CIRCULAR
OF THE MINISTRY OF FINANCE AND THE MINISTRY OF INTERIOR
Regulations on the Collection of Fees for Managing Motor Vehicles and Drivers
Pursuant to Article 6 of the People's Police Law issued on January 28, 1989.
Pursuant to Decision No. 276/CT dated July 28, 1992 of the Chairman of the Council of Ministers on the unification of management of various types of fees and charges.
The Ministry of Finance and the Ministry of Interior stipulate the system for collecting fees for managing motor vehicles and drivers as follows:
I - OBJECTS OF COLLECTION
The objects of collection of fees for managing motor vehicles and drivers include:
- Organizations, Vietnamese citizens, and foreign organizations and individuals residing in Vietnam when they are granted registration certificates for managing motor vehicles that must be registered with public security authorities.
- Vietnamese citizens and foreign citizens residing in Vietnam who are granted driving licenses and managed by public security authorities for motor vehicles.
II - AMOUNT OF FEES, TYPE OF MONEY COLLECTED
1. The amount of fees for issuing registration certificates for managing motor vehicles and driving licenses shall be applied according to the attached table in this Circular. Collection agencies must publicly display the fee schedule and may not collect additional amounts beyond those specified. When market prices fluctuate by 20% or more, the Ministry of Interior will coordinate with the Ministry of Finance to adjust the fee levels accordingly.
2. Type of money collected
- For organizations and Vietnamese citizens, fees shall be collected in Vietnamese dong.
- For foreign organizations and individuals, fees shall be collected in US dollars or converted to Vietnamese dong at the buying rate published by the State Bank of Vietnam at the time of fee collection.
- For joint ventures between Vietnam and foreigners, if the vehicle is registered under plates designated for foreigners, the fees shall be collected as for foreign organizations and individuals.
III - MANAGEMENT AND USE OF REVENUE
1. Regarding the production of license plates
Units producing license plates must comply with the prescribed models of the General Department of Public Security and be subject to inspection and guidance from the Traffic Police Corps. They must register and operate in accordance with current state regulations. Financial management systems and tax obligations must be adhered to as stipulated by law, with the price of license plates based on reasonable costs in each locality at different times.
2. Regarding the collection of fees
The Traffic Police Corps (Ministry of Interior) and provincial and municipal public security agencies are responsible for organizing the collection of fees for managing motor vehicles and drivers in conjunction with the issuance of management certificates and driving licenses. They must declare and register with local Tax Departments. When collecting fees, they must use revenue receipts issued by the Ministry of Finance (General Department of Taxation). Collection units can retain 60% of the total collected amount in Vietnamese dong (including foreign currency converted to Vietnamese dong) to cover expenses for purchasing license plates, documents, and other necessary costs, and to supplement operational funds. The Ministry of Interior will regulate the management and use of these retained funds in accordance with state regulations.
The remaining amount (after retention) must be fully deposited into the state budget at the provincial or municipal treasury within five days at the beginning of the following month, according to Chapter 14, Clause 1, Item 1, Section 35 of the current budget classification, with foreign currency deposited into Account No. 229-110-370-001 at the Vietnam Foreign Trade Bank. Financial departments of the Traffic Police Corps and provincial and municipal public security agencies must liaise with local Tax Departments to receive revenue receipts from the Tax Departments and provide them to the departments issuing management certificates and driving licenses. They are responsible for managing and using these funds in accordance with the regulations of the Ministry of Finance. Accounting records must be maintained to track all expenses, collection and payment situations, and retained fee amounts as required by the Accounting and Statistics Ordinance. Quarterly and annual consolidated reports must be submitted for settlement to the Ministry of Interior and local Tax Departments.
- Local Tax Departments have the responsibility to urge the timely submission of fees for managing motor vehicles and drivers in accordance with the provisions of this Circular.
During implementation, any difficulties or issues should be reported promptly to the Ministry of Finance and the Ministry of Interior for research and resolution.
