CIRCULAR

Regulations on importation under tariff quotas for the years 2016 and 2017 with a preferential special import tax rate of 0% for goods originating from Cambodia

pursuant to the Memorandum of Understanding on promoting bilateral trade between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on October 26, 2016;

The Minister of Industry and Trade issues this Circular regulating the importation under tariff quotas for the years 2016 and 2017 with a preferential special import tax rate of 0% for goods originating from Cambodia.  

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to||| The Agreement Apply tariff quotas for the importation with a preferential special import tax rate of 0% for two groups of goods originating from Cambodia: rice and dried tobacco leaves.

At the proposal of the Director of the Import-Export Department,

Article 2. Goods and quantities of tariff quota imports for the years 2016 and 2017

Article 1. Scope of Regulation

1. The commodity codes and total quantities of tariff quotas for the groups of goods benefiting from a preferential special import tax rate of 0% are listed in Appendix No. 01 attached to this Circular.

2. The tariff quota for importation in 2016 specified in Clause 1 of this Article shall apply to declarations submitted to customs authorities from October 26, 2016 to December 31, 2016.

3. The tariff quota for importation in 2017 specified in Clause 1 of this Article shall apply to declarations submitted to customs authorities from January 1, 2017 to December 31, 2017.

Article 3. Import tax rates

The import tax rates within and outside the tariff quotas for rice and dried tobacco leaves originating from Cambodia shall be implemented according to the regulations of the Government.

Article 4. Conditions for enjoying the preferential special import tax rate of 0% within the tariff quota

Imported goods must have a Certificate of Origin in Form S (C/O form S) issued by the Ministry of Commerce of the Kingdom of Cambodia or authorized agencies as prescribed and cleared through the border gates listed in Appendix No. 02 attached to this Circular.

Specifically, for dried tobacco leaves, Vietnamese traders must hold an import license for tobacco raw materials under the tariff quota issued by the Ministry of Industry and Trade according to Circular No. 04/2014/TT-BCT dated January 27, 2014 of the Ministry of Industry and Trade detailing the implementation of certain provisions of Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries. The quantity imported will be deducted from the tariff quota for importation as per the license issued by the Ministry of Industry and Trade.

Article 4. Import procedures

Import procedures for rice and dried tobacco leaves shall be handled at the customs office where the import declaration is made, following the principle of automatic retroactive deduction until the end of the quantity of the tariff quota for each item specified in Appendix 1 attached to this Circular.

This Circular takes effect from January 18, 2017 to December 31, 2017./.

The import procedures for rice and dried tobacco leaves shall be processed at the customs checkpoint where the import formalities for goods are handled, following the automatic retroactive principle until the quota volume of import tariffs for each item specified in Appendix 1 attached to this Circular is exhausted.

Article 5. Effective Date

This Circular takes effect from January 18, 2017 to December 31, 2017./.
