OF THE GOVERNMENT NUMBER  28-CP DATED MAY 24, 1993 ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE POST AND TELECOMMUNICATIONS GENERAL DEPARTMENT 

THE GOVERNMENT

Pursuant to the Law on the Organization of the Government dated September 30, 1992;
Pursuant to Decree No. 3-CP dated October 26, 1992 of the Government on the establishment of the Post and Telecommunications General Department;
Considering the proposal of the Minister, Head of the Government Organizational and Cadre Affairs Board, and the Director of the Post and Telecommunications General Department;

DECREE:

Article 1.- The Post and Telecommunications General Department is an agency under the Government with the function of managing the postal industry nationwide.

Article 2.- The Post and Telecommunications General Department has tasks and powers:

1. To develop plans for the development of the postal industry to be submitted to the Government for approval, organize and direct the implementation of such plans nationwide.

2. To draft laws for submission to the Government for consideration by the National Assembly and the Standing Committee of the National Assembly; sub-law documents, policies on postal services to be submitted to the Government for issuance.

Within the scope of authority granted, issue decisions, circulars, directives guiding the implementation of state regulatory documents; establish systems, standards, economic-technical norms, procedures, regulations concerning the postal industry.

3. To organize and direct the implementation of research plans, application of scientific and technological progress, inventions, patents, technical improvements in the industry.

4. To submit to the Government participation in international organizations related to postal services; participate in activities of world postal and telecommunications unions and other international organizations as prescribed by the State, sign international treaties on postal services pursuant to the authorization of the Government.

5. To uniformly manage state affairs regarding radio frequency spectrum, signal transmission technology for broadcasting and television, directly manage the national newspaper distribution system and imported foreign newspapers, printing and distribution of postal stamps nationwide.

To grant permits for establishing private postal and telecommunications networks, using transmitters and radio frequencies for organizations and individuals nationwide (including representative offices, organizations and individuals of foreign nationals operating in Vietnam).

The Director of the Post and Telecommunications General Department serves as Chairman of the Radio Frequency Spectrum Commission.

6. To review conditions for the production of broadcasting equipment, telecommunication services, postal services to be submitted to the Prime Minister for decision.

To coordinate with relevant Ministries and sectors in managing state affairs on business operations and import-export of postal and telecommunications equipment nationwide.

7. To manage enterprises and public service organizations subordinate to the General Department in accordance with the law and regulations of the Government.

8. To manage organization, staffing, cadres, training and technical improvement in the industry according to the regulations of the Government.

9. To inspect and audit Ministries, sectors, People's Committees at all levels, organizations and individuals nationwide, including foreign organizations and individuals regarding compliance with laws and State regulations and those of the General Department in the field of postal services.

Article 3.- The Post and Telecommunications General Department is headed by its Director, with Deputy Directors assisting the Director.

The Director and Deputy Directors are appointed and relieved of their duties by the Prime Minister.

The Director of the Post and Telecommunications General Department is responsible to the Prime Minister for the entire scope of work assigned. Deputy Directors are responsible to the Director for the tasks delegated to them.

Article 4.- The organizational structure of the General Post Office Administration includes:

a) The machinery assisting the Director-General:

1. Policy Department.

2. Economic Planning Department.

3. Science and Technology Cooperation International Department.

4. Organization and Cadre Labor Department.

5 Inspection.

6. Office.

For management purposes, the Director of the Post and Telecommunications General Department may establish representatives in certain regions or delegate some management tasks to the Provincial Postal Service Directors under central cities to implement state management over postal services.

1. Vietnam Standard Quality Center;

1. Institute of Science and Technology.

2. Radio Frequency Spectrum Administration.

3. Information Publishing Center.

c) Production and Business Units:

1. Postal and Telecommunications Corporation.

2. Other enterprises directly subordinate to the General Department.

The Director of the Post and Telecommunications General Department is responsible for drafting the charter of organization and operation of the Postal and Telecommunications Corporation to be decided by the Prime Minister.

Article 5.- This Decree takes effect from the date of issuance, all previous provisions contrary to this Decree are abolished.

Article 6.- The Director of the Post and Telecommunications General Department, Ministers, Heads of ministerial-level agencies and agencies under the Government, Chairmen of Provincial People's Committees under central cities are responsible for implementing this Decree.
