CIRCULAR

when violating management and operation of operating thecompetitive power generation market

 

Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Electricity Law dated December 3, 2004; and the Law Amending and Supplementing Certain Provisions of the Electricity Law dated November 20, 2012;

Pursuant to Decision No. 63/2013/QĐ-TTg dated November 8, 2013 of the Prime Minister on the roadmap, conditions, and industry structure for forming and developing various levels of electricity markets in Vietnam;

At the proposal of the Director of the Electricity Regulatory Authority;

The Minister of Industry and Trade issues this Circular on the operation of the competitive power generation market.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the operation of the competitive power generation market (hereinafter referred to as the electricity market) and the responsibilities of entities participating in the electricity market.

Article 2. Applicability

This Circular applies to the following entities participating in the electricity market:

1. The sole bulk buyer entity.

2. Power generation units.

3. System operator and electricity market operator.

4. Transmission system operator.

5. Metering data management entity.

6. Vietnam Electricity Corporation.

Article 3. Explanation of Terms

Strategic multi-purpose hydropower plant

1. Bid sheet is the bid sheet submitted by the bidding entity to the System Operator and Electricity Market Operator for each generating unit to sell power onto the electricity market according to the bid sheet model prescribed in this Circular.

2. Mandatory bid sheet is the bid sheet established and used by the System Operator and Electricity Market Operator to prepare the next day's and hour's dispatch schedule during the period when hydropower plants violate the water level limit for two consecutive weeks.

3. Dispatch bid sheet is the bid sheet accepted by the System Operator and Electricity Market Operator to prepare the next day's and hour's dispatch schedule.

4. Default bid sheet is the bid sheet used by the System Operator and Electricity Market Operator to prepare the next day's and hour's dispatch schedule in case of not receiving a valid bid sheet from the Power Generation Unit.

5. Settlement statement is the calculation statement of payments for direct participating power plants prepared by the System Operator and Electricity Market Operator for each trading day and each settlement cycle.

6. Market intervention is the action to change the normal operation mode of the electricity market that the System Operator and Electricity Market Operator must apply to handle situations as prescribed in Clause 1, Article 61 of this Circular.

7. Trading cycle is the one-hour period starting from the first minute of each hour.

8. Settlement cycle is the cycle for issuing invoices for transactions on the electricity market within one month, starting from the first day of each month.

9. Published capacity is the maximum available capacity of the generating unit announced by the bidding entity or the System Operator and Electricity Market Operator and the Power Generation Unit in the service contract for ancillary services according to the market operation schedule.

10. Dispatched capacity is the actual capacity of the generating unit dispatched by the System Operator and Electricity Market Operator during the trading cycle.

11. Next hour dispatch capacity is the anticipated capacity of the generating unit scheduled to be dispatched for the first hour in the next hour's dispatch schedule.

12. Next day dispatch capacity is the anticipated capacity of the generating unit scheduled to be dispatched for each trading cycle in the next day's dispatch schedule based on the constrained dispatch result.

13. Additional generation capacity is the difference between the dispatched capacity and the capacity scheduled in the market price dispatch schedule of the generating unit.

14. Capacity payment is the capacity of the unit within the hourly capacity schedule and is paid the market capacity price.

15. Ancillary services are frequency regulation services, spinning reserve, fast-start reserve, forced generation due to system security constraints, voltage adjustment, and black start.

16. Additional generation is the amount of power generated by the generating unit due to being dispatched corresponding to the additional generation capacity.

17. Bidding entity is the entity directly submitting bid sheets in the electricity market, including power generation units or power plants registered for direct bidding and representative entities bidding for cascaded hydropower plants.

18. Sole bulk buyer entity is the entity purchasing all electricity through the electricity market and power purchase contracts.

19. Power Generation Unit is the entity owning one or more power plants participating in the electricity market and signing power purchase contracts with the Sole Bulk Buyer Entity for these power plants.

20. Indirectly trading power generation entity is a power generation entity with power plants participating in the electricity market but does not directly submit bids in the electricity market.

21. Directly trading power generation entity is a power generation entity with power plants participating in the electricity market that directly submits bids in the electricity market.

22. Metering data management entity is the entity providing, installing, managing, and operating the system for collecting, processing, storing metering data and communication networks serving the electricity market.

23. Transmission electricity unit is the power company licensed to operate in the transmission sector, responsible for managing and operating the national transmission grid.

24. System Operator and Market Operator is the entity commanding and controlling the power generation, transmission, and distribution processes in the national power system, managing electricity market transactions.

25. Market-based capacity price is the price per unit of effective capacity for each trading cycle, applied to calculate capacity payments for power generation entities in the electricity market.

26. Minimum bid price is the lowest price allowed for a generating unit in the next day's bid sheet submitted by the bidding entity.

27. Market electricity price is the price per unit of electricity for each trading cycle, applied to calculate electricity payments for power generation entities in the electricity market.

28. Full market electricity price is the total of the market electricity price and the market capacity price for each trading cycle.

29. Maximum bid price is the highest price allowed for a generating unit in the next day's bid sheet submitted by the bidding entity.

30. Maximum market electricity price is the highest market electricity price determined annually.

31. Water value is the expected marginal price calculated for the volume of water stored in hydropower reservoirs when used to generate electricity instead of thermal power plants in the future, converted for each unit of electric energy.

32.  Efficiency decay factor is the index indicating the decline in efficiency of the generating units over time.

33. Annual or monthly average load factor is the ratio between the total amount of electrical energy generated in one year or one month and the product of total installed capacity with the total number of hours used to calculate the load factor for that year or month.

34. Electricity market information system is the set of equipment and databases serving the management and exchange of electricity market information managed by the System Operator and Market Operator.

35. a) Civil contract, applicable for electricity purchases for household purposes, implemented in accordance with the Civil Code. The model contract is defined by the Ministry of Industry; Standard electricity purchase and sale agreement

36. Non-standard electricity purchase and sale agreement is the electricity purchase and sale agreement signed between the sole wholesale buyer and the power generation units directly trading according to the model issued by the Ministry of Industry and Trade.

37. Constrained scheduling is the arrangement of the sequence of dispatching generating units using the minimum cost method for purchasing electricity while considering technical constraints in the power system.

38. Unconstrained scheduling is the arrangement of the sequence of dispatching generating units using the minimum cost method for purchasing electricity without considering constraints in the power system.

39. Capacity schedule is the schedule established by the System Operator and Market Operator after operation to determine the quantity of capacity to be settled in each trading cycle.

40. Next hour dispatch schedule is the anticipated dispatch schedule of the generating units to produce electricity and provide ancillary services for the upcoming trading cycle and the next three consecutive cycles, established by the System Operator and Market Operator.

41. Next day dispatch schedule is the anticipated dispatch schedule of the generating units to produce electricity and provide ancillary services for the trading cycles of the upcoming trading day, established by the System Operator and Market Operator.

42. Market electricity price calculation schedule is the schedule established by the System Operator and Market Operator after the current trading day to determine the market electricity price for each trading cycle.

43. Electricity market simulation model is the system of software simulating the dispatch of generating units and calculating the market electricity price used by the System Operator and Market Operator in annual, monthly, and weekly operational planning.

44. Water value calculation model is the system of software optimizing hydrothermal power to calculate the value of water used by the System Operator and Market Operator in annual, monthly, and weekly operational planning.

45. Limit water level is the lowest upstream water level of the hydropower reservoir at the end of each month in a year or at the end of each week in a month, calculated and announced by the System Operator and Market Operator according to the Process for Implementing Medium and Short-Term Power System Security Assessment issued by the Electricity Regulatory Authority guiding the Implementation Regulation on the Transmission System issued by the Ministry of Industry and Trade.

46. Optimal water level is the upstream water level of the hydropower reservoir at the end of each month or each week, ensuring the most efficient use of water for power generation purposes and meeting all binding requirements, calculated and announced by the System Operator and Market Operator.

47. Year N Current operational year of the electricity market, counted according to the Gregorian calendar year.

48. Day D is the current trading day.

49. Trading day is the day during which market electricity trading activities take place, from 00:00 to 24:00 daily.

50. BOT power plant is a power plant invested under the Build-Operate-Transfer model through a contract between the investor and the competent state authority.

51. Best new power plant is the newly commissioned thermal power plant with the lowest calculated average generation cost for the next year and the agreed upon contract electricity purchase and sale price based on the standard power plant generation price framework issued by the Ministry of Industry and Trade. The best new power plant is selected annually for use in calculating the market capacity price.

52. Strategic multi-purpose hydropower plant is a hydropower plant included in the list of large power plants with special significance for economic and social development, national defense, and security approved by the Prime Minister, or part of the list of hydropower plants operating in coordination with large power plants with special significance for economic and social development, national defense, and security approved by the Ministry of Industry and Trade.

53. Cascade hydropower plant group is a collection of hydropower plants where the outflow from the reservoir of the upper cascade hydropower plant constitutes the entirety or a significant portion of the inflow to the reservoir of the lower cascade hydropower plant, and there is no large regulating reservoir between these two power plants larger than one week.

54. Scheduling software is a software system used by the System Operator and Electricity Market to schedule the next day and hour dispatch for generating units in the electricity market.

55. System load is the total converted electricity output of all generating units in the entire power system and imported electricity within a trading cycle, minus the output of power plants with installed capacity not exceeding 30 MW that do not participate in the electricity market and the output of cascade hydropower plants on the same river belonging to a power generation unit with installed capacity not exceeding 60 MW (meeting the applicable avoided cost tariff standard).

56. Measured output is the amount of electrical energy measured at the metering point of the power plant.

57. Hourly contract output is the allocated electricity output for each trading cycle and is paid according to the difference purchase and sale electricity contract.

58. Annual contract output is the annual committed electricity output under the difference purchase and sale electricity contract.

59. Monthly contract output is the monthly allocation from the annual contract output.

60. Planned annual output is the anticipated electricity output of the power plant to be dispatched in the upcoming year.

61. Planned monthly output is the anticipated electricity output of the power plant to be dispatched in each month of the upcoming year.

62. Heat rate is the amount of heat energy (or fuel quantity) consumed by a generating unit or power plant to produce one unit of electrical energy.

63. Forced generation payment is the payment received by the Power Generation Unit for additional generated electricity.

64. Market participant are entities participating in trading activities or providing services in the electricity market as stipulated in Article 2 of this Circular.

65. Month M is the current month of electricity market operation, calculated according to the Gregorian calendar month.

66. Capacity shortage is the situation where the total announced capacity of all Power Generation Units is less than the forecasted system load demand in a trading cycle.

67. Confidential information includes classified information as prescribed by law and other information agreed upon by mutual confidentiality agreements between parties.

68. Market information encompasses all data and information related to market operations.

69. End time for bidding is the time after which Power Generation Units are not permitted to change their next-day bid, except in special cases as provided for in this Circular. In the electricity market, the end time for bidding is 11:30 on day D-1.

70. Dispatch order is the result of arranging the bid capacity bands according to price from low to high, taking into account system constraints.

71. Excess capacity is the situation where the total capacity offered at the floor price by directly trading Power Generation Units and the planned dispatch capacity of power plants belonging to indirectly trading Power Generation Units announced by the System Operator and Electricity Market in a trading cycle exceeds the forecasted system load.

72. Total hours for annual load factor calculation is the total number of hours in year N for generating units that have been in commercial operation since year N-1 or earlier, or the total number of hours from the start of commercial operation of the generating unit until the end of year N, excluding approved maintenance time for the generating unit in year N.

73. Total hours for monthly load factor calculation is the total number of hours in month M for generating units that have been in commercial operation since month M-1 or earlier, or the total number of hours from the start of commercial operation of the generating unit until the end of month M, excluding approved maintenance time for the generating unit in month M.

74. Slow-start generating unit is a generating unit that cannot start up and synchronize to the grid within less than 30 minutes.

75. Week T is the current week of electricity market operation.

76. Metering location is the location of the electrical energy metering system to determine the electricity output for settlement between the Power Generation Unit and the sole Bulk Purchaser as specified in Circular No. 27/2009/TT-BCT dated September 27, 2009, issued by the Minister of Industry and Trade on metering electrical energy in competitive power generation markets and under the purchase and sale electricity contract between the Power Generation Unit and the sole Bulk Purchaser.

Chapter II
APPLICATION FOR PARTICIPATION IN THE ELECTRICITY MARKET

Article 4. Obligation to Participate in the Electricity Market

1. Power plants with an installed capacity greater than 30 MW, holding a license for electricity operation in the power generation sector, and connected to the national power grid, except those specified in Clause 3 of this Article, shall be obligated to participate in the electricity market no later than 30 days from the date of commercial operation of the power plant.

2. Power plants with an installed capacity up to 30 MW, connected to the power grid at voltage levels of 110 kV or higher, except those specified in Clause 3 of this Article, have the right to choose to participate in the electricity market. In case they choose to participate in the electricity market, the power plants shall be responsible for:

a) Preparing infrastructure in accordance with Clause 5 of this Article;
b) Completing and submitting registration documents to participate in the electricity market in accordance with Article 5 of this Circular;
c) Adhering to requirements for power generation units participating in the electricity market as stipulated in this Circular and relevant regulatory legal documents.

3. Power plants not participating in the electricity market include:

a) BOT power plants;
b) Renewable energy power plants other than hydropower;
c) Gas turbine power plants with constraints requiring the maximum use of gas fuel to ensure national interests;
d) Power plants within industrial zones that only sell part of their production to the national power grid.

4. Before November 1st of year N-1, the System Operator and Electricity Market Operator shall be responsible for compiling and reporting to the Electricity Regulatory Authority a list of direct trading power generation units, indirect trading power generation units, and power generation units not participating in the electricity market as specified in Clause 3 of this Article for year N to be announced to market participants.

5. Power plants participating in the electricity market shall be responsible for investing and completing systems and equipment to connect to the Electricity Market Information System (including: Bidding System, Dispatch Management System (DIM), Market Settlement Support System, Internal Market Information Network System), SCADA/EMS system, and electricity metering system before the date of commercial operation of the power plant to meet the operational requirements of the power system and the electricity market.

6. The sole bulk buyer shall be responsible for sending to the System Operator and Electricity Market Operator a document regarding the date of commercial operation of the power plant agreed upon with the power generation unit.

7. Before the 20th day of month M when there is a plan to put the power plant into commercial operation in month M+1, the power generation unit shall be responsible for sending necessary information (technical specifications, electricity prices...) to the System Operator and Electricity Market Operator to calculate the next month's and subsequent months' operational plans in year N.

8. In cases where a power plant meets the conditions but has not participated in the electricity market as stipulated in Clause 1 of this Article or a power plant has been suspended from participating in the electricity market as stipulated in Article 8 of this Circular:

a) The System Operator and Electricity Market Operator shall be responsible for mobilizing the power plant only in the following situations:
- Ensuring downstream water levels according to the inter-reservoir operation procedures and single-reservoir operation procedures or as required by competent authorities (for hydropower plants);
- Ensuring power system security;
- Preventing overflow (for hydropower plants).
b) Payment for electricity to power plants during the period when they are not participating in the electricity market or have been suspended from participation shall be carried out according to the agreement in the power purchase and sale contract with the sole bulk buyer, consistent with the operational status of the power plant.

Article 5. Documents for Registration to Participate in the Electricity Market

1. Within the latest 20 days from the date of commercial operation, the Power Generation Unit shall be responsible for completing all registration documents for participating in the electricity market for power plants required to participate in the electricity market as stipulated in Clause 1, Article 4 of this Circular.

2. The Power Generation Unit shall submit one set of registration documents for participating in the electricity market for each power plant to the System Operation and Electricity Market Unit through the electricity market's electronic information website.

3. The registration documents for participating in the electricity market include:

a) A registration form to participate in the electricity market, clearly stating the name and address of the Power Generation Unit, the power plant, the bidding subject on the electricity market, and the expected date of officially joining the electricity market of the power plant;
b) A copy of the License for Electricity Business in the field of power generation;
c) Acceptance documents for putting systems into operation as prescribed in Clause 5, Article 4 of this Circular;
d) A copy of the Power Purchase Agreement;
đ) A copy of the Minutes of Agreement on the bidding unit representing a cascade hydropower plant group (in case the Power Generation Unit represents a cascade hydropower plant group).

Article 6. Inspection of Registration Documents for Participation in the Electricity Market

1. The System Operation and Electricity Market Unit shall be responsible for urging the Power Generation Units to complete the procedures for registering to participate in the electricity market for power plants required to participate in the electricity market as stipulated in Clause 1, Article 4 of this Circular, starting from the date when the expected date of commercial operation of the power plant is determined.

2. Within five days from the date of receiving valid registration documents for participation in the electricity market, the System Operation and Electricity Market Unit shall be responsible for inspecting the documents, assessing the ability to officially join the electricity market according to the proposal of the power plant (or proposing a suitable time for the power plant to join the electricity market, not earlier than the date proposed by the power plant and not later than thirty days from the date of commercial operation of the power plant), and issuing a report on the results to the Electricity Regulatory Authority.

3. In case the power plant has met all conditions to participate in the electricity market, the System Operation and Electricity Market Unit shall be responsible for announcing on the electricity market's electronic information website at least twenty-four hours before the power plant officially joins the electricity market.

Article 7. Information of Participants in the Electricity Market

1. The Transmission Unit, the Single Buyer Unit, and the Data Measurement Management Unit shall be responsible for registering general information about their units with the System Operation and Electricity Market Unit.

2. The System Operation and Electricity Market Unit shall be responsible for storing registration information and updating changes to the registration information of participants in the electricity market.

3. Participants in the electricity market shall be responsible for notifying the System Operation and Electricity Market Unit of any changes to the registered information.

4. The System Operation and Electricity Market Unit shall be responsible for publishing the registration information of participants in the electricity market and any updated registration information.

Article 8. Suspension from the Electricity Market of Power Plants

1. A power plant shall be suspended from participating in the electricity market if it commits any of the following violations:

a) Failing to provide information or providing inaccurate information for the purpose of planning the operation of the electricity market and scheduling units within the power system;
b) Failing to provide information or providing inaccurate information for the resolution of disputes and handling of violations on the competitive power generation market at the request of the dispute resolution authority and in accordance with the law;
c) Directly or indirectly agreeing with another entity to limit or control the capacity offered on the market in order to increase the spot electricity price and affect the security of power supply;
d) Agreeing with another power generation unit on bidding prices to be scheduled;
đ) Agreeing with the System Operator and the Electricity Market on bidding prices to be scheduled in violation of regulations;

2. A power plant that violates the provisions stipulated in Clause 1 of this Article shall be suspended from participating in the electricity market in accordance with Article 114 of this Circular.

Article 9. Termination of Participation in the Electricity Market

1. A power plant shall terminate its participation in the electricity market in the following cases:

a) At the request of the power generation entity owning the power plant in the following situations:
- The power plant ceases operations entirely;
- The power plant fails to maintain and lacks the ability to restore its installed capacity greater than 30 MW within one year.
b) The power business license of the power plant in the power generation sector is revoked or expires.

2. In the case stipulated in Point a Clause 1 of this Article, at least 30 days prior to the intended date of termination of participation in the electricity market, the power generation entity owning the power plant shall have the responsibility to send a written notice of termination of participation in the electricity market to the System Operator and the Electricity Market.

3. Within ten days from the date of receipt of the written notice requesting termination of participation in the electricity market from the power generation entity, the System Operator and the Electricity Market shall have the responsibility to review, decide, and report to the Electricity Regulatory Authority for supervision and implementation.

4. The System Operator and the Electricity Market shall have the responsibility to store records and announce on the electricity market's website about the termination of participation in the electricity market by the power plant.

Chapter III
PRINCIPLES FOR OPERATING THE ELECTRICITY MARKET

Article 10. Price Quotation Limits

1. The price quotation of power generation units on the electricity market is limited from the floor price of the bid to the ceiling price of the bid.

2. The ceiling price of the bid for thermal power plants is determined annually, adjusted monthly, and calculated based on the following factors:

a) Heat rate of the power generation unit;
b) Efficiency degradation factor over time of the power generation unit;
c) Fuel price;
d) Price variation according to the power purchase and sale contract.

3. The floor price of thermal power plants is 01 VND/kWh.

4. The price quotation limits for hydro power plants are regulated in Article 41 of this Circular.

Article 11. Water Value

1. The water value is used to determine the price quotation limits of hydro power plants in the electricity market.

2. The System Operator and the Electricity Market shall have the responsibility to calculate and publish the water value according to the market operation schedule as prescribed in Appendix 1 of this Circular.

Article 12. Full Market Electricity Price

The full market electricity price for each trading cycle is calculated as the sum of the following two components:

1. Market electricity energy price.

2. Market electricity capacity price.

Article 13. Market Electricity Energy Price

1. The market electricity energy price is calculated by the System Operation Unit and Electricity Market after the operation period based on the non-binding scheduling method.

2. The market electricity energy price shall not exceed the ceiling price of the electricity market.

3. The market electricity energy price is determined in accordance with Articles 69 and 71 of this Circular.

Article 14. Market Electricity Capacity Price

1. The market electricity capacity price for each trading cycle is calculated by the System Operation Unit and Electricity Market during the process of planning the next year's operation and remains unchanged throughout the application year.

2. The market electricity capacity price is calculated based on the principle of ensuring that the best new power plant recovers all variable and fixed costs.

3. The market electricity capacity price is determined in accordance with Articles 25 and 26 of this Circular.

Article 15. Differential Purchase-Sale Electricity Contract

1. The Direct Trading Power Generation Unit and the Single Wholesale Purchaser are responsible for signing a differential purchase-sale electricity contract according to the form issued by the Ministry of Industry and Trade.

2. The annual contract volume is calculated by the System Operation Unit and Electricity Market based on the planned annual production volume and the ratio of production volume paid at the contract price as stipulated in Clause 5 of this Article. The planned annual production volume is calculated by the System Operation Unit and Electricity Market, in coordination with the Single Wholesale Purchaser, during the process of planning the next year's operation as prescribed in Clause 2 of Article 27 of this Circular.

3. The monthly contract volume is determined by the System Operation Unit and Electricity Market during the process of planning the next year's operation based on the allocation of the annual contract volume to months as provided for in Article 28 of this Circular.

4. The hourly contract volume is determined by the System Operation Unit and Electricity Market during the process of planning the next month's operation based on the allocation of the monthly contract volume to hours within the month as provided for in Article 37 of this Circular.

5. The Electricity Regulatory Authority is responsible for determining and announcing the ratio of production volume paid at the contract price for power generation units annually, depending on the type of technology, according to the following principles:

a) Ensuring harmony among the following objectives:
- Encouraging effective competition in the electricity market;
- Stabilizing revenue for power generation units;
- Stabilizing the average electricity generation price, consistent with regulations on retail electricity pricing.
b) The ratio of electricity energy volume paid at the contract price is specified for power plants according to the type of technology (hydropower, thermal power). This ratio shall not exceed 95% and shall not be less than 60%.

Article 16. Payment Principles in the Electricity Market

1. Direct Trading Power Generation Units are paid according to the market electricity price and the differential purchase-sale electricity contract.

2. Payment according to the market price applies only to Direct Trading Power Generation Units and is calculated based on the following factors:

a) Market electricity energy price;
b) Market electricity capacity price;
c) Generated electricity energy volume and capacity.

3. Payment to Direct Trading Power Generation Units is carried out in accordance with Chapter VI of this Circular.

4. Indirect Trading Power Generation Units and units not participating in the electricity market are paid according to the provisions of the purchase-sale electricity contract.

Chapter IV
MARKET OPERATION PLAN

Section 1
NEXT YEAR'S OPERATION PLAN

Article 17. Annual Operation Plan

1. The entity operating the power system and electricity market shall be responsible for establishing the annual operation plan for the electricity market, including the following contents:

a) Selecting the best new power plant;
b) Calculating the market capacity price;
c) Calculating the optimal water value and water level of hydropower reservoirs;
d) Calculating the bidding price limit of thermal power units;
đ) Determining the ceiling prices of the electricity market;
e) Planned generation volume, annual contractual generation volume, and allocation of annual contractual generation volume to each month of the year for direct trading power generation units.

2. The entity operating the power system and electricity market shall be responsible for using the market simulation model to calculate the contents prescribed in Points a, b, c, d, and đ Clause 1 of this Article. Input parameters used in the thermal power unit market simulation model are the variable costs of the unit determined in Clause 3 of this Article, hydrological characteristics, and technical characteristics of hydropower plants.

3. Variable costs of thermal power units are determined as follows:

a) In cases where the heat rate value according to the contract or the test results of the unit can be determined, the variable costs of the unit are determined as follows:

Where:

: Adjusted variable cost component based on fluctuations in the main fuel cost (coal, gas) of the power plant (VND/kWh);

: Adjusted variable cost component based on fluctuations in the auxiliary fuel cost (oil) of the power plant (VND/kWh);

: Other variable cost components outside the main fuel and auxiliary fuel (oil) variable costs of the power plant according to the power purchase and sale contract (VND/kWh).

- The adjusted variable cost component based on fluctuations in the main fuel cost of the power plant (VND/kWh) is determined according to the following formula:

 

Where:

: Average heat rate of the main fuel according to the power purchase and sale contract or the test results of the unit conducted by the testing unit authorized or decided by the competent state agency and unified by the sole purchasing and selling entity, calculated corresponding to the load level as stipulated in Appendix 1 of Circular No. 56/2014/TT-BCT dated December 19, 2014 issued by the Minister of Industry and Trade on the method of building power generation prices and procedures for checking power purchase and sale contracts (kg/kWh or BTU/kWh or kcal/kWh).

For power plants using coal from various sources including imported coal and domestic coal: The base calorific value (CV0) used to calculate the average heat rate is calculated as the weighted average based on quantity and calorific value converted to dry basis total calorific value as specified in coal purchase and sale contracts (kcal/kg).

: Main fuel price including transportation costs.

- The adjusted variable cost component based on fluctuations in the auxiliary fuel cost of the power plant (VND/kWh) is determined according to the following formula:

 

Where:

: Average heat rate of auxiliary fuel agreed upon by both parties based on equipment manufacturer specifications (kg/kWh);

: Auxiliary fuel price including transportation fees and other charges as stipulated (VND/kg).

- The average heat rate of fuel (main, auxiliary) provided by the sole purchasing and selling entity is adjusted according to the efficiency degradation factor. If the heat rate in the power purchase and sale contract is the average heat rate over the life of the project, it will not be adjusted according to the efficiency degradation factor. In cases where the power purchase and sale contract only has heat rate characteristics at different load levels, the heat rate of the units is determined at the load level corresponding to the average annual generation volume of the power plant as stipulated in the power purchase and sale contract.

In cases where the thermal power unit does not have a heat rate result from the unit test and is not included in the power purchase and sale contract, it is determined by the heat rate of the standard power plant of the same technology and installed capacity group and the same equipment manufacturer. The entity operating the power system and electricity market is responsible for calculating the fuel consumption rate or heat rate of the standard power plant.

- The efficiency degradation factor of the thermal power unit is determined according to the efficiency degradation factor in the power purchase and sale contract provided by the sole purchasing and selling entity.

In cases where the thermal power plant does not have data on the efficiency degradation factor in the power purchase and sale contract, the efficiency degradation factor of the standard power plant of the same group as that power plant is applied, as determined by the entity operating the power system and electricity market.

- Other variable cost components of the power plant (VND/kWh) are determined according to the provisions of the power purchase and sale contract.

b) In cases where there is no heat rate determined after the unit test process or specified in the signed power purchase and sale contract, the variable costs of the unit are determined by the year N variable price (including main fuel transportation costs) in the power purchase and sale contract updated with factors affecting the year N variable price according to the method agreed upon in the contract. For power plants without signed power purchase and sale contracts, the year N variable price is taken from the variable price of power plants with signed power purchase and sale contracts having equivalent power generation technology and installed capacity.

c) The main fuel price, auxiliary fuel price, limestone, and main fuel transportation costs used in calculating the year N variable price and variable costs are determined in the following order of priority:

- The fuel price applicable for year N published or directed by the competent authority;

- The fuel price applicable for year N in the fuel purchase and sale contract;

- The fuel price in the latest electricity payment invoice before the planning year N. In cases where there is no electricity payment invoice with complete fuel price for the latest month at the time of planning year N (the invoice has not fully calculated the fuel price according to the fuel purchase and sale contract), the average monthly fuel price based on invoices according to the provisions of the fuel purchase and sale contract may be used.

4. The entity operating the power system and electricity market shall be responsible for submitting to Vietnam Electricity Corporation for review and then submitting to the Electricity Regulatory Authority for approval the annual operation plan according to the schedule of the electricity market operation as stipulated in Appendix 1 of this Circular. The submission file shall include calculation results, input data, and calculation explanations.

5. In case there is a significant fluctuation in coal prices and gas prices for power generation compared to the time of approving the annual operation plan, the Electricity Regulatory Authority shall be responsible for reviewing, requesting the entity operating the power system and electricity market to update data and recalculate the remaining months' operation plans of the year, which shall then be submitted to Vietnam Electricity Corporation for review and to the Electricity Regulatory Authority for approval.

Article 18. Classification of Hydroelectric Power Plants

1. Hydroelectric power plants in the electricity market shall be specifically classified as follows:

a) Strategic multi-purpose hydroelectric power plant;
b) Cascade hydroelectric power plant group;
c) Hydroelectric power plant group with reservoir regulation over one week;
d) Hydroelectric power plant group with reservoir regulation from two days to one week;
đ) Hydroelectric power plant group with reservoir regulation under two days;
e) For hydroelectric power plants belonging to the group of power plants with reservoir regulation over one week, if the electricity supply volume in the annual power supply plan issued annually by the Ministry of Industry and Trade is lower than 65% of the average annual electricity supply volume (GO), then the participation in the electricity market of such power plants in that year shall be applied as for hydroelectric power plants with reservoir regulation under two days as prescribed in this Circular.
For hydroelectric power plants using water from irrigation reservoirs for power generation and having special requirements from competent state agencies, the Electricity Regulatory Authority shall be responsible for reporting to the Ministry of Industry and Trade for consideration and decision on the form of participation in the electricity market of such power plants in that year.

2. Annually, the entity operating the power system and electricity market shall be responsible for updating the list of hydroelectric power plant groups according to Clause 1 of this Article.

3. Based on the proposal of Vietnam Electricity Corporation, the Electricity Regulatory Authority shall be responsible for compiling the list of strategic multi-purpose hydroelectric power plants to submit to the competent authority for approval as prescribed.

Article 19. Load Forecasting for Annual Operation Plan Preparation

The entity operating the power system and electricity market shall be responsible for load forecasting to serve the preparation of the annual operation plan according to the method prescribed in the Transmission System Regulation issued by the Ministry of Industry and Trade. The load forecasting data serving the preparation of the annual operation plan shall include:

1. Total national power system load demand and regional North, Central, South loads for the whole year and each month within the year. Maximum and minimum power system load capacity of the national power system in each month.

2. Typical daily load profiles of the North, Central, South regions and the entire national power system for each month of the year.

3. Load profile of each trading cycle of the North, Central, South regions and the entire national power system during the year.

Article 20. Ancillary Services for Annual Operation Plan

1. The entity operating the power system and electricity market shall be responsible for determining the need for various ancillary services for the next year according to the provisions of the Transmission System Regulation issued by the Ministry of Industry and Trade.

2. The entity operating the power system and electricity market shall be responsible for selecting power plants to provide ancillary services. Selected power plants shall be responsible for providing ancillary services and shall be paid according to the regulations of the Ministry of Industry and Trade.

Article 21. Classification of base load, intermediate load, and peak load power units for the upcoming year

1. The entity operating the electricity system and electricity market shall be responsible for classifying base load, intermediate load, and peak load power units in accordance with the provisions set forth in the Power Unit Classification Process and Maximum Bid Price Calculation Procedure for Thermal Power Plants issued by the Electricity Regulatory Authority.

2. The entity operating the electricity system and electricity market shall be responsible for using market simulation models to determine the annual average load factor of each power generation unit.

3. Based on the annual average load factor from the simulation results, power units will be classified into three groups as follows:

a) Base load power unit group includes power generation units with an annual average load factor greater than or equal to 60%;
b) Intermediate load power unit group includes power generation units with an annual average load factor greater than 25% and less than 60%;
c) Peak load power unit group includes power generation units with an annual average load factor less than or equal to 25%.

Article 22. Determination of the upper limit of bid prices for thermal power units

1. In cases where the heat rate value according to the power purchase contract or the test results of the power unit can be determined:

a) The maximum bid price of the thermal power unit is determined according to the following formula:

 

Where:

: Maximum bid price of the thermal power unit (VND/kWh);

signing and implementing AgreementsDC: Price ceiling adjustment factor based on the classification result of the thermal power unit. For base load thermal power units KDC = 0%; for intermediate load thermal power units KDC = 5%; for peak load thermal power units KDC = 20%;

"5. The pre-tax weighted average cost of capital i (%) is determined according to the formula below:NLC: Price of primary fuel (including primary fuel transportation costs) of the thermal power unit (VND/kCal; VND/BTU or VND/kg);

"5. The pre-tax weighted average cost of capital i (%) is determined according to the formula below:NLP: Price of secondary fuel of the thermal power unit (VND/kCal; VND/BTU or VND/kg);

HRC: Primary fuel heat rate at the average load level of the thermal power unit (BTU/kWh; kCal/kWh or kg/kWh);

HR"5. The pre-tax weighted average cost of capital i (%) is determined according to the formula below:: Secondary fuel heat rate at the average load level of the thermal power unit (BTU/kWh; kCal/kWh or kg/kWh);

: Other variable cost components outside the primary and secondary fuel (oil) costs of the power plant as stipulated in the power purchase contract (VND/kWh).

b) For thermal power plants using imported coal, the price of coal (including coal transportation costs) for year N is the coal price determined according to the fuel purchase contract for year N of the power plant. If there is no coal purchase contract for year N at the time of planning, the coal price for year N is determined as the coal price in the most recent electricity payment statement before the planning period for year N. If there is no electricity payment statement with complete fuel costs for the most recent month at the time of planning for year N (the payment statement does not fully reflect the fuel costs of the month according to the imported coal purchase contracts), the average fuel price for the month can be calculated based on the bills at the port loading point as stipulated in the imported coal purchase contracts;
c) Fuel price and heat rate parameters of the thermal power unit are determined in accordance with Point a Clause 3 Article 17 of this Circular;
d) The price of primary fuel provided by the sole bulk buyer to the entity operating the electricity system and electricity market within the timeframe specified in the Market Operation Plan Preparation Process.

2. In cases where there is no heat rate data in the power purchase contract or test results of the power unit and no suitable benchmark power plant in the same group:

a) The maximum bid price of the thermal power unit is determined according to the following formula:

 

Where:

: Maximum bid price of the thermal power unit (VND/kWh);

signing and implementing AgreementsDC: Price ceiling adjustment factor based on the classification result of the thermal power unit. For base load thermal power units signing and implementing AgreementsDC = 2%; for intermediate load thermal power units signing and implementing AgreementsDC = 5%; for peak load thermal power units signing and implementing AgreementsDC = 20%;

: Variable price (including primary fuel transportation costs) for year N according to the power purchase contract of the power plant (VND/kWh);

b) The variable price (including primary fuel transportation costs) used to calculate the maximum bid price is the forecasted variable price for year N provided by the sole bulk buyer to the entity operating the electricity system and electricity market.

3. The floor price of thermal power units as prescribed in Clause 3 Article 10 of this Circular.

4. The entity operating the electricity system and electricity market shall be responsible for announcing the approved bid price limits of thermal power units according to the market operation schedule as stipulated in Appendix 1 of this Circular.

Article 23. Determination of the Market Electricity Price Cap

1. The system operator and electricity market unit shall be responsible for calculating at least three options for the market electricity price cap.

2. The market electricity price cap for year N shall be determined according to the following principles:

a) Not lower than the variable cost of base load and direct peaking thermal power plants bidding on the electricity market;
b) Not higher than 115% of the highest price cap bid by base load or direct peaking thermal power plants on the electricity market.

Article 24. Selection of the Best New Power Plant

1. The best new power plant for year N is a power plant participating in the electricity market that meets the following criteria:

a) Begins commercial operation and operates at full installed capacity throughout year N-1, except as provided for in Clause 3 of this Article;
b) Is a base load power plant classified according to the criteria set forth in Clause 3 of Article 21 of this Circular;
c) Uses coal-fired thermal power or combined cycle gas turbine technology;
d) Has the lowest average full cost of generation per 1 kWh.

2. The sole bulk buyer shall be responsible for compiling a list of power plants meeting the criteria specified in Points a and c of Clause 1 of this Article and providing the electricity purchase and sale contract data of these power plants to the system operator and electricity market unit to determine the best new power plant. The data includes:

a) Variable price for year N;
b) Fixed price for year N agreed upon in the electricity purchase and sale contract applicable for payment in year N;
c) Agreed-upon electricity output for calculating the contract price for year N.

3. In cases where fewer than three power plants meet the criteria stipulated in Points a, b, and c of Clause 1 of this Article, the system operator and electricity market unit shall supplement the list with newly selected power plants from year N-1 to ensure a minimum of three power plants and request the sole bulk buyer to update and provide the relevant data as prescribed in Clause 2 of this Article to calculate and select the best new power plant for year N.

4. The system operator and electricity market unit shall be responsible for calculating the average full cost of generation per 1 kWh for power plants meeting the criteria specified in Points a, b, and c of Clause 1 of this Article using the following formula:

 

: Average full cost of generation per 1 kWh in year N of the power plant (VND/kWh);

: Fixed price for year N under the electricity purchase and sale contract of the power plant (VND/kWh);

: Variable price for year N under the electricity purchase and sale contract of the power plant (VND/kWh);

: Agreed-upon electricity output for calculating the contract price for year N of the power plant (kWh);

: Projected electricity output in year N of the power plant determined from the market simulation model using the scheduled method (kWh).

5. The list of the best new power plants shall be ranked in ascending order of the average full cost of generation per 1 kWh. The best new power plant selected for year N is the power plant with the lowest average full cost of generation per 1 kWh based on the calculation results in Clause 4 of this Article.

Article 25. Principles for Determining Market Capacity Price

1. Ensure that the best new power plant recovers all generation costs when participating in the electricity market.

2. The market capacity price is proportional to the forecasted national electricity system load for the trading period.

Article 26. Procedure for Determining Market Capacity Price

The system operator and electricity market have the responsibility to determine the market capacity price according to the following procedure:

1. Determine the annual shortfall cost of the best new power plant

a)Determine the expected revenue from the market of the best new power plant in year N using the following formula:

 

Where:

R+ C: Expected revenue through the market electricity price of the best new power plant in year N (VND);

i: Trading cycle i in year N;

I: Total number of trading cycles in year N;

SMPinternational: Expected market electricity price of trading cycle i in year N determined from the market simulation model using the non-binding scheduling method (VND/kWh);

: Expected generation at the metering point of the best new power plant in trading cycle i in year N determined from the market simulation model using the binding scheduling method (kWh).

b)Determine the total annual generation cost of the best new power plant using the following formula:

Economic life of the power plant as specified in the Appendix attached to this Circular (years).BNE: Annual generation cost of the best new power plant in year N (VND);

"5. The pre-tax weighted average cost of capital i (%) is determined according to the formula below:BNE: Full generation cost price for 1 kWh of the best new power plant determined according to Clause 4, Article 24 of this Circular (VND/kWh);

: Expected generation at the metering point of the best new power plant in trading cycle i in year N determined from the market simulation model using the binding scheduling method (kWh);

i: Trading cycle i in year N;

I: Total number of trading cycles in year N.

c)The annual shortfall cost of the best new power plant is determined using the following formula:

 

Where:

AS: Annual shortfall cost of the best new power plant in year N (VND);

Economic life of the power plant as specified in the Appendix attached to this Circular (years).BNE: Total annual generation cost of the best new power plant in year N determined in Point b of this Clause (VND);

: Expected revenue through the market electricity price of the best new power plant in year N determined according to Point a of this Clause (VND).

d)In case the annual shortfall cost calculation results in a negative value with the lowest market price cap option, the system operator and electricity market report to the Electricity Regulatory Authority to select the next best new power plant in the list of new power plants as stipulated in Article 24 of this Circular and re-calculate or review the list of power plants participating in the electricity market to reasonably determine the market price cap.

2. Determine the monthly shortfall cost

The monthly shortfall cost of the best new power plant is determined by allocating the annual shortfall cost to each month in year N using the following formula:

 

Where:

MS: Monthly shortfall cost t of the best new power plant (VND);

AS: Annual shortfall cost of the best new power plant in year N (VND);

: Peak load capacity in month t (MW).

3. Determine the market capacity price for each trading cycle

a)Determine the average annual available capacity of the best new power plant using the following formula:

: Average annual available capacity in year N of the best new power plant (kW);

I: Total number of trading cycles in year N;

i: Trading cycle in which the best new power plant is expected to be mobilized;

: Expected mobilization capacity of the best new power plant in trading cycle i of year N according to the market simulation model using the binding scheduling method converted to the metering point (kW).

b)Determine the market capacity price for each trading cycle in the upcoming year using the following formula:

 

Where:

I: Total number of trading cycles in month t;

i: Trading cycle i in month t;

: Market capacity price of trading cycle i (VND/kW);

: Average annual available capacity in year N of the best new power plant (kW);

­­­: Monthly shortfall cost t of the best new power plant (VND);

c)Dorganize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.: System load forecast of trading cycle i according to the typical day load profile forecast of month t as stipulated in Article 19 of this Circular (MW).

Article 27. Determining the annual total output of the power purchase contract

The annual total output of the power purchase contract for the power plant shall be determined through the following steps:

1. Develop the annual power system operation plan using the constrained scheduling method. Input parameters used in developing the annual power system operation plan include the variable prices of thermal power plants, hydrological characteristics, and technical specifications of the power plant.

2. Calculate the planned annual total output of the power plant according to the following formula:

Where:

: The planned annual total output N of the power plant (kWh);

: The expected annual output N of the power plant determined from the annual power system operation plan converted to the metering point (kWh);

GO: The average annual electricity generation capacity of the power plant specified in the power purchase contract (kWh);

a, b: The annual output adjustment factor determined according to the provisions on the method of building electricity generation prices and the procedures for inspecting power purchase contracts issued by the Ministry of Industry and Trade.

3. Calculate the annual contractual total output of the power plant according to the following formula:

 

Where:

Article 24of: The annual contractual total output N (kWh);

: The planned annual output N of the power plant (kWh);

: The payment ratio based on the contract price applied for year N (%) determined according to Clause 5, Article 15 of this Circular.

Article 28. Determining the monthly contractual output

The monthly contractual output of thermal power plants and hydropower plants with reservoirs over one week is determined during the process of developing the annual power market operation plan, including the following steps:

1. Use the market simulation model as prescribed in Clause 2, Article 17 of this Circular using the constrained scheduling method to determine the expected monthly output of the power plant.

2. Determine the monthly contractual output according to the following formula:

 

Where:

 : The monthly contractual output t of the power plant (kWh);

Article 24of : The annual contractual total output of the power plant (kWh);

: The expected output in month t of the power plant determined from the market simulation model using the constrained scheduling method (kWh).

3. For new power plants expected to participate in the power market in year N and lacking sufficient basis for allocating contractual output in the annual power market operation plan, the Power System Operation and Market Unit shall be responsible for calculating the monthly contractual output for the power plant from the date of market participation until the end of year N, report to Vietnam Electricity Corporation, and submit to the Electricity Regulatory Authority for approval. The specific calculation method is as follows:

 

Where:

 : The monthly contractual output t of the power plant (kWh);

: The payment ratio based on the contract price applied for year N (%) determined according to Clause 5, Article 15 of this Circular;

: The planned output according to the updated system operation method for month t and the remaining months of year N of the power plant, converted to the delivery point (kWh).

Article 29. Responsibilities for determining and signing the annual and monthly contractual outputs

1. The Power System Operation and Market Unit shall be responsible for:

a) Calculating the annual and monthly contractual outputs of power generation units according to Articles 27 and 28 of this Circular;
b) Publishing on the power market electronic portal the input data for calculating and the results of calculating the annual and monthly contractual outputs for the Single Buyer and direct trading power generation units for inspection before November 15 each year.

2. The Single Buyer shall be responsible for:

a) Providing data to the Power System Operation and Market Unit for calculating the annual and monthly contractual outputs;
b) Checking and coordinating with the Power System Operation and Market Unit to resolve discrepancies in the results of calculating the annual and monthly contractual outputs before November 25 each year;
c) Signing confirmation with the power generation unit regarding the annual and monthly contractual outputs according to the calculation results.

3. Direct trading power generation units shall be responsible for:

a) Providing data to the Power System Operation and Market Unit and the Single Buyer for calculating the annual and monthly contractual outputs;
b) Checking and coordinating with the Power System Operation and Market Unit to resolve discrepancies in the results of calculating the annual and monthly contractual outputs before November 25 each year;
c) Signing confirmation with the Single Buyer regarding the annual and monthly contractual outputs according to the calculation results.

Article 30. Determination of the Expected Average Power Generation Price for Year N

1. The system operator and electricity market unit shall be responsible for calculating the expected average power generation price for year N and the degree of change in the expected average power generation price compared to year N-1.

2. The annual average power generation price shall be calculated according to the following formula:

 

Where:

j: Power plant j of the direct trading power generation unit;

J: Total number of power plants of direct trading power generation units;

"5. The pre-tax weighted average cost of capital i (%) is determined according to the formula below:PDTB: The average power generation price of the entire system in year N (VND/kWh);

: The average full market electricity price for year N as stipulated in Clause 4 of this Article (VND/kWh);

: Total electricity output of the entire system in year N approved by the Ministry of Industry and Trade (kWh);

: Total electricity output of direct trading power generation units in year N approved by the Ministry of Industry and Trade (kWh);

: Total electricity output under the power purchase and sale contract with differentials in year N of power plant j (kWh);

: Power purchase and sale contract price with differentials in year N of power plant j (VND/kWh);

: Total cost of purchasing electricity from BOT power plants in year N (VND);

: Total cost of purchasing electricity from strategic multi-purpose hydropower plants in year N (VND);

CDVPT: Total cost of purchasing ancillary services in year N (VND).

3. The system operator and electricity market unit shall be responsible for collecting information on costs from BOT power plants, strategic multi-purpose hydropower plants, and power plants providing ancillary services from the Vietnam Electricity Corporation to calculate the annual average power generation price according to the provisions of Clause 2 of this Article.

4. The average full market electricity price shall be determined according to the following formula:

 

Where:

i: Trading cycle i in year N;

I: Total trading cycles in year N;

: The average full market electricity price for year N (VND/kWh);

: The total expected electricity output entering the market of all participating power plants in trading cycle i determined from the constrained market simulation model (kWh);

: The expected electricity price of trading cycle i determined from the unconstrained market simulation model (VND/kWh);

: Market capacity price of trading cycle i (VND/kW).

Article 31. Announcement of the Next Year's Electricity Market Operation Plan

1. After the next year's electricity market operation plan has been approved according to the provisions of Article 17 of this Circular, the system operator and electricity market unit shall be responsible for publishing on the electricity market's electronic information website the input data and results of the next year's electricity market operation plan for market participants.

2. Information about the next year's electricity market operation plan that will be published includes:

a) Calculation results of the next year's operation plan, including:

- Expected electricity price;

- Results of selecting the best new power plant;

- Hourly market capacity price;

- Ceiling of the electricity price in the market;

- Classification of thermal power units;

- Annual contract volume and monthly allocation of contract volume for each power plant.

b) Input parameters for calculating the next year's market operation plan, including:

- Load forecast for each region (North, Central, South) and the national power system in each trading cycle;

- Hydrological data of hydropower reservoirs used for market simulation calculation;

- Progress of new power plants coming into operation;

- Technical parameters of transmission grid;

- Schedule of electricity import/export;

- Maintenance and repair schedule for the year of power plants, transmission grid, and major gas sources.

3. Information about the next year's electricity market operation plan will only be published for direct trading power generation units owning power plants directly related to such information, including:

a) Expected power generation output in the market simulation of the power plant for each trading cycle;

b) Water value of the hydropower plant;

c) Data on the variable price of the thermal power plant used in the simulation calculation.

Section 2
MONTHLY OPERATION PLAN

Article 32. Load Forecasting for Monthly Operation Planning

The system operator and electricity market entity shall be responsible for load forecasting to serve the preparation of monthly operation plans according to the method prescribed in the Transmission System Regulation issued by the Ministry of Industry and Trade. The load forecasting data for preparing the monthly operation plan includes:

1. The total national power system load demand and the load demand of each North, Central, and South region for the entire month and each week within the month.

2. Load profile diagrams of typical days in each North, Central, and South region and the entire national power system for each week within the month.

Article 33. Calculation of Water Value

The system operator and electricity market entity shall be responsible for calculating the water value for each week in the upcoming month. The results of the water value calculation will be used to prepare the monthly operation plan, including:

1. The expected output of strategic multi-purpose hydropower plants.

2. The water value of hydropower plants in the cascade hydropower group.

3. The water value of hydropower plants with regulating reservoirs for each week.

4. The optimal water level for each week in the month of hydropower plants with regulating reservoirs for each week.

Article 34. Classification of Base, Shoulder, and Peak Units for the Upcoming Month

1. The system operator and electricity market entity shall be responsible for classifying base, shoulder, and peak units for the upcoming month according to the Unit Classification Process and Monthly Maximum Offer Price Calculation Procedure for Thermal Power Plants issued by the Electricity Regulatory Authority.

2. The system operator and electricity market entity shall be responsible for using a market simulation model to determine the average monthly load factor of generating units for the upcoming month.

3. Based on the average monthly load factor from the simulation results, the units are classified into three groups as follows:

a) The base unit group includes generating units with an average monthly load factor of 70% or higher.
b) The shoulder unit group includes generating units with an average monthly load factor greater than 25% and less than 70%.
c) The peak unit group includes generating units with an average monthly load factor of 25% or lower.

Article 35. Adjustment of Maximum Offer Price of Thermal Power Units

1. The system operator and electricity market entity shall be responsible for calculating and adjusting the maximum offer price of thermal power units for the upcoming month according to the method stipulated in Article 22 of this Circular, which updates factors affecting the variable cost of month M according to the agreed method in the contract and based on:

a) The fuel price (primary, secondary, limestone, primary fuel transportation) for the upcoming month is determined in the following priority order:
- The fuel price applicable for the upcoming month is published or directed by the competent authority;
- The fuel price applicable for the upcoming month in the fuel purchase and sale contract;
- The fuel price in the most recent electricity payment statement before the planning period for the upcoming month. In case there is no electricity payment statement with the full fuel price of the most recent month at the time of planning for the upcoming month (the payment statement has not fully reflected the fuel price according to the fuel purchase and sale contract), the average fuel price of the month can be calculated based on invoices according to the provisions of the fuel purchase and sale contract;
- For coal-fired power plants using imported coal, the fuel price for the upcoming month is the fuel price in the most recent electricity payment statement before the planning period for the upcoming month. In case there is no electricity payment statement with the full fuel price of the most recent month (the payment statement has not fully reflected the fuel price of the month according to the imported coal purchase and sale contracts) at the time of planning for the upcoming month, the average fuel price of the month can be calculated based on invoices at the port according to the provisions of the imported coal purchase and sale contracts.
b) The variable cost (including primary fuel transportation cost) for the upcoming month of thermal power plants.
The sole bulk buyer is responsible for updating changes in the variable cost of thermal power plants and providing them to the system operator and electricity market entity.
c) The classification results of thermal power units for the upcoming month as prescribed in Article 34 of this Circular.
2. The system operator and electricity market entity shall be responsible for announcing the maximum offer price of thermal power units for the upcoming month according to the electricity market operation schedule as stipulated in Appendix 1 of this Circular.

Article 36. Adjustment of Monthly Contract Volume

1. The monthly contract volume may be adjusted in the event that the maintenance schedule of the plant in month M is changed from the annual operation plan due to:

  1. Requirements of the System Operation Unit and Electricity Market to ensure system security not due to reasons of the plant;
  2. Requirements of competent state agencies and agreed upon by the System Operation Unit and Electricity Market based on actual operating conditions of the system.

2. The System Operation Unit and Electricity Market shall be responsible for adjusting the monthly contract volume in cases stipulated in Clause 1 of this Article according to the following principle: Shifting between months the corresponding volume Qc for the time of repair being shifted, ensuring the total annual Qc with adjustment remains unchanged as guided by the Process for Adjusting Contract Volumes issued by the Electricity Regulatory Authority.

In the case where the plant's maintenance schedule is changed in the last month of the year, the volume Qc corresponding to the repair time of this month will not be shifted into the next year.

3. The monthly contract volume of hydropower plants with regulation reservoirs over one week may be adjusted if the actual hydrology of hydropower plants differs significantly from the hydrological forecast used in planning calculations, with the adjustment principle as follows:

a) Adjustment shall be carried out when the average inflow volume, power generation volume of the plant from January 1st of year N to the 20th of each month, and the upstream water level at the beginning of the next month differ significantly from the inflow volume, cumulative flood contract volume, and reservoir level at the beginning of the month calculated in the annual plan.

b) Adjustment to increase the monthly contract volume of hydropower plants shall only be carried out when the total monthly contract volume of participating power plants in the electricity market according to the annual operation plan is lower than 95% of the total expected generation volume (converted to delivery points) of the power plants according to the monthly operation plan.

4. Power Generation Units and the Sole Wholesale Purchaser shall be responsible for coordinating with the System Operation Unit and Electricity Market to confirm and report to the Electricity Regulatory Authority for consideration of adjustment for the next month in cases stipulated in Clause 3 of this Article according to the guidance provided in the Process for Adjusting Contract Volumes issued by the Electricity Regulatory Authority.

5. In the event that the approved available volume of month M+1 of the power plant does not meet the monthly contract volume, the monthly contract volume shall be adjusted to the available volume of that month, and the shortfall due to the adjustment shall be allocated to the last months of year N according to the ratio of the monthly contract volume already approved by the Electricity Regulatory Authority and shall not exceed the available volume.

Article 37. Determination of Hourly Contract Volume

The System Operation Unit and Electricity Market shall be responsible for determining the hourly contract volume for the power plant in the upcoming month according to the following steps:

1. Using the market simulation model as prescribed in Clause 2 of Article 17 of this Circular to determine the expected hourly volume in the month of the power plant according to the constrained scheduling method.

2. Determine the hourly contract volume according to the following formula:

 

Where:

international: Cycle i in the month;

I: Total number of cycles in the month;

: Contract volume of the power plant in cycle i (kWh);

: Expected generation volume of the power plant in cycle i determined from the market simulation model using the constrained scheduling method (kWh);

: Monthly contract volume of the power plant determined according to Article 28 of this Circular (kWh).

3. If the contract volume of the power plant in cycle i exceeds the maximum generation volume of the power plant, then the contract volume in that trading cycle shall be adjusted to the maximum generation volume of the power plant. The maximum generation volume of the power plant in the trading cycle corresponds to the volume within one hour calculated based on the published capacity in the default bid price for the upcoming month sent by the Power Generation Unit to the System Operation Unit and Electricity Market as prescribed in Point a, Clause 3, Article 47 of this Circular.

4. If the contract volume of the thermal power plant in cycle i is greater than 0 MW and less than the lowest stable generation capacity (Pmin) of the power plant, then the contract volume in that trading cycle shall be adjusted to the lowest stable generation capacity of the power plant. The lowest stable generation capacity (Pmin) of the power plant is determined by the lowest stable generation capacity of one unit of the power plant scheduled for mobilization in the market simulation model of that cycle.

In the case where the contract volume of small hydropower plants is less than the lowest stable generation capacity, it may be adjusted to 0 MW or to the lowest stable generation capacity.

5. The System Operation Unit and Electricity Market shall be responsible for allocating the total difference volume resulting from the adjustment of hourly contract volumes as prescribed in Clauses 3 and 4 of this Article to other hours in the month on the principle of ensuring the monthly contract volume remains unchanged and in accordance with the provisions of the Annual, Monthly, and Weekly Operation Planning Process issued by the Electricity Regulatory Authority.

6. The System Operation Unit and Electricity Market shall be responsible for publishing through the Electricity Market Electronic Information Portal the input data and preliminary calculation results of the hourly contract volume for the upcoming month for the Sole Wholesale Purchaser and Direct Trading Power Generation Units before the 23rd of each month. The Sole Wholesale Purchaser and Direct Trading Power Generation Units shall be responsible for coordinating with the System Operation Unit and Electricity Market to check discrepancies in the calculation results of the hourly contract volume for the upcoming month before the 25th of each month. The System Operation Unit and Electricity Market shall be responsible for sending the official calculation results of the monthly hourly contract volume to the Sole Wholesale Purchaser and Direct Trading Power Generation Units according to the market operation schedule as prescribed in Appendix 1 of this Circular.

7. The sole bulk purchasing unit and the direct power generation trading unit shall be responsible for signing to confirm the adjusted monthly contract volume according to Article 36 of this Circular and the hourly contract volume based on the calculation results of the system operation unit and the electricity market.

Article 38. Adjustment of Hourly Contract Volume

1. Cases for considering adjustment of hourly contract volume (Qc hour):

a) In case of boiler failure of coal-fired thermal power units with multiple boilers or power plant unit failure;

b) In case the repair time of a boiler of coal-fired thermal power units with multiple boilers or a power plant unit exceeds the approved plan and is included in the calculation of the hourly contract volume.

2. In cases where there is sufficient basis to confirm the situation specified in Point a Clause 1 of this Article, the adjustment of the hourly contract volume shall be carried out according to the following principles:

a) In case the duration of the incident is less than or equal to 72 hours (equivalent to 72 trading cycles): The hourly contract volume (Qc) of the power plant will not be adjusted;

b) In case the duration of the incident exceeds 72 hours:

- During the period from the time of the incident to the 72nd trading cycle: Maintain the allocated contract volume (Qc) for the power plant;

- During the period from the 73rd trading cycle until the power plant unit repairs the incident and becomes available:

+ If the actual generation volume at the delivery point (Qmq) of the power plant is lower than the contract volume (Qc) of the power plant during this period, adjust the hourly contract volume by the actual generation volume (Qmq) of the power plant;

+ If the Qmq of the power plant is greater than or equal to the Qc of the power plant during this period, do not adjust the Qc of the power plant.

3. In cases where there is sufficient basis to confirm the situation specified in Point b Clause 1 of this Article, the adjustment of the hourly contract volume during extended maintenance cycles shall be carried out according to the principle that if there is a cycle where the actual generation volume at the delivery point (Qmq) of the power plant is lower than the Qc of the power plant, then adjust the hourly contract volume for those cycles by the actual generation volume (Qmq) of the power plant.

4. The direct power generation trading unit shall be responsible for coordinating with the system operation unit and the electricity market to confirm events as stipulated in Clause 1 of this Article according to the procedures for coordinated confirmation of events serving payment items on the market issued by the Electricity Regulatory Authority and send them to the sole bulk purchasing unit and the direct power generation trading unit as the basis for adjusting the hourly contract volume of the power plant. For the case of confirming boiler failure of coal-fired thermal power units with multiple boilers:

a) In case there is sufficient data from the distributed control system (DCS system) or equivalent control systems for this event: Confirm the event based on these data;

b) In case there is no data from the distributed control system (DCS system) or equivalent control systems: Use information and data from other sources for each specific case according to the procedures for coordinated confirmation of events serving payment items on the market issued by the Electricity Regulatory Authority to confirm the event.

5. The sole bulk purchasing unit and the direct power generation trading unit shall be responsible for re-signing to confirm the adjusted monthly contract volume and hourly contract volume of the power plant according to the provisions of Clauses 1, 2, and 3 of this Article.

Section 3
WEEKLY OPERATION PLAN

Article 39. Value of Water for the Upcoming Week

1. The entity operating the power system and electricity market shall be responsible for updating forecast load data, hydrological data, and other relevant data to calculate the value of water for the upcoming week.

2. The entity operating the power system and electricity market shall be responsible for updating information, recalculating the value of water for the upcoming week, and announcing the following results:

a) The value of water and the expected hourly generation of strategic multi-purpose hydropower plants;
b) The value of water for groups of cascaded hydropower plants and hydropower plants with reservoirs regulating over one week;
c) The expected hourly generation of hydropower plants with reservoirs regulating under two days;
d) The weekly water level limits of hydropower reservoirs capable of regulating over one week, as stipulated in the Process for Implementing Mid-term and Short-term Power System Security Assessment issued by the Electricity Regulatory Authority to guide the Implementation Regulation of the Transmission Power System issued by the Ministry of Industry and Trade.

Article 40. Determination of Contracted Generation of Hydropower Plants with Reservoirs Regulating from Two Days to One Week

1. The entity operating the power system and electricity market shall be responsible for calculating and announcing the weekly contracted generation and allocating the weekly contracted generation for each trading cycle within the week for hydropower plants with reservoirs regulating from two days to one week, as stipulated in the Annual, Monthly, and Weekly Operation Plan Preparation Process issued by the Electricity Regulatory Authority.

2. The entity operating the power system and electricity market shall be responsible for sending the weekly contracted generation of hydropower plants with reservoirs regulating from two days to one week to the sole bulk buyer and the power generator. The sole bulk buyer and the power generator shall be responsible for confirming the weekly contracted generation of the plant as the basis for electricity payment.

Article 41. Price Quotation Limits for Hydropower Plants

1. The price quotation limit for hydropower plants with reservoirs regulating over one week is determined based on the announced value of water for the upcoming week of that plant according to Clause 2, Article 39 of this Circular, specifically as follows:

a) The floor price quotation is zero VND/kWh;
b) The ceiling price quotation is the highest value of:
- The value of water of that plant;
- The average of the ceiling price quotations of thermal power units participating in the electricity market in the operational plan for the month.
c) Monthly, the entity operating the power system and electricity market shall be responsible for announcing the average of the ceiling price quotations of thermal power units for the upcoming month to hydropower plants at the same time as the announcement of the ceiling price quotations of thermal power units for the upcoming month.

2. The price quotation limit for hydropower plants with reservoirs regulating from two days to one week is determined as follows:

a) The floor price quotation is zero VND/kWh;
b) The ceiling price quotation is the highest value of:
- The highest value of water of hydropower plants participating in the market;
- The average of the ceiling price quotations of thermal power units participating in the electricity market in the operational plan for the month;
c) Weekly, the entity operating the power system and electricity market shall be responsible for announcing the highest value of water of hydropower plants participating in the market for the upcoming week to hydropower plants with reservoirs regulating from two days to one week.

3. In cases where the reservoir of a hydropower plant violates the first-week water level limit, the ceiling price quotation of this hydropower plant for the following week will be equal to the variable price of the most expensive oil-fired thermal power unit in the power system. When ensuring compliance with the first-week water level limit, the plant continues to apply the ceiling price quotation according to Clause 1 or Clause 2 of this Article from the third day of the week. Monthly, the entity operating the power system and electricity market shall be responsible for announcing the variable price of the most expensive oil-fired thermal power unit in the power system.

4. In cases where the hydropower plant located in a region with reserve capacity lower than 5% as announced according to the Process for Implementing Mid-term and Short-term Power System Security Assessment issued by the Electricity Regulatory Authority to guide the Implementation Regulation of the Transmission Power System issued by the Ministry of Industry and Trade, the ceiling price quotation of hydropower plants in this region for the evaluation week will be equal to the variable price of the most expensive oil-fired thermal power unit in the power system. When the reserve capacity of the region is equal to or higher than 5%, the plants in this region continue to apply the ceiling price quotation according to Clause 1 and Clause 2 of this Article.

5. Hydropower plants participating in the electricity market shall be responsible for quoting prices that meet the following requirements:

a) Compliance with the ceiling and floor price quotation regulations stipulated in Clauses 1, 2, 3, and 4 of this Article;
b) Requirements regarding downstream water usage constraints and other hydrological constraints.

Chapter V
ELECTRICITY MARKET OPERATIONS

Section 1
ELECTRICITY DAY-AHEAD MARKET OPERATIONS

Article 42. Information for Operating the Next Day Electricity Market

Before 10:00 on day D-1, the System Operation Unit and Electricity Market must determine, calculate, and publish the following information:

1. The load forecast curve for day D of the national power system and each region of North, Central, and South.

2. The expected generation volume during each trading cycle of the next day for strategic multi-purpose hydropower plants, BOT power plants, and power plants not directly bidding on the electricity market.

3. The total gas volume expected for the next day of combined-cycle thermal power plants using a shared gas source.

4. The expected export and import electricity volume during each trading cycle of day D.

5. Short-term system security assessment results for day D as prescribed in the Transmission System Regulation issued by the Ministry of Industry and Trade.

6. The expected generation volume of hydropower plants with reservoir regulation under two days during each trading cycle of the next day.

Article 43. Bid Sheet

The bid sheet shall be in accordance with Appendix 3 of this Circular and must comply with the following principles:

1. There can be a maximum of five pairs of bid prices (VND/kWh) and capacities (MW) for each unit for each trading cycle of day D.
2. The capacity in the bid sheet is the capacity at the generator terminal.
3. The capacity bid for the subsequent bid range cannot be lower than the capacity of the preceding bid range. The minimum bid increment is three MW.
4. Technical parameters of the unit, including:
a) The announced capacity of the unit for day D;
b) The lowest stable generation capacity of the unit;
c) The maximum rate of increase and decrease in capacity of the unit;
d) Technical constraints when operating multiple units simultaneously.
5. The announced capacity of the unit in the bid sheet for day D must not be lower than the announced capacity on day D-2 according to the Mid-term and Short-term System Security Assessment Implementation Procedures issued by the Electricity Regulatory Authority to guide the implementation of the Transmission System Regulation issued by the Ministry of Industry and Trade, except in cases of emergency maintenance or unforeseeable technical failures. Power plants are responsible for updating the announced capacity when reducing available capacity.
6. Under normal conditions, the first capacity bid range in the bid sheet of thermal power units must equal the lowest stable generation capacity of the unit. The last capacity bid range must equal the announced capacity. For thermal power plants in the process of startup or shutdown, hourly bids with capacity lower than the lowest stable generation capacity are allowed.
7. Hydropower plants may bid the first capacity range in each hour at zero (0) MW. For hydropower plants with regulation capability over two days, the last capacity bid range must equal the announced capacity.
8. The unit of bid price is VND/kWh, with the smallest decimal being 0.1.
9. The bid price must be within the floor and ceiling prices of the unit and cannot decrease with increasing bid capacity.

Article 44. Modification of Bid Sheets

1. Cases for Modifying Bid Sheets

The modified bid sheets of the Bidder Units shall apply in the following cases:

a) Thermal power units in the process of startup, grid connection, or shutdown: The Bidder Unit for the thermal power plant may modify and submit an increased or decreased capacity bid sheet for that thermal power unit;

b) Thermal power units grid-connected earlier than scheduled upon request of the System Operation Unit and Electricity Market: The Bidder Unit may modify and submit an increased announced capacity bid sheet for that thermal power unit;

c) Power generation units experiencing technical failures causing shutdown or reduction in available capacity; or unplanned maintenance of the unit approved by the System Operation Unit and Electricity Market according to the Transmission System Regulation issued by the Ministry of Industry and Trade: The Bidder Unit may modify and submit a reduced announced capacity bid sheet for that thermal power unit;

d) Hydropower plants with reservoir regulation under two days: The Bidder Unit may submit a modified bid sheet consistent with actual operational conditions (in cases where water inflow exceeds the reservoir's capacity leading to spillage or the reservoir level drops to the dead storage level);

đ) Hydropower plants with reservoir regulation of two days or more: The Bidder Unit may modify the bid sheet in the following cases:

- Requests for downstream water supply on day D from hydropower plants as stipulated in the reservoir operation procedures (or inter-reservoir procedures) or government agency directives determined after 11:30 on day D-1;

- Reservoir levels of hydropower plants violating the specified levels in the reservoir operation procedures or reaching the spillway threshold due to higher-than-forecasted water inflow into the reservoir on day D;

- Hydropower plants unable to meet downstream water supply requirements on day D due to technical failures in the power plant's units on day D.

2. Principles for Modifying Bid Sheets

a) For the cases stipulated in Points a, b, and c Clause 1 of this Article:

- Modified bid sheets cannot change bid prices compared to the bid sheets of the Bidder Unit for the next day;

- Modified bid sheets cannot change capacities at levels smaller than or equal to the announced capacity for the upcoming hour, except in cases of technical bid requirements violations;

- In the case stipulated in Point a Clause 1 of this Article: Modified bid sheets of thermal power units have five equal capacity bid ranges equal to the expected generation capacity during the grid connection or shutdown process;

- In the case stipulated in Point b Clause 1 of this Article: Modified bid sheets increase capacity for early trading cycles on day D of grid-connected thermal power units earlier than scheduled, except for the cycles specified in Point b of this Clause, which are valid bid sheets of the most recent cycle with announced capacity greater than zero (0) MW of the unit.

b) For the cases stipulated in Point đ Clause 1 of this Article:

- Power generation units may only change capacity levels in the bid ranges of the bid sheet for the next day.

- The power generation unit shall submit to the System Operation and Electricity Market Unit (through the Electricity Market Information System) the revised bid for the remaining trading cycles on Day D, along with the reasons and necessary information and data for the System Operation and Electricity Market Unit to consider and approve the use of the revised bid.

- The revised bid must comply with the provisions set forth in Article 43 of this Circular.

3. The bidding entity is permitted to revise and resubmit the next day's bid or for the remaining trading cycles on Day D to the System Operation and Electricity Market Unit at least 45 minutes before the trading cycle in which the bid revision occurs.

4. After receiving the revised bid from the bidding entity, the System Operation and Electricity Market Unit shall, based on the actual situation of the power system, conduct verification and confirm the validity of the revised bid.

a) In case the revised bid is invalid, the System Operation and Electricity Market Unit shall be responsible for informing the power generation unit of the reasons.

b) In case the revised bid is valid,

- For increased capacity revised bids (except for cases stipulated in Points d and đ of Clause 1 of this Article): The System Operation and Electricity Market Unit shall be responsible for using this revised bid during the electricity market operation when the next-day, next-hour dispatch forecast indicates a shortage of capacity or in other necessary situations to ensure power supply security.

- For all other cases: The System Operation and Electricity Market Unit shall be responsible for using this revised bid during the electricity market operation.

Article 45. Bidding for Cascade Hydroelectric Power Plants

1. The cascade hydroelectric power plant group shall be responsible for bidding according to a single joint bid and adhering to the price bidding limits as prescribed in Article 41 of this Circular.

2. The power plants within the cascade hydroelectric power plant group shall be responsible for negotiating and agreeing on a representative bidding entity. The representative bidding entity for the cascade hydroelectric power plant group shall be responsible for submitting the registration document accompanied by the agreement document among the power plants in the group to the System Operation and Electricity Market Unit.

3. In the absence of registering a representative bidding entity for the cascade hydroelectric power plant group, the System Operation and Electricity Market Unit shall be responsible for announcing the dispatch diagram for the power plants in this group based on the calculated water value of the group.

4. The representative bidding entity shall be responsible for complying with the bidding regulations for all power plants within the cascade hydroelectric power plant group.

5. In the event that a hydroelectric power plant within the cascade hydroelectric power plant group proposes to bid independently, based on the proposal of the hydroelectric power plant within the cascade hydroelectric power plant group and the optimal water usage constraints of the entire group, the Electricity Regulatory Authority shall be responsible for reviewing and deciding on the bidding of this hydroelectric power plant.

6. The water value of the cascade hydroelectric power plant group is the water value of the largest reservoir in the cascade. The System Operation and Electricity Market Unit shall be responsible for determining the reservoir used to calculate the water value for the cascade hydroelectric power plant group together with the classification of hydroelectric power plants as prescribed in Article 18 of this Circular.

7. In the case where the cascade hydroelectric power plant group includes a multi-purpose strategic hydroelectric power plant,

a)The System Operation and Electricity Market Unit shall be responsible for announcing the hourly generation volume for each power plant in the cascade hydroelectric power plant group in the upcoming week as prescribed in Clause 2 of Article 39 of this Circular;
b)When the announced generation volume of the multi-purpose hydroelectric power plant in the group is adjusted according to the provisions of Article 56 of this Circular, the System Operation and Electricity Market Unit shall be responsible for adjusting the announced generation volume of the power plants in the lower cascade stages accordingly.

Article 46. Bidding for hydropower plants other than regulated reservoirs

1. Hydropower plants with regulated reservoirs of two days or more shall bid on the market and comply with the bidding price limits as stipulated in Article 41 of this Circular.

2. Hydropower plants with regulated reservoirs under two days shall be responsible for submitting their day D bidding offers to the System Operation Unit and the electricity market. The bidding offer of such plants shall be specified as follows:

a) The bidding price is VND 0/kWh for all bidding bands;
b) The bidding capacity is equal to the expected generation capacity of the unit during the trading cycle.
3. Hydropower plants with regulated reservoirs under two days are permitted to submit hourly bidding offers to adjust capacity according to the actual hydrological conditions of the plant.

Article 47. Submission of Bidding Offers

1. Before 11:30 AM on day D-1 (the deadline for bidding for day D), the bidding entity shall be responsible for submitting the day D bidding offer.

2. The bidding entity shall submit the bidding offer through the Electricity Market Information System. In case of technical issues preventing the use of the Electricity Market Information System, the bidding entity shall coordinate with the System Operation Unit and the electricity market to agree on alternative submission methods in the following priority order:

a) By email to the address specified by the System Operation Unit and the electricity market;
b) By fax to the number specified by the System Operation Unit and the electricity market;
c) Submitting the bidding offer directly at the office of the System Operation Unit and the electricity market.

Article 48. Verification of the Validity of Bidding Offers

1. Before 11:00 AM on day D-1, the System Operation Unit and the electricity market shall be responsible for verifying the validity of the received bidding offers in accordance with Article 43 of this Circular. If multiple bidding offers are submitted by the bidding entity, only the last received bidding offer will be considered.

2. In case of an invalid bidding offer, the System Operation Unit and the electricity market shall notify the entity that submitted the bidding offer and request it to resubmit the final bidding offer before the bidding deadline for the next day.

3. Upon receiving notification from the System Operation Unit and the electricity market regarding an invalid bidding offer, the bidding entity shall be responsible for revising and resubmitting the bidding offer before the bidding deadline.

Article 49. Scheduling Bidding Offer

1. After the bidding deadline, the System Operation Unit and the electricity market shall be responsible for verifying the validity of the final received bidding offers in accordance with Article 43 of this Circular. The final valid bidding offer shall be used as the scheduling bidding offer for the next day's scheduling.

2. In case the System Operation Unit and the electricity market do not receive a bidding offer or the final bidding offer of the bidding entity is invalid, the System Operation Unit and the electricity market shall use the default bidding offer of the power plant as the scheduling bidding offer.

3. The default bidding offer of the power plant is determined as follows:

a) For thermal power plants, the default bidding offer is the most recent valid bidding offer. In case the most recent valid bidding offer does not match the actual operational status of the unit, the default bidding offer is the corresponding bidding offer based on the current status and fuel type in the default bidding offer set applicable for the month, which the bidding entity is responsible for developing and submitting to the System Operation Unit and the electricity market before the 28th of each month;
b) For hydropower plants and cascaded hydropower plants, the default bidding offer is the bidding offer with the highest ceiling price as stipulated in Article 41 of this Circular.

4. The mandatory bidding offer of hydropower plants violating the water level limit for two consecutive weeks is the bidding offer with a price of VND 0/kWh for all bidding bands to ensure the minimum requirement for downstream water security (flood control, irrigation, ecological flow) as prescribed in the inter-reservoir operation procedures and single-reservoir operation procedures or as required by the competent authority, while the prices for the remaining bidding bands are the highest between the water value and the price variation of the most expensive oil-fired thermal power unit in the system.

Article 50. Data for Scheduling the Next Day's Dispatch

The system operator and electricity market entity shall be responsible for using the following data to schedule the next day's dispatch:

1. National power system load profile and load profiles for each region (North, Central, South).

2. Bids for scheduling from bidding entities.

3. Expected generation volume in each trading cycle of the next day for power plants as stipulated in Clause 2, Article 42, Clause 7, Article 45, and Point b, Clause 2, Article 46 of this Circular.

4. Exported and imported electricity volumes as prescribed in Articles 64 and 65 of this Circular.

5. Capacity of units providing ancillary services at power plants.

6. Requirements for spinning reserve and frequency regulation capacity.

7. Maintenance and repair schedules for transmission grids and generating units approved by the system operator and electricity market entity.

8. Testing schedules for generating units.

9. Dispatch diagrams of power plants whose participation rights in the electricity market have been suspended as prescribed in Clause 3, Article 8 of this Circular.

10. Short-term system security assessment results for day D as prescribed in the Transmission System Regulation issued by the Ministry of Industry and Trade.

11. Updated information on the readiness of the transmission grid and generating units from the SCADA system or provided by the transmission entity and generating entities.

Article 51. Scheduling the Next Day's Dispatch

The system operator and electricity market entity shall be responsible for scheduling the next day's dispatch. The next day's dispatch schedule includes:

1. Unconstrained dispatch schedule, including:

a)Expected electricity price in each trading cycle of the next day;
b)Order of dispatching generating units in each trading cycle of the next day.

2. Constrained dispatch schedule, including:

a)Expected dispatch diagram for each unit in each trading cycle of the next day, price margins for each region in each trading cycle of the next day;
b)Shutdown, startup, and grid connection status schedule for each unit in the next day;
c)Operation mode, expected system wiring diagram in each trading cycle of the next day;
d)Warning information (if any).

3. Scheduling the next day's dispatch in cases of excess capacity

The system operator and electricity market entity shall calculate the gradual reduction of capacity to the lowest stable generation level or shutdown and reschedule the startup time of units in cases of excess capacity according to the following principles:

  1. Reduce capacity of units with higher electricity purchase and sale contract prices first;
  2. Shutdown units with higher electricity purchase and sale contract prices first;
  3. Shutdown units with lower startup costs first;
  4. Restart units with lower electricity purchase and sale contract prices first;

d)Calculate the shutdown time of units to meet system requirements and minimize multiple start-stop cycles.

Article 52. Announcing the Next Day's Dispatch Schedule

Before 16:00 daily, the system operator and electricity market entity shall be responsible for announcing the information in the next day's dispatch schedule, specifically as follows:

1. Expected dispatch capacity including frequency regulation and spinning reserve capacity of units in each trading cycle of the next day. Price margins for each region in each trading cycle of the next day.

2. Expected electricity market price for each trading cycle of the next day.

3. List of units expected to increase or decrease capacity in each trading cycle of the next day.

4. Information about potential capacity shortage warnings for the next day (if any), including:

a)Trading cycles expected to experience capacity shortages;
b)Amount of capacity shortage;
c)Violations of system security constraints.

5. Information about potential excess capacity warnings (if any) for the next day, including:

a)Trading cycles expected to experience excess capacity;
b)Units expected to stop generating electricity.

Article 53. Grid Synchronization of Power Generation Units

1. For slow-start units, the Power Generation Unit shall be responsible for preparing to synchronize this unit with the grid according to the daily dispatch schedule announced by the System Operation Unit and the Electricity Market. In cases where the start-up time of the unit exceeds 24 hours, the Power Generation Unit shall be responsible for synchronizing this unit based on the short-term system security assessment results announced by the System Operation Unit and the Electricity Market.

2. For units that are not slow-start units, the Power Generation Unit shall be responsible for preparing to synchronize this unit with the grid according to the hourly dispatch schedule announced by the System Operation Unit and the Electricity Market.

3. During the grid synchronization process of thermal power units, the Power Generation Unit shall be responsible for updating the hourly capacity into the previous hour's bid 60 minutes before the trading cycle to serve operational purposes and market calculation.

Article 54. Handling in Cases of Power Deficiency Warnings

1. The System Operation Unit and the Electricity Market are permitted to adjust the published capacity of multi-purpose hydropower plants as stipulated in Clause 2, Article 56 of this Circular.
2. The System Operation Unit and the Electricity Market shall be responsible for using the increased capacity bids as the price-based scheduling bids to create the next hourly dispatch schedule and calculate the electricity market price.

Section 2
OPERATIONS OF THE HOURLY ELECTRICITY MARKET

Article 55. Data for Creating the Next Hourly Dispatch Schedule

The System Operation Unit and the Electricity Market shall be responsible for using the following data to create the next hourly dispatch schedule:

1. The national power system load curve and each region's (North, Central, South) forecasted load curve for the next hour and the subsequent three hours.

2. The synchronization plan of slow-start units according to the daily dispatch schedule already announced.

3. The price-based scheduling bids of bidding entities that have updated the hourly bids of slow-start units during the synchronization process, the hourly bids of units during the shutdown due to accidents or reduction in capacity due to technical accidents,gthe hourly bids of units announcing increased capacity in case of power deficiency in the system, entities are allowed to update the hourly bids at least 45 minutes before the trading cycle.

4. The output of multi-purpose hydropower plants.

5. Frequency regulation capacity, spinning reserve, fast-start reserve, and forced generation required by system security constraints for the next hour.

6. The transmission network and power generation unit readiness status from the SCADA system or provided by the Transmission Unit and power generation units.

7. Other system security constraints.

8. Testing schedules for generating units.

9. The published capacity according to the next day's dispatch schedule of power plants not directly bidding on the electricity market.

10. Imported electricity volume.

Article 56. Adjustment of Published Output of Multi-Purpose Hydropower Plants

1. Before creating the next hourly dispatch schedule, the System Operation Unit and the Electricity Market are permitted to adjust the hourly output of multi-purpose hydropower plants that have been published according to the provisions of Clause 2, Article 42 of this Circular in the following cases:

a) There is an unusual hydrological fluctuation;
b) There is a power deficiency warning according to the next day's dispatch schedule;
c) There is a decision by the competent state management agency regarding the regulation of the reservoir of multi-purpose hydropower plants for flood control and irrigation purposes.

2. The range of adjustment of the hourly output of multi-purpose hydropower plants in the cases stipulated in Points a and b of Clause 1 of this Article is ±5% of the total installed capacity of multi-purpose hydropower plants in the system excluding the portion reserved for frequency regulation and spinning reserve.

Article 57. Scheduling for the next hour

1. The system operator and electricity market entity shall be responsible for scheduling the power generation units for the next hour using both constrained and unconstrained scheduling methods.

2. Scheduling for the next hour in case of insufficient capacity

a) The system operator and electricity market entity shall schedule the power generation units in the following order:
- According to the bidding schedule;
- Strategic multi-purpose hydropower plants according to adjustable capacity;
- Power generation units providing fast-start reserve services according to the next-day scheduling plan;
- Power generation units providing operational services due to system security constraints;
- Spinning reserve capacity;
- Reducing non-spinning reserve capacity to the lowest allowable level.
b) The system operator and electricity market entity shall check and determine the amount of capacity expected to be shed to ensure system security.

3. Scheduling for the next hour in case of excess capacity

The system operator and electricity market entity shall adjust the scheduling for the next hour through the following measures in sequence:

a) Stopping voluntary shutdown power generation units;
b) Gradually reducing the output of slow-start power generation units to the lowest stable output level;
c) Minimizing the output of power generation units providing spinning reserve services;
d) Minimizing the output of power generation units providing frequency regulation services;

e) Stopping slow-start power generation units in the following order:

- With the shortest start-up time;

- With the highest purchase and sale electricity contract price from high to low;

- With the lowest start-up cost from low to high. The start-up cost is agreed upon by the sole bulk buyer with the power generation entity and provided to the system operator and electricity market entity;

- With the lowest capacity sufficient to resolve excess capacity conditions.

Article 58. Announcing the scheduling for the next hour

The system operator and electricity market entity shall announce the scheduling for the next hour 15 minutes before the trading cycle, including the following contents:

1. The forecast load for the next hour of the national power system and each region North, Central, South.

2. The scheduling of power generation units, marginal prices for each region North, Central, South in the next hour and the subsequent three hours as prescribed in Article 57 of this Circular.

3. Measures taken by the system operator and electricity market entity in cases of insufficient or excess capacity.

4. Information on adjustments in capacity announcements of strategic multi-purpose hydropower plants as prescribed in Article 56 of this Circular.

5. The planned load shedding schedule (if any).

Section 3
REAL-TIME OPERATIONS

Article 59. Real-time dispatching of the power system

1. The system operator and electricity market entity shall operate the power system in real-time based on the announced scheduling for the next hour and comply with the regulations on real-time power system operation as stipulated in the Transmission System Regulation issued by the Ministry of Industry and Trade.

2. Power generation entities shall comply with the dispatch orders of the system operator and electricity market entity.

3. Power generation entities owning hydropower plants shall comply with the regulations on water level limits as prescribed in Article 39 of this Circular.

Article 60. Handling in cases where the reservoir of a hydropower plant violates the weekly water level limit

1. The entity operating the power system and electricity market shall be responsible for warning about the violation of the weekly water level limit by the plant, and the power plant shall be responsible for adjusting its bidding price in subsequent days to ensure that it does not violate the weekly water level limit in the following week.

2. In the event that the hydropower plant's bidding leads to the reservoir violating the weekly water level limit for two consecutive weeks, starting from 00:00 on Monday of the following week, the bid of this power plant will not be used to prepare the dispatch schedule. The entity operating the power system and electricity market shall prepare the dispatch schedule for these plants based on the mandatory bids established for the power plant to bring the reservoir water level back to the weekly water level limit.

In the case where the hydropower reservoir violates the weekly water level limit for two consecutive weeks due to the operation of the entity running the power system and electricity market to ensure power system security, the mandatory bidding will not be applied.

3. Once the weekly water level limit violation is ensured not to occur, the hydropower plant may continue to participate in bidding for the following week.

4. Before 10:00 on Monday, the entity operating the power system and electricity market shall be responsible for notifying the power generation unit and the sole bulk buyer about the dispatch schedule from Tuesday in the following cases:

a) The plant violated the reservoir water level limit in the first week and the plant violated the water level limit for the second consecutive week;

b) The list of plants that have ceased to violate the weekly water level limit and are implementing bidding for the upcoming day.

Article 61. Intervening in the Electricity Market

1. The entity operating the power system and electricity market is permitted to intervene in the electricity market in the following cases:

a) The system is operating under emergency conditions as defined in the Power Transmission System Regulation issued by the Ministry of Industry and Trade;
b) It is impossible to issue the dispatch schedule fifteen minutes before the operational hour.

2. In the event of intervening in the electricity market, the entity operating the power system and electricity market shall be responsible for mobilizing units to ensure the following priority objectives:

a) Ensuring balance between generation capacity and load;
b) Meeting frequency reserve requirements;
c) Meeting spinning reserve requirements;
d) Meeting voltage quality requirements.

3. Announcing information about intervening in the electricity market

a) When intervening in the electricity market, the entity operating the power system and electricity market must announce the following contents:
- Reasons for intervening in the electricity market;
- Expected trading cycles to be intervened in the electricity market.
b) Within twenty-four hours from the end of the intervention in the electricity market, the entity operating the power system and electricity market shall be responsible for announcing the following contents:
- Reasons for intervening in the electricity market;
- Trading cycles intervened in the electricity market;
- Measures taken by the entity operating the power system and electricity market to intervene in the electricity market.

Article 62. Halting the Electricity Market

1. The electricity market ceases operations when any of the following situations occur:

a) Due to emergency situations caused by natural disasters or national defense security protection;
b) Due to the entity operating the power system and electricity market proposing to halt the electricity market in one of the following cases:
- The power system operates in extreme emergency mode as stipulated in the Power Transmission System Regulation issued by the Ministry of Industry and Trade;
- Failure to ensure safe and continuous operation of the electricity market.
c) Other cases as required by competent authorities.

2. The Electricity Regulatory Authority is responsible for reviewing and deciding to halt the electricity market in the cases specified in Point a and Point b Clause 1 of this Article and notifying the entity operating the power system and electricity market.

3. The entity operating the power system and electricity market shall be responsible for informing the participants in the electricity market about the decision to halt the electricity market made by the Electricity Regulatory Authority and by the competent authority.

4. Operating the power system during the halt of the electricity market

a) The entity operating the power system and electricity market shall be responsible for scheduling and operating the power system according to the following principles:
- Ensuring safe, stable, reliable operation of the system with the lowest cost of electricity purchase for the entire system;
- Ensuring the fulfillment of production volume agreements in export and import electricity contracts, BOT power plant electricity purchase and sale contracts, and electricity purchase and sale contracts with production volume commitments from other power plants;
- Ensuring compliance with downstream water supply requirements for hydropower plants;
b) Power generation units, power transmission units, and other related units shall be responsible for complying with the dispatch orders of the entity operating the power system and electricity market.

Article 63. Restoration of the Electricity Market

1. The electricity market shall be restored to operation when the following conditions are met:

a) The causes leading to the suspension of the electricity market have been resolved;
b) The system operator and the electricity market confirm the ability to resume the operation of the electricity market.

2. The Electricity Regulatory Authority shall be responsible for reviewing and deciding on the restoration of the electricity market and notifying the system operator and the electricity market.

3. The system operator and the electricity market shall be responsible for informing the participants in the electricity market about the decision to restore the electricity market made by the Electricity Regulatory Authority.

Section 4
EXPORT AND IMPORT OF ELECTRICITY
IN THE OPERATION OF THE ELECTRICITY MARKET

Article 64. Handling of Exported Electricity in Dispatch Planning

1. Before 10:00 on day D-1, the system operator and the electricity market shall be responsible for announcing the expected volume of exported electricity in each trading cycle of day D.

2. The volume of exported electricity shall be calculated as load at the export point and used to forecast system load for dispatch planning of the next day and hour.

Article 65. Handling of Imported Electricity in Dispatch Planning

1. Before 10:00 on day D-1, the system operator and the electricity market shall be responsible for announcing the expected volume of imported electricity in each trading cycle of day D.

2. In dispatch planning, the volume of imported electricity shall be treated as a required generation with a previously announced profile for the next day.

Article 66. Payment for Exported and Imported Electricity

The volume of imported electricity shall be paid according to the power purchase and sale contracts signed between the parties.

Chapter VI
CALCULATION OF ELECTRICITY PRICES IN THE MARKET AND
PAYMENTS IN THE ELECTRICITY MARKET

Section 1
MEASUREMENT DATA

Article 67. Provision of Measurement Data

1. Before 15:00 on day D+1, the entity managing measurement data shall be responsible for providing the system operator and the electricity market and the sole bulk buyer with the measurement data of each trading cycle of day D.

2. Before the eighth working day after the end of the settlement period, the entity managing measurement data shall be responsible for providing the system operator and the electricity market with the measurement data of the settlement period as prescribed in the Regulation on Measurement of Electricity in the Competitive Power Generation Market issued by the Ministry of Industry and Trade.

Article 68. Storage of Measurement Data

The system operator and the electricity market shall be responsible for storing measurement data and related records for a minimum period of five years.

Section 2
CALCULATION OF ELECTRICITY PRICES IN THE MARKET
AND CAPACITY PAYMENTS

Article 69. Determination of Market Electricity Prices

1. After trading day D, the system operator and the electricity market shall be responsible for preparing the schedule for calculating market electricity prices for each trading cycle of day D in the following sequence:

a) Calculating system load in the trading cycle by converting measured production volumes to the head-end side of generating units;
b) Implementing the schedule for calculating market electricity prices using the non-binding dispatch method in the following order:
- Fixing the actual generation volumes of indirect market electricity traders, imported electricity, BOT power plants, test units, power plants in industrial zones selling only part of their output to the national grid, and units separated from the market electricity under the base load portion of the system load profile;
- Arranging the capacity bands in the bidding schedules of direct market electricity traders.

2. The market electricity price shall be equal to the bid price of the last capacity band scheduled to meet the system load level in the pricing schedule. If the bid price of the last capacity band in the pricing schedule exceeds the market electricity price ceiling, the market electricity price shall be calculated based on the market electricity price ceiling.

3. Before 9:00 on day D+2, the system operator and the electricity market shall be responsible for announcing the market electricity price for each trading cycle of day D.

Article 70. Determining Payment Capacity

1. Principles for determining payment capacity for each trading cycle:

  1. Power units participating in electricity generation in each cycle on the market shall be scheduled to receive the market capacity price for that cycle, except for slow-start units that have stopped to serve as reserves and units that have stopped due to accidents.
  2. For power units not providing spinning reserve and frequency regulation services, the payment capacity of the unit equals the amount of electrical energy generated by the unit at the metering point during the trading cycle.

2. Before 9:00 AM on day D+2, the System Operation Unit and Electricity Market shall be responsible for announcing the quantity of payment capacity for each power unit in the trading cycles of day D.

Article 71. Determining Market Electricity Price and Payment Capacity When Intervening in the Electricity Market

1. In cases where the intervention time in the market is less than 24 hours

a)The System Operation Unit and Electricity Market shall use valid bid prices to determine the market electricity price according to Article 69 of this Circular and the quantity of payment capacity according to Article 70 of this Circular;
b)In cases where power units do not have valid bid prices, the System Operation Unit and Electricity Market shall use the floor price for the contracted hourly output and the ceiling bid price for the non-contracted output to schedule the calculation of the market electricity price and the capacity schedule for that trading cycle.

2. In cases where the intervention time in the market is equal to or greater than 24 hours, the System Operation Unit and Electricity Market shall not be responsible for calculating the market electricity price and payment capacity for the period when the market is intervened.

Section 3
PAYMENT FOR GENERATING UNITS ENGAGED IN DIRECT TRADING

Article 72. Quantity of Electrical Energy for Settlement in the Electricity Market

1. The System Operation Unit and Electricity Market shall be responsible for calculating the components of the quantity of electrical energy of the power plant in the trading cycle for settlement in the electricity market, including:

a)The quantity of electrical energy paid based on the bid price for thermal power plants with bid prices higher than the market electricity price ceiling (Qbp);
b)Additional generation quantity (Qcon);
c)Generation quantity different from the dispatched quantity (Qdu);
d)Quantity of electrical energy paid based on the market electricity price (Qsmp).

2. The generation quantity different from the dispatched quantity (Qdu) of the power plant in the trading cycle shall be determined in the following sequence:

a)Determine the dispatched quantity

The dispatched quantity is the quantity at the generator terminal calculated based on the dispatch order of the System Operation Unit and Electricity Market, based on the dispatch capacity and the rate of load increase or decrease of the generating unit. The dispatched quantity is determined according to the following formula:

 

Where:

international: Trading cycle i;

power: Number of times the dispatch order changes in trading cycle i;

: Time point j in trading cycle i when the System Operation Unit and Electricity Market issue a dispatch order to change the capacity of the generating unit (minutes);

: Time point when the generating unit reaches the capacity ordered by the System Operation Unit and Electricity Market at time (minutes);

: Dispatched quantity at the generator terminal determined for trading cycle i;

: Capacity ordered by the System Operation Unit and Electricity Market for the generating unit at time ;

: Capacity reached by the unit at time .

The time interval from the dispatch order time to the time when the generating unit reaches the capacity is determined as follows:

 

Where:

a: Rate of load increase or decrease registered in the bidding schedule (MW/minute).

The rate of load increase or decrease registered in the bidding schedule must comply with the rate of load increase or decrease published in the power purchase and sale contract. In cases where the power purchase and sale contract does not specify the rate of load increase or decrease or if there is a discrepancy between the rate specified in the contract and the actual rate, the Generating Unit shall be responsible for determining these figures based on test results or compiled from the actual operation of the unit and signing a supplementary technical characteristic appendix to the sole bulk buyer's contract as the basis for settlement.
b)The System Operation Unit and Electricity Market shall be responsible for converting the dispatched quantity (Qddi j ) to the metering position;
c)The generation quantity different from the dispatched quantity is determined according to the following formula:

 

Where:

: Generation quantity different from the dispatched quantity converted to the metering position for trading cycle i;

: Measured quantity of electrical energy of the power plant in trading cycle i (kWh);

: Dispatched quantity converted to the metering position for trading cycle i.

d)In cases where thermal power units are in the process of starting up or shutting down (not due to accidents), the quantity Qdu equals zero (Qdu = 0). If the unit has technical constraints affecting the capacity of other units in the plant, those affected units also do not calculate the quantity Qdu (Qdu = 0).international e)For power units with installed capacity under 100 MW, the permissible dispatching energy error at the generator terminal is 5%, for units with installed capacity of 100 MW or more, it is 3%, but in all cases, it cannot be less than 1.5 MW. If the quantity falls within the permissible error range, this portion of the quantity is considered zero ( = 0).international = 0);

3. The quantity of electrical energy paid based on the bid price for thermal power plants with bid prices higher than the market electricity price ceiling in the trading cycle shall be determined as follows:

a)Identify the units with bid prices higher than the market electricity price ceiling scheduled to calculate the market price for trading cycle i and the metering position of the unit.

3. The quantity of electricity billed at the bid price for thermal power plants with bid prices higher than the market electricity price ceiling during the trading cycle shall be determined as follows:

a) Identify the generating units with bid prices higher than the market electricity price ceiling that are scheduled to have their market price calculated for trading cycle i and the metering point of such generating unit.
b) Calculate the quantity of electricity to be settled at the bid price at each specific metering point as determined in Point a of this Clause according to the following formula:

Where:

i: The ith trading cycle;

j: The jth metering point of the thermal power plant, as determined in Point a of this Clause;

: The quantity of electricity to be settled at the bid price at metering point j in the ith trading cycle (kWh);

: The measured quantity of electricity at metering point j in the ith trading cycle (kWh);

: The quantity of electricity corresponding to the amount of capacity with bid prices lower than or equal to the market electricity price ceiling in the ith trading cycle for units connected to metering point j and converted to that metering point (kWh);

: The quantity of electricity corresponding to the amount of capacity with bid prices higher than the market electricity price ceiling and included in the market price calculation schedule in the ith trading cycle for units connected to metering point j and converted to that metering point (kWh);

: The difference in electricity generation compared to the mobilized quantity according to the dispatch order for units connected to metering point j and converted to that metering point (kWh).

c) Calculate the quantity of electricity to be settled at the bid price for the power plant according to the following formula:

 

Where:

j: The jth metering point of the thermal power plant, as determined in Point a of this Clause;

J: The total number of metering points of the power plant with units bidding prices higher than the market electricity price ceiling and included in the market price calculation schedule;

: The quantity of electricity to be settled at the bid price for the power plant in the ith trading cycle (kWh);

: The quantity of electricity to be settled at the bid price at metering point j in the ith trading cycle (kWh).

4. The additional electricity generation quantity of the power plant in the trading cycle shall be determined in the following sequence:

a) Calculate the additional electricity generation quantity in the trading cycle at the generator terminal according to the following formula:
In the case where Qdu > 0:

 

         In the case where Qdu ≤ 0:

 

         Where:

         : The additional electricity generation quantity of the unit calculated at the generator terminal in the ith trading cycle (kWh);

          : The measured quantity of electricity to be settled of unit g in the ith trading cycle converted to the generator terminal (kWh);

international: Trading cycle i;

power: The number of times the dispatch order changes due to constraints in the ith trading cycle;

: The time point of the jth change in the dispatch order of the power generation unit by the System Operation and Electricity Market Unit due to constraints in the ith trading cycle (minutes). If at this time point, the power generation unit's capacity is lower than  , then  is determined as the time point when the unit reaches its capacity;

: The time point when the unit reaches the capacity ordered by the System Operation and Electricity Market Unit at time point  (minutes). If at this time point, the power generation unit's capacity is lower than  , then  is determined as the time point when the unit reaches its capacity;

: The capacity of the unit included in the market electricity price calculation schedule in the ith trading cycle (kW);

: The capacity ordered by the System Operation and Electricity Market Unit for the power generation unit at time point . If this capacity is smaller than  , it is considered as ;

: The capacity reached by the unit at time point ;

: The difference in electricity generation compared to the mobilized quantity according to the dispatch order converted to the generator terminal.

The time interval from the dispatch order time to the time when the generating unit reaches the capacity is determined as follows:

 

Where:

a: Rate of load increase or decrease registered in the bidding schedule (MW/minute).
b) Determine the additional electricity generation quantity in the trading cycle of the unit, , by converting the quantity  from the generator terminal position to the metering point position. In the case of a thermal power plant during startup or shutdown (not due to failure), is 0;
c) Calculate the additional electricity generation quantity of the power plant in the ith trading cycle according to the following formula:

 

Where:

: The total additional electricity generation quantity of the power plant in the ith trading cycle (kWh);

g: The additional generating unit of the power plant in the ith trading cycle;

G: The total number of additional generating units of the power plant in the ith trading cycle;

: The additional electricity generation quantity of unit g in the ith trading cycle (kWh).

5. The quantity of electricity to be settled at the market electricity price of the power plant in the ith trading cycle shall be determined according to the following formula:

a) In the case where the difference in electricity generation compared to the mobilized quantity according to the dispatch order is positive (> 0):

 

b) In the case where the difference in electricity generation compared to the mobilized quantity according to the dispatch order is negative (< 0):

 

Where:

: The quantity of electricity to be settled at the market electricity price for the power plant in the ith trading cycle (kWh);

: Sản lượng điện được thanh toán theo giá chào trong chu kỳ giao dịch i đối với nhà máy nhiệt điện có giá chào cao hơn giá trần thị trường điện (kWh);

: Sản lượng điện năng phát tăng thêm của nhà máy điện trong chu kỳ giao dịch i (kWh);

: Sản lượng điện năng phát sai khác so với sản lượng huy động theo lệnh điều độ trong chu kỳ giao dịch i.

Điều 73. Điều chỉnh sản lượng điện năng phục vụ thanh toán trong thị trường điện

1. Các thành phần sản lượng điện năng phục vụ thanh toán trong thị trường được điều chỉnh trong các trường hợp sau:
a) Trường hợp trong chu kỳ giao dịch i sản lượng điện năng đo đếm của nhà máy điện nhỏ hơn hoặc bằng sản lượng điện hợp đồng giờ ( ≤ );

b) Trường hợp trong chu kỳ giao dịch i sản lượng điện năng đo đếm của nhà máy điện lớn hơn sản lượng điện hợp đồng giờ của nhà máy điện ( > ) đồng thời sản lượng điện năng thanh toán theo giá điện năng thị trường của nhà máy điện nhỏ hơn sản lượng hợp đồng giờ ( < ).

2. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm tính toán điều chỉnh lại các thành phần sản lượng điện năng phục vụ thanh toán trong thị trường trong các chu kỳ giao dịch theo quy định tại Khoản 1 Điều 72 Thông tư này căn cứ vào các thành phần sản lượng sau:
a) Sản lượng điện hợp đồng giờ của nhà máy điện trong chu kỳ giao dịch i ( ) được xác định theo quy định tại Điều 37 Thông tư này;
b) Sản lượng điện năng thanh toán theo giá điện năng thị trường (Qsmpi) của nhà máy điện trong chu kỳ giao dịch i được xác định theo quy định tại Khoản 5 Điều 72 Thông tư này;
c) Sản lượng điện năng đo đếm của nhà máy điện trong chu kỳ giao dịch i ( ).

3. Nguyên tắc điều chỉnh

a) Trong trường hợp quy định tại Điểm a Khoản 1 Điều này, sản lượng điện năng phát tăng thêm (Qconi) và sản lượng điện năng thanh toán theo giá chào đối với nhà máy có giá chào cao hơn giá trần thị trường điện (Qbpi) được điều chỉnh trong chu kỳ giao dịch này bằng không (Qconi = 0; Qbpi = 0);

b) Trong trường hợp quy định tại Điểm b Khoản 1 Điều này, các sản lượng điện năng phục vụ thanh toán trong thị trường điện được điều chỉnh theo nguyên tắc đảm bảo không được làm thay đổi sản lượng điện năng đo đếm trong chu kỳ giao dịch này và theo quy định tại Quy trình lập lịch huy động các tổ máy phát điện, vận hành thời gian thực và tính toán thanh toán trong thị trường điện do Cục Điều tiết điện lực ban hành.

Điều 74. Thanh toán điện năng thị trường

1. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm tính toán tổng các khoản thanh toán điện năng thị trường của nhà máy điện trong chu kỳ thanh toán theo công thức sau:

 

Trong đó:

Rg: Tổng các khoản thanh toán điện năng thị trường trong chu kỳ thanh toán (đồng);

Rsmp: Khoản thanh toán cho phần sản lượng được thanh toán theo giá điện năng thị trường trong chu kỳ thanh toán (đồng);

Rbp: Khoản thanh toán cho phần sản lượng được thanh toán theo giá chào đối với các nhà máy nhiệt điện có giá chào lớn hơn giá trần thị trường điện trong chu kỳ thanh toán (đồng);

: Khoản thanh toán cho phần sản lượng điện năng phát tăng thêm trong chu kỳ thanh toán (đồng);

Rdu: Khoản thanh toán cho phần sản lượng điện năng phát sai khác so với sản lượng huy động theo lệnh độ trong chu kỳ thanh toán (đồng).

2. Khoản thanh toán cho phần sản lượng được thanh toán theo giá điện năng thị trường của nhà máy điện trong chu kỳ thanh toán được xác định theo trình tự sau:

a) Tính toán cho từng chu kỳ giao dịch theo công thức sau:

 

Trong đó:

: Khoản thanh toán cho phần sản lượng được thanh toán theo giá điện năng thị trường của nhà máy điện của chu kỳ giao dịch i trong chu kỳ thanh toán (đồng);

SMPi : Giá điện năng thị trường của chu kỳ giao dịch i trong chu kỳ thanh toán (đồng/kWh);

: Sản lượng điện năng được thanh toán theo giá điện năng thị trường của chu kỳ giao dịch i trong chu kỳ thanh toán (kWh).

b) Tính toán cho chu kỳ thanh toán theo công thức sau:

 

Trong đó:

: Khoản thanh toán cho phần sản lượng được thanh toán theo giá điện năng thị trường của nhà máy điện trong chu kỳ thanh toán (đồng);

i: Chu kỳ giao dịch thứ i trong chu kỳ thanh toán;

I: Tổng số chu kỳ giao dịch của chu kỳ thanh toán;

: Khoản thanh toán cho phần sản lượng được thanh toán theo giá điện năng thị trường của nhà máy điện của chu kỳ giao dịch i (đồng).

3. Khoản thanh toán cho phần sản lượng được thanh toán theo giá chào đối với nhà máy nhiệt điện có giá chào lớn hơn giá trần thị trường điện trong chu kỳ thanh toán được xác định theo trình tự sau:

a) Tính toán cho từng chu kỳ giao dịch theo công thức sau:

 

Trong đó:

: Khoản thanh toán cho phần điện năng chào cao hơn giá trần của nhà máy điện trong chu kỳ giao dịch i (đồng);

j: Dải chào thứ j trong bản chào giá của các tổ máy thuộc nhà máy nhiệt điện có giá chào cao hơn giá trần thị trường điện và được sắp xếp trong lịch tính giá điện năng thị trường;

J: Tổng số dải chào trong bản chào giá của nhà máy nhiệt điện có giá chào cao hơn giá trần thị trường điện và được sắp xếp trong lịch tính giá điện năng thị trường;

: Giá chào tương ứng với dải chào j trong bản chào giá của các tổ máy của nhà máy nhiệt điện g trong chu kỳ giao dịch i (đồng/kWh);

: Mức giá chào cao nhất trong các dải chào được sắp xếp trong lịch tính giá điện năng thị trường của nhà máy nhiệt điện trong chu kỳ giao dịch i (đồng/kWh);

: Tổng công suất được chào với mức giá  trong bản chào giá của nhà máy nhiệt điện được huy động trong chu kỳ giao dịch i và quy đổi về vị trí đo đếm (kWh);

: Tổng sản lượng điện năng có giá chào cao hơn giá trần thị trường điện của nhà máy nhiệt điện trong chu kỳ giao dịch i (kWh).

b) Tính toán cho chu kỳ thanh toán theo công thức sau:

 

Trong đó:

 : Khoản thanh toán cho phần điện năng chào cao hơn giá trần của nhà máy điện trong chu kỳ thanh toán (đồng);

i: Chu kỳ giao dịch i trong đó nhà máy điện được huy động với mức giá chào cao hơn giá trần;

I: Tổng số chu kỳ giao dịch trong đó nhà máy điện được huy động với mức giá chào cao hơn giá trần;

: Khoản thanh toán cho phần điện năng chào cao hơn giá trần của nhà máy điện trong chu kỳ giao dịch i (đồng).

4. Khoản thanh toán cho sản lượng điện năng phát tăng thêm của nhà máy điện trong chu kỳ giao dịch được xác định theo trình tự sau:

a)Tính toán cho từng chu kỳ giao dịch theo công thức sau:

 

Trong đó:

: Khoản thanh toán cho sản lượng điện năng phát tăng thêm trong chu kỳ giao dịch i (đồng);

g: Tổ máy phát tăng thêm của nhà máy điện trong chu kỳ giao dịch i;

G: Tổng số tổ máy phát tăng thêm của nhà máy điện trong chu kỳ giao dịch i;

: Điện năng phát tăng thêm của tổ máy g trong chu kỳ giao dịch i, (kWh);

: Giá chào cao nhất tương ứng với dải công suất phát tăng thêm của tổ máy g trong chu kỳ giao dịch i (đồng/kWh). Đối với các nhà máy thuỷ điện nếu giá chào này lớn hơn giá trần thị trường điện thì lấy bằng giá trần thị trường điện.

b)Tính toán cho chu kỳ thanh toán theo công thức sau:

 

Trong đó:

Rcon: Khoản thanh toán cho sản lượng điện năng phát tăng thêm trong chu kỳ thanh toán (đồng);

i: Chu kỳ giao dịch thứ i của chu kỳ thanh toán trong đó nhà máy điện phải phát tăng thêm theo lệnh điều độ;

I: Tổng số chu kỳ giao dịch của của chu kỳ thanh toán trong đó nhà máy điện phải phát tăng thêm theo lệnh điều độ;

Rconi : Khoản thanh toán cho sản lượng điện năng phát tăng thêm trong chu kỳ giao dịch i (đồng).

5. Trường hợp nhà máy thuỷ điện được huy động do điều kiện ràng buộc phải phát và có giá chào cao hơn giá trần thị trường điện hoặc được huy động công suất với dải chào giá cao hơn giá trần thị trường điện thì nhà máy được thanh toán cho phần sản lượng phát tương ứng trong chu kỳ đó bằng giá trần thị trường điện.

6. Khoản thanh toán cho sản lượng điện năng phát sai khác so với sản lượng huy động theo lệnh độ của nhà máy điện trong chu kỳ giao dịch.

a)Tính toán cho từng chu kỳ giao dịch theo công thức sau:
- Trường hợp sản lượng điện năng phát tăng thêm so với lệnh điều độ:

 

Trong đó:

: Khoản thanh toán cho sản lượng điện năng phát sai khác so với lệnh điều độ trong chu kỳ giao dịch i (đồng);

g: Tổ máy phát tăng thêm so với lệnh điều độ của nhà máy điện trong chu kỳ giao dịch i;

G: Tổng số tổ máy phát tăng thêm so với lệnh điều độ của nhà máy điện trong chu kỳ giao dịch i;

: Điện năng phát tăng thêm so với lệnh điều độ của tổ máy g trong chu kỳ giao dịch i, (kWh);

: Giá chào thấp nhất của tất cả các tổ máy trong chu kỳ giao dịch i (đồng/kWh).

- Trường hợp sản lượng điện năng phát giảm so với lệnh điều độ:
 
Trong đó:

: Khoản thanh toán cho sản lượng điện năng phát sai khác so với lệnh điều độ trong chu kỳ giao dịch i (đồng);

g: Tổ máy phát giảm so với lệnh điều độ của nhà máy điện trong chu kỳ giao dịch i;

G: Tổng số tổ máy phát giảm so với lệnh điều độ của nhà máy điện trong chu kỳ giao dịch i;

: Điện năng phát giảm so với lệnh điều độ của tổ máy g trong chu kỳ giao dịch i(kWh);
SMPi : Giá điện năng thị trường trong chu kỳ giao dịch i (đồng/kWh);

Pbpi,max: Giá điện năng của tổ máy đắt nhất được thanh toán trong chu kỳ giao dịch i.

b)Tính toán cho chu kỳ thanh toán theo công thức sau:
 


Trong đó:

: Khoản thanh toán cho sản lượng điện năng phát sai khác so với lệnh điều độ trong chu kỳ thanh toán (đồng);

i: Chu kỳ giao dịch thứ i của chu kỳ thanh toán trong đó nhà máy nhiệt điện đã phát sai khác so với lệnh điều độ;

I: Tổng số chu kỳ giao dịch của của chu kỳ thanh toán trong đó nhà máy nhiệt điện đã phát sai khác so với lệnh điều độ;

: Khoản thanh toán cho sản lượng điện năng phát sai khác so với sản lượng huy động theo lệnh độ trong chu kỳ giao dịch i (đồng).

Điều 75. Thanh toán công suất thị trường

Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm tính toán khoản thanh toán công suất thị trường cho nhà máy điện trong chu kỳ thanh toán theo trình tự sau:

1. Tính toán cho từng chu kỳ giao dịch theo công thức sau:

 

Trong đó:

: Khoản thanh toán công suất cho nhà máy điện trong chu kỳ giao dịch i (đồng);

g: Tổ máy của nhà máy điện được thanh toán theo giá công suất;

G: Tổng số các tổ máy của nhà máy điện được thanh toán theo giá công suất;

: Giá công suất thị trường trong chu kỳ giao dịch i (đồng/kW);

: Lượng công suất thanh toán của tổ máy g trong chu kỳ giao dịch i quy đổi về vị trí đo đếm (kW).

2. Tính toán cho chu kỳ thanh toán theo công thức sau:

 

Trong đó:

Rcan: Khoản thanh toán công suất cho nhà máy điện trong chu kỳ thanh toán (đồng);

i: Chu kỳ giao dịch thứ i trong chu kỳ thanh toán;

I: Tổng số chu kỳ giao dịch trong chu kỳ thanh toán;

Rcani : Khoản thanh toán công suất cho nhà máy điện trong chu kỳ giao dịch i (đồng).

Điều 76. Khoản thanh toán theo hợp đồng mua bán điện dạng sai khác

Căn cứ vào giá điện năng thị trường và giá công suất thị trường do Đơn vị vận hành hệ thống điện và thị trường điện công bố, Đơn vị phát điện có trách nhiệm tính toán khoản thanh toán theo hợp đồng mua bán điện dạng sai khác trong chu kỳ thanh toán theo trình tự sau:

Tính toán cho từng chu kỳ giao dịch theo công thức sau:

 

Trong đó:

: Khoản thanh toán sai khác trong chu kỳ giao dịch i (đồng);

: Sản lượng điện năng thanh toán theo giá hợp đồng trong chu kỳ giao dịch i (kWh);

c: Giá hợp đồng mua bán điện dạng sai khác (đồng/kWh). Đối với các nhà máy thuỷ điện giá hợp đồng này chưa bao gồm thuế tài nguyên nước và phí môi trường rừng;

SMPi: Giá điện năng thị trường trong chu kỳ giao dịch i (đồng/kWh);

CANi: Giá công suất thị trường trong chu kỳ giao dịch i (đồng/kWh).

Tính toán cho chu kỳ thanh toán theo công thức sau:

 

Trong đó:

Rc: Khoản thanh toán sai khác trong chu kỳ thanh toán (đồng);

i: Chu kỳ giao dịch thứ i của chu kỳ thanh toán;

I: Tổng số chu kỳ giao dịch của chu kỳ thanh toán;

: Khoản thanh toán sai khác trong chu kỳ giao dịch i (đồng).

Điều 77. Thanh toán khi can thiệp vào thị trường điện

1.Trường hợp thời gian can thiệp thị trường nhỏ hơn 24 giờ, Đơn vị phát điện được nhận các khoản thanh toán theo quy định tại Điều 74, Điều 75 và Điều 76 theo giá điện năng thị trường và lượng công suất thanh toán xác định tại Điều 71 Thông tư này.

2.Trường hợp thời gian can thiệp thị trường lớn hơn hoặc bằng 24 giờ, việc thanh toán cho Đơn vị phát điện được thực hiện theo thỏa thuận tại hợp đồng mua bán điện với Đơn vị mua buôn duy nhất phù hợp với trạng thái vận hành của nhà máy điện.

Điều 78. Thanh toán khi dừng thị trường điện

Trong thời gian dừng thị trường điện, việc thanh toán cho Đơn vị phát điện được thực hiện theo thỏa thuận tại hợp đồng mua bán điện với Đơn vị mua buôn duy nhất phù hợp với trạng thái vận hành của nhà máy điện.

Mục 4
THANH TOÁN DỊCH VỤ PHỤ TRỢ VÀ THANH TOÁN KHÁC

Điều 79. Thanh toán cho dịch vụ dự phòng quay và dịch vụ điều tần

Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm tính toán khoản thanh toán cho Đơn vị phát điện cung cấp dịch vụ dự phòng quay và dịch vụ điều tần theo quy định của Bộ Công Thương.   

Điều 80. Thanh toán cho dịch vụ dự phòng khởi động nhanh, dịch vụ vận hành phải phát do ràng buộc an ninh hệ thống điện, dịch vụ điều chỉnh điện áp và khởi động đen

Đơn vị cung cấp dịch vụ dự phòng khởi động nhanh, dịch vụ vận hành phải phát do ràng buộc an ninh hệ thống điện, dịch vụ điều chỉnh điện áp và khởi động đen được thanh toán theo hợp đồng cung cấp dịch vụ phụ trợ theo mẫu do Bộ Công Thương ban hành.

Điều 81. Thanh toán cho các nhà máy thuỷ điện có hồ chứa điều tiết dưới 02 ngày

1. Tính toán thanh toán doanh thu từng chu kỳ giao dịch cho các nhà máy có hồ chứa điều tiết dưới 02 ngày theo công thức sau:

Rgi = Pc × (Qhci × α) + (CANi + SMPi) × (Qhci ×(1 - α)) + Rdui

Trong đó:

Rgi: Khoản thanh toán cho nhà máy có hồ chứa điều tiết dưới 02 ngày trong chu kỳ giao dịch i (đồng);

Pc: Giá hợp đồng mua bán điện (đồng/kWh);

Qhci : Sản lượng điện hiệu chỉnh trong chu kỳ giao dịch i (kWh) được xác định như sau:

- Trường hợp Qdui > 0, Qhci = Qmi - Qdui;

- Trường hợp Qdui ≤ 0, Qhci = Qmi.

Qmi: Sản lượng điện năng tại vị trí đo đếm trong chu kỳ giao dịch i (kWh);

Qdui: Sản lượng điện năng phát sai khác so với mệnh lệnh điều độ (kWh) trong chu kỳ giao dịch i.

Rdui: Thanh toán cho sản lượng điện phát sai khác so với sản lượng huy động theo lệnh điều độ trong chu kỳ giao dịch i (đồng);

SMPi: Giá điện năng thị trường trong chu kỳ giao dịch i (đồng/kWh);

CANi: Giá công suất thị trường trong chu kỳ giao dịch i (đồng/kWh);

α: Tỷ lệ sản lượng điện năng thanh toán theo giá hợp đồng cho các nhà máy thủy điện có hồ điều tiết dưới 02 ngày do Cục Điều tiết điện lực quy định.

Đơn vị phát điện có trách nhiệm tính toán khoản thanh toán theo giá hợp đồng mua bán điện (Pc × Qhci × α). Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm tính toán các khoản thanh toán còn lại.

2. Thanh toán cho chu kỳ thanh toán theo công thức sau:

 

Trong đó:

: Khoản thanh toán cho nhà máy có hồ chứa điều tiết dưới 02 ngày (đồng);

i: Chu kỳ giao dịch thứ i cuả chu kỳ thanh toán;

I: Tổng số chu kỳ giao dịch của chu kỳ thanh toán;

Rgi : Khoản thanh toán cho nhà máy có hồ chứa điều tiết dưới 02 ngày trong chu kỳ giao dịch i (đồng).

Điều 82. Thanh toán khác

1.Đơn vị phát điện có tổ máy phát hoặc nhận công suất phản kháng trong chế độ chạy bù đồng bộ được thanh toán cho lượng điện năng hữu công nhận từ lưới điện theo quy định tại hợp đồng mua bán điện.

2.Trường hợp sản lượng đo đếm điện năng tháng do Đơn vị quản lý số liệu đo đếm cung cấp theo quy định tại Khoản 2 Điều 67có sai khác so với tổng điện năng đo đếm các ngày trong tháng do Đơn vị quản lý số liệu đo đếm cung cấp theo quy định tại Khoản 1 Điều 67Thông tư này, phần điện năng chênh lệch được thanh toán theo giá hợp đồng mua bán điện đã ký giữa Đơn vị mua buôn duy nhất và Đơn vị phát điện.

3.Tổ máy nhiệt điện bị buộc phải ngừng theo quy định tại Điểm đ Khoản 3 Điều 57Thông tư này hoặc phải ngừng 01 lò hơi để giảm công suất theo quy định tại Điểm b Khoản 3 Điều 57Thông tư này được thanh toán chi phí khởi động theo mức chi phí thỏa thuận giữa Đơn vị mua buôn duy nhất và Đơn vị phát điện. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm xác nhận các sự kiện này đối với các tổ máy do Đơn vị phát điện công bố để Đơn vị mua buôn duy nhất để làm căn cứ thanh toán chi phí khởi động.

4.Trường hợp nhà máy có tổ máy phát điện thí nghiệm thì tách toàn bộ nhà máy đó ra khỏi thị trường điện trong các chu kỳ chạy thí nghiệm. Toàn bộ sản lượng phát của nhà máy lên lưới trong các chu kỳ có thí nghiệm được thanh toán theo quy định tại hợp đồng mua bán điện đã ký với Đơn vị mua buôn duy nhất tương ứng với cấu hình tổ máy và loại nhiên liệu sử dụng.

5.Trường hợp các tổ máy nhiệt điện tuabin khí có chung đuôi hơi có thời điểm vận hành chu trình đơn, vận hành với nhiên liệu hỗn hợp hoặc không phải nhiên liệu chính theo yêu cầu của Đơn vị vận hành hệ thống điện và thị trường điện để đảm bảo an ninh hệ thống điện thì các chu kỳ giao dịch đó nhà máy điện được thanh toán theo giá điện trong hợp đồng mua bán điện đã ký với Đơn vị mua buôn duy nhất tương ứng với cấu hình tổ máy khi vận hành chu trình đơn, vận hành với nhiên liệu hỗn hợp hoặc không phải nhiên liệu chính.

6.Trường hợp nhà máy điện tuabin khí tạm thời gián tiếp tham gia thị trường điện theo yêu cầu của Đơn vị vận hành hệ thống điện và thị trường điện để đảm bảo an ninh hệ thống điện, toàn bộ sản lượng phát điện của nhà máy điện trong các chu kỳ giao dịch có liên quan được thanh toán theo quy định của hợp đồng mua bán điện.

7.Trường hợp tổ máy đã có kế hoạch ngừng máy được phê duyệt nhưng vẫn phải phát công suất theo yêu cầu của Đơn vị vận hành hệ thống điện và thị trường điện để đảm bảo an ninh hệ thống điện, thì tách toàn bộ nhà máy đó ra  thị trường điện trong khoảng thời gian phát công suất theo yêu cầu của Đơn vị vận hành hệ thống điện và thị trường điện. Toàn bộ sản lượng phát của nhà máy lên lưới trong khoảng thời gian này được thanh toán theo giá điện trong hợp đồng mua bán điện đã ký với Đơn vị mua buôn duy nhất.

8.Trường hợp nhà máy điện có tổ máy phát điện tách lưới phát độc lập theo yêu cầu của Đơn vị vận hành hệ thống điện và thị trường điện, toàn bộ sản lượng phát điện của nhà máy điện trong các chu kỳ giao dịch có liên quan được thanh toán theo giá điện trong hợp đồng mua bán điện đã ký với Đơn vị mua buôn duy nhất.

9.Trường hợp nhà máy điện có tổ máy phát điện tách khỏi hệ thống điện quốc gia và đấu nối vào lưới điện mua từ nước ngoài căn cứ theo kết quả tính toán vận hành hệ thống điện năm tới của Đơn vị vận hành hệ thống điện và thị trường điện, việc tham gia thị trường điện trong năm tới và thanh toán cho nhà máy điện này được quy định như sau:

a) Nhà máy thủy điện có hồ chứa điều tiết dưới 02 ngày có kế hoạch đấu nối vào lưới điện mua điện từ nước ngoài thì tách toàn bộ nhà máy điện này tham gia gián tiếp thị trường điện trong năm tới. Toàn bộ sản lượng phát điện của nhà máy điện trong năm tới được thanh toán theo giá điện trong hợp đồng mua bán điện đã ký với Đơn vị mua buôn duy nhất. Các nhà máy điện khác loại hình nhà máy thủy điện có hồ chứa điều tiết dưới 02 ngày có kế hoạch đấu nối vào lưới điện mua điện từ nước ngoài tiếp tục tham gia trực tiếp thị trường điện.

b) Các nhà máy điện không có kế hoạch đấu nối vào lưới điện mua điện từ nước ngoài có trách nhiệm tham gia trực tiếp thị trường điện trong năm tới (là đơn vị phát điện trực tiếp giao dịch). Trường hợp trong năm vận hành nhà máy điện này có tổ máy phát điện đấu nối vào lưới điện mua điện từ nước ngoài, toàn bộ sản lượng phát điện của nhà máy điện trong ngày giao dịch mà tổ máy có chu kỳ đấu nối vào lưới điện mua điện từ nước ngoài được thanh toán theo giá điện trong hợp đồng mua bán điện đã ký với Đơn vị mua buôn duy nhất.

10.Trường hợp tổ máy thủy điện phải phát công suất lớn hơn công suất công bố trong bản chào giá lập lịch theo yêu cầu của Đơn vị vận hành hệ thống điện và thị trường điện vì lý do an ninh hệ thống, toàn bộ sản lượng phát của nhà máy lên lưới trong khoảng thời gian này được thanh toán theo giá điện trong hợp đồng mua bán điện đã ký với Đơn vị mua buôn duy nhất.

11.Trường hợp nhà máy thủy điện tham gia điều chỉnh tần số cấp I theo yêu cầu của Đơn vị vận hành hệ thống điện và thị trường điện, toàn bộ sản lượng phát điện của nhà máy điện trong các chu kỳ liên quan được thanh toán theo cơ chế nhà máy thủy điện có hồ chứa điều tiết dưới 02 ngày, không tính đến sản lượng điện năng phát sai khác so với lệnh điều độ (Qdu=0). Các nhà máy thủy điện cùng nhóm nhà máy thủy điện bậc thang (nếu có) của các nhà máy tham gia điều tần cấp I được thanh toán theo cơ chế nhà máy thủy điện có hồ chứa điều tiết dưới 02 ngày, có xét đến sản lượng điện năng phát sai khác so với lệnh điều độ.

12.Trường hợp nhà máy điện có tổ máy phát điện tham gia thử nghiệm hệ thống tự động điều chỉnh công suất (AGC) theo yêu cầu của Đơn vị vận hành hệ thống điện và thị trường điện thì tách toàn bộ nhà máy điện này ra ngoài thị trường điện, toàn bộ sản lượng phát của nhà máy lên lưới trong các chu kỳ có thử nghiệm được thanh toán theo giá hợp đồng mua bán điện (giá Pc toàn phần) đã ký với Đơn vị mua buôn duy nhất. Trước ngày 01 tháng 12 năm N-1, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm lập và công bố danh sách các tổ máy phát điện dự kiến tham gia thử nghiệm hệ thống tự động điều chỉnh công suất (AGC) trong năm N cho các thành viên tham gia thị trường điện.

Mục 5

TRÌNH TỰ, THỦ TỤC THANH TOÁN

Điều 83. Số liệu phục vụ tính toán thanh toán thị trường điện

Trước 9h00 ngày D+2, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm tổng hợp và cung cấp cho Đơn vị mua buôn duy nhất và các đơn vị phát điện số liệu phục vụ việc tính toán thanh toán cho từng nhà máy điện theo quy định tại Phụ lục 6 Thông tư này.

Điều 84. Bảng kê thanh toán thị trường điện cho ngày giao dịch

1. Trước ngày D+4, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm lập và gửi cho Đơn vị mua buôn duy nhất và các đơn vị phát điện bảng kê thanh toán thị trường điện sơ bộ cho ngày giao dịch D qua trang thông tin điện tử thị trường điện theo mẫu quy định tại Phụ lục 4 Thông tư này.

2. Trước ngày D+6, Đơn vị phát điện trực tiếp giao dịch và Đơn vị mua buôn duy nhất có trách nhiệm xác nhận bảng kê thanh toán thị trường điện theo quy định trên trang thông tin điện tử thị trường điện; thông báo lại cho Đơn vị vận hành hệ thống điện và thị trường điện các sai sót trong bảng kê thanh toán thị trường điện sơ bộ (nếu có).

3. Ngày D+6, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm lập và gửi cho Đơn vị mua buôn duy nhất và các đơn vị phát điện bảng kê thanh toán thị trường điện hoàn chỉnh cho ngày D qua trang thông tin điện tử thị trường điện theo biểu mẫu tại Phụ lục 4 Thông tư này. Đơn vị phát điện có trách nhiệm phát hành bảng kê thanh toán ngày và đưa vào hồ sơ phục vụ công tác thanh toán cho chu kỳ thanh toán.

Điều 85. Bảng kê thanh toán thị trường điện cho chu kỳ thanh toán

1. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm tổng hợp các số liệu thanh toán cho tất cả ngày giao dịch trong chu kỳ thanh toán và kiểm tra, đối chiếu với biên bản tổng hợp sản lượng điện năng do Đơn vị quản lý số liệu đo đếm điện năng cung cấp.

2. Trong thời hạn 10 ngày làm việc kể từ ngày giao dịch cuối cùng của chu kỳ thanh toán, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm lập và phát hành bảng kê thanh toán thị trường điện cho chu kỳ thanh toán.

3. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm lập và phát hành bảng kê thanh toán thị trường điện của chu kỳ thanh toán cho Đơn vị mua buôn duy nhất và Đơn vị phát điện.

4. Bảng kê thanh toán thị trường điện cho chu kỳ thanh toán bao gồm bảng tổng hợp theo mẫu quy định tại Phụ lục 5 Thông tư này và biên bản xác nhận chỉ số công tơ và sản lượng điện năng.

5. Hình thức xác nhận bảng kê thanh toán và sự kiện thị trường điện: Đơn vị phát điện trực tiếp giao dịch, Đơn vị mua buôn duy nhất và Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm sử dụng chữ ký số để phục vụ công tác xác nhận, phát hành bảng kê thanh toán thị trường điện và xác nhận các sự kiện thị trường điện. Trong trường hợp chữ ký số bị sự cố, Đơn vị mua buôn duy nhất và Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm xác nhận, phát hành bảng kê thanh toán thị trường điện và xác nhận các sự kiện thị trường điện trực tiếp và xác nhận lại sau khi sự cố được khắc phục.

Điều 86. Hồ sơ thanh toán điện năng

1. Đơn vị phát điện trực tiếp giao dịch lập và gửi chứng từ thanh toán thị trường điện cho Đơn vị mua buôn duy nhất căn cứ trên bảng kê thanh toán thị trường điện cho chu kỳ thanh toán.

2. Đơn vị phát điện lập và gửi chứng từ thanh toán hợp đồng cho Đơn vị mua buôn duy nhất theo các quy định trong hợp đồng mua bán điện đã ký giữa Đơn vị mua buôn duy nhất và Đơn vị phát điện.

3. Trước ngày 20 hàng tháng, Đơn vị phát điện trực tiếp giao dịch lập và gửi hóa đơn thanh toán cho Đơn vị mua buôn duy nhất. Hóa đơn thanh toán bao gồm các khoản thanh toán thị trường điện và thanh toán hợp đồng trong chu kỳ thanh toán.

Điều 87. Hồ sơ thanh toán cho hợp đồng cung cấp dịch vụ phụ trợ

Đơn vị phát điện có trách nhiệm lập hồ sơ thanh toán dịch vụ phụ trợ theo hợp đồng cung cấp dịch vụ phụ trợ.

Điều 88. Hiệu chỉnh hóa đơn

1. Trong trường hợp hóa đơn có sai sót, Đơn vị phát điện hoặc Đơn vị mua buôn duy nhất có quyền đề nghị xử lý theo các quy định hiện hành có liên quan trong thời hạn 01 tháng kể từ ngày phát hành. Các bên liên quan có trách nhiệm phối hợp xác định và thống nhất các khoản thanh toán hiệu chỉnh.

2. Đơn vị phát điện có trách nhiệm bổ sung khoản thanh toán hiệu chỉnh vào hóa đơn của chu kỳ thanh toán tiếp theo.

Điều 89. Thanh toán

1. Đơn vị mua buôn duy nhất và Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm thực hiện thanh toán theo hoá đơn của Đơn vị phát điện, thời hạn thanh toán căn cứ theo quy định tại hợp đồng mua bán điện đã ký kết giữa hai bên.

2. Đơn vị phát điện và Đơn vị mua buôn duy nhất có trách nhiệm thống nhất phương thức thanh toán trong thị trường điện phù hợp với quy định tại Thông tư này và các quy định có liên quan.

3. Trường hợp đến ngày 20 hàng tháng, nếu Đơn vị phát điện chưa nhận được Bảng kê thanh toán thị trường điện mà nguyên nhân không phải từ Đơn vị phát điện, Đơn vị phát điện có quyền lập, gửi hồ sơ tạm và hóa đơn thanh toán căn cứ theo sản lượng điện phát và giá hợp đồng mua bán điện. Sau khi bảng kê thanh toán thị trường điện được phát hành, phần chênh lệch giữa giá trị tạm thanh toán và giá trị quyết toán sẽ được bù trừ vào tháng kế tiếp.

Điều 90. Xử lý các sai sót trong thanh toán

Trường hợp có thanh toán thừa hoặc thiếu so với hóa đơn, các đơn vị liên quan xử lý các sai sót này theo quy định trong hợp đồng mua bán điện hoặc hợp đồng cung cấp dịch vụ phụ trợ

Chương VII
PHẦN MỀM CHO HOẠT ĐỘNG CỦA THỊ TRƯỜNG ĐIỆN

Điều 91. Phần mềm cho hoạt động của thị trường điện

1. Các phần mềm cho hoạt động của thị trường điện bao gồm:

a)Mô hình mô phỏng thị trường;
b)Mô hình tính toán giá trị nước;
c)Phần mềm lập lịch huy động và điều độ;
d)Phần mềm phục vụ tính toán thanh toán;
đ) Các phần mềm khác phục vụ hoạt động thị trường điện.

2. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm xây dựng, phát triển và vận hành các phần mềm phục vụ thị trường điện.

Điều 92. Yêu cầu đối với phần mềm cho hoạt động của thị trường điện

1. Đảm bảo tính chính xác, độ tin cậy, tính bảo mật và đáp ứng được các tiêu chuẩn do Đơn vị vận hành hệ thống điện và thị trường điện xây dựng.

2. Có đầy đủ các hướng dẫn kỹ thuật, quy trình vận hành kèm theo.

Điều 93. Xây dựng và phát triển các phần mềm cho hoạt động của thị trường điện

1. Các phần mềm cho hoạt động thị trường điện phải được xây dựng, phát triển để hỗ trợ thực hiện các tính toán và giao dịch theo quy định tại Thông tư này và các quy trình vận hành của thị trường điện.

2. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm

a)Xây dựng các tiêu chuẩn đối với các phần mềm cho hoạt động của thị trường điện;
b)Thẩm định, kiểm tra khả năng đáp ứng của phần mềm đối với các tiêu chuẩn theo quy định tại Điểm a Khoản này trước khi áp dụng;
c)Công bố danh sách, các thuật toán và quy trình sử dụng các phần mềm cho hoạt động của thị trường điện.

Điều 94. Kiểm toán phần mềm

1. Các phần mềm phục vụ thị trường phải được kiểm toán trong các trường hợp sau:

a)Trước khi thị trường điện chính thức vận hành;
b)Trước khi đưa phần mềm mới vào sử dụng;
c)Sau khi hiệu chỉnh, nâng cấp có ảnh hưởng đến việc tính toán;
d)Kiểm toán định kỳ.

2. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm đề xuất đơn vị kiểm toán độc lập có năng lực để thực hiện kiểm toán, báo cáo Cục Điều tiết điện lực trước khi thực hiện.

3. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm công bố kết quả kiểm toán cho các thành viên tham gia thị trường điện.

 

 

 

Chương VIII
HỆ THỐNG THÔNG TIN THỊ TRƯỜNG ĐIỆN
VÀ QUY ĐỊNH VỀ CÔNG BỐ THÔNG TIN

Mục 1
HỆ THỐNG THÔNG TIN THỊ TRƯỜNG ĐIỆN

Điều 95. Cấu trúc hệ thống thông tin thị trường điện

Hệ thống thông tin thị trường điện bao gồm các thành phần cơ bản sau:

1. Hệ thống phần cứng và phần mềm phục vụ quản lý và trao đổi thông tin thị trường điện.

2. Hệ thống cơ sở dữ liệu và lưu trữ.

3. Cổng thông tin điện tử phục vụ thị trường điện, bao gồm cả trang thông tin điện tử nội bộ và trang thông tin điện tử công cộng.

Điều 96. Quản lý và vận hành hệ thống thông tin thị trường điện

1. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm xây dựng, quản lý và vận hành Hệ thống thông tin thị trường điện.

2. Thành viên tham gia thị trường điện có trách nhiệm đầu tư trang thiết bị trong phạm vi quản lý đáp ứng các yêu cầu kỹ thuật do Đơn vị vận hành hệ thống điện và thị trường điện quy định, đảm bảo việc kết nối với Hệ thống thông tin thị trường điện.

3. Đơn vị quản lý số liệu đo đếm điện năng có trách nhiệm phát triển, quản lý và vận hành mạng đường truyền kết nối giữa Hệ thống thông tin thị trường điện của Đơn vị vận hành hệ thống điện và thị trường điện với các thiết bị của các thành viên tham gia thị trường điện.

4. Đơn vị vận hành hệ thống điện và thị trường điện chỉ được vận hành hoặc thay đổi Hệ thống thông tin thị trường điện hiện có sau khi đã nghiệm thu hoàn chỉnh và được Cục Điều tiết điện lực thông qua.

5. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm trang bị thiết bị dự phòng cho Hệ thống thông tin thị trường điện để đảm bảo có thể thu thập, truyền và công bố thông tin thị trường trong trường hợp Hệ thống thông tin thị trường điện chính bị sự cố hoặc không thể vận hành.

Mục 2
QUẢN LÝ VÀ CÔNG BỐ THÔNG TIN THỊ TRƯỜNG ĐIỆN

Điều 97. Cung cấp và công bố thông tin thị trường điện

1. Đơn vị phát điện, Đơn vị mua buôn duy nhất, Đơn vị truyền tải điện và Đơn vị quản lý số liệu đo đếm điện năng có trách nhiệm cung cấp cho Đơn vị vận hành hệ thống điện và thị trường điện các thông tin, số liệu phục vụ lập kế hoạch vận hành, lập lịch huy động và tính toán thanh toán theo quy định tại Thông tư này qua cổng thông tin điện tử của Hệ thống thông tin thị trường điện.

2. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm cung cấp và công bố thông tin, số liệu và các báo cáo vận hành thị trường điện cho các thành viên tham gia thị trường điện theo quy định tại Thông tư này qua cổng thông tin điện tử của Hệ thống thông tin thị trường điện.

3. Mức độ phân quyền truy cập thông tin được xác định theo chức năng của các đơn vị và theo quy định tại Quy trình quản lý vận hành hệ thống công nghệ thông tin điều hành thị trường điện và công bố thông tin thị trường điện do Cục Điều tiết điện lực ban hành.

4. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm công bố công khai trên trang thông tin điện tử công cộng các thông tin sau:

a)Thông tin về các thành viên tham gia thị trường điện;
b)Dữ liệu về phụ tải hệ thống;
c)Số liệu thống kê về giá thị trường;
d)Các thông tin khác được quy định trong Quy trình quản lý vận hành hệ thống công nghệ thông tin điều hành thị trường điện và công bố thông tin thị trường điện do Cục Điều tiết điện lực ban hành.

Điều 98. Trách nhiệm đảm bảo tính chính xác của thông tin thị trường điện

1. Thành viên tham gia thị trường có trách nhiệm đảm bảo tính chính xác và đầy đủ của thông tin thị trường điện tại thời điểm cung cấp.

2. Trường hợp phát hiện các thông tin đã cung cấp, công bố không chính xác và đầy đủ, thành viên tham gia thị trường có trách nhiệm cải chính và cung cấp lại thông tin chính xác cho đơn vị có liên quan.

Điều 99. Bảo mật thông tin thị trường điện

1. Đơn vị vận hành hệ thống điện và thị trường điện không được tiết lộ các thông tin do thành viên tham gia thị trường điện cung cấp, bao gồm:

a)Thông tin về hợp đồng mua bán điện;
b)Bản chào giá của Đơn vị phát điện trước khi kết thúc ngày giao dịch;
c)Các thông tin khác ngoài thẩm quyền.

2. Thành viên tham gia thị trường điện không được tiết lộ các thông tin ngoài phạm vi được phân quyền cung cấp và công bố.

Điều 100. Các trường hợp miễn trừ bảo mật thông tin

1. Cung cấp thông tin theo yêu cầu của Cục Điều tiết điện lực hoặc cơ quan có thẩm quyền theo quy định của pháp luật.

2. Các thông tin tự tổng hợp, phân tích từ các thông tin công bố trên thị trường điện, không phải do các thành viên tham gia thị trường điện khác cung cấp sai theo quy định tại Điều 99Thông tư này.

Điều 101. Lưu trữ thông tin thị trường điện

Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm lưu lại toàn bộ hoạt động trao đổi thông tin được thực hiện qua Hệ thống thông tin thị trường điện. Thời hạn lưu trữ thông tin ít nhất là 05 năm.

Mục 3

Điều 102. Công bố thông tin vận hành thị trường điện

Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm định kỳ lập và công bố thông tin vận hành thị trường điện theo quy định tại Quy trình vận hành Hệ thống thông tin thị trường điện do Cục Điều tiết điện lực ban hành, cụ thể như sau:

1. Trước 15h00 hàng ngày, lập và công bố báo cáo vận hành thị trường điện ngày hôm trước.

2. Trước 16h00 thứ Ba hàng tuần, lập và công bố báo cáo vận hành thị trường điện tuần trước.

3. Trước ngày 20 hàng tháng, lập và công bố báo cáo vận hành thị trường điện tháng trước.

4. Trước ngày 31 tháng 01 hàng năm, lập và công bố báo cáo vận hành thị trường điện năm trước.

Điều 103. Chế độ báo cáo vận hành thị trường điện

1. Trước ngày 10 hàng tháng, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm gửi Cục Điều tiết điện lực báo cáo vận hành hệ thống điện và thị trường điện của tháng trước theo mẫu do Cục Điều tiết điện lực quy định.

2. Trước ngày 31 tháng 01 hàng năm, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm gửi Cục Điều tiết điện lực các báo cáo vận hành hệ thống điện và thị trường điện của năm trước theo mẫu do Cục Điều tiết điện lực quy định.

3. Trong thời hạn 24 giờ kể từ khi kết thúc can thiệp thị trường điện, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm báo cáo Cục Điều tiết điện lực về việc can thiệp thị trường điện.

4. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm báo cáo đột xuất về vận hành hệ thống điện, thị trường điện theo yêu cầu của Cục Điều tiết điện lực.

Điều 104. Kiểm toán số liệu và tuân thủ trong thị trường điện

1. Kiểm toán định kỳ

Trước ngày 31 tháng 3 hàng năm, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm tổ chức thực hiện và hoàn thành việc kiểm toán số liệu và sự tuân thủ thị trường điện của năm trước. Nội dung kiểm toán hàng năm bao gồm:

a)Kiểm toán số liệu, quá trình thực hiện tính toán của Đơn vị vận hành hệ thống điện và thị trường điện trong thị trường điện, bao gồm:
- Số liệu cho quá trình tính toán trong thị trường điện;
- Các bước thực hiện tính toán;
- Kết quả tính toán.
b)Kiểm toán tuân thủ của Đơn vị vận hành hệ thống điện và thị trường điện đối với các trình tự, thủ tục theo quy định tại Thông tư này.

2. Kiểm toán đột xuất

Cục Điều tiết điện lực có quyền yêu cầu Đơn vị vận hành hệ thống điện và thị trường điện tổ chức thực hiện kiểm toán đột xuất theo các nội dung và phạm vi kiểm toán cụ thể trong các trường hợp sau:

a)Khi phát hiện dấu hiệu bất thường trong vận hành thị trường điện;
b)Theo đề nghị bằng văn bản của thành viên tham gia thị trường điện trong đó nêu rõ nội dung và lý do hợp lý để yêu cầu kiểm toán đột xuất.

3. Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm đề xuất đơn vị kiểm toán độc lập đủ năng lực thực hiện các nội dung kiểm toán thị trường điện trình Cục Điều tiết điện lực thông qua.

4. Các thành viên tham gia thị trường điện có trách nhiệm hợp tác đầy đủ trong quá trình thực hiện kiểm toán thị trường điện.

5. Chi phí kiểm toán

a)Do Đơn vị vận hành hệ thống điện và thị trường điện chi trả trong các trường hợp kiểm toán theo quy định tại Khoản 1 và Điểm a Khoản 2 Điều này;
b)Do đơn vị đề nghị kiểm toán chi trả trong trường hợp kiểm toán theo quy định tại Điểm b Khoản 2 Điều này.

6. Trong thời hạn 10 ngày kể từ khi kết thúc kiểm toán, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm gửi báo cáo kiểm toán cho Cục Điều tiết điện lực và các đơn vị liên quan.

Chương IX
GIẢI QUYẾT TRANH CHẤP VÀ XỬ LÝ VI PHẠM

Mục 1
GIẢI QUYẾT TRANH CHẤP

Điều 105. Trình tự giải quyết tranh chấp trong thị trường điện

1. Các tranh chấp phát sinh trong thị trường điện được giải quyết theo Quy định về trình tự, thủ tục giải quyết tranh chấp trên thị trường điện lực do Bộ Công Thương ban hành.

2. Trước khi thực hiện giải quyết tranh chấp theo quy định tại Khoản 1 Điều này, trong thời hạn 60 ngày kể từ thời điểm phát sinh tranh chấp trong thị trường điện, các bên có trách nhiệm tiến hành đàm phán để tự giải quyết tranh chấp theo một trong các hình thức sau:

a)Thương lượng;
b)Hoà giải.

Điều 106. Trách nhiệm của các bên trong quá trình tự giải quyết tranh chấp

1. Thống nhất về hình thức tự giải quyết tranh chấp, thời gian, địa điểm tiến hành đàm phán.

2. Cung cấp đầy đủ, trung thực, chính xác những thông tin, tài liệu cần thiết liên quan đến nội dung tranh chấp.

3. Đưa ra chứng cứ hợp pháp để bảo vệ quyền và lợi ích hợp pháp.

4. Tham gia quá trình đàm phán với tinh thần thiện chí, hợp tác.

5. Trong quá trình tự giải quyết tranh chấp, nếu phát hiện tranh chấp có dấu hiệu vi phạm quy định thị trường điện thì bên phát hiện có trách nhiệm thông báo cho bên kia biết để dừng tự giải quyết tranh chấp và báo cáo Cục Điều tiết điện lực.

Điều 107. Thông báo tranh chấp và chuẩn bị đàm phán

1. Khi phát sinh tranh chấp, bên yêu cầu có trách nhiệm thông báo bằng văn bản cho bên bị yêu cầu về việc tranh chấp và yêu cầu giải quyết tranh chấp và gửi Cục Điều tiết điện lực 01 bản để báo cáo.

2. Trong thời hạn 15 ngày kể từ ngày nhận được thông báo, các bên có trách nhiệm thống nhất về hình thức giải quyết tranh chấp, nội dung cần giải quyết, thời gian và địa điểm đàm phán. Trường hợp lựa chọn hình thức hoà giải thông qua trung gian, các bên có trách nhiệm thống nhất về việc chọn người làm trung gian hoà giải. Các bên có quyền thoả thuận thay đổi người trung gian hoà giải trước thời gian dự kiến hoà giải đã thống nhất.

Điều 108. Tổ chức tự giải quyết tranh chấp

1. Thương lượng

Các bên có trách nhiệm trao đổi, thoả thuận về các nội dung cần giải quyết.

2. Hoà giải

a)Các bên có thể mời chuyên gia có chuyên môn hoặc đề nghị Cục Điều tiết điện lực cử cán bộ làm trung gian hoà giải và thống nhất về trách nhiệm của người trung gian hoà giải;
b)Các bên có trách nhiệm cung cấp cho người trung gian hoà giải nội dung vụ việc tranh chấp, các thông tin, tài liệu có liên quan đến vụ việc tranh chấp và các yêu cầu giải quyết của từng bên;
c)Các bên có thể nhất trí với phương án giải quyết của người trung gian hoà giải; yêu cầu người trung gian hoà giải sửa đổi, bổ sung phương án giải quyết đó hoặc tự thoả thuận để thống nhất phương án giải quyết mới.

Điều 109. Biên bản tự giải quyết tranh chấp

1. Sau khi kết thúc tự giải quyết tranh chấp hoặc hết thời hạn tự giải quyết tranh chấp, các bên tranh chấp có trách nhiệm lập Biên bản tự giải quyết tranh chấp bao gồm các nội dung sau:

a)Thời gian và địa điểm tiến hành tự giải quyết tranh chấp;
b)Tên, địa chỉ các bên tham gia tự giải quyết tranh chấp;
c)Tóm tắt nội dung tranh chấp;
d)Nội dung yêu cầu của các bên;
đ) Những nội dung đã được các bên thoả thuận;
e)Những nội dung các bên không thoả thuận được và lý do.

2. Trong thời hạn 05 ngày kể từ ngày lập Biên bản tự giải quyết tranh chấp, các bên có trách nhiệm gửi Cục Điều tiết điện lực 01 bản để báo cáo.

Điều 110. Giải quyết tranh chấp tại Cục Điều tiết điện lực

1. Các bên có quyền gửi vụ việc lên Cục Điều tiết điện lực để giải quyết tranh chấp trong các trường hợp sau:

a)Hết thời hạn tự giải quyết tranh chấp theo quy định tại Khoản 2 Điều 105Thông tư này mà vụ việc tranh chấp hoà giải không thành hoặc không thể tổ chức tự giải quyết tranh chấp được do một bên không tham gia tự giải quyết tranh chấp;
b)Một bên không thực hiện các nội dung đã thoả thuận trong Biên bản tự giải quyết tranh chấp.

Sau khi nhận được hồ sơ đề nghị giải quyết tranh chấp hợp lệ theo quy định, Cục Điều tiết điện lực có trách nhiệm giải quyết tranh chấp theo trình tự, thủ tục theo quy định tại Quy định về trình tự, thủ tục giải quyết tranh chấp trên thị trường điện lực do Bộ Công Thương ban hành.

Mục 2
XỬ LÝ VI PHẠM

Điều 111. Phát hiện và trình báo vi phạm

1. Các hành vi vi phạm trong thị trường điện bị phát hiện phải được trình báo Cục Điều tiết điện lực bằng văn bản.

2. Nội dung trình báo hành vi vi phạm bao gồm:

a) Ngày, tháng, năm trình báo;

b) Tên, địa chỉ tổ chức, cá nhân trình báo;

c) Tên, địa chỉ tổ chức, cá nhân thực hiện hành vi có dấu hiệu vi phạm;

d) Mô tả hành vi có dấu hiệu vi phạm;

đ) Thời gian, địa điểm xảy ra hành vi có dấu hiệu vi phạm;

e) Lý do phát hiện hành vi có dấu hiệu vi phạm (nếu có).

Điều 112. Xác minh hành vi vi phạm

1. Trong thời hạn 05 ngày kể từ ngày tiếp nhận vụ việc về hành vi có dấu hiệu phạm, Cục Điều tiết điện lực có trách nhiệm thụ lý vụ việc. Trường hợp không thụ lý thì phải thông báo bằng văn bản cho tổ chức, cá nhân trình báo.

2. Sau khi thụ lý vụ việc, Cục Điều tiết điện lực có trách nhiệm tiến hành xác minh hành vi có dấu hiệu vi phạm. Trong quá trình tiến hành xác minh hành vi vi phạm, Cục Điều tiết điện lực có quyền:

a) Yêu cầu đơn vị có dấu hiệu vi phạm, các đơn vị liên quan cung cấp thông tin, tài liệu cần thiết phục vụ cho quá trình xác minh;
b) Yêu cầu đơn vị có dấu hiệu vi phạm giải trình;
c) Trưng cầu giám định, lấy ý kiến chuyên gia hoặc ý kiến của cơ quan, đơn vị có liên quan;
d) Triệu tập đơn vị có dấu hiệu vi phạm, các đơn vị bị ảnh hưởng do hành vi vi phạm để lấy ý kiến về hướng giải quyết và khắc phục hành vi vi phạm.

3. Trong quá trình xác minh, Cục Điều tiết điện lực có trách nhiệm giữ bí mật các thông tin, tài liệu được cung cấp theo quy định về bảo mật thông tin theo quy định tại Thông tư này và các quy định khác liên quan đến bảo mật thông tin.

Điều 113.  Lập Biên bản vi phạm hành chính

1. Trong thời hạn 60 ngày làm việc kể từ ngày tiến hành xác minh, Cục Điều tiết điện lực có trách nhiệm kết thúc xác minh và lập Biên bản vi phạm hành chính đối với hành vi vi phạm quy định vận hành thị trường điện. Trường hợp vụ việc có nhiều tình tiết phức tạp, thời hạn xác minh có thể kéo dài nhưng không quá 30 ngày làm việc kể từ ngày hết hạn xác minh.

2. Biên bản vi phạm hành chính được lập theo quy định về xử phạt vi phạm hành chính trong lĩnh vực điện lực.

3. Trường hợp kết quả xác minh cho thấy hành vi bị trình báo không vi phạm quy định vận hành thị trường điện, Cục Điều tiết điện lực dừng xác minh, thông báo cho tổ chức, cá nhân trình báo và cho tổ chức, cá nhân bị xác minh.

Điều 114. Xử lý vi phạm

Đơn vị phát điện sở hữu nhà máy điện có hành vi vi phạm hành chính trong lĩnh vực điện lực ngoài việc bị xử phạt vi phạm hành chính theo quy định tại Nghị định của Chính phủ quy định về xử phạt vi phạm hành chính trong lĩnh vực điện lực, an toàn đập thủy điện, sử dụng năng lượng tiết kiệm và hiệu quả còn bị đình chỉ tham gia thị trường điện, cụ thể như sau:

1. Căn cứ vào mức độ nghiêm trọng của hành vi vi phạm ảnh hưởng đến việc vận hành thị trường điện, Cục Điều tiết điện lực ra quyết định đình chỉ tham gia thị trường điện đối với nhà máy điện. Thời hạn đình chỉ tham gia thị trường điện là từ 06 tháng đến 01 năm tính từ ngày hiệu lực của quyết định xử phạt vi phạm hành chính. 
2. Trong thời hạn 01 ngày tính từ ngày nhận được Quyết định đình chỉ nhà máy điện tham gia thị trường điện, Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm công bố việc đình chỉ quyền tham gia thị trường điện đối với nhà máy điện vi phạm.
3. Hết thời hạn quy định tại Khoản 1 Điều này, nhà máy điện vẫn chưa khắc phục vi phạm, Cục Điều tiết điện lực có quyền ra quyết định gia hạn đình chỉ quyền tham gia thị trường điện.
4. Khi hoàn thành việc khắc phục hành vi vi phạm và các nghĩa vụ quy định trong quyết định đình chỉ tham gia thị trường điện, nhà máy điện có trách nhiệm gửi tài liệu chứng minh tới Cục Điều tiết điện lực và tham gia thị trường điện sau khi hết thời hạn bị đình chỉ.

TỔ CHỨC THỰC HIỆN

Điều 115. Trách nhiệm của Cục Điều tiết điện lực

1. Phổ biến, kiểm tra và giám sát việc thực hiện Thông tư này.

2. Hướng dẫn hoặc trình Lãnh đạo Bộ hướng dẫn thực hiện các nội dung mới phát sinh hoặc vướng mắc trong quá trình thực hiện Thông tư này.

Điều 116. Trách nhiệm của Tập đoàn Điện lực Việt nam

Tập đoàn Điện lực Việt Nam có trách nhiệm chỉ đạo Đơn vị vận hành hệ thống điện và thị trường điện và các đơn vị có liên quan:
1. Rà soát, hiệu chỉnh các quy trình kỹ thuật trình Cục Điều tiết điện lực ban hành sau 30 ngày kể từ ngày ban hành Thông tư này, bao gồm:
a) Quy trình lập kế hoạch vận hành năm, tháng và tuần tới;
b) Quy trình lựa chọn nhà máy mới tốt nhất và tính toán giá công suất thị trường;
c) Quy trình mô phỏng thị trường điện;
d) Quy trình tính toán giá trị nước;
đ) Quy trình phân loại tổ máy và tính giá trần bản chào của nhà máy nhiệt điện;
e) Quy trình lập lịch huy động các tổ máy phát điện, vận hành thời gian thực và tính toán thanh toán trong thị trường điện;
g) Quy trình quản lý vận hành hệ thống công nghệ thông tin điều hành thị trường điện và công bố thông tin thị trường điện;
h) Quy trình phối hợp đối soát số liệu thanh toán giữa Đơn vị vận hành hệ thống điện và thị trường điện, các đơn vị phát điện và Đơn vị mua buôn duy nhất;
i) Quy trình tối ưu sử dụng nguồn nhiên liệu khí phục vụ công tác lập lịch huy động ngày tới;
k) Quy trình phối hợp xác nhận các sự kiện phục vụ các khoản thanh toán trên thị trường điện.

l) Quy trình đào tạo, kiểm tra và công nhận chức danh kỹ sư điều hành giao dịch thị trường điện;

m) Quy trình điều chỉnh sản lượng hợp đồng.

2. Đầu tư, xây dựng, lắp đặt và nâng cấp Hệ thống thông tin thị trường điện và các phần mềm phục vụ thị trường điện phù hợp với yêu cầu theo quy định tại Thông tư này.

Điều 117. Trách nhiệm của các đơn vị liên quan

1.Các đơn vị tham gia thị trường điện có trách nhiệm hoàn thiện các trang thiết bị thông tin phù hợp với Hệ thống thông tin thị trường điện theo quy định tại Thông tư này.

2.Các đơn vị phát điện tham gia thị trường điện có trách nhiệm ký hợp đồng mua bán điện theo mẫu do Bộ Công Thương ban hành áp dụng cho thị trường điện.

3.Đơn vị vận hành hệ thống điện và thị trường điện có trách nhiệm nâng cấp Trang thông tin điện tử thị trường điện để các đơn vị phát điện nộp hồ sơ đăng ký tham gia thị trường điện theo hình thức trực tuyến thông quan Trang thông tin điện tử này. 

Điều 118. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 15 tháng 11 năm 2018.

2. Bãi bỏ Thông tư số 30/2014/TT-BCT ngày 02 tháng 10 năm 2014 của Bộ trưởng Bộ Công Thương quy định vận hành thị trường phát điện cạnh tranh; Điều 1 Thông tư số 51/2015/TT-BCT ngày 29 tháng 12 năm 2015 của Bộ trưởng Bộ Công Thương sửa đổi, bổ sung một số điều của Thông tư số 30/2014/TT-BCT ngày 02 tháng 10 năm 2014 của Bộ trưởng Bộ Công Thương quy định vận hành thị trường phát điện cạnh tranh và Thông tư số 56/2014/TT-BCT ngày 19 tháng 12 năm 2014 của Bộ trưởng Bộ Công Thương quy định phương pháp xây dựng giá phát điện, trình tự kiểm tra hợp đồng mua bán điện; Điều 3 Thông tư số 13/2017/TT-BCT ngày 03 tháng 8 năm 2017 của Bộ trưởng Bộ Công Thương sửa đổi, bổ sung một số điều của Thông tư số 56/2014/TT-BCT quy định phương pháp xác định giá phát điện, trình tự kiểm tra hợp đồng mua bán điện, Thông tư số 30/2014/TT-BCT quy định vận hành thị trường phát điện cạnh tranh và Thông tư số 57/2014/TT-BCT quy định phương pháp, trình tự xây dựng và ban hành khung giá phát điện; Điều 13 Thông tư số 21/2015/TT-BCT ngày 23 tháng 6 năm 2015 của Bộ trưởng Bộ Công Thương quy định phương pháp xác định giá dịch vụ phụ trợ hệ thống điện, trình tự kiểm tra hợp đồng cung cấp dịch vụ phụ trợ hệ thống điện, tính từ ngày Thông tư này có hiệu lực thi hành.

3. Trong quá trình thực hiện, nếu phát sinh vướng mắc, tổ chức cá nhân trách nhiệm phản ánh về Bộ Công Thương để bổ sung, sửa đổi cho phù hợp./.
