for inspection, review, and comments. Within fifteen working days from the date of receipt of the full dossier on the pricing plan from Vietnam Electricity, the Ministry of Industry and Trade shall be responsible for providing written comments on the calculation results of electricity prices. Vietnam Electricity shall decide to adjust the average retail electricity price downward or upward after receiving written comments from the Ministry of Industry and Trade. “1. Inspection of adjustments to average retail electricity prices
a) In cases where the average retail electricity price needs to be adjusted downward but Vietnam Electricity does not make such an adjustment, the Ministry of Industry and Trade shall be responsible for requiring Vietnam Electricity to adjust the average retail electricity price downward. Vietnam Electricity shall be responsible for implementing the written request of the Ministry of Industry and Trade within five working days from the date of receipt of the request;
b) In cases where errors are found in the calculation results of electricity prices during the process of the Ministry of Industry and Trade inspecting and reviewing the pricing plan prepared by Vietnam Electricity according to Clause 2 of Article 4 and reported according to Clause 1 of Article 5, Clause 1 of Article 6 of this Decree, the Ministry of Industry and Trade shall be responsible for requiring Vietnam Electricity to update and adjust the pricing plan. Vietnam Electricity shall be responsible for implementing the written request of the Ministry of Industry and Trade within five working days from the date of receipt of the request.
2. Annual inspection of each stage of average retail electricity prices
a) Before June 30 of year N, Vietnam Electricity shall be responsible for reporting to the Ministry of Industry and Trade the actual costs incurred in each stage of year N-1 as stipulated in Clause 2 of Article 4 of this Decree. The Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Finance and relevant agencies to inspect the actual costs incurred in each stage of year N-1 by Vietnam Electricity. If necessary, the Ministry of Industry and Trade may engage independent consultants to assist in conducting the inspection and verification of the actual costs incurred in each stage of year N-1 by Vietnam Electricity;
b) The Ministry of Industry and Trade shall publicly announce the results of the inspection of the actual costs incurred in each stage of year N-1 on its electronic information website;
c) The Minister of Industry and Trade shall specify Clause 2 of this Article;
d) In cases where competent state authorities discover errors in the calculation results of average retail electricity prices, Vietnam Electricity shall be responsible for updating and adjusting the pricing plan in subsequent adjustments.”
This Decree takes effect from July 9, 2026.
Article 2. Effective Date
Ministers, heads of ministerial-level agencies, Chairpersons of provincial People's Committees under the central government, and related organizations and individuals are responsible for implementing this Decree.
