Regulations on ensuring air operations for special aircraft flights

Pursuant to the Civil Aviation Law of Vietnam 2006;
Pursuant to the Law on Legislative Documents of 2008;
Pursuant to Decree No. 24/2009/NĐ-CP dated March 5, 2009 of the Government detailing and providing implementation measures for the Law on Enacting Legal Normative Documents;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 28, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 03/2009/NĐ-CP dated January 9, 2009, issued by the Government, on aircraft piloting and flight support for special missions;
The Minister of Transport hereby provides detailed regulations on ensuring air operations for special aircraft flights as follows:
Chapter I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular stipulates the organization, implementation, and assurance of special aircraft flights of Vietnam. In cases where there are requirements from authorized agencies as specified in Article 9 of Decree No. 03/2009/NĐ-CP dated January 9, 2009 of the Government on special aircraft flight assurance work, the provisions of this Circular shall also apply to special aircraft flights of foreign countries flying to, departing from, or within the airspace of Vietnam.
2. The objects subject to this Circular include organizations and individuals related to the organization and implementation of special mission flight support.
Article 2. Requirements for Vietnamese airlines performing special aircraft missions 1. Hold a valid aircraft operator certificate issued by the Civil Aviation Administration of Vietnam; have the capacity and scope of operation approved in the certificate that is suitable for the assigned special aircraft mission.
2. Have at least five years of commercial aircraft operation experience; implement safety management programs and reliability programs for aircraft operation and technical assurance in accordance with regulations, fully and comprehensively meeting aviation safety requirements.
c) No similar malfunctions occurring on the same equipment or system within three days of operation or seven consecutive flights without thorough rectification, or malfunctions permitted to be deferred according to the Minimum Equipment List (MEL) on critical systems of the aircraft, including propulsion systems, fire detection and extinguishing systems, hydraulic and aircraft control systems;
Chapter II
AIRCRAFT, CREW, AND PERSONNEL ON BOARD PERFORMING SPECIAL MISSION DUTIES
Article 3. Requirements for aircraft performing special mission duties
1. Registered with Vietnamese nationality and operated by an airline complying with the provisions of Article 2 of this Circular.
2. Belong to a type of aircraft with two or more engines.
3. Possess a valid airworthiness certificate.
4. At the time of performing special mission duties, must meet the following requirements:
a) Ensuring maintenance work for the aircraft and equipment installed on the aircraft according to the approved maintenance schedule;
b) Fully implementing all airworthiness directives applicable to that type of aircraft;
5. The aircraft body's operational time does not exceed two-thirds of its lifespan (life limit), if applicable, as defined by the manufacturer based on calendar time, flight hours, or takeoff and landing cycles.
d) Having all emergency and safety equipment in operational readiness.
3. No similar malfunctions occurring on the same equipment or system within three days of operation or seven consecutive flights without thorough rectification, or malfunctions permitted to be deferred according to the Minimum Equipment List (MEL) on critical systems of the engine such as control systems, fire detection and extinguishing systems, and engine performance parameter indicators.
6. Operation and maintenance records must be complete and clear at the time of preparing for the special mission flight.
7. Must have a configuration capable of meeting diplomatic ceremony requirements when requested.
8. Must have a minimum of two lie-flat seats or comfortable seats for rest for special mission passengers when the flight duration exceeds four hours.
9. Approved in writing by the General Director or Director of the Vietnamese airline for the aircraft to perform special mission duties.
Article 4. Requirements for engines installed on aircraft serving as special aircraft
1. Must be operated and maintained in accordance with operational manuals and maintenance programs approved by the Civil Aviation Administration of Vietnam.
2. Must have complete and clear operational and maintenance records or major overhaul history.
b) Accumulate a minimum total flight time of 4,000 hours for the captain and 2,000 hours for the co-pilot in cases where the average flight duration of the aircraft type exceeds two hours; 3,000 hours for the captain and 1,500 hours for the co-pilot in cases where the average flight duration of the aircraft type is less than two hours;
4. Must be authorized in writing by the General Director or the Director of a Vietnamese airline company to be used for aircraft serving as special aircraft.
Article 5. Pilot Standards for Special Aircraft
1. Must meet conditions appropriate to the type and nature of aircraft operations as prescribed.
2. For Vietnamese pilots:
a) Must possess professional expertise, piloting skills, and proficiency in English at level four (4) or higher according to International Civil Aviation Organization standards;
c) Accumulate a minimum total flight time of 500 hours on the aircraft type performing special aircraft missions, according to the permitted position; 300 hours in cases where the average flight duration of the aircraft type is less than two hours;
a) Have a labor contract with the airline performing special aircraft missions for a minimum of 24 months up to the selection date for serving special aircraft flights; in exceptional cases requiring the use of newly operated aircraft types in Vietnam for less than 24 months, personnel with a minimum contract period of three months may be used;
d) Must have good moral character, work style, sense of responsibility, and organizational discipline, with a clear record;
đ) Must not have committed any violations that threaten safety at or above the level of reprimand during the past twenty-four (24) months prior to undertaking special aircraft missions;
e) Must be authorized in writing by the General Director or the Director of a Vietnamese airline company to undertake special aircraft duties.
3. For foreign pilots:
d) Meet the special aircraft pilot standards as stipulated in Points b, c, d, đ, and e of Clause 1 of this Article;
b) Must hold a pilot license issued by the Civil Aviation Administration of Vietnam for the appropriate aircraft type and qualifications suitable for the anticipated special aircraft duties;
c) Must possess professional expertise, a sense of responsibility, and organizational discipline to successfully fulfill Vietnamese special aircraft duties;
1. Meet the safety cabin knowledge requirements as prescribed;
đ) Must perform special aircraft duties alongside Vietnamese pilots.
e) Must be authorized in writing by the General Director or the Director of a Vietnamese airline company to undertake special aircraft duties.
Article 6. Standards for Cabin Crew Serving on Special Aircraft
2. Hold Vietnamese nationality;
3. Accumulate a total of at least 700 hours of service experience;
4. Accumulate a total of at least 100 hours of service experience on the aircraft type performing special aircraft missions;
2. Hold a certification permit to complete maintenance level B1, B2, or C for the aircraft type they accompany to serve;
5. Possess good moral conduct, work style, sense of responsibility, organizational discipline awareness, and clear background.
6. Not have committed any disciplinary violations punishable by reprimand or higher within twelve months prior to the date of selection for special aircraft service.
7. Be authorized in writing by the General Director or Director of the Vietnamese airline to perform special aircraft duties.
Article 7. Standards for Technical Personnel Accompanying Special Aircraft
1. Be Vietnamese or foreign nationals, meeting the standards for aircraft technical personnel as prescribed.
3. Possess good moral character, conduct, sense of responsibility, organizational discipline awareness, and clear background;
4. Not have been disciplined with penalties ranging from reprimand or higher within twelve months prior to the selection date for serving special aircraft flights;
1. In addition to complying with the regulations on maintenance completion confirmation, authorized technical staff of Vietnamese airlines performing special aircraft missions must sign off on satisfactory technical preparation for the aircraft performing special aircraft missions in the special aircraft flight logbook.
5. Be authorized in writing by the General Director or Director of the Vietnamese airline to perform special aircraft duties.
Article 8. Confirmation of Technical Status of Special Aircraft
2. The technical staff referred to in Clause 1 of this Article can be Vietnamese or foreign nationals, appointed in writing by the General Director or Director of the Vietnamese airline to perform special aircraft missions.
1. Vietnamese airlines performing special aircraft missions establish, manage, and notify the Civil Aviation Administration of Vietnam in writing of the list of aircraft, engines installed on Vietnamese special aircraft, crew lists, and technical staff permitted to perform special aircraft missions in compliance with the requirements and standards set forth in Articles 3, 4, 5, 6, 7, and 8 of this Circular.
Article 9. Management of the List of Special Aircraft, Engines, and Crew Lists for Special Aircraft Duties
2. Vietnamese airlines performing special aircraft missions notify the relevant Air Traffic Control Authority in writing and by fax of the full list of non-crew personnel accompanying the aircraft to serve the special aircraft flight before boarding passengers.

Chapter III
AIRFIELD 2. The parking area and specific parking positions for special aircraft must be secured with protective walkways around them and other security and safety conditions for special aircraft; ensure security, safety, solemnity, and convenience for special aircraft welcoming and farewell ceremonies.
Article 10. Designated Area for Special Aircraft Flights
1. The airport operator must determine the parking area, aircraft parking position, and passenger terminal to serve special aircraft flights.
3. The airport operator determines the specific parking areas and positions, operating procedures for the parking areas at airports under their management, reports to the Civil Aviation Administration of Vietnam for approval, and updates the airport operation documentation.
The application for approval is sent to the Civil Aviation Administration of Vietnam either directly or through postal services. The Civil Aviation Administration has the responsibility to review and approve within three days from the date of receipt of the application and notify the airport operator. If disapproved, the reasons must be clearly stated.
The application for approval shall be submitted to the Civil Aviation Authority of Vietnam either directly in writing or via postal service. The Civil Aviation Authority of Vietnam shall be responsible for examining and approving within three days from the date of receipt of the application and notifying the airport operator. In case of disapproval, the reasons must be clearly stated.
4. The Civil Aviation Port Authority shall take the lead and coordinate with the airport operator and other air service providers at the airport to determine the area and procedures for serving cargo and baggage of the special aircraft delegation at the airport in a convenient, swift manner while ensuring relevant regulations on aviation security and safety.
Article 11. Runway, Taxiway, Aircraft Parking Area, and Equipment Systems Ensuring Flight Operations for Special Aircraft Flights
1. The airport operator must carry out runway inspection work for takeoff and landing strips, taxiways, and apron areas to ensure safe conditions for flights. Such inspections must be completed within thirty to forty-five minutes prior to the scheduled time of the special aircraft's takeoff or landing.
2. The airport operator shall establish a list, content, and conduct technical condition checks on primary and backup systems and equipment necessary for flight operations for the management enterprise. These inspections must be completed within ninety to one hundred eighty minutes before the scheduled time of the special aircraft's takeoff or landing.
3. The inspection work specified in Clause 1 and Clause 2 must be documented and stored at relevant units.
Article 12. Restrictions on Airport Operations During Special Aircraft Activities
1. For arrival flights: five minutes before the aircraft lands, the designated runway shall be reserved for the special aircraft; after the aircraft has landed and rolled past the handover point between the Control Tower and Ground Control, the designated taxiway and apron area shall be reserved for the special aircraft; the taxiway may only resume operation once the special aircraft has rolled into the designated apron area.
2. For departure flights: the special aircraft's parking position shall be protected and isolated from the moment it arrives at the location to prepare for the flight; five minutes before the aircraft rolls out of its parking position, the designated apron area, taxiway, and runway shall be reserved exclusively for the special aircraft; after the special aircraft has rolled to the takeoff holding point, the designated apron area may resume normal operations; after the special aircraft takes off, the taxiway and runway may resume normal operations; for airports with multiple runways, the runways not planned for the special aircraft's takeoff or landing may operate normally according to regulations governing parallel runway operations.
3. The airport operator is responsible for promptly notifying via radio communication and/or telephone individuals and vehicle operators currently operating in areas related to the special aircraft flight activities about operational restrictions at the airport during such activities.
4. When there is a notice of operational restrictions, individuals and vehicles not serving the special aircraft that are operating in areas related to the special aircraft flight activities must cease operations temporarily.
AIR TRAFFIC CONTROL ASSURANCE
Chapter IV
ENSURE FLIGHT OPERATIONS
Article 13. Air Traffic Information Notification
1. Vietnam Air Navigation Corporation is responsible for issuing NOTAMs regarding operational restrictions at civil aviation ports upon receiving notifications from the Civil Aviation Administration of Vietnam concerning special aircraft flight plans and any amendments thereto.
2. If the actual takeoff or landing time of the special aircraft differs from the planned time in the air traffic control flight plan by more than five minutes, the following actions shall be taken:
a) For arrival flights: the regional air navigation company shall notify the Civil Aviation Port Authority, the airport operator, and the relevant airline;
b) For departure flights: the airline shall notify the airport operator; the airport operator shall notify the Civil Aviation Port Authority, the regional air navigation company, and the air traffic information center;
c) Relevant units shall implement support services for special aircraft according to their functions and tasks based on the adjusted plan.
Article 14. Standards for Air Traffic Controllers
1. Meeting general standards prescribed for air traffic controllers.
2. Possessing professional skills and experience in handling unexpected situations during flight operations.
3. There shall be continuous air traffic control operations at air traffic service facilities for at least five years.
4. Demonstrating good moral character, work style, sense of responsibility, organizational discipline, and clear background.
5. Not having committed any violations that threaten flight safety within twelve months prior to performing special aircraft duties.
6. The air traffic controller assigned to serve the special aircraft shall be authorized in writing by the head of the air navigation company, the head of the airport, or the relevant airport to perform such duties.
Article 15. Separation between state aircraft and other aircraft
1. Within the airport area: The separation between special aircraft and other aircraft on the ground within the operational area must comply with the limitations set forth in Article 12 of this Circular.
2. In the approach control area, the method of overtaking state aircraft on the same flight path shall not be applied. The minimum separation value between state aircraft and other aircraft in the approach control area shall be applied as follows:
a) Radar separation: 10 nautical miles;
b) Other forms of separation shall be applied according to the standard.
3. In the en-route control area:
a) Minimize changes in the cruise altitude and direction of special aircraft compared to the planned flight path;
b) Do not request changes in the speed of special aircraft;
c) The minimum separation value between state aircraft and other aircraft in the en route control area shall be applied as follows: for radar separation: 20 NM; other forms of separation shall be applied according to standards.
4. The separation between state aircraft shall be applied similarly to the separation between state aircraft and other aircraft.
Article 16. Management of the List of Non-Pilot Air Traffic Controllers for Special Aircraft Flights
Vietnam Air Traffic Management Corporation, Regional Civil Aviation Airport Corporation shall establish and manage the list of air traffic controllers permitted to operate state aircraft flights.
Article 17. Priority Principles in Air Traffic Control for Special Aircraft Flights When Multiple Aircraft Are Operating Simultaneously
1. Upon takeoff: state aircraft performing duties have the right of priority to take off after combat aircraft.
2. During landing: the special aircraft has the right to land after emergency landing aircraft and aircraft with insufficient fuel to perform holding or safe alternate airport operations.
Chapter V
AIRPORT SECURITY
Article 18. Cards and permits for security control serving state aircraft
1. Cards and permits for security control serving state aircraft (hereinafter referred to as cards and permits) include:
a) A multi-use card is a multi-use security control card with a special area for state aircraft displayed in red, issued to personnel regularly serving state aircraft flights, including: those responsible for directing, inspecting, supervising the work of ensuring and serving state aircraft flights; those regularly working in the VIP terminal; those regularly serving passengers of state aircraft flights; airline staff regularly serving state aircraft.
b) A single-use security control card valid for each flight is issued to: aviation personnel directly preparing state aircraft flights; aviation security personnel assigned to directly guard, protect, and conduct security checks for state aircraft flights; personnel serving passengers of state aircraft flights.
c) A multi-use permit is a multi-use security control permit issued to aircraft operating in the airport area directly serving state aircraft flights.
d) A single-use security control permit is issued to aircraft and equipment directly serving state aircraft flights and passengers of state aircraft flights.
2. Only equipment with a security control permit for state aircraft and individuals with a security control card for state aircraft may enter the parking position of state aircraft and the VIP terminal area and be subject to inspection and supervision by aviation security personnel. The card must be worn on the chest (individuals on equipment with permits must also wear the card), and the permit must be placed in front of the driver's view throughout the time in the area serving state aircraft.
3. The Civil Aviation Administration of Vietnam implements the issuance of sample cards and permits; issues and manages multi-use cards; guides regional civil aviation authorities in issuing and managing single-use cards and multi-use permits.
4. Heads of units participating in serving state aircraft flights register lists of regular service personnel with the Civil Aviation Administration of Vietnam to obtain multi-use cards, specifying the regular tasks of the person requesting the card and the number of multi-use security control cards. If a multi-use security control card has not been issued, they must submit an application for a multi-use security control card according to the provisions of the Civil Aviation Security Program. The Civil Aviation Administration of Vietnam will issue the card within five days from the date of receipt of the list or notify non-issuance without stating the reason.
5. Heads of units managing equipment operating in the airport area directly serving state aircraft flights register lists of equipment with the Civil Aviation Administration of Vietnam to obtain multi-use permits, specifying the function of the equipment for state aircraft flights. The Civil Aviation Administration of Vietnam will issue the permit within five days from the date of receipt of the list or notify non-issuance without stating the reason.
6. Heads or authorized persons of units participating in serving state aircraft flights register with the regional civil aviation authority lists of individuals and equipment requesting single-use cards and permits, presenting their security control cards or identification documents, signing the record book for card and permit issuance. After completing the service work, the person who signed for the card is responsible for recovering and returning the issued cards and permits to the regional civil aviation authority, confirming full return of the cards and permits.
7. Heads or authorized persons of units responsible for welcoming/greeting passengers of state aircraft flights register with the regional civil aviation authority lists of individuals and equipment requesting single-use cards and permits, submitting identification documents of the person requesting the card, signing the record book for card and permit issuance. After completing the work, the person who signed for the card is responsible for recovering and returning the issued cards and permits to the regional civil aviation authority, confirming full return of the cards and permits and reclaiming submitted identification documents.
8. The location for issuing single-use cards and permits must be outside the area serving state aircraft. The regional civil aviation authority shall coordinate with the airport operator regarding the specific location and time for issuance suitable for each airport. Signatures of those registering to receive cards and permits as stipulated in Clauses 5 and 6 of this Article must be registered with the regional civil aviation authority beforehand. Issuance and recovery of cards and permits must be recorded and retained in the card issuance record book by the issuing authority, including: name of the person receiving the card, place of work, task performed, card number, signature for receipt and return.
9. In addition to the provisions of this Circular, the issuance of cards and permits must comply with and adhere to the regulations in the Civil Aviation Security Program and the Coordination Regulations between the General Staff of Guard and the Civil Aviation Administration of Vietnam.
10. For senior Party and State officials, and foreign diplomatic representatives receiving and seeing off the subjects served by the special aircraft flight and directly serving those subjects, security screening and issuance of security access cards and permits shall be exempted, but aviation security supervision shall still be carried out.
Article 19. Ensuring Security and Public Order at Airports when Special Aircraft Flights are Conducted
1. Aviation security forces shall cooperate with local police to establish checkpoints for controlling entry and exit routes at airports with appropriate personnel and equipment; organize control and maintain public order in the public areas of the airport throughout the preparation and service of the special aircraft; detect, prevent, and promptly handle actions that threaten the security and safety of the special aircraft flight.
2. The airport operator shall allocate sufficient security personnel and equipment to monitor and control the movement of people and vehicles entering and exiting, and activities within the special aircraft service area; luggage and cargo when brought into the special aircraft service area; prevent, detect, and stop actions that threaten the security and safety of the special aircraft flight.
Article 20. Ensuring security for meals served to special aircraft passengers
1. Food processing enterprises shall be responsible for ensuring food safety for meals served on special aircraft flights departing from Vietnam; seal and retain meal samples for special aircraft passengers for at least 24 hours, starting from the time the meals are loaded onto the special aircraft.
2. Airport operators' aviation security forces shall be responsible for coordinating with airlines conducting special aircraft flights and food processing enterprises to visually inspect meals for special aircraft flights departing from Vietnam before loading them into the meal storage compartments of the aircraft, sealing the meal storage compartments securely, and arranging aviation security personnel to escort the meals from the processing facility to the aircraft.
3. Airlines operating special aircraft flights shall coordinate with the Command of Security Guard to conduct appropriate security checks on meals for special aircraft flights when abroad.
4. The flight crew may only accept sealed security storage compartments containing meals for special aircraft passengers onboard the aircraft.
Article 21. Quality of fuel for special aircraft
1. The airline shall inspect and supervise the assurance of fuel quality for special aircraft in accordance with regulations.
2. Fuel must have a Certificate of Fuel Quality Inspection before being loaded onto special aircraft.
3. Remaining fuel on the aircraft must be checked for quality according to aircraft maintenance guidelines; fuel not meeting requirements must be removed from the aircraft, and the fuel tank must be cleaned before refueling.
4. Security checks for fuel transport vehicles and their drivers before entering the operational area in Vietnam:
a) In cases where fuel delivery trucks pass through public areas to refuel the special aircraft, they must be accompanied by security personnel from the fueling unit.
b) Airport operators' security personnel must check the entire fuel truck and seals on the fuel tank before entering restricted areas.
c) The fueling unit must assign skilled and morally upright personnel to operate the vehicle and perform the fueling tasks; strictly follow the procedures for checking the fuel truck and fueling equipment before performing the fueling operation.
c) For state flights at Vietnam
a) Refueling of the aircraft in Vietnam shall be conducted under direct supervision of the Supervision Team consisting of representatives from the port authority, the technical preparation team for the special aircraft, the airport operator, and the fueling unit; a record of the refueling process shall be made by a representative of the port authority.
b) Refueling of the aircraft abroad shall be conducted under direct supervision of the Supervision Team consisting of representatives from the technical preparation team for the special aircraft and the Security Command.
c) The Supervision Team shall be responsible for: verifying the legality of the Fuel Quality Inspection Certificate; checking the seals on the fuel truck's fuel intake and exhaust ports; supervising the entire refueling process; in Vietnam, also supervising the sampling and sealing of fuel samples after refueling.
d) In Vietnam, the Fuel Quality Inspection Certificate must be signed and confirmed by the head or authorized representative of the fuel supply unit or the person in charge of the testing laboratory according to the TCVN ISO/IEC 17025 standard.
6. Sampling, storing fuel samples, and fuel quality inspection certificates in Vietnam:
a) Before refueling, samples of remaining fuel on the aircraft and fuel in the fuel truck must be taken, sealed, and retained; containers used for sample retention must have a minimum capacity of 01 liter and be made of material that does not alter the characteristics of the fuel.
b) Each sample must clearly indicate: aircraft number being fueled, fueling vehicle number, sampling time, sampler's name, sealing date, sealer's name and signature.
c) The Fuel Quality Inspection Certificate and special aircraft fuel samples must be stored at the fuel supply unit and the airport operator until the special aircraft safely lands at its destination airport.
7. For foreign special aircraft, implement the provisions of this Article and other requirements of the aircraft operator.
Article 22. Security Assurance for State Aircraft Flights
1. The airport operator shall arrange security personnel to guard, supervise, and protect the special aircraft from the time it is parked in the preparation position until the end of the special aircraft service operations.
2. In cases where the special aircraft is parked overnight, the airline must seal the aircraft doors and hand over to the airport operator's security personnel; the parking area must have adequate lighting and be guarded or monitored by cameras to detect and prevent unauthorized access to the aircraft. Stairs, airstairs, conveyor belts, and other service equipment must be removed from the aircraft.
3. Security inspection and supervision of the aircraft, passengers, baggage, and cargo of the special aircraft flight, and ensuring aviation security during the flight shall be carried out in accordance with the provisions of the Civil Aviation Security Program and the Memorandum of Understanding between the Security Command and the Civil Aviation Administration of Vietnam on special aircraft security inspections.
Clause 4. Air security inspection and monitoring of items served on state aircraft:
a) Items to be served on board the aircraft must undergo aviation security screening using X-ray machines or visual inspection and continuous security monitoring until they are loaded onto the aircraft.
b) Items to be served on board the aircraft when being loaded onto or unloaded from the aircraft must be subject to security checks and verified for quantity and type.
c) Objects serving on aircraft conducting regular domestic flights in Vietnam that have been subject to security checks may remain on the aircraft for state aircraft flights without having to be removed for another security check.
Article 23. Security Assurance for Foreign State Aircraft Flights
1. The airport operator is responsible for conducting a security check on all persons, baggage, cargo, and items belonging to the state delegation at the airport; coordinating with the security of the state delegation to escort checked baggage and cargo from the security checkpoint to the state aircraft.
2. For separate state aircraft flights, if there is a diplomatic note from a foreign country notifying Vietnam or if the Ministry of Foreign Affairs requests in writing not to conduct aviation security checks, the Civil Aviation Administration of Vietnam shall issue a document requesting the airport operator to implement the content of the diplomatic note or request according to the requirements for persons, baggage, and cargo of the state delegation.
3. The airport operator is responsible for coordinating with relevant agencies of the Ministry of Foreign Affairs and the General Guard Command to implement enhanced security measures for state aircraft, passengers, baggage, and cargo of foreign delegations in the airport area when required by competent authorities or agreed upon with foreign diplomatic missions.
Article 24. Management of Lists of Security Personnel and Aircraft Servicing Staff for Special Aircraft Flights in Vietnam
The Regional Airport Corporation establishes and manages a list of aviation security staff and service personnel at the VIP lounge.
Chapter VI
RESPONSIBILITIES FOR GUARANTEEING SPECIAL AIRCRAFT FLIGHTS
Article 25. Responsibilities of the Civil Aviation Authority of Vietnam
1. Receiving and implementing tasks to ensure state aircraft flights conducted by Vietnamese airlines, foreign state aircraft flights, and related changes to the flight plan for state aircraft to the following agencies and units:
a) Civil Aviation Port Authorities;
b) Vietnam Air Traffic Control Corporation;
c) The Regional Airport Corporation where the state aircraft takes off or lands.
2. Coordinating to uniformly implement the flight plan for state aircraft with the airline assigned to carry out the state aircraft flight and supervising the implementation of the plan.
3. Organizing supervision of the implementation of security and safety measures for state aircraft flights; urging and monitoring the preparation work for state aircraft flights, and handling abnormal situations during the execution of state aircraft tasks.
4. Implementing the issuance of permits for state aircraft flights within its authority; coordinating and supporting Vietnamese airlines in obtaining permits for foreign state aircraft flights.
Article 26. Responsibilities of Regional Civil Aviation Authorities
1. Receive special aircraft tasks from the Civil Aviation Authority of Vietnam.
2. Organize the implementation of special aircraft tasks to state management agencies operating at airports; coordinate with relevant agencies and organizations to execute special aircraft guaranteeing tasks.
3. Directly supervising the implementation of state aircraft tasks, compliance with technical standards, security, and safety measures for state aircraft flights by organizations and individuals at airports under their management responsibility.
Article 27. Responsibilities of the airport operator where state aircraft take off and land
1. Taking the lead in coordinating to ensure security for state aircraft, state passengers, and baggage and cargo of the state delegation within the airport area;
2. Arranging separate parking areas and security forces to guard state aircraft and taking the lead in coordinating the guarding of state aircraft;
3. Creating favorable conditions for departments preparing and servicing state aircraft to ensure the schedule for takeoff and landing of state aircraft;
4. Coordinating the organization of appropriate welcoming and farewell ceremonies suitable for the nature of state aircraft tasks, meeting the requirements of competent authorities.
5. For foreign state aircraft flights: The airport coordinates with relevant agencies of the Ministry of Foreign Affairs and the Ministry of Public Security to provide enhanced security for foreign state aircraft and passengers in the Vietnamese airport area when requested by the foreign side.
Article 28. Responsibilities of Vietnamese airlines assigned the task of charter flights
1. Receiving and implementing tasks to ensure the charter flight
2. Establishing plans for serving charter flights including: identifying aircraft for charter flight duties, backup aircraft, flight routes, lists of countries requesting permission to fly through, land in, entry and exit points of these countries, details related to operation and technical assurance, reporting to the Civil Aviation Administration after completing preparation work and any changes that occur.
3. Applying for permission for domestic Vietnamese charter flights conducted by the airline in accordance with current regulations. Coordinating with the Consular Department of the Ministry of Foreign Affairs to apply for permission for international Vietnamese charter flights.
4. Leading coordination with relevant units to ensure safety, security, and takeoff and landing schedules for Vietnamese charter aircraft throughout the mission; closely coordinating with the Central Party Office, National Assembly Office, State President's Office, Government Office, State Reception Agency, and advance teams to develop service plans at foreign airports.
5. Establishing service procedures, seating arrangements, and selection of passengers when serving charter guests alongside regular passengers, notifying the Central Party Office, National Assembly Office, State President's Office, Government Office, State Reception Agency, Civil Aviation Administration, and organizing implementation.
6. Leading coordination with relevant units to serve charter guests thoroughly and safely, meeting the requirements of authorized agencies. Leading guidance and maintaining order to ensure security on charter aircraft when there are attendants and other individuals flying with the charter guest.
7. Coordinating to ensure safety and security for goods, luggage, documents, and property of the charter guest group.
8. Coordinating with the Security Guard Command to ensure security for charter aircraft, charter guests, luggage, and goods of the charter guest group abroad.
9. For combined charter and commercial transport flights, Vietnamese airlines are responsible for coordinating with relevant agencies and units to implement effective measures to minimize risks of compromising the security and safety of charter guests; not transporting special passengers as required by aviation security regulations on combined charter and commercial transport flights.
Article 29. Responsibilities of Enterprises Providing Services to Ensure Flight Operations
1. Coordinate with the air traffic control agency and military airspace management agency to manage air traffic.
2. Coordinate the implementation of regulations regarding restricted operations at airports.
3. Ensure separation between official aircraft and other aircraft, flight corridors, and communication methods during the management of official aircraft flights.
4. Ensure continuous operation of air traffic control equipment throughout the management of official aircraft flights.
5. Be prepared to handle abnormal situations.
Article 30. Management of files for the execution of special aircraft missions
Agencies and units participating in charter tasks are responsible for recording and storing all details of handover, preparation, implementation, and handling of incidents related to charter tasks according to storage regulations and state requirements.
Chapter VII
IMPLEMENTING PROVISIONS
Article 31. Effective Date
This Circular takes effect 45 days from the date of signature and revokes Decision No. 02/2004/QĐ-BGTVT dated February 23, 2004, issued by the Minister of Transport on the issuance of the Civil Air Charter Regulations.
Article 32. Responsibility for Implementation
The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular.
