Pursuant to Decree No.96/2022/NĐ-CPdated August 1, 2024, of the Government amends and supplements some articles of Decree No. 96/2022/NĐ-CP dated November 29, 2022, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade and Decree No. 26/2018/NĐ-CP dated February 28, 2018, of the Government on the Charter of Organization and Operation of Vietnam Electricity Corporation;

The Minister of Industry and Trade issues this Circular stipulating energy consumption standards in the beer and non-alcoholic beverage manufacturing industry.
This Circular stipulates the methods for determining energy consumption levels, energy consumption standards, and reporting procedures in the beer and non-alcoholic beverage manufacturing industry.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. Production facilities operating in the beer and non-alcoholic beverage manufacturing industry with production types and capacity scales as specified in Article 5 of this Circular.
Article 2. Applicability
2. Other relevant agencies, organizations, and individuals.
The beer and non-alcoholic beverage manufacturing industry is an industry producing various types of beer and non-alcoholic beverages as defined in the Vietnamese Economic Classification System.
Article 3. Explanation of Terms
1. Production facilities within the beer and non-alcoholic beverage manufacturing industry subject to this Circular (hereinafter referred to as production facilities) are those with production types and capacity scales as specified in Article 5 of this Circular.
2. Production facilities are those producing beer products and non-alcoholic beverages according to the seven-digit product code issued by the Prime Minister regarding the Vietnamese Product Classification System.
3. Non-alcoholic beer is beer produced using alcohol removal technology.
4. Energy consumption level (SEC) is the total energy consumed to produce one unit of product.
5. Energy consumption standard is the energy consumption level applicable to specific products as stipulated in this Circular.
METHODS FOR DETERMINING ENERGY CONSUMPTION LEVELS, ENERGY CONSUMPTION STANDARDS, AND REPORTING PROCEDURES
Chapter II
Article 4. Methods for Determining Energy Consumption Levels
1. The energy consumption level in beer production is determined according to the method set out in Appendix I of this Circular.
2. The energy consumption level in non-alcoholic beverage production is determined according to the method set out in Appendix II of this Circular.
Article 5. Energy Consumption Standards
Energy consumption standards apply to production facilities in the beer and non-alcoholic beverage manufacturing industry as follows:

Article 6. Periodic Reporting Procedures |

1. By January 31 each year, production facilities subject to Clause 1 of Article 2 of this Circular shall be responsible for submitting reports to the provincial Department of Industry and Trade in writing through direct submission, postal service, or via the website https://dataenergy.vn regarding the implementation results of the energy consumption standards of the previous year according to Appendix IV of this Circular. In case of reporting via the website https://dataenergy.vn, the production facility shall be responsible for contacting the Department of Industry and Trade to establish and provide an account.
Within twenty working days from the date of receipt of the report from the production facility, the Department of Industry and Trade shall send feedback and request additional information (if any).
Within five working days from the date of receipt of the request for additional information from the Department of Industry and Trade, the production facility shall be responsible for resubmitting the report with corrections and additional information as required.
2. By March 31 each year, the Department of Industry and Trade shall submit a report on the implementation results of the energy consumption standards of the previous year in the beer and non-alcoholic beverage manufacturing industry at the local level to the Ministry of Industry and Trade (Department of Energy Saving and Sustainable Development) in writing through direct submission, postal service, or via the website https://dataenergy.vn according to the model in Appendix III of this Circular.
2. Before March 31 each year, the Department of Industry and Trade reports on the implementation results of energy consumption standards for the previous calendar year in the beer and non-alcoholic beverage manufacturing industry at the local level to the Ministry of Industry and Trade (Department of Energy Saving and Sustainable Development) in writing through direct submission or via postal service or through the website https://dataenergy.vn according to Appendix III of this Circular.
Chapter III
IMPLEMENTATION
Article 7. Responsibilities of the Department of Energy Saving and Sustainable Development
1. Take the lead and coordinate with relevant agencies to disseminate, promote, and guide organizations and individuals related to the implementation of the provisions of this Circular.
2. Coordinate with provincial Departments of Industry and Trade to inspect the implementation of energy consumption standards set out in plans to ensure that the energy consumption standards prescribed in this Circular are met.
3. Aggregate and compile statistics on energy consumption standards for the beer and non-alcoholic beverage manufacturing industry based on reports from localities.
Article 8. Responsibilities of Provincial Departments of Industry and Trade
1. Annually, take the lead in guiding, urging, reminding, developing inspection plans, and inspecting compliance with energy consumption standards of production facilities subject to this Circular in their locality and handle violations according to the law.
2. Coordinate with the Department of Energy Saving and Sustainable Development to guide, urge, and inspect the implementation of energy consumption standards in accordance with the contents of this Circular.
3. Implement the reporting system as stipulated in Article 6 of this Circular.
Article 9. Responsibilities of Production Facilities
1. Manage and supervise the production process to determine the amount of energy consumed.
2. Comply with the energy consumption standards prescribed in Article 5 of this Circular. In case of changes or fluctuations during the production process leading to non-compliance with the standards, the facility shall be responsible for reporting and explaining the reasons and plans to comply with the standards to competent authorities based on an energy audit report.
3. Implement the reporting system as stipulated in Article 6 of this Circular.
Article 10. Effective Date
This Circular takes effect from April 1, 2025, and replaces Circular No. 19/2016/TT-BCT dated September 14, 2016, on the regulation of energy consumption standards in the beer and soft drink manufacturing industry.
2. During the course of implementation, if there are any issues or difficulties, relevant agencies, organizations, and individuals shall promptly report to the Ministry of Industry and Trade for study, amendment, and supplementation of the Circular./.

METHOD FOR DETERMINING ENERGY CONSUMPTION STANDARDS IN BEER PRODUCTION FACILITIES
(Attached to Circular No. 28/2024/TT-BCT dated25 December 2024 of the Minister of Industry and Trade)
1.Scope of assessment: the production area for beer products including the main production area and auxiliary areas (cooling machines, compressors, boilers...); excluding administrative areas, internal transportation, raw water treatment, wastewater treatment, and production areas for other products not specified inoClause 3, Article 3 of this Circular. The period for determining energy consumption standards is one year (from January 1 to December 31). In cases where it is necessary to conduct inspections, the inspection period is the time required to complete one production cycle..

(Annexed to Circular No. 28/2024/TT-BCT dated December 25, 2024 of the Minister of Industry and Trade)
1. Scope of assessment: the production area for non-alcoholic beverages includes the main production area and auxiliary areas (refrigeration, compressors, boilers, PET bottle blowing); it does not include administrative areas, internal transportation, raw water treatment, wastewater treatment, and production areas for products other than non-alcoholic beverages as specified in Clause 3, Article 3 of this Circular.Clause 3, Article 3 of this Circular.
2.The period for determining the level of energy consumption is one year (from January 1 to December 31). In cases where energy consumption levels need to be checked, the inspection period is the time necessary to complete one production cycle.
3.Parameters for determining the level of energy consumption in non-alcoholic beverage production facilities are stipulated in Table 2.1, applicable within the scope and timeframe set out in Clause 1 and 2 of Appendix II of this Circular.

4.The standardized product is non-alcoholic beverages bottled in PET. In cases where production facilities produce both carbonated and non-carbonated non-alcoholic beverages, the carbonated PET bottled product will be selected as the standardized product. Glass bottled products and other packaging types will be converted to the standardized product based on the electricity usage factor and thermal usage factor to calculate energy consumption levels., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPi about the standardized product according to the electricity usage factor and thermal usage factor to calculate energy consumption levels.
