DECISION

Regarding the issuance of regulations on approving measurement instrument samples

 THE MINISTER

MINISTRY OF SCIENCE, TECHNOLOGY AND ENVIRONMENT

Pursuant to the Measurement Ordinance dated October 6, 1999;

Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government on the tasks, powers, and organizational structure of the Ministry of Science, Technology, and Environment;

At the proposal of the General Director of the Standard Measurement Quality Administration,

 DECISION:

Article 1.Issued herewith is the "Regulations on Approving Measurement Instrument Samples".

Article 2.The General Director of the Standard Measurement Quality Administration shall be responsible for guiding and supervising the implementation of this Decision.

Article 3.THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 4.The Standard Measurement Quality Administration, local standard measurement quality administrations, and related organizations and individuals shall be responsible for implementing this Decision.

1. General Provisions

1.1 Approval of measurement instrument samples is the act of the competent state management agency for measurement examining, evaluating, and confirming that the sample of the measurement instrument meets the technical and measurement requirements stipulated.

1.2 Organizations and individuals (hereinafter referred to collectively as the entity) producing or importing measurement instruments listed in the Catalogue for Mandatory Calibration for Sale must register for sample approval with the competent state management agency for measurement.

1.3 In the following cases, the entity does not need to register for sample approval but must notify the competent state management agency for measurement (in accordance with the form prescribed in Appendix 1 of these Regulations):

1.3.1 In the case of production

a) Measurement instruments produced according to a design sample already approved by the competent state management agency for measurement;

b) Measurement instruments produced according to a sample from another entity already approved by the competent state management agency for measurement. In this case, written consent from that entity is required.

1.3.2 In the case of importation

a) Measurement instruments with a certificate of sample approval issued by an international legal metrology organization (OIML);

b) Measurement instruments with a certificate of sample approval issued by a national metrology authority of countries that mutually recognize each other's testing results for measurement instruments with Vietnam.

1.3.3 In the case of production or importation of measurement instruments for self-use at the entity. These measurement instruments must undergo calibration in accordance with the regulations.

1.4 The examination and evaluation of sample approval for measurement instruments are conducted based on the Testing Procedure mentioned in Point 3.2. The basis for developing the Testing Procedure includes Vietnamese Technical Standards (TCVN), Industry Standards (TCN), Vietnamese Metrological Technical Documents (ĐLVN), International Organization for Standardization (ISO) standards, and other international organizations' standards, and recommendations of the International Legal Metrology Organization (OIML) for those measurement instruments.

1.5 The Standard Measurement Quality Administration (hereinafter referred to as the Administration) is the competent state management agency for measurement authorized to organize the approval of measurement instrument samples.

2. Procedures for approving measurement instrument samples

2.1 Application dossier for sample approval

2.1.1 The application dossier for sample approval to produce measurement instruments includes:

a) Sample approval registration (in accordance with the form prescribed in Appendix 2);

b) Two copies of the overall design of the sample measurement instrument;

c) Two copies of the technical description (principle, technical and measurement features);

d) Test procedures, test records, and test results of the sample measurement instrument organized by the entity (if available);

2.1.2 The application dossier for sample approval to import measurement instruments includes:

a) Sample approval registration (in accordance with the form prescribed in Appendix 2);

b) Two copies of the technical description of the measurement instrument;

c) Test records and test results of the sample measurement instrument organized by the entity (if available);

2.2 Processing the application dossier

2.2.1 Based on the application dossier and the test results already carried out by the entity, if they meet the requirements specified in Section 3 of these Regulations, the Administration will examine and decide on sample approval.

2.2.2 If the sample has not yet been tested or the testing of the sample does not comply with the requirements specified in Section 3 of these Regulations, the Administration will designate an organization mentioned in Point 3.1 to carry out the testing and evaluation of the sample measurement instrument. Based on the test results, the Administration will examine and decide on sample approval.

2.3 The decision on sample approval shall specify: the name of the entity producing or importing; the name, code, and main technical and measurement characteristics of the measurement instrument.

The decision on sample approval shall be sent to the entity and copied to relevant state management agencies.

2.4 Approved measurement instrument samples and measurement instruments produced according to approved samples shall bear the sample approval mark. The form and content of the sample approval mark are prescribed in Appendix 3.

Two copies of the overall design of the approved measurement instrument sample will be confirmed by a Decision of the Standard Measurement Quality Administration and bear the sample approval mark. One copy is kept at the Administration, and one copy is kept at the entity.

3. Testing to approve measurement instrument samples

3.1 The measurements and tests to determine the technical and measurement characteristics of the measurement instrument sample must be carried out at calibration and testing laboratories recognized, organizations recognized for their ability to calibrate, or designated by the Administration.

3.2 Testing is conducted according to the Testing Procedure issued by the Administration. In the absence of a Testing Procedure, the testing organization must develop a Testing Procedure and submit it to the Administration for approval.

3.3 The test results for sample approval of measurement instruments must be the results of at least three measurement instrument samples; fewer than this number requires approval by the Administration.

4. Implementation Clause

4.1 Measurement instruments previously approved by the Administration do not need to go through the sample approval procedure again under these regulations.

4.2 When the entity makes improvements that change the technical and measurement characteristics compared to the approved sample, the sample approval procedure must be repeated.

Approval mark for sample of measuring instrument

The approval mark for sample of measuring instrument has the shape as shown in the following illustration. The size of the mark is not specified.

1.The upper part is the logo conventionally used for the approval of the sample of measuring instrument.

2.The lower part consists of three groups of letters and numbers separated by a hyphen (-). The first group includes the letter "M" and two digits indicating the order of the approved sample,

-        The third group includes two digits indicating the last two digits of the year of approval.
