Pursuant to the Government Decree No. 86/2003/NĐ-CP dated July 18, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Prime Minister's Decision No. 220/2005/QĐ-TTg dated September 9, 2005 establishing the Vietnam Academy of Agricultural Sciences;

Considering the proposal of the Director of the Vietnam Academy of Agricultural Sciences and the Head of the Personnel Department.

Article 1. Position and Function

1. The Institute of Agricultural Genetics was established pursuant to point a Clause 1 Article 2 of the Prime Minister's Decision No. 220/2005/QĐ-TTg dated September 9, 2005 establishing the Vietnam Academy of Agricultural Sciences.

2. The Institute of Agricultural Genetics is a scientific research institution under the Vietnam Academy of Agricultural Sciences with the task of conducting fundamental research with direction and applying scientific and technological achievements in the field of genetics and biotechnology to implement economic and social development tasks of the Sector.

3. The State shall provide funding for the operation of the Institute, which may use its own seal and account at the State Treasury and Bank in accordance with the provisions of the law.

The English international name of the Institute is: Agricultural Genetics Institute, abbreviated as AGI.

The main office of the Institute is located in Thuy Liem District, Hanoi City.

Article 2. Tasks of the Institute

1. To develop long-term, five-year, and annual scientific research programs and technology transfer projects in the fields of genetics and biotechnology serving the goal of economic and social development, submit them to competent authorities for approval and organize their implementation.

2. To carry out scientific research and technology transfer in the following areas:

a) Genetic laws and variation at molecular, cellular, individual, and population levels in crops and microorganisms;

b) Application of recombinant DNA technology and nanotechnology to analyze plant genomes;

c) Application of genetic methods and biotechnology to increase genetic diversity and create initial materials for crop and microorganism breeding and selection;

d) Development and application of bioinformatics to build gene databases for crops and microorganisms: gene maps, gene sequences, gene functions, genetically modified crops, genetically modified products;

đ) Application of technological solutions to protect agricultural biological environments, biodiversity, and biosafety.

3. To perform technology transfer and extension services in the fields of genetics and biotechnology.

4. To conduct international cooperation in scientific research, technology transfer, expert collaboration, and human resource training in the fields of genetics and agricultural biotechnology with foreign organizations and individuals in accordance with state regulations.

5. To link and cooperate in scientific research and technological development, test new techniques, and train human resources in assigned fields with domestic organizations in accordance with the law.

6. To operate and engage in business activities in compliance with the law.

7. To manage and use human resources, funds, and assets effectively in accordance with the law.

Article 3. Organizational Structure

1. Leadership of the Institute: The Institute of Agricultural Genetics has a Director and Deputy Directors.

a) The Director is appointed by the Minister of Agriculture and Rural Development upon the recommendation of the Director of the Vietnam Academy of Agricultural Sciences and is responsible to the Director of the Vietnam Academy of Agricultural Sciences and to the law for all activities of the Institute.

b) The Deputy Directors are appointed by the Director of the Vietnam Academy of Agricultural Sciences upon the recommendation of the Director and are responsible to the Director and to the law for the tasks assigned by the Director.

2. Business units assisting the Director in performing tasks:

a) Administrative Office;

b) Science and International Cooperation Office;

c) Finance and Accounting Office.

Each office has a Head and Deputy Head.

Depending on specific conditions, the Director of the Vietnam Academy of Agricultural Sciences may decide to establish a General Management Office, but not exceeding the number of offices mentioned above.

3. Research Departments:

a) Mutagenesis and Hybrid Vigor Department;

b) Microbial Technology Department;

c) Molecular Biology Department;

d) Molecular Pathology Department;

đ) Genetic Engineering Department;

Each department has a Head and Deputy Head.

4. Subordinate scientific research units of the Institute:

a) National Key Laboratory of Plant Cell Technology;

b) Agricultural Biological Environment Center;

c) High-tech Agricultural Biotechnology Experimental Center;

These laboratories and centers may use their own seals and accounts at the State Treasury under the authorization of the Director and in accordance with the law.

Each center has a Director and Deputy Director.

5. Enterprises subordinate to the Institute:

a) Hong River Mushroom Company: based on the existing Plant Biotechnology Center. The company is a subsidiary of the Institute of Agricultural Genetics and may use its own seal and open a separate account;

b) Vinh Gang Agricultural Biotechnology Company. The company is established and operates in accordance with the law.

Article 4. The Director of the Vietnam Academy of Agricultural Sciences is tasked with specifying detailed tasks and approving the Charter of organization and operation of the Institute; the Director of the Institute of Agricultural Genetics is tasked with defining functions, tasks, organizational structures, and operational regulations for subordinate organizations; registering and operating scientific and technological activities of the Institute with competent authorities in accordance with state regulations.

Article 5. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 6.The Chief of the Office, Heads of the Personnel Department, Heads of relevant agencies and units under the Ministry, the Director of the Vietnam Academy of Agricultural Sciences, and the Director of the Institute of Agricultural Genetics are responsible for implementing this decision./.
