Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decision No. 571/2002/QĐ-TTg dated July 12, 2002 of the Prime Minister approving the "Feasibility Study for Investment Construction of Pu Mat National Park, Nghe An Province";

Pursuant to Decision No. 147/2005/QĐ-TTg dated June 15, 2005 of the Prime Minister approving the Project "Economic and Social Development of Western Nghe An Province until 2010";

Considering the proposal of the People's Committee of Nghe An Province at Report No. 3059 TTr-UBND dated June 8, 2006 and of the Ministry of Planning and Investment at Document No. 8097 BKH/KTĐP< dated November 2, 2006 regarding the request to approve the Project "Preservation and Sustainable Development of the Dan Lai Ethnic Minority Group Currently Residing in the Core Area of Pu Mat National Park, Con Cuong District, Nghe An Province."

DECISION:

Article 1. Approving the Project "Preservation and Sustainable Development of the Dan Lai Ethnic Minority Group Currently Residing in the Core Area of Pu Mat National Park, Con Cuong District, Nghe An Province" with the main contents as follows:

1. Objectives of the Project

Improving living conditions, developing economy and society to preserve and sustainably develop the ethnic minority group currently residing in the core area of Pu Mat National Park, preserving the natural environment of Pu Mat National Park, and protecting border security.

2. Scope and Location of Implementation of the Project

Among the total of 176 households of the Dan Lai ethnic minority group currently residing in the core area of Pu Mat National Park, organize the relocation of 146 households to new locations and stabilize 30 households at their current location as follows:

- Organize the relocation of 146 households of the Dan Lai ethnic minority group currently residing upstream of Khe Kheng belonging to two villages: Khe Cong and Ban Bun, Mon Son Commune, to the resettlement area at three villages: Ke Gia, Ke Tat, Ba Ha, Thac Ngan Commune;

- Organize the stabilization of life for 30 households remaining at Ban Co Phat Village, Mon Son Commune, Con Cuong District, Nghe An Province;

- Continue supporting 36 households that were relocated in 2002.

3. Scale of Investment Construction

- For the 146 households moving away: construct a resettlement area for 146 households at the new location in Thach Ngan Commune, Con Cuong District, Nghe An Province including:

+ Resettlement Point No. 1: Ban Ke Gia for 42 households;

+ Resettlement Point No. 2: Ban Ke Tat for 40 households;

+ Resettlement Point No. 3: Ban Ba Ha for 64 households.

- For the 30 households staying: organize the stabilization of production, life, and social culture for 30 households at Ban Co Phat to coordinate with the Border Guard, forest protection force, and tourism management agency to maintain border security, protect forests, and combine with the development of eco-tourism in Pu Mat National Park.

- For the 36 households relocated in 2002: continue supporting the organization of the stabilization of production, life, and social culture for 36 households, 194 individuals who have been relocated to two villages Tan Son and Cu Ra, Mon Son Commune, Con Cuong District, Nghe An Province.

4. Main Contents of Investment

a) Investment Support for Production

- Regarding the allocation of production tasks.

+ At the resettlement point in Thach Ngan Commune, Con Cuong District.

Agricultural land: clearing, rice cultivation, field crops; on the household garden area, guide planting vegetables, field crops, fruit trees such as lychee, plum, orange, mango, papaya.

Forestry land: on the foot of hills plant 1,000 hectares of raw material forests, 100 hectares of fruit trees (orange, peach, lychee...), intercropping short-term food crops during the first years when the forest has not yet closed. On the slopes and hilltops apply forestry techniques to encircle and protect existing forests.

Livestock breeding: develop cattle, pig, poultry farming towards concentration with pens, planting grass to provide fodder locally for livestock.

+ At the settlement point for 30 households in Ban Co Phat, Mon Son Commune, Con Cuong District.

Develop eco-tourism, river cruises over rapids on Giang-Khe Kheng River, culinary culture, exploiting the cultural characteristics of the Dan Lai people such as gong dance, archery, pole climbing, stone throwing...; produce souvenirs from local materials such as bamboo, rattan, weaving (scarves, skirts, shirts...) to sell to tourists.

Develop forestry linked to the community: assign forest protection contracts averaging 5 hectares per household, plant oil-producing, resin-producing, and fruit-bearing trees (ginger, wind tree) or bamboo, rattan... apply forestry techniques to encircle and protect primary forests, maintaining a sustainable ecological environment.

Stabilize production on existing paddy fields, utilize the edge of streams to grow vegetables, cassava, fruit trees...

Livestock breeding: develop cattle, pig, poultry farming to create commercial products and daily food sources.

+ At the resettlement point for 36 households in 2002 in Mon Son Commune, Con Cuong District.

Continue to promote compensation and land recovery to allocate to resettled households for combined agricultural and forestry production. Provide funding support for livestock development.

- Investment Support for Stabilization and Development of Production.

+ At the resettlement point in Thach Ngan Commune: due to the transition from shifting cultivation, hunting, gathering to flatland agriculture, rice cultivation, forestry, and animal husbandry, support according to Decree No. 197/2004/NĐ-CP of the Government:

 Support agricultural land: each household averages 0.219 hectares of rice fields; 0.158 hectares of field crops; 2.7 hectares of forestry land; 400 square meters of residential land; 0.324 hectares of garden land;2 Support seeds and fertilizers for the first crop;

Support livestock breeds, including purchasing draft cattle, piglets;

Support production tools: plows, harrows, shovels, spades;

Support agricultural and forestry extension services such as training and guiding technical cultivation methods, building household gardens and farms. Apply new scientific and technological advances in crop cultivation, animal husbandry, raw material tree planting, forest product processing, and other trades to households; support pest control and veterinary services for three years (from 2007 to 2009). Support the construction of mountainous economic garden models.

+ At the settlement point for 30 households in Ban Co Phat, Mon Son Commune, Con Cuong District.

+ Settlement point for 30 households at Ban Co Phat, Mon Son commune, Con Cuong district.

Mainly supporting agricultural extension services such as training and guiding farming techniques, building household gardens and farms, applying new scientific and technological advances in crop cultivation, animal husbandry, beekeeping, and forestry. Supporting various types of seeds for planting, livestock, materials, and fertilizers. Supporting the construction of economic garden models.

+ For the relocation site of 36 households in 2002 at Mon Son commune, Cong Cuong district: support purchasing draft cattle, breeding pigs.

b) Infrastructure construction

- The relocation site of Thach Ngan commune.

+ Road transportation: constructing a road from the commune center to relocation site number 1 (11 km long) to serve general civilian needs and the specific relocation area, consistent with the scale of roads from the commune center to mountain villages. Constructing transportation routes totaling 2.8 km from the main axis to other relocation sites according to rural traffic type B standards.

+ Water resources and drinking water: constructing facilities to provide drinking water for relocation sites number 2 and number 3.

+ Electricity: constructing a 35 Kv line 11 km long from Ban Ke Gia to the relocation sites and three substations, and a 0.4 Kv low-voltage line 10 km long.

+ Supporting the construction of a school measuring 800 square meters2, a health station measuring 210 square meters2, and three community houses each measuring 71.3 square meters2.

- Relocation site for 30 households at Ban Co Phat, Mon Son commune, Cong Cuong district.

+ Constructing a road from the commune center to the village center, 30 km long, following the old path, serving the residents and border patrols.

+ Constructing an internal village road 2 km long, with a base width of 3.5 meters and a concrete surface width of 2 meters.

+ Constructing the Co Phat irrigation dam to stabilize water supply for paddy fields.

+ Constructing a five-classroom school measuring 400 square meters2, and a community house for the village measuring 120 square meters2 (including one room for village healthcare).

+ Developing tourism infrastructure: including constructing a reception area (at Pha Lai Dam), accommodation and comprehensive service areas, and a transfer zone (at Ban Co Phat). Supporting the purchase of transportation equipment according to the approved plan for developing the Pha Lai Dam and Ban Co Phat tourist area by Nghe An province.

- Relocation site for 36 households in 2002 at Mon Son commune, Cong Cuong district.

Constructing the Tan Son pump station to serve irrigation for 38 hectares of rice fields for two crops.

c) Building housing for ethnic groups

- Constructing housing for relocated households: using a three-bay stilt house model with reinforced concrete columns and tiled roofs at 22 square meters per house.2.

- Relocation site for 30 households at Ban Co Phat, Mon Son commune, Cong Cuong district.

+ Housing support: implemented according to Decision No. 134/QĐ-TTg of the Prime Minister, providing 15 million VND per household, with the central budget contributing 5 million VND, the provincial budget contributing 5 million VND, and the district budget contributing 5 million VND.

+ Supporting the construction of drinking water and sanitation facilities: each well supported with 300 thousand VND and 5 tons of cement; supporting 50% of the value for bathhouses and sanitation facilities.

d) Initial resettlement and living support

- Moving support: providing 3 million VND per household for moving expenses.

- Living stabilization support includes: food rations and living expenses; the support period is 12 months, equivalent to 30 kilograms of rice.

- Purchasing daily necessities: beds, mats, quilts, mosquito nets.

đ) Cultural and social preservation and development

- Culture: guiding villagers' activities to strengthen propaganda efforts to encourage people to implement policies on marriage, family planning, cultural village and family construction, superstition elimination, etc., to create a healthy cultural environment, improve literacy. Expanding cultural exchanges with other ethnic groups to build solidarity among ethnic groups living in the area.

- Education and training: implementing long-term training plans, organizing children of ethnic minorities to study in boarding schools at the district and provincial levels; vocational training and career guidance so that after studying, they return to serve their villages.

- Health: increasing medical personnel to serve health check-ups and treatment for the population. Promoting knowledge about reproductive health to raise awareness among ethnic groups about consanguineous marriages, contributing to improving the quality of the population.

5. Investment capital

a) Capital investment requirements:

- Total investment capital: 93,244 million VND.

- Capital invested up to 2006: 9,997 million VND.

b) Investment capital from 2007 to 2009: 83,246 million VND, including:

- State budget: 69,403 million VND, of which the central government will provide partial support and allocate additional targeted funds based on annual balancing capacity.

- Other sources: 13,843 million VND.

6. Project effectiveness

- Social: contributing to preserving and promoting ethnic culture, eliminating outdated customs; preventing genetic degradation risks; stabilizing livelihoods, raising awareness and educational levels, ensuring hygiene and healthcare. Gradually improving the material and spiritual lives of the Dan Lai ethnic group.

- Economic: addressing basic infrastructure needs for civilian life, planning and rearranging residential areas, exploiting land advantages, protecting forest resources, water sources, tourism potential, and gradually stabilizing production development, improving living standards for ethnic groups.

- Natural conservation and ecological environment: preventing forest resource degradation risks, protecting and developing rare animal species and biodiversity in Pu Mat National Park.

- National defense and security: ensuring border security goals tied to sustainable development and conservation of the Dan Lai minority group currently residing in the core area of Pu Mat National Park.

7. Implementation schedule

To be carried out over three years from 2007 to 2009.

Article 2. The People's Committee of Nghe An Province shall have the responsibility:

1. Establishing a Steering Committee to implement the project, headed by a Deputy Chairman of the People's Committee of the province. Relevant departments shall strengthen coordination with Cong Cuong district to implement the project.

2. Based on the ability to mobilize capital and the urgency of each issue, reasonably select priority order and instruct the project owner to prepare component projects for approval by competent authorities in accordance with current regulations.

3. Proactively integrate various sources of capital to implement the Project, while directing focused investment with a clear orientation to quickly achieve practical benefits, prioritizing investment in technical infrastructure for production and social infrastructure to ensure sustainable and long-term development for ethnic minorities.

4. Enhance the effectiveness of the management machinery of local authorities at all levels, including districts and communes, linked with villages and hamlets.

Article 3. Ministries, agencies equivalent to ministries, and government agencies shall, based on their functions and responsibilities, be responsible for coordinating with the People's Committee of Nghe An Province to concretize the Project "Preservation and Sustainable Development of the Dan Lai Ethnic Minority Group Currently Residing in the Core Area of Pu Mat National Park, Con Cuong District, Nghe An Province," which has been approved, into component projects for implementation.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

The Chairman of the People's Committee of Nghe An Province, Ministers, Heads of agencies equivalent to ministries, and Heads of government agencies are responsible for enforcing this Decision.
