REGULATIONS ON THE FUNCTIONS, DUTIES, POWERS AND ORGANIZATIONAL STRUCTURE OF THE COUNCIL FOR COOPERATIVE ECONOMY AND RURAL DEVELOPMENT
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, duties, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Article 19 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, duties, powers, and organizational structure of Ministries and ministerial-level agencies;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1. Position and Functions
The Council for Cooperative Economy and Rural Development is a subordinate agency under the Ministry of Agriculture and Rural Development, performing the function of advising the Minister on specialized state management and implementing state management tasks in the fields of cooperative economy, population resettlement, rural development, and relocation and resettlement within the scope of the Ministry's state management.
The Council has legal personality, its own bank account and seal, and operational funds as prescribed by law.
The headquarters of the Council is located in Hanoi and it has a permanent office in Ho Chi Minh City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit draft laws, ordinances, and draft regulatory documents of a specialized nature to the Ministry according to the annual legislative program of the Ministry and projects and programs assigned by the Minister. Submit draft decisions, directives, and other documents within the Minister’s authority to direct and manage to the Minister.
2. Submit strategies, plans, and long-term, five-year, and annual plans; regional strategic plans, inter-regional, and inter-provincial plans, and important programs, projects, and works within the specialized field managed by the Council as assigned by the Minister.
3. Issue individual documents and provide professional guidance on the specialized field and sector entrusted with management. Announce detailed implementation plans for programs, projects, and initiatives managed by the Ministry for each locality and unit after the overall plan for the sector managed by the Council has been approved by the Ministry.
4. Submit to the Ministry for publication strategies, plans, and development programs and organize the direction, guidance, and inspection of the implementation of regulatory documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical quotas in the specialized field after approval; direct and organize the dissemination, popularization, and education of laws related to the specialized field within the Council's management scope.
5. On cooperative economy:
a) Take the lead and coordinate with relevant agencies to develop mechanisms and policies to encourage and support the development of cooperatives, cooperative groups, and other forms of cooperative economy; household and farm economies in agriculture (agriculture, forestry, fisheries, salt production), and rural areas; submit them to the Ministry.
b) Aggregate and submit to the Ministry programs, projects, and plans for developing cooperative economies, household economies, and farm economies in agriculture and rural areas; guide, direct, and inspect their implementation after approval.
6. On rural development:
a) Aggregate and submit to the Minister the comprehensive program for rural development; regional and territorial planning for rural development; other basic investigation projects related to rural development; participate in building the strategy for developing rural industries and crafts linked to households and cooperatives.
b) Take the lead and coordinate with relevant agencies to develop mechanisms and policies for rural development; submit them to the Ministry.
c) Take the lead in managing programs, projects, or components of programs and projects on poverty reduction; new rural construction; rural infrastructure construction programs; Program 135; replacement and eradication of drug-containing plants; and other programs and projects as assigned by the Ministry.
d) Guide, summarize practical models of rural development, and propose expanding these models.
7. On population resettlement planning:
a) Take the lead and coordinate with relevant agencies to develop mechanisms and policies for planning and resettling populations; define the division of responsibilities and levels of review for programs and projects related to rural population relocation and resettlement; basic investigation projects and planning designs for population resettlement.
b) Aggregate and submit to the Minister plans for resettling and arranging populations according to programs and projects related to rural population relocation and resettlement according to the national socio-economic development plan; resettlement for large hydropower and irrigation projects.
c) Guide, direct, and inspect the implementation of programs and projects on population resettlement planning; population relocation and resettlement work in agriculture and rural areas according to the national socio-economic development plan; guide the construction of residential areas; implement rural infrastructure construction programs as assigned by the Minister.
d) Guide, summarize practical models, and propose expanding these models.
8. Propose to the Ministry a list of investment programs and projects within the Council's management scope. Lead the appraisal and perform the role of the main investor for programs and projects assigned by the Ministry to the Council.
9. Organize the direction of statistical surveys and database management on cooperative economy and rural development as prescribed.
10. On science and technology:
a) Propose and submit to the Ministry programs, plans, and research topics on scientific research and application of advanced technology and techniques in the specialized field.
b) Lead the appraisal of research outlines and topics; commission organizations and individuals to carry out research; accept, manage results, and direct the implementation of research and application of advanced technology and techniques within the Council's management scope.
c) Manage information on science and technology in the specialized field managed by the Council.
d) Participate in drafting national standards and technical regulations within the Ministry's state management scope as assigned by the Minister.
11. Direct the implementation of agricultural and fishery extension activities in the fields of cooperative economy, population resettlement, relocation and resettlement, and rural development as assigned by the Minister.
12. Participate in trade promotion activities in the fields of cooperative economy, population resettlement, relocation and resettlement, and rural development as assigned by the Minister.
13. Regarding international cooperation:
a) Establish and submit to the Ministry the program and project plans for international cooperation within the scope of the Bureau's management;
b) Organize and implement international cooperation, programs, and projects funded according to the分级授权的部长权限;
14. Regarding administrative reform:
a) Develop and organize the implementation of administrative reform plans in accordance with the Ministry's plan and the Minister's directives;
b) Direct the review, systematization, and proposal for the establishment of institutional and legal systems within the scope of the Bureau's management;
c) Direct the improvement of functions, tasks, and authorities of subordinate organizations under the Bureau in accordance with the division of labor and delegation; submit to the Ministry for the delegation of state management tasks and fields to local governments;
d) Direct the implementation of regulations on autonomy and responsibility for performing tasks, organizational structure, staffing, finance, and administrative reform, innovation in working methods, modernization of offices, application of information technology to serve the activities of the Bureau.
15. Regarding state management of organizations providing public services within the industry and field managed by the Bureau:
a) Submit to the Ministry mechanisms, policies, technical standards for providing public services; regarding the socialization of activities providing public services in the industry and field;
b) Issue economic-technical norms and timeframes for providing public services within the industry and field;
c) Guide, inspect, and support organizations providing public services within the industry and field in accordance with the provisions of the law;
16. Regarding state management of the activities of associations and non-governmental organizations within the industry and field managed by the Bureau as assigned by the Minister:
a) Guide and create conditions for associations and non-governmental organizations to participate in activities within the industry and field under the Bureau's management; organize the collection of opinions and absorption of proposals and critiques from associations and non-governmental organizations to improve regulatory management of the industry and field;
b) Recommend measures to address violations of the law by associations and non-governmental organizations operating within the industry and field;
17. Regarding organizational structure, staffing, and cadres and civil servants:
a) Draft the functions, tasks, authorities, and organizational structure of the Bureau; propose the establishment and restructuring of subordinate organizations under the Bureau;
b) Decide on the establishment of the Bureau's Working Group; specify detailed regulations on autonomy, organizational charters, and operations for state-run institutions under the Bureau in accordance with the law;
c) Submit to the Ministry the annual staffing plan of the Bureau; decide on the allocation of administrative staffing for agencies under the Bureau;
d) Decide on sending cadres, civil servants, and officials abroad for study and work according to the Ministry's cadre management classification;
e) Specify the authority and responsibilities of heads of organizations under the Bureau;
f) Decide and implement specific measures to strengthen administrative discipline; organize the implementation of anti-corruption, thrift, and anti-bureaucracy, arrogance, and favoritism in units under the Bureau;
g) Implement recruitment, utilization, transfer, retirement, salary systems, rewards, and other systems for cadres, civil servants, and officials under the Bureau's management in accordance with the law and the Ministry's classification; train and enhance professional skills according to the Minister's assignment;
h) Establish professional and vocational standards for civil servant and official ranks within the industry and field according to the Minister's assignment;
i) Report on the implementation of organizational and personnel work and staffing in accordance with the law;
18. Regarding inspection and supervision:
a) Guide and inspect the implementation of policies and laws concerning the industry and field under the Bureau's management in accordance with the law;
b) Resolve or participate in resolving complaints, reports, and suggestions from organizations and citizens related to the industry and field managed by the Bureau; organize citizen reception in accordance with the law;
c) Inspect and supervise the implementation of delegated management in the field under the Bureau's management and handle violations according to the law;
19. Regarding financial and asset management:
a) Submit to the Ministry the annual budget estimate and medium-term budget plan of the Bureau;
b) Be responsible for settling accounts for funds directly managed by the Bureau; manage and be responsible for state assets entrusted to the Bureau according to the Minister's classification and the law;
20. Perform standing committee tasks: New Rural Development, Central Highlands, Border Population Arrangement, Poverty Reduction Program; Programs 134, 135 as assigned by the Government; Opium Poppy Eradication and Substitution Program; Office of the Special Task Force on Resettlement of the Son La Hydropower Project;
21. Perform other tasks as stipulated by specialized laws and the Minister's assignment.
Article 3. Organizational Structure
1. Leadership of the General Department:
The leadership of the General Department includes the Director and Deputy Directors appointed and relieved from duty by the Minister of Agriculture and Rural Development in accordance with regulations.
The Director manages the operations of the General Department and is responsible to the Minister of Agriculture and Rural Development and to the law for the activities of the General Department.
Deputy Directors assist the Director in overseeing and directing certain aspects of work as assigned by the Director and are responsible to the Director for the tasks delegated to them.
2. Management Structure:
a) Department of Cooperative Economy and Farms;
b) Department of Rural Development;
c) Department of Planning and Population Arrangement;
d) Department of Planning and Finance;
đ) Office of the General Department;
e) Department of Inspection and Legal Affairs;
g) Permanent Unit in Ho Chi Minh City.
3. Public Service Units:
The Director of the General Department of Cooperative Economy and Rural Development shall develop a proposal to establish public service units under the General Department and submit it to the Minister for decision.
The Director of the General Department of Cooperative Economy and Rural Development shall define the functions and responsibilities of the management structure, appoint officials according to the classification of personnel management by the Ministry, and issue the Operating Regulations of the General Department.
Article 4. Effective date
This Decision takes effect fifteen days after its publication in the Official Gazette. Decree No. 96/2003/QĐ-BNN dated September 4, 2003, issued by the Minister of Agriculture and Rural Development regarding the functions, responsibilities, authorities, and organizational structure of the General Department of Cooperatives and Rural Development, and all previous provisions inconsistent with this Decision are hereby repealed.
Article 5. Responsibility for Implementation
The Director of the General Department of Cooperative Economy and Rural Development, the Head of the Ministry's Office, the Heads of Departments, the Directors of other General Departments, the Inspector General of the Ministry, and the Heads of relevant agencies and units under the Ministry are responsible for implementing this Decision./.
