THE MINISTER OF HEALTH

WHEREAS EDUCATIONDecree 68/ dated October 20, 2015 of October 11,/1993Government Decree No. 17/2001/NĐ-CP dated May 4, 2001 on the issuance of the Management and Utilization Regulations for Official Development Assistance (ODA). the proposal of the Minister of Planning and Investment;

Pursuant to the Government Decree number 17/2001/NĐ-CP dated May 4, 2001, of the Government on the issuance of the Regulation on Management and Use of Official Development Assistance (ODA) Pursuant to Circular No.

WHEREAS 2001/TT-BKH dated September 20, 2001 of the Ministry of Planning and Investment guiding the implementation of the Management and Utilization Regulations for Official Development Assistance issued together with Government Decree No.17/2001/NĐ-CP dated May 4, 2001. 06/Based on the management requirements of ODA of the Ministry of Health. Issued herewith are the Management and Utilization Regulations for Official Development Assistance of the Ministry of Health. assistance This Decision shall take effect fifteen days from the date of issuance. All previous regulations contrary to this Decision are hereby abolished.

The Director of the Planning Department shall be responsible for guiding and supervising the implementation of this Decision.

DECISION:

Article 1.The Heads of the Office, Inspectorate, Departments, Bureaus, and Units under the Ministry of Health and other relevant parties shall be responsible for implementing this Decision.Health.

Article 2.

Article 3These Regulations govern all activities related to attracting, managing, and utilizing Official Development Assistance (including non-repayable aid and concessional loans, hereinafter referred to as ODA) of the Ministry of Health.

Article 4.a)These Regulations apply to all programs and projects under the Departments, Bureaus, Offices, and Inspectorate within the Ministry of Health and its affiliated units in receiving, managing, and utilizing ODA.

 

REGULATIONS b)For health programs and projects implemented by units not directly under the Ministry of Health, they are not within the scope of these Regulations.standards

c)For programs and projects under paragraph b of this Article, the Ministry of Health assigns the Planning Department to be the focal point for receiving project application files to coordinate with relevant Departments and Bureaus to fulfill the State management responsibilities of the Ministry of Health in participating in the review process or providing comments. PART I

GENERAL PROVISIONS

Article 1.Scope of regulation.

Basic Principles.

Article 21.Official Development Assistance funds for the Ministry of Health must be received, managed, and implemented in accordance with the provisions of the law.

2.In cases where the Aid Agreement signed between the State or the Government of Vietnam and the donor specifies different provisions, such provisions shall be followed. . Definitions.

In these Regulations, the following terms are understood as follows: 1.The competent authority is the Ministry of Health for ODA programs and projects (hereinafter referred to as programs and projects) directly implemented by units within the Ministry or its affiliated units.

2.The project proponent is units under the Ministry or public service units directly under the Ministry (collectively referred to as units entrusted with the direct responsibility of managing and using aid funds and counterpart funds to implement programs and projects according to the approved content. Registering the list and content of ODA programs and projects. Based on strategic plans and sector development planning, the Minister of Health will consider and coordinate the plan for attracting and utilizing ODA during each period and the list and content of ODA programs and projects that require funding to be registered.

Article 3Approving ODA Programs and Projects.

1.Programs and projects within the approval authority of the Prime Minister as stipulated in Clause 1, Article 20 of Government Decree No. 17/2001/NĐ-CP dated May 4, 2001 shall be reviewed and commented on by the Minister of Health before submitting for approval. If necessary, the Minister may delegate this task to the Deputy Minister in charge of planning, investment, and foreign aid. 2.Programs and projects within the approval authority of the Minister of Health.

a)The Minister approves: basic construction investment programs and projects in Group B, technical assistance projects unrelated to institutional policies, laws, administrative reform, cultural information, national defense security with a value from 500,000 USD to less than 1,000,000 USD or equivalent.

Article 4b)The Deputy Minister in charge of planning, investment, and foreign aid approves: basic construction investment programs and projects in Group C, technical assistance projects unrelated to institutional policies, laws, administrative reform, cultural information, national defense security with a value below 500,000 USD or equivalent.

ATTRACTING AND RAISING ODA FUNDS

General principles for attracting and raising ODA funds.Units attracting and raising ODA funds base on the following grounds: a)State regulations and policies. b)Strategies, plans, annual, five-year, and ten-year plans of the Ministry of Health. c)Priority policies of the Ministry of Health for the development of the sector and fields in each period. d)Needs to fulfill the unit's tasks.

e)The mission, purpose, strengths, and priorities of the donor. f)The proactive role of the Ministry of Health and the implementing unit.

Article 5.Establishing a priority program and project list for ODA mobilization.

Each August, units actively establish a priority list for ODA utilization accompanied by a preliminary outline (according to Model Appendix No. 2 of Circular No. 06/2001/TT-BKH dated September 20, 2001 of the Ministry of Planning and Investment) and submit it in writing to the Ministry of Health (Planning Department).

Article 6The Planning Department acts as the focal point to consolidate and coordinate with the International Cooperation Department and relevant departments to review and submit the priority list for ODA utilization of the Ministry of Health to the Minister for approval.

Announcing the list of programs and projects to be considered for funding. The Planning Department is responsible for notifying in writing to units about the list of programs and projects agreed by donors to consider funding and approved by the Prime Minister (hereinafter referred to as programs and projects to be considered for funding).

2.Programmes and projects within the approval authority of the Minister of Health.

a)The Minister shall approve programmes and projects on basic construction investment group B, technical assistance projects unrelated to institutional policy, legal system, administrative reform, cultural information, national defense and security with a value from 500,000 USD to under 1,000,000 USD or equivalent.

b)The Deputy Minister in charge of planning, investment, and foreign aid shall approve basic construction investment programmes and projects group C, technical assistance projects unrelated to institutional policy, legal system, administrative reform, cultural information, national defense and security with a value under 500,000 USD or equivalent. Chapter II

SPECIFIC PROVISIONS

Part 1. ATTRACTION AND PROMOTION OF ODA

, Clause 1, Clause 2 Article 7a of this Regulation.General principles for attracting and promoting ODA.

Units attracting and promoting ODA shall base on the following:

a)State regulations and policies.

b)Strategies, plans, annual, five-year, and ten-year plans of the Ministry of Health. Health.

c)Priority policies of the Ministry of Health for the development of the sector and fields during each period.

d)Needs to fulfill the tasks of the unit.

e)The mission, purpose, strengths, and priorities of the donor.

f)The proactive role of the Ministry of Health and the implementing unit.Establishing a Priority Programme and Project List for Attracting ODA.

Article 8By August each year, units shall proactively establish a priority list for using ODA accompanied by a preliminary outline (according to Model Appendix No. 2 of Circular No. 06/2001/TT-BKH dated September 20, 2001 of the Ministry of Planning and Investment) and submit it in writing to the Ministry of Health (Planning Department).

The Planning Department shall be responsible for consolidating and coordinating with the Department of International Cooperation and relevant departments to review and submit the priority list for using ODA of the Ministry of Health to the Minister for approval.

Announcing the List of Programmes and Projects Under Consideration for Funding.

Article 9The Planning Department shall be responsible for announcing in writing to units the list of programmes and projects that the donor agrees to consider funding according to each period and approved by the Prime Minister (hereinafter referred to as programmes and projects under consideration for funding).

The Minister approves.

Part 2.

PREPARATION OF THE CONTENT OF THE PROGRAM AND PROJECT ODA

Article 10.Determining the project owner and establishing the Program Preparation Board.

1.Determining the project owner: The Planning Department is responsible for coordinatingwith relevant departments to propose the project owner, report to the DeputyMinister in charge of planning and investment for approval before submitting tothe Minister. The Minister approves the project leader.

2.Establishment of the Program and Project Preparation Board (hereinafter referred toas the Preparation Board): carried out after the Minister's approval of theproject owner. involving multiple areas and health sector policies, with a large implementation scale: After receiving the official written notification from the Ministry,

2.1.For projects with loans involving multiple fields, health sector policies, and largeimplementation scales: After receiving the official notification from the Ministryof Planning and Investment regarding the list of programs and projects underconsideration for funding, the Planning Department coordinates with the CadreOrganizing Department, International Cooperation Department, Project ManagementBoard, and relevant departments based on the main content of the project topropose the members of the Project Preparation Board and the Board Chairperson.Report to the Deputy Minister in charge of planning and investment for approvalbefore submitting to the Minister. After approval by the Minister, the CadreOrganizing Department drafts the decision for signature and issuance by theMinistry leadership. A the Organization and Cadre Affairs Department, the Department of International Cooperation, the Project Management Board, and relevant departments shall propose the composition of the Project Preparation Team and its Head based on the main content of the project, report to the Deputy Minister in charge of planning and investment for approval before submitting to the Minister for approval. After being approved by the Minister, the Organization and Cadre Affairs Department drafts the decision for leadership of the Ministry to sign and issue. 2.2.For projects not covered by Clause 2.1 of this Article: After obtaining approvalfrom the competent authority for the list of ODA usage, the Planning Departmentcoordinates with the Cadre Organizing Department, International CooperationDepartment, Project Management Board, and the project owner based on the maincontent of the project to propose the members of the Project Preparation Boardand the Board Chairperson. Report to the Deputy Minister in charge of planningand investment for approval before submitting to the Minister. After approvalby the Minister, the Cadre Organizing Department drafts the decision forsignature and issuance by the Ministry leadership. the Organization and Cadre Affairs Department, the Department of International Cooperation, the Project Management Board, and the project leader shall propose the composition of the Project Preparation Team and its Head based on the main content of the project, report to the Deputy Minister in charge of planning and investment for approval before submitting to the Minister for approval. After being approved by the Minister, the Organization and Cadre Affairs Department drafts the decision for leadership of the Ministry to sign and issue.

2.3.The specific procedures will be implemented according to the guidelines of theMinistry of Health. 3.The Project Preparation Team is responsible for preparing feasibility studies, detailed feasibility reports, and program/project documents for authorities with approval authority to review. The main contents of the preparation plan for programs and projects are stipulated in Article 14 of Chapter III of Decree No. 17/2001/NĐ-CP dated May 4, 2001 of the Government and detailed guidance of the Ministry of Health. .

3.The Project Preparation Board is responsible for preparing the pre-feasibility studyreport, feasibility study report, and program/project documentation forconsideration and approval by the competent authorities. The main contents ofthe preparation plan for the program/project are stipulated in Article 14 ofChapter III of Decree No. 17/2001/NĐ-CP dated May 4, 2001 of the Government andaccording to detailed guidance from the Ministry of Health. Health.

Establishing the Content of Basic Construction Investment Programs and Projects. Health.

4.Funds for preparing ODA programs and projects shall be implemented in accordancewith Article 12 of Chapter III of Decree No. 17/2001/NĐ-CP dated May 4, 2001 ofthe Government. The project owner is responsible for proposing the fundrequirement and source of funds for preparing the program/project and sendingit to the Ministry of Health (Planning Department and Financial AccountingDepartment). The Financial Accounting Department is responsible for coordinatingwith the Planning Department to guide the project owner in determining andallocating appropriate funds and sources of funds for preparing the program/project.

Article 11Decree No. 17/2001/NĐ-CP dated May 4, 2001 of the Prime Minister.

Pre-feasibility and feasibility study reports for basic construction investmentprograms/projects are prepared in accordance with current regulations oninvestment management and construction, clearly stating domestic sources offunding, ODA sources, conditions agreed upon with the financier, and addingcertain contents as specified in Article 15 and Article 16 of Chapter III ofDecree No. 17/2001/NĐ-CP dated May 4, 2001 of the Prime Minister. Establishing the Content of Technical Assistance Program and Project Documents.

In the feasibility study report of the program/project, it is necessary to allocateappropriate funds for inspection and evaluation activities from ODA funds orfrom co-financing sources.

Article 12.According to the requirements of the donor.

Documentation for technical assistance programs/projects is prepared according tothe detailed outline model in Appendix 8 of Circular No. 06/2001/TT-BKH datedSeptember 20, 2001 of the Ministry of Planning and Investment and according tothe requirements of the financier. Review and Approve Technical Assistance Projects with Contents Already Agreed Upon by Participating Departments and Capital Below 800,000 USD or Equivalent.

In the documentation of the program/project, it is necessary to allocate appropriaterevenues for inspection and evaluation activities from ODA funds or fromco-financing sources.

Part 3. REVIEW AND APPROVAL OF CONTENTS OF ODA PROGRAMMES AND PROJECTS

Article 13||| Review programmes and projects using ODA under the Prime Minister's approvalauthority. The Ministry of Planning and Investment is the leading agency to reviewprogrammes and projects using ODA under the Prime Minister's approval authority.

The review of ODA technical assistance programmes shall be carried out inaccordance with the provisions set forth in Section III of Circular No. 06/2001/TT-BKH dated September 20, 2001 issued by the Ministry of Planning and Investment.

TheMinistry of Health stipulates certain specific points (including basic construction investmentprojects and technical support projects):

1. Programmes and projects submitted for review must be within the approved listby the Prime Minister. For projects outside this list, they must be agreed upon bythe Minister of Health regarding the principle of accepting the project. 2. A valid programme/project dossier includes:

a) A letter requesting acceptance of the project from the project proponent. b) Project documentation (or a pre-feasibility report or feasibility report forbasic construction investment projects): at least five copies in Vietnameseconsistent with the preliminary outline of the programme/project alreadyapproved by the Prime Minister.

c) Draft agreement (or agreement) on the project to be signed betweenrepresentatives of Vietnam and representatives of the donor: at least five copiesin Vietnamese and another language proposed by the donor.

3. The Planning Department of the Ministry of Health is responsible for receivingprogramme/project dossiers from units to seek opinions from the Deputy Ministerin charge of the sector and related departments and bureaus.

4. The Deputy Minister in charge of planning and investment shall chair the meeting,including relevant departments and bureaus and the Project Preparation Board toreview and re-examine the project documentation before the Ministry of Healthissues a letter to the competent authorities for review and submission to thePrime Minister for project approval.

||| Review of programmes and projects using ODA under the approval authority of theMinister of Health. 1. Conditions for review: A project meets the conditions for review when it fulfillsboth of the following requirements: .

a) The project is within the approved list of ODA programmes and projects by thePrime Minister (for projects outside the list, they can only be reviewed afteragreement from the Prime Minister regarding the principle of accepting theproject). b) Valid review dossier: As stipulated in Clause 2 of Article 13 of this Regulation.

Article 142. Forms of review: Depending on the content, scale, and nature of the programme orproject requiring review, the Ministry of Health will conduct the review in oneof the following three forms: a) Compilation of written opinions from relevant departments and submission tothe leadership of the Ministry for examination and approval for technicalassistance projects whose contents have been agreed upon by participatingdepartments and have a capital amount below US$800,000 or equivalent.

The review organization is chaired by the Planning Department:

b1) Technical assistance projects with a capital amount from US$800,000 toUS$500,000 or equivalent.

b2) Annual action plans for projects approved by the Prime Minister fordocumentation or feasibility study reports for a cycle. c) The review organization chaired by the Deputy Minister for technicalassistance projects with a capital amount exceeding US$500,000 or equivalentand basic construction investment projects classified as Group B or Group C.

3. Leading agency organizing the review and participating agencies:a) The Planning Department is the main agency organizing the review, responsiblefor coordinating with relevant departments, bureaus, and boards based on theirassigned state management functions.

b) Participating units bear responsibility before the Minister and the law for thecontent of their contributions to the opinions on ODA programmes and projects. The appraisal body chaired by the Planning Department:

b)Organizing the design, printing of securities, and providing blank seals when requested by credit institutions. b1)Technical assistance projects with capital from 800,000 USD to 500,000 USD or equivalent.

b2)Annual action plans for projects approved by the Prime Minister for documentation or feasibility study reports for a cycle.

c)The appraisal body chaired by the Deputy Minister for technical assistance projects with capital over 500,000 USD or equivalent and basic construction investment projects group B, group C.

3.The leading appraisal body and participating appraisal bodies: a)The Planning Department is the leading body organizing the appraisal, responsible for coordinating with relevant departments, bureaus, and boards based on their assigned state management functions.

b)Participating appraisal units are responsible to the Minister

and to the law for the content of their contributions to ODA programs and projects.

c)Projects related to overseas training. d)ODA projects that are loans must follow withdrawal procedures specified in the Loan Agreement (Credit Agreement) signed with each donor. Withdrawal requests sent to the Ministry of Finance must also be sent to the Financial Accounting Department and the Planning Department of the Ministry of Health for monitoring disbursement progress.

Part 4. NEGOTIATION AND SIGNING OF ODA PROGRAMS AND PROJECTS

Article 15.Basis for negotiating and signing specific international treaties on ODA.

The basis for negotiating and signing specific international treaties on ODA isthe program and project documentation (feasibility study report or investmentdecision for construction projects) that has been approved by the competentauthority. .

2.In certain special cases, to ensure the progress of ODA fund mobilization, thecompetent authority may allow the use of a pre-feasibility study report that hasbeen approved for negotiating and signing specific international treaties onODA based on the nature of the ODA programs and projects.

Article 16.Negotiation and Signing.

For programs and projects that require negotiation and signing between theMinistry of Health and the donor: The Department of International Cooperationshall take the lead in coordinating with relevant departments and project ownersin conducting negotiation and signing procedures in accordance with currentregulations. Part 5..

MANAGEMENT AND USE OF ODA PROGRAMS AND PROJECTS Organizational structure for implementing ODA programs and projects.

Article 17.Organization 1.After approval of programs and projects, the project owner must establish amanagement organization for the program/project to implement activities,ensure the operation of the project and use of ODA funds and counterpartfunds in accordance with state management regulations and commitments made tothe donor.

2.The project owner proposes a list of the proposed Project Management Boardand sends it to the Ministry of Health (Planning Department).

3.The Planning Department serves as the focal point for soliciting opinions fromrelevant departments, the Department of Organization and Cadres, and theProject Management Board to submit to the leadership of the Ministry forapproval of the proposed Project Management Board list. 4.The Department of Organization and Cadres takes the lead, coordinates withthe Planning Department, and submits to the leadership of the Ministry fordeciding to establish the Project Management Board.

5.Functions, tasks, organizational structure, personnel, and operationalregulations of the Project Management Board shall be implemented inaccordance with Point 1 of Part III of Circular No. 06/2001/TT-BKH datedSeptember 20, 2001 issued by the Ministry of Planning and Investment andguidelines of the Ministry of Health. Management and Implementation of ODA Programs and Projects.

Based on the project documentation approved by the competent authority,project owners shall prepare annual action plans and send them to the Ministryof Health (Planning Department) for approval by the leadership of the Ministry. The approved annual action plan serves as the basis for programs and projectsto implement according to government and Ministry of Health regulations,especially noting the following contents: a)Activities involving the provision of goods, consulting services, basicconstruction... of programs and projects must go through bidding inaccordance with current state regulations on procurement and serviceprovision. In cases where the specific international treaty with the donorcontains separate provisions on bidding for goods and services, suchprovisions shall be followed.

Regarding the bidding process for ODA projects, the Planning Department isthe focal point for coordinating with relevant departments to guide andimplement as stipulated in Document No. 5797/YT-KH dated July 19, 2002issued by the Minister of Health. V b)The dispatch of experts under ODA projects shall be carried out inaccordance with the expert regulations for ODA projects issued in DecisionNo. 21/1/9981/QD-TTG dated January 1998 by the Prime Minister. Theproject owner shall submit a request for confirmation of ODA experts in theprescribed form to the Ministry of Health. The Department of InternationalCooperation is the focal point for coordinating with the Planning Departmentto confirm experts under the program/project as the basis for relevantauthorities to consider preferential exemptions according to the ODA expertregulations. c)Activities involving the dispatch of officials for overseas training within theprogram/project plan must be carried out in accordance with currentregulations of the Ministry of Health on overseas training. Health.

Article 18d)For ODA projects that are loans, the withdrawal of loan funds shall beprocessed according to the Loan Agreement (Credit Agreement) signed witheach donor. Withdrawal requests sent to the Ministry of Finance must alsobe sent to the Department of Financial Accounting and the PlanningDepartment of the Ministry of Health for monitoring disbursementprogress.

e)For ODA projects that are non-reimbursable grants, the disbursement ofactivities involving the receipt of money and goods from the project shall betransacted through grant acceptance procedures at the Planning Departmentof the Ministry of Health before sending to the Ministry of Finance. Specificrequirements for financial management shall be implemented in accordancewith Decision No. 992/2002/QD-BYT dated March 26, 2002 issued by theMinister of Health. f)ODA projects must comply with tax laws currently in effect and must budgetadequate counterpart funds to meet tax requirements. In cases whereinternational treaties signed between the Government and donors haveagreements on taxes different from those stipulated, such agreements shallbe implemented in accordance with the provisions of those internationaltreaties. g)In cases where unused funds remain after the completion of project objectivesor surplus funds arise due to lower than expected bid prices, the projectowner must report to the Ministry of Health (Planning Department andFinancial Accounting Department) to examine and proceed with necessaryprocedures to utilize the surplus funds. h)For programs and projects where counterpart funds cannot be arranged in thebudget plan or there is an urgent need for counterpart funds, the projectowner must submit a document explaining the need for counterpart funds tothe Ministry of Health (Planning Department, Financial AccountingDepartment) to examine and proceed with necessary procedures in accordancewith regulations to ensure counterpart funds for project operations.

Adjustment and Modification of Programs and Projects. During theimplementation of the project, if there are changes or adjustments to theprogram/project compared to the initial approval decision, the following shallbe implemented:

The project owner must submit a document explaining the content andadjustment plan to the Project Management Board.2.The Project Management Board shall provide comments on the adjustmentrequest of the project owner and submit to the Planning Department for thePlanning Department to review or organize an assessment. 3.The assessment procedure shall be conducted in accordance with Article 18 andArticle 14 of this Regulation.

4.The issuance of the decision approving the adjustment shall be implementedin accordance with Article 31 of Decree No. 17/2001/NĐ-CP dated May 4,2001 issued by the Government and guidelines at Point 3 of Part V ofCircular No. 06/2001/TT-BKH dated September 20, 2001 issued by theMinistry of Planning and Investment and guidelines of the Ministry of Health. In cases where it is necessary to amend and supplement an already signedinternational treaty on ODA

, it shall be implemented in accordance with the Ordinance on theConclusion and Implementation of International Treaties. e)ODA projects

that are non-reimbursable grants must implement disbursements of project activities through grant acceptance procedures at the Planning Department of the Ministry of Health before sending to the Ministry

of Finance. Specific financial management requirements are implemented according to Decision No. 992/2002/QĐ-BYT dated March 26, 2002 of the Minister of Health. f)ODA projects must comply with tax laws currently in effect and must budget sufficient counterpart funds to meet tax requirements. In cases where international agreements signed between the Government and donors have different tax provisions, such provisions shall be followed. g)In cases where the project has completed its objectives but has not fully utilized the approved capital, or there is surplus capital due to lower tender prices than the bid price, the project leader must report to the Ministry of Health (Planning Department and Financial Accounting Department) to review and proceed with necessary procedures to utilize the surplus capital. h)For programs and projects that cannot allocate counterpart funds in the budget plan or have urgent needs for counterpart funds, the project leader shall submit a written explanation of the need for counterpart funds to the Ministry of Health.

f) Official ODA projects must comply with the current tax ordinance and must budget sufficient counterpart funds to meet tax requirements. In cases where international treaties signed between the Government and the donor have different agreements on taxes, such agreements shall be implemented according to the provisions of those international treaties. g) In cases where, after the project has completed its objectives without using all approved capital, or there is surplus capital due to the bidding result being lower than the tender price, the project owner must report to the Ministry of Health (Planning Department and Financial Accounting Department) for consideration and to proceed with necessary procedures to utilize the surplus capital.

h) For programs and projects that fail to allocate counterpart funds in the budget plan or have urgent needs for counterpart funds, the project owner shall submit a statement explaining the need for counterpart funds to the Ministry of Health. vốnđã phê duyệt, hoặc có phần vốn dư ra do kết quả đấu thầu thấp hơn trịgiá bỏ thầu thì chủ dự án phải báo cáo về Bộ Y tế (Vụ Kế hoạch và Vụ Tài chínhkế toán) để xem xét tiến hành các thủ tục cần thiết để sử dụng phần vốn dư đó.

Part 6. MONITORING, EVALUATION OF ODA PROGRAMS AND PROJECTS

Article 20.Monitoring, inspection, and evaluation of implementation of programs and projects.

Chapter III. IMPLEMENTING PROVISIONS

Article 23. For technical assistance programs and projects, after completion, the project proponent must organize acceptance, utilization, and take measures to maintain and enhance the effectiveness of the programs and projects.
