CIRCULAR
Regulations on the scope of medical examination and treatment activities and the content of specialized knowledge and skills of training programs for healthcare personnel working in organizational, unit, and institutional healthcare without establishing medical examination and treatment facilities.
Pursuant to the Law on Health Examination and Treatment No. 15/2023/QH15 dated January 9, 2023;
Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Health Environment Management Department;
The Minister of Health issues this Circular to regulate the scope of medical examination and treatment activities and the content of specialized knowledge and skills of training programs for healthcare personnel working in organizational, unit, and institutional healthcare without establishing medical examination and treatment facilities.
Article 1. Scope of Regulation
This Circular guides Point b Clause 2 Article 19 of the Medical Examination and Treatment Law No. 15/2023/QH15 regarding the scope of medical examination and treatment activities and the content of specialized knowledge and skills of training programs for healthcare personnel working in organizational, unit, and institutional healthcare without establishing medical examination and treatment facilities.
Article 2. Interpretation of Terms
1. Organizational, unit, and institutional healthcare includes:
a) Healthcare of state agencies and public service units;
b) Healthcare of production and business establishments;
c) Healthcare of educational institutions;
d) Healthcare of other units and organizations.
2. Healthcare personnel of organizational, unit, and institutional healthcare as specified in Points a, b, and d Clause 1 of this Article include:
a) Healthcare personnel of state agencies, public service units, and other units and organizations meeting the conditions stipulated in Appendix III and Appendix VIII issued together with Circular No. 12/2022/TT-BNV dated December 30, 2022, of the Minister of Home Affairs guiding positions of civil servant leadership and management; common professional skills; support and services in administrative organizations and positions of common professional titles and support and services in public service units;
b) Healthcare personnel of production and business establishments are individuals engaged in healthcare work meeting the conditions stipulated in Clause 3 Article 37 of Decree No. 39/2016/NĐ-CP dated May 15, 2016, of the Government detailing certain provisions of the Labor Safety and Health Law.
3. Healthcare personnel at educational institutions as specified in Point c Clause 1 of this Article include:
a) Individuals with health care expertise working in school health care meeting the requirements stipulated in Clause 2 Article 8 of Joint Circular No. 13/2016/TTLT-BYT-BGDĐT dated May 12, 2016, of the Ministers of Health and Education and Training regarding school health care (hereinafter referred to as Joint Circular No. 13/2016/TTLT-BYT-BGDĐT); Clause 2 Article 7 of Circular No. 33/2021/TT-BYT dated December 31, 2021, of the Minister of Health regarding school health care in higher education institutions and vocational education institutions (hereinafter referred to as Circular No. 33/2021/TT-BYT);
b) Individuals with health care expertise not meeting the requirements stipulated in Joint Circular No. 13/2016/TTLT-BYT-BGDĐT, Circular No. 33/2021/TT-BYT, and individuals without health care expertise assigned tasks to perform school health care.
Article 3. The scope of medical examination and treatment activities and the content of specialized knowledge and skills of training programs for healthcare personnel working in organizational, unit, and institutional healthcare as specified in Point a, b, d Clause 1 of Article 2 of this Circular
1. In the case where healthcare personnel do not have a diploma in medical assistant or physician and have completed the training program according to the content of specialized knowledge and skills stipulated in Clause 3 of this Article, they may conduct medical examinations and treatments within the scope of activities as follows:
a) As specified in Appendix I issued together with this Circular;
b) By the designation of a person authorized to practice medical examination and treatment: administering injections (injections), taking samples for testing (blood, urine, secretions).
2. In the case where healthcare personnel hold a diploma in medical assistant or physician and have completed the training program according to the content of specialized knowledge and skills stipulated in Clause 3 of this Article, in addition to the scope of medical examination and treatment activities stipulated in Clause 1 of this Article, they may also conduct early detection, initial handling, and advice to patients to seek medical care at healthcare facilities when necessary for diseases specified in Appendix II issued together with this Circular.
3. Content of specialized knowledge and skills of the training program: Healthcare personnel must be trained and certified with a certificate recognizing their expertise in occupational health care as stipulated in Circular No. 29/2021/TT-BYT dated December 24, 2021, of the Minister of Health on guiding the operation of training in occupational health care expertise.
Article 4. The scope of medical examination and treatment activities and the content of professional training programs for healthcare personnel working at educational institutions as stipulated in point c, Clause 1, Article 2 of this Circular
1. In cases where healthcare personnel do not have a diploma in medical assistant or physician but have completed the training program according to the professional content specified in Clause 3 of this Article, they may conduct medical examinations and treatments within the scope of activities as prescribed in Appendix I attached to this Circular.
2. In cases where healthcare personnel hold a diploma in medical assistant or physician and have completed the training program according to the professional content specified in Clause 3 of this Article, in addition to the scope of medical examination and treatment activities prescribed in Clause 1 of this Article, they may also conduct early detection, initial management, and advice to patients to seek care at healthcare facilities when necessary for diseases specified in Appendix III attached to this Circular.
3. Content of professional training programs:
a) The content of professional training programs is specified in Appendix IV attached to this Circular;
b) Initial training time is 40 hours, including evaluation time, with emphasis on practical skills training. Continuing education is conducted every five years, with a minimum training duration equal to 50% of the initial training time, including evaluation time;
c) Educational institutions in the health sector, healthcare facilities with training functions or assigned training tasks (hereinafter referred to as training institutions), shall develop, review, issue training programs and materials suitable for each training group; publicly announce information about the training course on the training institution's website before organizing the training and issuing certificates in accordance with current laws on education;
d) Training method: Concentrated.
Article 5. Reference Provisions
In cases where referenced documents in this Circular are replaced or amended, the new documents shall be applied.
Article 6. Effectiveness
1. This Circular takes effect from January 1, 2024.
2. Healthcare personnel working at educational institutions continue to implement the contents related to medical examination and treatment as prescribed in Joint Circular No. 13/2016/TTLT-BYT-BGDĐT, Circular No. 33/2021/TT-BYT, and must complete the specialized training in medical examination and treatment as prescribed in this Circular before December 31, 2025.
Article 7. Responsibility for Implementation
The Director of the Department of Health Environment Management, the Head of the Ministry’s Office, Heads of Departments and Bureaus under the Ministry of Health, Directors of Provincial Health Services, and relevant agencies, organizations, and individuals are responsible for implementing this Circular. Any difficulties encountered during implementation should be reported to the Ministry of Health (Department of Health Environment Management) for consideration and resolution.
During the implementation process, if there are any difficulties or obstacles, agencies, organizations, and individuals should report them to the Ministry of Health (Department of Health Environment Management) for consideration and resolution./.
