DECREE

REGULATIONS ON THE ESTABLISHMENT, FORMATION OF FINANCIAL RESOURCES, MANAGEMENT, EXPENDITURE ACTIVITIES, AND USE OF THE ROAD TRAFFIC ACCIDENT DAMAGE REDUCTION FUND

Pursuant to Law on Government Organization No. 63/2025/QH15;

Pursuant to State Budget Law No. 89/2025/QH15;

Pursuant to the Law on Traffic Order and Safety 2024 No. 36/QH15;

The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.

The Government issues this Decree to regulate the establishment, formation of financial resources, management, expenditure activities, and use of the Road Traffic Accident Damage Reduction Fund.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

To provide detailed regulations for Clause 5, Article 85 of the Law on Traffic Order and Safety regarding the establishment, formation of financial resources, management, expenditure activities, and use of the Road Traffic Accident Damage Reduction Fund.

Article 2. Applicability

This Decree applies to agencies, organizations, and individuals within Vietnam; foreign organizations and individuals residing, operating, or participating in ensuring traffic order and safety in Vietnam.

Article 3. Establishment of the Road Traffic Accident Damage Reduction Fund

The Government establishes the Road Traffic Accident Damage Reduction Fund (hereinafter referred to as the Fund), which is a state financial fund outside the budget, formed at the central level to mobilize social resources to support the reduction of damage from road traffic accidents.

Article 4. Position and Functions of the Road Traffic Accident Damage Reduction Fund

1. The Road Traffic Accident Damage Reduction Fund is a state financial fund outside the budget established by the Government according to this Decree, managed by the Ministry of Public Security, with accounts opened at the State Treasury and at commercial banks legally operating in Vietnam.

2. The international transaction name of the Road Traffic Accident Damage Reduction Fund is: Road Accident Damage Reduction Fund, abbreviated as RADRF.

Article 5. Management and Operation Organization of the Road Traffic Accident Damage Reduction Fund

1. The Ministry of Public Security uses a subordinate unit of the Ministry of Public Security to advise on policies, laws, and guidelines on traffic order and safety (hereinafter referred to as the advisory unit) as the managing agency of the Fund.

2. The management organization of the Fund includes the Director, Deputy Directors, Chief Accountant, officers, and soldiers; these members work under a concurrent appointment system.

a) The Director of the Fund is the head of the advisory unit, representing the Fund under the law; he/she may enter into contracts in accordance with the law for certain tasks serving the operations of the Fund, and is responsible before the law and the Minister of Public Security.

b) Deputy Directors of the Fund are appointed by the Minister of Public Security upon the recommendation of the Director of the Fund.

c) The Chief Accountant and concurrently appointed officers and soldiers are decided by the Director of the Fund in accordance with the law.

3. The working system, duties, and powers of the management organization of the Fund are stipulated in the Charter of the Fund's Organization and Operations issued by the Minister of Public Security upon the recommendation of the advisory unit.

4. The Fund may use the seal of the advisory unit.

Chapter II

FORMATION OF FINANCIAL RESOURCES; RECEIPT OF SUPPORT, AID, AND VOLUNTARY CONTRIBUTIONS TO THE ROAD TRAFFIC ACCIDENT DAMAGE REDUCTION FUND

Article 6. Sources of Financial Resources

1. Support, aid not included in budget revenue, voluntary contributions from domestic and foreign organizations and individuals in Vietnamese currency, foreign currency, or in kind.

2. Interest from deposit accounts.

3. Carryover balance of the Fund from the previous year transferred to the next year.

4. The charter capital of the Fund is supported once by the central budget at 500 billion Vietnamese dong.

Article 7. Receiving Support, Aid, and Voluntary Contributions to the Fund

1. Support, aid not from state budget revenues, and voluntary contributions from domestic and foreign organizations and individuals for reducing traffic accident damage on roads and other lawful sources shall be transferred to the Fund.

2. The Minister of Public Security shall instruct the Fund management agency to be responsible for receiving financial resources as stipulated in Clause 1 of this Article, depositing them into the Fund's account opened at the State Treasury and at commercial banks legally operating in Vietnam.

3. For financial resources as stipulated in Clause 1 of this Article that support specific organizations and individuals with designated addresses, they shall be transferred according to the address of the supported individual or organization in accordance with the law.

Article 8. Procedures for Receiving

1. Financial resources as stipulated in Clause 1 of Article 6 of this Decree shall be received at the Fund management agency either directly or through accounts.

2. In cases where funds are received through accounts opened at commercial banks, the Fund management agency shall be responsible for transferring them into the Fund's account opened at the State Treasury. In cases where funds are received in cash, the Fund management agency shall be responsible for depositing them into the Fund's account opened at the State Treasury. In cases where support, aid, and voluntary contributions are made in kind, the Fund management agency shall be responsible for implementing procedures to receive goods, preparing conditions for receiving and storing goods to ensure convenience and speed.

Article 9. Disclosure of Information

Information about the Fund's activities shall be disclosed to domestic and foreign organizations and individuals in accordance with the law; published on the Ministry of Public Security's electronic portal, the unit's advisory website, and at the headquarters of the Fund management agency, specifically:

1. Time of disclosure:

January 31 each year.

2. Content of disclosure:

a) Basic information about the Fund, operational regulations, and the Fund's activity plan.

b) The Fund's financial report.

c) Report on the Fund's operational results.

Chapter III

AUTHORITY TO SPEND, CONTENT OF EXPENSES AND LEVEL OF EXPENSES FOR THE TRAFFIC ACCIDENT DAMAGE REDUCTION FUND

Article 10. Authority to Spend

The Minister of Public Security decides on specific spending levels in accordance with Article 12 of this Decree and other relevant laws for each period.

Article 11. Content of Expenses

1. Support for victims injured in traffic accidents on roads with an injury rate of over 31% but less than 81%; families of deceased victims due to traffic accidents on roads experiencing economic difficulties.

2. Support for community integration and continued development for victims injured in traffic accidents with an injury rate of over 81%.

3. Support for organizations and individuals directly participating in helping, rescuing, and transporting traffic accident victims on roads to emergency care.

4. Support for organizations and individuals directly participating in activities to reduce traffic accident damage on roads without state funding guarantees.

5. Support for publicizing and organizing fundraising events.

6. Funding for disability assessment for victims injured in traffic accidents on roads as stipulated in Clause 1 and Clause 2 of this Article (excluding cases where victims in traffic accident-related criminal or administrative cases are undergoing investigation and resolution and must undergo assessment according to the law); office supplies, printing materials, office supplies expenses, postal service fees for the Fund's activities.

Article 12. Levels of Expenditure

The levels of expenditure for the contents prescribed in Article 11 of this Decree shall be implemented as follows:

1. Based on the degree of injury, the level of support provided to victims injured in road traffic accidents with an injury rate of over 31% but under 81%, and families of deceased victims due to road traffic accidents who are facing economic difficulties: the support amount shall not exceed VND 20 million per incident per family with a deceased victim; and not more than VND 10 million per incident per injured person.

2. Based on the degree of injury, the level of support provided for community integration activities and continued development for victims injured in road traffic accidents with an injury rate of over 81%: the support amount shall not exceed VND 100 million per injured person per occasion.

3. Based on the severity of the road traffic accident, the level of support provided to organizations and individuals directly participating in helping, rescuing, and transporting road traffic accident victims to emergency care: the support amount shall not exceed VND 10 million for organizations per incident and not more than VND 5 million for individuals per incident.

4. Based on the scale of promotional activities, the level of support provided to organizations and individuals directly participating in promotional activities aimed at reducing road traffic accident damage without state funding assurance: the support amount shall not exceed VND 10 million for organizations per incident; and not more than VND 5 million for individuals per incident.

5. Based on the scale of promotional activities, the level of support provided for organizing promotional activities and events to raise funds: the support amount shall not exceed VND 100 million for fund management agencies per incident.

6. Other levels of expenditure as stipulated by current laws.

Chapter IV

IMPLEMENTING PROVISIONS

Article 13. Implementation Organization

1. Ministry of Public Security:

a) Shall be responsible for managing, directing, using, and settling accounts and finalizing the Road Traffic Accident Damage Reduction Fund according to the provisions of the law.

The unit assisting the Minister of Public Security in monitoring, managing, using, and settling accounts and finalizing the Fund according to this Decree and other relevant legal provisions is authorized to open an account at the State Treasury (where the unit is based) and at commercial banks legally operating in Vietnam to manage and maintain accounting records tracking revenues and expenditures, prepare annual financial plans including activity plans, revenue plans, and financial expenditure plans for approval by the Minister of Public Security; prepare financial reports and final settlement reports according to the law on finance and accounting. Implement accounting, management, and use of assets, independent audit of financial reports according to the law and guidance from the Ministry of Finance on accounting regulations. Publicize financial information, operational rules, and results of the Fund's operations according to this Decree and other relevant legal provisions.

b) Organize fundraising and receiving voluntary contributions from domestic and foreign organizations and individuals for the Fund.

c) Summarize and evaluate the effectiveness of managing and using the Fund periodically every six months, annually, and ad hoc reports to the Prime Minister, simultaneously sending to the Ministry of Finance for monitoring and consolidation.

d) Specify guidelines on procedures and formalities for implementing expenditures from the Road Traffic Accident Damage Reduction Fund.

2. People's Committees of provinces and centrally-administered cities shall be responsible for:

a) Periodically every three months, compile local damages and propose expenditure items and support needs of the locality to the Fund management agency for consolidation and proposal to the Minister of Public Security for decision.

b) Allocate budget support for cases not covered by Articles 11 and 12 of this Decree.

Article 14. Effective Date

1. This Decree takes effect from December 15, 2025.

2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
