Pursuant to the Inspection Law No. 22/2004/QH11 dated June 15, 2004;

Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 136/2004/NĐ-CP dated June 16, 2004 of the Government on the organization and operation of transport inspection;

After reaching consensus with the Government Inspectorate (document number 887/TTCP dated April 14, 2005 of the Government Inspectorate);

At the proposal of the Chief Inspector of the Ministry of Transport,

DECISION:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Decision stipulates provisions on flags, uniforms, insignia, rank badges, license plates; means of transport, technical equipment of traffic inspection authorities at all levels.

2. The subjects to which this Decision applies are organizations and individuals within the traffic inspection system and other organizations and individuals related to traffic inspection.

Article 2. General Principles

1. Only officers, civil servants, and staff members within the establishment of traffic inspection organizations are permitted to wear uniforms and carry insignia, rank badges, license plates of traffic inspection according to the provisions of this Decision.

2. Officers, civil servants, and staff members of traffic inspection organizations when performing tasks must carry their inspector identification card (for inspectors), wear the correct uniform, and carry complete insignia, rank badges, license plates as prescribed. Strictly prohibited are acts of erasing, altering, lending inspector identification cards or flags, uniforms, insignia, rank badges, license plates, and technical equipment for other purposes.

3. Upon completion of duty hours, officers, civil servants, and staff members of traffic inspection organizations must return insignia, rank badges, license plates, and technical equipment to the office, except in cases where they have planned work at the premises without having to go to or return to the headquarters of the inspection agency.

4. Officers, civil servants, and staff members of traffic inspection organizations are responsible for maintaining and preserving flags, uniforms, insignia, rank badges, license plates, inspector identification cards, and technical equipment for performing duties. In case of loss or damage, they must immediately report to the agency and bear full responsibility for the consequences; in case of job transfer, retirement, or disciplinary action resulting in dismissal, they must hand over to the inspection agency all uniforms, insignia, rank badges, license plates, inspector identification cards, technical equipment provided, and related documents.

Chapter II

FLAGS, UNIFORMS, INSIGNIA, RANK BADGES, LICENSE PLATES; MEANS OF TRANSPORT, TECHNICAL EQUIPMENT OF TRAFFIC INSPECTION AUTHORITIES

Article 3. Flags of traffic inspection authorities

1. Flags of traffic inspection authorities are attached to vehicles and other dignified positions of traffic inspection authorities.

The model of the flag of traffic inspection authorities is attached as Appendix 1 to this Decision.

2. The flag has an equilateral triangle shape, with the base equal to two-thirds the height, made of dark blue fabric, embroidered with the traffic inspection insignia, specifically:

a) Flags hung on vessels such as ships and boats have a base length of 600mm and a height of 900mm. On the flag, there is an insignia with a diameter of 170mm.

b) Flags hung on vessels such as speedboats, cars, motorcycles, and other patrol vehicles have a base length of 300mm and a height of 450mm. On the flag, there is an insignia with a diameter of 110mm.

Article 4. Insignia of traffic inspection authorities

1. The insignia is the common symbol of the traffic inspection force.

The model of the insignia of traffic inspection authorities is attached as Appendix 2 to this Decision.

2. The insignia of traffic inspection authorities is circular, with raised details and patterns, specifically as follows: the inner circle is two-thirds the size of the insignia, with a bright red background, in the center is the word "INSPECTORATE" in yellow, above it is a five-pointed star in raised gold; between the inner circle and the insignia circle is a dark blue background, with golden ears of rice on both sides; below the center of the insignia is a gear in gold with the abbreviation "TRAFFIC TRANSPORTATION" in dark purple.

3. The insignia of traffic inspection authorities includes five types:

a) Insignia attached to the kepi cap: with a diameter of 35mm, made of metal, worn in the middle front of the cap, above the visor along with silver-plated pine branches on both sides.

b) Insignia attached to soft caps: with a diameter of 29mm, made of metal, worn in the middle front of the soft cap, without silver-plated pine branches.

c) Insignia attached to lapels and ties (cravats): with a diameter of 18mm, made of metal.

d) Embroidered insignia on a shield measuring 35mm in diameter, attached to the left sleeve, 80mm - 100mm from the shoulder seam. The shield measures 70mm wide at its widest point and 90mm high at its highest point, made of blue fabric, with long ears of rice on both sides, a gold border around the shield, and the name of the state management agency for transportation at the same level, specifically as follows:

- MINISTRY OF TRAFFIC TRANSPORTATION, for the Inspectorate of the Ministry of Transport.
- DEPARTMENT OF TRAFFIC TRANSPORTATION (OR DEPARTMENT OF PUBLIC TRANSPORT), for local traffic inspection.
- VIETNAM ROADS COUNCIL, for the Inspectorate of the Vietnam Roads Council.
- VIETNAM RAILWAYS COUNCIL, for the Inspectorate of the Vietnam Railways Council.
- VIETNAM INLAND WATERWAYS COUNCIL, for the Inspectorate of the Vietnam Inland Waterways Council.
- VIETNAM MARITIME COUNCIL, for the Inspectorate of the Vietnam Maritime Administration.
- VIETNAM AVIATION COUNCIL, for the Inspectorate of the Vietnam Civil Aviation Administration.

đ) Embroidered insignia on the flag of traffic inspection authorities as prescribed in Article 3 of this Decision.

Article 5. Issuing Traffic Inspection Badges

1. Traffic inspection badges shall be worn on both shoulders of traffic inspection uniforms to distinguish leadership positions within traffic inspection organizations at various levels from other professional titles.

The model of the traffic inspection badge is attached as Appendix 3 to this Decision.

2. The badge shall be made of fabric, with a dark navy blue color, having dimensions: length 120mm, outer width 50mm, inner width 40mm, slanting tip width 18mm; it shall have a velvet border with the following size and color:

a) The border for the position of Director of the Ministry's Inspectorate and Deputy Director of the Ministry of Transport Inspectorate is 1.5mm wide, dark red in color.

b) The border for other positions is 1.5mm wide, light yellow in color.

c) A horizontal stripe on the badge is 6mm wide, light yellow in color.

d) A vertical stripe on the badge is 5mm wide, light yellow in color.

đ) A letter "V" shape made of metal, 6mm wide, silver white in color.

e) A five-pointed gold star made of metal, golden in color, shall be affixed on the badge with a diameter of 15mm.

3. Shoulder insignia for the position of Director of the Ministry and Deputy Director of the Ministry of Transport Inspectorate shall be pine branches with a star inside.

4. Specific badges for each position and title are as follows:

a) Director of the Ministry: no stripes and two evenly spaced five-pointed light yellow stars vertically.

b) Deputy Director of the Ministry: no stripes and one centrally placed five-pointed light yellow star.

c) Head of Department under the Ministry Inspectorate: two vertical stripes and two evenly spaced five-pointed light yellow stars centrally between the stripes.

d) Deputy Head of Department under the Ministry Inspectorate: two vertical stripes and one centrally placed five-pointed light yellow star between the stripes.

đ) Director of the Bureau Inspectorate: two vertical stripes and two evenly spaced five-pointed light yellow stars centrally between the stripes.

e) Deputy Director of the Bureau Inspectorate: two vertical stripes and one centrally placed five-pointed light yellow star between the stripes.

g) Director of the Provincial Inspectorate: two vertical stripes and two evenly spaced five-pointed light yellow stars centrally between the stripes.

h) Deputy Director of the Provincial Inspectorate: two vertical stripes and one centrally placed five-pointed light yellow star between the stripes.

i) Head of Division under the Bureau Inspectorate (or equivalent level): three horizontal stripes and two five-pointed light yellow stars.

j) Deputy Head of Division under the Bureau Inspectorate (or equivalent level): three horizontal stripes and one centrally placed five-pointed light yellow star.

k) Team Leader: two horizontal stripes and two five-pointed light yellow stars.

l) Deputy Team Leader: two horizontal stripes and one centrally placed five-pointed light yellow star.

m) Inspectors at all levels: one horizontal stripe and one centrally placed five-pointed light yellow star.

n) Specialists, clerical staff, and employees: two V-shaped horizontal stripes without stars.

Those who hold badges according to points a, b, c, d, đ, e, g, h, i, j, k, l shall not apply for badges according to point m, n of this clause.

Article 6. Traffic Inspection Emblem

1. The traffic inspection emblem shall be made of acrylic, measuring 50mm x 84mm, and shall be worn on the left chest of the uniform.

The model of the traffic inspection emblem is attached as Appendix 4 to this Decision.

2. The upper part of the emblem: background color dark blue, width 11mm, with white letters in the middle, height 5mm, standing upright with full punctuation marks, specifically as follows:

a) MINISTRY OF TRANSPORT INSPECTORATE.
b) VIETNAM HIGHWAY INSPECTORATE.
c) VIETNAM WATERWAY INSPECTORATE.
d) VIETNAM RAILWAY INSPECTORATE.
đ) VIETNAM MARITIME INSPECTORATE.
e) VIETNAM AVIATION INSPECTORATE.
g) PROVINCE TRANSPORT INSPECTORATE (or PROVINCE TRANSPORT AND COMMUNICATIONS INSPECTORATE) + province or city name directly under the central government (for local traffic inspectorates).

3. The lower part of the emblem: white background, left side is a half-length photograph measuring 3cm x 4cm in uniform; right side is the full name in blue letters, standing upright with full punctuation marks, height 5mm; below the name is the title; below the name and title is the civil service grade code and serial number, three digits, letters and numbers standing upright, sharp and clear.

The civil service grade code and serial number (according to the list issued by the issuing agency) shall be separated by a hyphen.

4. The emblem of inspectors or Directors of traffic inspectorates at various levels shall have a diagonal red stripe, 6mm wide. Specialists, clerical staff, employees, and other positions shall not have a diagonal red stripe.

Article 7. Uniforms of Traffic Inspection Officers

1. The uniforms of Traffic Inspection Officers include: shirts, pants (spring-summer, autumn-winter), caps, soft hats, ties (Cravats), belts, shoes, boots, helmets, and other accessories (gloves, socks, protective clothing...). The uniforms for Traffic Inspection Officers consist of male and female uniforms.

The model of Traffic Inspection Officer uniforms is attached as Appendix 5 to this Decision.

2. Spring-summer shirts:

a) For males: short-sleeved shirt with cuffs on sleeves, collar turned down or standing up, two breast pockets with cuffs, shoulder straps for insignia pins, blue fabric.

b) For females: short-sleeved shirt with cuffs on sleeves, collar turned down or standing up, two pockets sewn below the front flap, slightly diagonal pocket flaps, shoulder straps for insignia pins, blue fabric.

c) Traffic Inspection Officers working in offices are permitted to wear white standing-collar shirts tucked into pants. A badge similar to the one worn on a tie is fastened above the chest.

3. Autumn-winter shirts:

a) Suit jacket:

- For males: dark navy blue suit jacket with two layers of fabric, four pockets with flaps, V-shaped collar, cuffs, shoulder straps for insignia pins, four buttons, plastic buttons matching the color of the jacket.

- For females: dark navy blue suit jacket with two layers of fabric, two slightly diagonal pockets with hidden flaps inside the front panel, waist-tucked style, V-shaped collar, shoulder straps for insignia pins, three buttons, plastic buttons matching the color of the jacket.

b) Long-sleeved shirt:

- For males: long-sleeved shirt, blue fabric, standing collar, worn under the suit jacket.

- For females: long-sleeved shirt, blue fabric, feminine style, standing collar, worn under the suit jacket.

c) Vest, dark navy blue, worn under the suit jacket.

d) Overcoat, dark navy blue, shoulder straps for insignia pins, plastic buttons matching the color of the coat.

4. Trousers:

a) For females: long-legged dark navy blue trousers, moderately wide leg, two straight side pockets; suitable for all seasons.

b) For males: long-legged dark navy blue trousers, moderately wide leg, two diagonal side pockets and one back pocket; suitable for all seasons.

5. Cap: top and crown dark navy blue, brim and chin strap black, golden braid around the top and crown, two gold braids around the connection between the brim and crown.

6. Soft hat, dark navy blue, badge worn on the front, without pine branches.

7. Dark navy blue tie.

8. Black leather belt, dark buckle.

9. Document case with shoulder strap.

10. Short black leather shoes, lace-up.

11. Dark navy blue socks.

12. Specialized raincoat, overcoat style.

13. Black rubber boots.

14. Helmet for motorcycle control, male and female styles, blue, "TTGTVT" letters painted on both sides.

Article 8. Service Life

1. The service life of uniforms, badges, and insignias of Traffic Inspection Officers is specified as follows:

a) Caps, soft hats: 1 piece/2 years.

b) Badges, insignias: 1 set/2 years.

c) Spring-summer shirts and pants: 2 sets/1 year; autumn-winter shirts and pants, shirts: 1 set/2 years; vests: 1 piece/2 years; overcoats: 1 piece/3 years.

d) Ties, belts, document cases: 1 piece/1 year.

đ) Socks: 6 pairs/1 year.

e) Leather shoes: 1 pair/1 year.

g) Helmets: 1 piece/3 years.

h) Raincoats, flashlights: 1 piece/1 year.

i) Rubber boots: 1 pair/2 years.

2. If uniforms, badges, insignias, and signs are lost or damaged for valid reasons, they will be considered for replacement or exchange of insignias and signs when there is a change in position or title.

Article 9. Quality of flags, uniforms, insignia, rank badges, and license plates

1. Flags, uniforms, insignia, rank badges, and license plates of traffic inspection must be of high quality, durable, and aesthetically pleasing; products must have a clear origin from authorized management bodies.

2. It is strictly prohibited for traffic inspection organizations to use flags, uniforms, insignia, rank badges, and license plates that do not meet quality standards and are not in accordance with this Decision.

3. The fabric for making uniforms shall be temporarily specified as follows:

a) The fabric for spring and summer shirts is poplin pevi, blue color.

b) The fabric for pants, autumn and winter shirts, kepi hats, soft hats is gabardine blended with wool, dark navy blue color.

Article 10. Means of transportation and technical equipment

1. Means of transportation and technical equipment serving the activities of traffic inspection include:

a) Sedans, trucks, pickup trucks, cranes, tow trucks, with reflective letters painted on both sides of the vehicle or doors, specifications as follows: dark blue background, width 14cm, centrally inscribed with the name of the inspection agency as stipulated in Clause 2, Article 6, white color, letter height 10cm, stroke width 1.5cm, standing upright with full punctuation marks;

b) High-speed boats and ships painted white, with reflective letters painted on both sides of the cabin of the ship and both sides of the hull of the boat, the name of the inspection agency as stipulated in Clause 2, Article 6, blue color, height 20cm, stroke width 2.5cm, standing upright with full punctuation marks;

c) Two-wheeled or three-wheeled motorcycles, painted with letters according to point a, Clause 1 of this article, with smaller base size and letter size, depending on each type of vehicle;

d) Walkie-talkies, cameras, scales for weighing vehicles, and other supporting tools as prescribed by law;

đ) Office equipment;

e) Other means of transportation and technical equipment as required by the specific business sectors of road transport, railway, inland waterway, maritime, and air transport.

All means of transportation and technical equipment must be registered and inspected for safety and technical compliance according to current regulations.

2. It is not necessary for every traffic inspection organization at any level within the traffic inspection system to equip all means of transportation and technical equipment as prescribed in Clause 1 of this Article. Depending on each specific sector and inspection level, the competent authority decides on the provision of appropriate means of transportation and technical equipment.

3. The Minister of Transport, Directors of Vietnam Road Administration, Vietnam Waterway Administration, Vietnam Railway Administration, Vietnam Maritime Administration, Vietnam Civil Aviation Administration, and Directors of Provincial Departments of Transport, Provincial Departments of Transport and Public Works decide or submit to the competent authority for approval the allocation of office space, provision of means of transportation and technical equipment according to their respective levels.

4. In addition to the means of transportation and technical equipment mentioned in Clause 1 of this Article, when conducting inspections and in cases of necessity, inspection agencies may use the means of transportation and technical equipment of state management agencies, affiliated units of state management agencies at the same level, or lower-level traffic inspection agencies to serve inspection work according to legal provisions.

Article 11. System and budget for purchasing flags, uniforms, insignia, rank badges, and license plates; means of transportation and technical equipment

1. The budget for purchasing, repairing flags, uniforms, insignia, rank badges, and license plates; means of transportation and technical equipment is allocated in the annual state budget expenditure plan approved by the competent authority.

2. Each year, traffic inspection organizations must prepare a budget for purchasing flags, uniforms, insignia, rank badges, and license plates; means of transportation and technical equipment to serve inspection work and submit it to the competent authority for approval according to regulations.

3. The uniform distribution system varies depending on regions, areas, and zones suitable for the climate and weather conditions in the territory of the Socialist Republic of Vietnam.

Chapter III

IMPLEMENTING PROVISIONS

Article 12. Implementation Organization

1. Flags, uniforms, insignia, and rank badges of traffic inspection are protected under copyright laws. It is strictly prohibited for organizations and individuals to violate the copyrights of flags, uniforms, insignia, and rank badges of traffic inspection; violators will be dealt with according to the law.

2. Office spaces, means of transportation, and technical equipment already provided by the competent authority to administrative inspectors and specialized inspectors (previously) can continue to be used by traffic inspection organizations and must comply with the provisions of this Decision.

3. Those who have been issued uniforms, insignia, rank badges, and license plates but do not fall within the scope of issuance and provision according to this Decision must return these items. The Directors of Departments and Heads of Provincial Departments of Transport, Provincial Departments of Transport and Public Works are responsible for collecting them and deciding on their disposal according to their authority.

The collection of uniforms, insignia, rank badges, and license plates must be completed before December 30, 2005.

Article 13. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from January 1, 2006, replacing Decision No. 343/PC - VT dated February 22, 1997, of the Minister of Transport regarding the tasks, powers, titles, insignia, rank badges, license plates, uniforms, and equipment of the traffic inspection force, and Decision No. 1862/1998/QĐ-BGTVT dated July 24, 1998, of the Minister of Transport amending certain provisions of Decision No. 343/PC - VT; abolishing previous provisions contrary to this Decision.

2. The State Inspectorate of the Ministry of Transport assists the Minister in uniformly managing the flags, uniforms, insignia, rank badges, and license plates of traffic inspection nationwide according to this Decision.

3. The Heads of the Office, the Chief Inspector of the Ministry, Department Heads, Directors of Departments under the Ministry, Directors of Provincial Departments of Transport, Provincial Departments of Transport and Public Works, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Decision.
