Regulations on the system, policies, and support work for individuals and organizations performing tasks of searching for and collecting remains of revolutionary martyrs

Pursuant to the Law on Government Organization No. 63/2025/QH15;

Pursuant to Ordinance on Preferential Policies for Those Who Have Contributed to the Revolution No. 02/2020/UBTVQH14;

"Based on the proposal of the Minister of National Defense;"

The Government promulgates this Decree stipulating the system, policies, and support work for individuals and organizations performing tasks of searching for and collecting remains of revolutionary martyrs.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the system and policies for individuals performing tasks of searching for and collecting remains of revolutionary martyrs or those who are mobilized directly by competent authorities to participate in such tasks both domestically and abroad; support work for organizations directly directing and implementing tasks of searching for and collecting remains of revolutionary martyrs; funding for construction, repair, and renovation of memorials commemorating revolutionary martyrs, Memorials of Remembrance, and Memorials of Friendship for Vietnamese volunteer soldiers and experts who died abroad during wartime.

Article 2. Applicability

1. Officers, professional military personnel, non-commissioned officers, soldiers, workers, and civil servants under the establishment of search and collection teams for remains of revolutionary martyrs.

2. Individuals not falling within the scope prescribed in Clause 1 of Article 2 of this Decree, who are directly mobilized by competent authorities to perform tasks of searching for and collecting remains of revolutionary martyrs; individuals carrying out activities related to the search and collection of remains of revolutionary martyrs; individuals providing information about revolutionary martyrs and their graves; relatives or persons worshipping revolutionary martyrs or persons authorized to seek information about the graves of revolutionary martyrs.

3. Members belonging to the organizations prescribed in Point b Clause 4 of this Article.

4. Organizations directly directing and implementing tasks of searching for and collecting remains of revolutionary martyrs, including:

a) Search and collection teams for remains of revolutionary martyrs both domestically and abroad.

b) Steering Committees at various levels for searching for, collecting, and identifying the identities of remains of revolutionary martyrs with incomplete information (referred to as Steering Committees); Special Working Committees at various levels for searching for, collecting, and repatriating remains of Vietnamese volunteer soldiers and experts who died in Laos during wartime (referred to as Special Working Committees); Special Responsibility Committees at various levels for searching for, collecting, and repatriating remains of Vietnamese volunteer soldiers and experts who died in Cambodia during wartime (referred to as Special Responsibility Committees); Office of the National Steering Committee, Permanent Office of the Steering Committee or Special Working Committee or Special Responsibility Committee at various levels (referred to as Permanent Offices at various levels).

c) Units assigned the task of searching for and collecting remains of revolutionary martyrs; reviewing and completing烈士遗骸搜寻和收集任务的个人和组织的制度和政策。

5. Individuals, organizations, and localities related to the work of searching for and collecting the remains of war martyrs.

Chapter II

REGIME AND POLICIES FOR INDIVIDUALS PERFORMING SEARCH AND COLLECTION TASKS OF THE REMAINS OF WAR MARTYRS

SEARCHING FOR AND COLLECTING THE REMAINS OF WAR MARTYRS

Article 3. Regime and policies for individuals belonging to search and collection teams of the remains of war martyrs

The subjects specified in Clause 1 of Article 2 of this Decree, during the time performing tasks of searching for and collecting the remains of war martyrs, in addition to salary, allowances, and other regimes prescribed under current regulations, shall also enjoy the following regimes and policies:

1. Monthly responsibility allowance equal to 0.5 times the basic wage level stipulated by the Government at the time of implementing the regime for those receiving wages, and compared with the rank allowance for a private soldier for non-commissioned officers and soldiers.

The period of enjoyment starts from the month of actual performance of the task of searching for and collecting the remains of war martyrs until the month of completion of the task according to the plan for searching for and collecting the remains of war martyrs approved by the competent authority.

2. Special monthly allowance equal to 20% of the wage amount based on military rank or type, group, grade currently enjoyed plus leadership position allowance and seniority allowance exceeding the standard (if applicable) for those receiving wages, or military rank allowance currently enjoyed for non-commissioned officers and soldiers when performing tasks domestically; equal to 100% of the wage amount based on military rank or type, group, grade currently enjoyed plus leadership position allowance and seniority allowance exceeding the standard (if applicable) for those receiving wages, or military rank allowance currently enjoyed for non-commissioned officers and soldiers when performing tasks abroad.

The special allowance is calculated on a monthly basis; in cases where less than a full month has been served, it will be implemented as follows: From 15 days and above, it is counted as one month; less than 15 days, it is counted as half a month.

3. They are entitled to additional meals equivalent to two times the basic meal allowance for infantry non-commissioned officers/soldiers/person/day while performing tasks abroad, the additional meal allowance is calculated from the day of departure to the country to perform the task of searching for and collecting the remains of war martyrs until the day of return to the country; equivalent to one time the basic meal allowance for infantry non-commissioned officers/soldiers/person/day while performing tasks domestically, calculated based on the actual number of days performing the task of searching for and collecting the remains of war martyrs according to the plan for searching for and collecting the remains of war martyrs approved by the competent authority. The aforementioned additional meal allowance is included in the meal, not paid in cash.

4. They are entitled to a subsistence allowance of 0.2 times the basic wage level/person/day calculated based on the actual number of days performing the task of surveying, verifying information, organizing activities for searching for and collecting the remains of war martyrs (including mobilization time). On the actual working day, if the task is performed for less than four hours, it is counted as half a day; from four hours and above, it is counted as one day. When enjoying the aforementioned subsistence allowance, they do not enjoy travel expenses.

5. They are provided with specialized uniforms as physical items specified in Appendix I attached to this Decree.

6. Health allowance level 1 at VND 1,500,000 per person (not exceeding two times per year) shall be calculated as follows: For time performing the mission of searching for and collecting烈士遗骸, including both domestic and overseas search and collection activities (if interrupted, the periods shall be accumulated), from six to twelve months inclusive, two allowances shall be provided; less than six months, one allowance shall be provided; when the Government adjusts the base salary upward, the allowance level prescribed in this clause shall be adjusted upward according to the ratio of the increase in the base salary.

7. The team leader, political commissar, deputy team leader, and deputy political commissar of search and collection teams for烈士遗骸shall be supported with telephone expenses at VND 200,000 per month; when the Government adjusts the base salary upward, the support level prescribed in this clause shall be adjusted upward according to the ratio of the increase in the base salary.

8. When performing tasks abroad, the following additional benefits shall be enjoyed:

a) Monthly regional subsidy equal to one time the base salary as stipulated by the Government at the time of implementing the system for those on salary, or equivalent to the rank allowance for a second-class private for non-commissioned officers and soldiers.

The regional subsidy shall be calculated monthly; if it does not reach a full month, it shall be calculated as follows: From fifteen days and above, it shall be calculated as one month; less than fifteen days, it shall be calculated as half a month. The benefit period starts from the month of departure to the foreign country to perform the search and collection mission until the month of return to the home country.

b) Support for learning Lao and Cambodian languages for forces performing tasks in Laos and Cambodia: Maximum amount VND 2,000,000 per person per year (duration not exceeding three years per person).

c) In case of injury or illness requiring examination and treatment at medical facilities abroad, all examination and treatment costs shall be reimbursed according to the regulations of the local medical facility; they shall also enjoy health allowances and additional food expenses as stipulated in Clause 3 and Clause 4 of this Article. If transferred back to the home country for treatment, transportation costs shall be reimbursed based on actual expenses.

d) Time spent performing the mission of searching for and collecting烈士遗骸abroad shall be converted into working time at a rate of one year equivalent to one year and six months for enjoying the one-time allowance upon leaving military service according to current regulations.

9. Responsibility for payment

a) The material benefits and special uniforms prescribed in this Article shall be distributed, paid, and settled according to regulations by the search and collection teams for烈士遗骸.

b) The provisions stipulated in Clause 1, Clause 2; Clause 7; Point a of Clause 8 of this Article shall be paid concurrently with the monthly salary and shall not be used to calculate contributions or enjoy social insurance and medical insurance benefits.

Article 4. Benefits and policies for members of the Steering Committee, Special Task Force; Professional Committees; National Steering Committee Office; Permanent Offices at various levels

Members of the organizations specified in Point b of Clause 4 of Article 2 of this Decree during the period directly performing inspection and guidance tasks for the search and collection of烈士遗骸, in addition to their salaries, allowances, and other benefits as prescribed, shall also enjoy the following benefits:

1. When inspecting and guiding the search and collection of烈士遗骸activities abroad

a) They shall enjoy travel expenses for state officials traveling abroad according to current regulations.

b) They shall enjoy allowances as prescribed in Clause 4 of Article 3 of this Decree for days directly guiding and inspecting search and collection activities.

c) In case of injury or illness, they shall enjoy benefits and policies as prescribed in Point c of Clause 8 of Article 3 of this Decree.

2. When inspecting and guiding the search and collection of烈士遗骸activities domestically, they shall enjoy allowances as prescribed in Clause 4 of Article 3 of this Decree for days directly guiding and inspecting search and collection activities on-site. When enjoying the aforementioned allowance, they shall not enjoy travel expenses.

3. Units assigned the task of searching for and collecting烈士遗骸that have not established a Steering Committee, when organizing inspection and guidance teams for the search and collection of烈士遗骸tasks undertaken by themselves, members of the inspection and guidance team shall enjoy allowances as prescribed in Clause 4 of Article 3 of this Decree. When enjoying the aforementioned allowance, they shall not enjoy travel expenses.

4. Individuals who are not members of the organizations specified in Point b of Clause 4 of Article 2 of this Decree, but are dispatched by competent authorities to participate in inspection and guidance teams for the search and collection of烈士遗骸, shall enjoy benefits and policies as prescribed in Clause 1 or Clause 2 of this Article.

5. The benefits and policies prescribed in Clause 1, Clause 2, Clause 3, and Clause 4 of this Article shall be planned by the National Steering Committee Office, Permanent Offices at various levels, division-level units and equivalents, submitted for approval by competent authorities, and paid and settled according to regulations.

Article 5. Regulations and policies for persons mobilized by competent authorities to perform tasks or cooperate in performing tasks related to searching for and collecting remains of烈士; persons providing information about martyrs or martyrs' graves; relatives or persons worshipping martyrs or persons authorized to seek information about martyrs' graves.

1. Persons directly mobilized by competent authorities to perform tasks or cooperate in performing tasks related to searching for and collecting remains of martyrs abroad are local people (locals, the maximum number of people mobilized shall not exceed 50% of the search and collection team's personnel strength); during the period of mobilization, they shall enjoy the following regulations and policies:

a) They shall be entitled to a subsistence allowance of 0.3 times the basic wage level per person per day for actual days mobilized to perform tasks related to searching for and collecting remains of martyrs.

b) They shall be provided with food expenses equivalent to two times the food allowance of non-commissioned officers and soldiers of the infantry per person per day, calculated based on the actual number of days mobilized to perform tasks related to searching for and collecting remains of martyrs.

c) They shall be supported with funds for purchasing specialized uniforms, specifically:

For periods of duty in searching for and collecting remains of martyrs from one month up to three months, support amounts to VND 500,000 per person for up to one month, VND 1,000,000 per person for more than one month up to two months, and VND 1,500,000 per person for more than two months up to three months; if the State Government adjusts the basic wage level upwards, the support amount specified in this clause shall be adjusted accordingly at the same ratio.

For periods of duty in searching for and collecting remains of martyrs exceeding three months, specialized uniforms prescribed in Item 1 of Appendix I attached to this Decree shall be provided, and the funds shall be paid in cash.

d) They shall be provided with transportation means (traveling together with the search and collection team).

đ) During the period of duty, if they fall ill, suffer accidents, get injured, or die (excluding cases of intentional injury, suicide, self-harm, or accidents caused by alcohol, drugs, or conflicts unrelated to the task of searching for and collecting remains of martyrs), they shall be entitled to the following regulations and policies:

All medical examination and treatment costs according to the regulations of the local healthcare facilities shall be reimbursed.

During the period of inpatient treatment, they shall be entitled to subsistence allowances and food expenses as stipulated in points a and b of Clause 1 of this Article.

If the period of mobilization ends but they continue inpatient treatment, the medical examination and treatment costs, subsistence allowances, and food expenses as stipulated above shall be reimbursed, but not exceeding fifteen days; if the illness persists beyond fifteen days, they shall be treated until recovery according to the healthcare facility's instructions and all medical examination and treatment costs shall be reimbursed.

In case of death due to illness or accident, the relatives of the mobilized person shall be supported with a one-time payment equivalent to ten months of the basic wage level.

2. Persons mobilized by competent authorities are those who travel from Vietnam to participate in guiding the location of martyrs' graves abroad.

a) Mobilization targets and conditions: They are individuals who have participated in combat in the search and collection area (with proof documents showing participation in combat in the search and collection area) and directly buried martyrs or witnessed their comrades burying martyrs; they must not suffer from serious illnesses requiring long-term treatment, ensuring health to perform the task.

The mobilization period shall not exceed ten working days from the date of departure to the date of return; the maximum number of people for each piece of information about the burial site of martyrs shall not exceed two.

They shall be guaranteed exit and entry procedures by the mobilizing agency according to regulations and provided with accommodation and meals together with the search and collection team of martyrs' remains; they shall enjoy the regulations and policies stipulated in points a, b, c, and d of Clause 1 of this Article.

If the mobilized person is currently receiving salary and allowances and participating in social insurance, health insurance, and unemployment insurance, and if their daily salary and allowance (daily salary and allowance calculated by dividing monthly salary and allowance by twenty-four days) is higher than the daily subsistence allowance stipulated in point a of Clause 1 of this Article, they shall be entitled to a subsistence allowance equal to their current daily salary and allowance of the preceding month before being mobilized; during the mobilization period, social insurance, health insurance, and unemployment insurance contributions shall be made according to laws on social insurance, health insurance, and labor.

If the mobilized person participates in social insurance, health insurance, and occupational accident and disease insurance during the mission abroad and falls ill, suffers an accident, gets injured, or dies, they shall be entitled to the following regulations and policies:

One hundred percent of medical examination and treatment costs according to the regulations of the host country shall be reimbursed. If transferred back to the home country for treatment, transportation costs shall be reimbursed according to actual expenses.

During the mobilization period, if they undergo inpatient treatment abroad, they shall be entitled to subsistence allowances and food expenses as stipulated in points a and b of Clause 1 of this Article.

If the mobilization period ends but they continue inpatient treatment abroad, medical examination and treatment costs, subsistence allowances, and food expenses as stipulated above shall be reimbursed, but not exceeding fifteen days; if the illness persists beyond fifteen days, they shall be transferred back to the home country for treatment until recovery according to the healthcare facility's instructions and shall enjoy health insurance benefits according to laws on health insurance.

In case of illness or accident leading to disability or death, they shall be entitled to regulations and policies according to laws on social insurance, health insurance, and labor safety and hygiene.

đ) If the mobilized person does not participate in social insurance, health insurance, or occupational accident and disease insurance during the mission abroad and falls ill, suffers an accident, gets injured, or dies, they shall be entitled to the following regulations and policies:

One hundred percent of medical examination and treatment costs according to the regulations of the host country shall be reimbursed. If transferred back to the home country for treatment, transportation costs shall be reimbursed according to actual expenses.

During the mobilization period, if inpatient treatment abroad is received, compensation and meal expenses shall be provided according to points a and b of Clause 1 of this Article.

In cases where the mobilization period has ended but inpatient treatment continues, costs for medical examination and treatment, compensation, and meal expenses shall be reimbursed according to the aforementioned regulations, but not exceeding a maximum of fifteen days; if the illness remains unstable after fifteen days, the person shall be repatriated for continued treatment until recovery, and all medical examination and treatment costs according to the service price framework issued by the Ministry of Health shall be reimbursed.

In cases of accidents leading to disability, medical assessment of the degree of reduced work capacity, or death due to illness, the person mobilized or their relatives shall be compensated at the level specified for those insured under labor accident and occupational disease insurance, as stipulated by laws on labor safety and hygiene, with the monthly salary rate being two times the base salary.

In cases of illness leading to death, the relatives of the person mobilized shall receive a pension allowance equivalent to five months' base salary.

The relatives or organizations or individuals arranging funeral services for the person mobilized who died from an accident or illness shall receive a burial allowance equivalent to that provided for the relatives of social insurance beneficiaries who have died, as stipulated by laws on social insurance.

e) In cases where the person mobilized intentionally causes injury, commits suicide, self-harms, or suffers an accident due to alcohol, drugs, or drug precursors while performing search and collection tasks, or suffers an accident unrelated to these tasks, they shall not be entitled to medical examination and treatment costs, compensation, and meal expenses during inpatient treatment abroad as stipulated in point d of this Article, nor shall they be entitled to other benefits and policies as stipulated in point đ of this Article.

g) In cases of injury or sacrifice during the mobilization period while performing tasks, the person shall be considered for recognition as a war invalid, a person receiving benefits similar to war invalids, or烈士遗属，按照关于革命烈士优待的法律规定进行认定。

3. Persons authorized by competent authorities to perform tasks or cooperate in searching for and collecting martyrs' remains within the country (except for persons mobilized to guide the location of martyrs' graves, whose mobilization period shall not exceed ten days, and the number of persons mobilized shall not exceed two people for each piece of information about the location of martyrs' remains) shall enjoy the following benefits and policies:

a) They shall enjoy the benefits and policies stipulated in points a, b, c of Clause 1 and point g of Clause 2 of this Article.

If the person mobilized is currently receiving salary and allowances and participating in social insurance, health insurance, and unemployment insurance, and if the daily salary and allowance rate (the daily salary and allowance rate is calculated by dividing the monthly salary and allowance by twenty-four days) is higher than the daily compensation rate stipulated in point a of Clause 1 of this Article, then they shall receive compensation equal to the daily salary and allowance rate enjoyed in the month immediately preceding the mobilization month; during the mobilization period, social insurance, health insurance, and unemployment insurance contributions shall be made according to the relevant laws on social insurance, health insurance, and employment.

b) Transportation means shall be arranged (to travel with the search team); transportation costs from the place of usual residence to the search team and back (upon completion of the mission) shall be reimbursed like those of civil servants on official business.

c) Persons mobilized who are participating in social insurance, health insurance, and occupational accident and disease insurance, during the performance of their duties, if they fall ill, suffer an accident, become injured, or die, shall enjoy benefits and policies according to the relevant laws on social insurance, health insurance, and labor safety and hygiene, in addition to the following:

During the mobilization period, if inpatient treatment is received, compensation and meal expenses shall be provided according to points a and b of Clause 1 of this Article.

In cases where the mobilization period has ended but inpatient treatment continues, compensation and meal expenses shall be provided according to the aforementioned regulations, but not exceeding a maximum of fifteen days.

d) Persons mobilized who are not participating in social insurance, health insurance, or occupational accident and disease insurance during the performance of their duties, if they fall ill, suffer an accident, become injured, or die (excluding cases of intentional injury, suicide, self-harm, or accidents due to alcohol, drugs, or drug precursors, or accidents unrelated to the search and collection of martyrs' remains), shall enjoy the following benefits and policies:

All medical examination and treatment costs according to the service price framework issued by the Ministry of Health shall be reimbursed.

During the mobilization period, if inpatient treatment is received, compensation and meal expenses shall be provided according to points a and b of Clause 1 of this Article.

In cases where the mobilization period has ended but inpatient treatment continues, compensation and meal expenses shall be provided according to the aforementioned regulations, but not exceeding a maximum of fifteen days; if the illness remains unstable after fifteen days, the person shall continue treatment until recovery according to the medical institution's instructions, and all medical examination and treatment costs according to the service price framework issued by the Ministry of Health shall be reimbursed.

In cases of accidents leading to disability, medical assessment of the degree of reduced work capacity, or death due to illness, the person mobilized or their relatives shall be compensated at the level specified for those insured under labor accident and occupational disease insurance, as stipulated by laws on labor safety and hygiene, with the monthly salary rate being two times the base salary.

In cases of illness leading to death, the relatives of the person mobilized shall receive a pension allowance equivalent to five months' base salary.

The relatives or organizations or individuals arranging funeral services for the person mobilized who died from an accident or illness shall receive a burial allowance equivalent to that provided for the relatives of social insurance beneficiaries who have died, as stipulated by laws on social insurance.

4. Persons providing accurate information, searching for, and collecting martyrs' remains shall be entitled to compensation and specific rewards as follows:

a) A compensation of five million VND for accurate information leading to the discovery of one martyr's remains; ten million VND for accurate information leading to the discovery of a single grave or a collective grave containing two to five martyrs' remains; and twenty million VND for accurate information leading to the discovery of a single grave or a collective grave containing six or more martyrs' remains.

b) A person who has outstanding achievements in providing accurate information for the search and collection of烈士遗骸 shall be commended in accordance with the laws on competition and rewards.

5. Relatives or persons worshipping martyrs, or those authorized to go to units or localities where martyrs once worked or fought to seek information about martyrs' graves (this does not apply to foreign territories) and who do not fall under the cases stipulated in Clause 1 and Clause 2 of Article 155 of Decree No. 131/2021/NĐ-CP dated December 30, 2021 of the Government detailing and providing implementation measures for certain provisions of the Ordinance on Preferential Treatment for Those Contributing to the Revolution, shall be supported with travel expenses and food costs at the level specified in Article 9 of Decree No. 75/2021/NĐ-CP dated July 24, 2021 of the Government regarding the levels of allowances and preferential policies for those contributing to the revolution.

When relatives or persons worshipping martyrs, or those authorized to go to units or localities where martyrs once worked or fought to seek information about martyrs' graves, the Provincial Military Command or division-level unit or equivalent, based on the introduction letter from the People's Committee of the commune, ward, special city (shortened as People's Committee of the commune) where they reside or the agency or unit where they work (accompanied by a copy of the death notice of the martyr or the "National Memorial" list), shall issue a payment voucher for the support system according to regulations and retain the aforementioned documents as proof for settlement and finalization.

6. Vietnamese citizens who are not authorized to be mobilized according to Clause 2 of this Article but come to overseas search teams for martyrs' remains to cooperate in providing information about martyrs' graves, during the cooperation period, the search team will ensure food expenses equal to two times the daily food allowance for infantry non-commissioned officers and soldiers/person/day, with a maximum duration of no more than seven days.

7. Basis and responsibility for payment of benefits and policies

a) The basis for paying the benefits and policies stipulated in Clause 1, Clause 2, and Clause 3 of this Article includes: The decision on mobilization issued by the Provincial Steering Committee, division-level command, or equivalent (where no Steering Committee is established) or by the head of the Political Department of military regions and corps assigned the task of searching and collecting martyrs' remains (the decision clearly states the mobilization period, number of people, benefits enjoyed, and amount paid) and the content stipulated and guided in Clause 8 of this Article.

b) The basis for paying the subsistence allowance stipulated in Point a, Clause 4 of this Article includes: The confirmation document between the search and collection team or the Provincial Military Command or equivalent and the person providing information about martyrs and their graves, detailing the number of martyrs' remains found and collected.

c) The responsibility for paying the benefits and policies stipulated in Clause 1, Clause 2, Clause 3, and Point a, Clause 4 of this Article shall be borne by the search and collection team of martyrs' remains or units at the division level or equivalent (where no search and collection team is established) and shall settle and finalize according to regulations.

8. The Minister of National Defense shall specify and guide the implementation of benefits and policies for those mobilized without social insurance, health insurance, and occupational accident and disease insurance who fall ill, suffer accidents, or die as stipulated in Point d, Clause 2 and Point d, Clause 3 of this Article.

Chapter III

WORK SUPPORT FOR ORGANIZATIONS PERFORMING TASKS

SEARCHING FOR AND COLLECTING THE REMAINS OF WAR MARTYRS

Article 6. Assurance work and operating funds for search and collection teams of烈士遗骸任务在国内和国外执行的相关工作和经费

1. When performing tasks within the country

a) Equipment, specialized means, logistics, and living conditions shall be provided in accordance with the provisions set out in Appendix II attached to this Decree.

b) Fuel costs for tasks such as collecting and verifying information about martyrs and their graves; surveying, searching, and collecting martyrs' remains; exhuming, transporting, and handing over martyrs' remains; guiding, protecting forces shall be reimbursed based on actual expenditures incurred during the performance of these tasks.

c) Operating funds for temporary housing construction, with a maximum of 250,000,000 VND/house for teams with up to 30 personnel; a maximum of 300,000,000 VND/house for teams with 31 to 70 personnel; a maximum of 500,000,000 VND/house for teams with more than 70 personnel; the funding period is five years per cycle. In cases where search and collection teams already have permanent housing, if they do not need to construct temporary housing, this portion of the funds can be used to repair permanent housing.

d) Expenditure for exhuming martyrs' graves containing remains, with a maximum of 5,000,000 VND/grave. The expenditure includes: purchasing clay urns, funeral cloth, nylon, alcohol or spirits, incense, candles, soap, and local customs offerings; organizing worship services while waiting for the burial of martyrs' remains.

đ) Registration and inspection fees for various equipment and means (cars, motorcycles; specialized means) as stipulated in Appendix II attached to this Decree shall be reimbursed based on actual expenditures.

e) Repair and replacement parts expenses for equipment and means (including equipment and means donated by organizations and individuals) are as follows:

Motorcycles (motorbikes), with a maximum of 5,000,000 VND/unit/year.

Mine detectors, with a maximum of 10,000,000 VND/unit/year.

Cars, with a maximum of 60,000,000 VND/unit/year.

Excavators, with a maximum of 80,000,000 VND/unit/year.

Other equipment and means specified in Appendix II attached to this Decree and donated equipment and means, with a maximum of 50,000,000 VND/team/year.

g) Support expenses for purchasing offerings for the groundbreaking ceremony before searching and collecting martyrs' remains and restoring the site after searching and collecting martyrs' remains (according to local customs), with a maximum of 5,000,000 VND/session/one grave or area searched and collected.

h) Support expenses for activities to mobilize the public to provide information about martyrs and their graves, with a maximum of 100,000,000 VND/team/year.

i) Expenses for purchasing water filtration equipment; electricity for daily life and for organizing the exhumation of martyrs' remains shall be reimbursed based on actual expenditures.

k) Renting of means and compensation for damage to structures, trees, crops (for one search and collection location) shall be carried out as follows:

For expenses under 100,000,000 VND, the search and collection team or the unit directly assigned the task of searching and collecting martyrs' remains shall decide.

For expenses from 100,000,000 VND to 400,000,000 VND, the Provincial Steering Committee or the Political Department of the Military Region or Army Corps (where no Provincial Steering Committee has been established) shall decide.

For expenses from 400,000,000 VND to 700,000,000 VND, the Military Region Steering Committee or the Head of the Army Corps Command (where no Provincial Steering Committee has been established) shall decide.

For expenses exceeding 700,000,000 VND, units shall report and request the National Steering Committee (through the Policy and Social Affairs Bureau - General Political Department - National Steering Committee Office) to consider and decide.

Based on the requirements of the search and collection tasks of martyrs' remains, units assigned the task of searching and collecting martyrs' remains shall develop plans for approval by the competent authority; establish contracts for renting means; determine the level of damage, prepare compensation records, and settle accounts according to regulations.

l) Purchase expenses for common medicines: A maximum of 30,000,000 VND/team (with up to 30 personnel)/year; a maximum of 50,000,000 VND/team (with 31 to 70 personnel)/year; a maximum of 60,000,000 VND/team (with more than 70 personnel)/year.

m) Purchase expenses for tools for digging (shovels, spades, crowbars, knives, axes, and other items...) and office supplies, with a maximum of 25,000,000 VND/year for teams with up to 30 personnel; a maximum of 40,000,000 VND/year for teams with 31 to 70 personnel; a maximum of 60,000,000 VND/year for teams with more than 70 personnel.

2. When performing tasks outside the country

Assurance shall include the contents stipulated in points a, b, c, đ, e, g, h, i, k, l, m of Clause 1 of this Article, in addition to the following:

a) Expenditure for exhuming martyrs' graves containing remains, with a maximum of 7,000,000 VND/grave. The expenditure includes: purchasing clay urns, funeral cloth, nylon, alcohol or spirits, incense, candles, soap, and local customs offerings; organizing worship services during the waiting period for the burial of martyrs' remains.

b) Support for the provincial government of the foreign country to organize farewell ceremonies and repatriation of Vietnamese martyrs' remains, at a rate of 60,000,000 VND/session.

c) Support expenses for civil affairs work, propaganda, and mobilization to provide information about martyrs and their graves. The expenditure includes: purchasing dried food, at a rate of 50,000,000 VND/session (no more than two sessions per year) when deploying troops abroad; cash, with a maximum of 60,000,000 VND/year for one province in a foreign country.

d) Purchase expenses for diplomatic gifts when going abroad to coordinate and implement search and collection tasks of martyrs' remains, with a maximum of 40,000,000 VND/session (no more than two sessions per year) for each province in a foreign country.

đ) Visa fee expenses and other related exit and entry fees shall be reimbursed based on actual expenditures for each exit and entry mission abroad.

e) Operating funds for constructing temporary memorial houses for worshipping martyrs when searching and collecting (prefabricated houses that can be assembled and disassembled, with altars, decorations, and shelves for martyrs' remains), with a maximum of 500,000,000 VND/house. In cases where search and collection teams already have permanent memorial houses, this portion of the funds can be used to repair and upgrade existing permanent memorial houses.

Article 7. Ensuring funding for the activities of the Steering Committee, Special Task Force Board, Level-specific Professional Committees; the National Steering Committee Office, Level-specific Permanent Agencies

1. Funding for serving outbound delegations, welcoming inbound delegations; the expenditure level shall be implemented according to the current regulations on reception expenses for foreign guests working in Vietnam; organizing international conferences and seminars in Vietnam, hosting domestic guests, and traveling abroad on official business.

2. Supporting the Government's Special Task Force Board, the Special Task Force Board of provinces in Laos; the Government's Professional Committee, the Military Region Professional Committee, the Provincial Professional Committee in Cambodia in coordinating search and collection of烈士遗骸。根据实际情况，国防部提出支持金额，并报告总理审议决定。

3. Funding for organizing meetings, training sessions, mid-term reviews, final summaries; rewards; activities related to receiving, transferring information, materials, and war relics handed over by organizations and individuals both domestically and internationally. The expenditure level shall be implemented according to current regulations.

4. Funding for purchasing diplomatic gifts during negotiations and exchanges of information with foreign counterparts regarding the search and collection of烈士遗骸，每次不超过150,000,000 VND; remuneration for members of the Steering Committee, the Office, and Level-specific Permanent Agencies; visiting and encouraging forces directly involved in searching and collecting烈士遗骸；visiting relatives of martyrs attending the funeral ceremony for烈士遗骸。由国家 Steering Committee Office 或 Level-specific Permanent Agency propose and report to the same-level Steering Committee for consideration and decision.

5. Funding for propaganda activities

a) The maximum support amount for provincial and centrally-administered city propaganda agencies is 200,000,000 VND/year, decided by the provincial Steering Committee.

b) The maximum support amount for military region and army corps propaganda agencies is 300,000,000 VND/year, decided by the military region Steering Committee, Army Corps Command.

c) Support for central news agencies, press, and communication organizations, the Ministry of National Defense, central ministries and sectors, and the Vietnam Veterans Association. Annually, based on the requirements and tasks of propaganda work about martyrs and their graves, the Policy and Social Affairs Bureau of the General Political Department will aggregate proposals from units and organizations, propose, and report to the national Steering Committee for consideration and decision, but the total support amount for units and organizations shall not exceed 15,000,000,000 VND/year.

6. Funding for collecting, concluding, processing information, building and perfecting files and data on martyrs and their graves; decoding unit symbols and designations; mapping and updating data for searching and collecting烈士遗骸。

a) Individuals assigned by competent authorities to collect, review, conclude, process information, build and perfect lists and systems of files and data on martyrs and their graves; decode unit symbols and designations; map and update data for searching and collecting烈士遗骸shall enjoy allowances as stipulated in Clause 4, Article 3 of this Decree. The number of days entitled to allowances shall be carried out according to the plan of the competent authority; when enjoying such allowances, they shall not receive travel expenses.

b) Funding for standardization conferences and seminars on information, perfecting lists of martyrs and their graves; surveying, measuring, verifying, and concluding areas to serve the work of mapping and updating data for searching and collecting烈士遗骸；the expenditure level shall be implemented according to current regulations.

c) Funding for comparing, disinfecting, supplementing information, integrating databases on martyrs; perfecting and supplementing lists of martyrs; updating databases on martyrs and their graves; extracting information on martyrs and their graves; the expenditure level shall be implemented according to current regulations.

d) Funding for mapping, updating, and standardizing databases for searching and collecting烈士遗骸work and maintaining and upgrading software for managing the database system and information on searching and collecting烈士遗骸annually; printing maps for searching and collecting烈士遗骸(at a scale of 1/25,000 or 1/50,000); the expenditure level shall be implemented according to current regulations.

7. Funding for publishing publications; registering electronic information pages on the Internet; maintaining operations, maintenance, and upgrades of the Electronic Information Portal of the Policy and Social Affairs Sector; the expenditure level shall be implemented according to current regulations.

8. Ensuring equipment, means, and uniforms

a) The National Steering Committee Office and Level-specific Permanent Agencies shall be provided with equipment and means as stipulated in Appendix III issued together with this Decree.

b) Funding for repairing and replacing automobile parts as stipulated in Point e, Clause 1, Article 6 of this Decree.

c) Members of Level-specific Steering Committees; the National Steering Committee Office, Level-specific Permanent Agencies, shall be provided with one set of uniforms every two years for diplomatic activities.

d) Funding for designing and producing carrying frames, glass cases, coffins, and ceramic urns for the work of collecting, mourning, and burying烈士遗骸。

9. Funding for ensuring fuel for directing, guiding, inspecting the work of searching and collecting烈士遗骸(including both domestically and abroad); reviewing and perfecting lists of martyrs and their graves; handing over grave records; transporting and handing over烈士遗骸to localities and other related activities, to be reimbursed according to actual expenditures incurred in performing the mission.

10. Ensuring for provincial Steering Committees and Military Region Political Departments to organize Departure Ceremonies for search and collection teams of烈士遗骸and Welcome Ceremonies for teams returning from abroad, with a maximum of 150,000,000 VND per occasion (no more than two occasions per year).

11. Funding for transporting and handing over烈士遗骸to localities and organizing mourning and burial ceremonies for烈士遗骸

a) Individuals assigned by competent authorities to transport and hand over identified烈士遗骸to localities shall enjoy allowances as stipulated in Clause 4, Article 3 of this Decree. When enjoying such allowances, they shall not receive travel expenses.

b) The organization of funeral ceremonies and burial of烈士遗体应按照第131/2021/NĐ-CP号决定第171条第1款的规定执行；军事机关：地方与民政部门配合，向同级人民政府建议并报告，供其审议决定。

12. Expenditure for purchasing office supplies shall be reimbursed based on actual expenses incurred.

13. Expenditure for supporting the construction, repair, and renovation of memorials for martyrs; historical and cultural sites, monuments, friendship towers, memorial statues, and martyrs' commemorative areas of Vietnamese volunteer soldiers and experts abroad. Based on proposals (accompanied by diplomatic letters and files) from the host countries, the Ministry of National Defense shall take the lead and coordinate with relevant ministries, sectors, and localities to conduct surveys, comprehensive evaluations, and reach consensus with the Ministry of Finance to report to the Prime Minister for consideration and decision.

Article 8. Assurance work for units and localities assigned tasks to organize activities for searching and collecting martyrs' remains; reviewing and completing martyrs' files and lists; concluding on search and collection areas to draw up maps.

1. Units and localities assigned tasks to review and complete martyrs' files and lists; conclude on search areas, draw up maps for searching and collecting martyrs' remains; decode unit symbols and designations shall be assured for their activities according to point a, b, and point c of Clause 6, Article 7 of this Decree.

2. Provincial Military Command or division-level units and equivalent units (without dedicated or temporary search and collection teams) when receiving information about martyrs' graves from competent authorities shall be organized to search and collect martyrs' remains and shall be assured as follows:

a) They may mobilize forces to search and collect martyrs' remains. The systems and policies shall be implemented as follows:

Those mobilized are officers and soldiers within the establishment of the mobilizing unit, during the mobilization period they shall enjoy a subsistence allowance of 0.2 times the base salary per person per day; food provisions shall be ensured at an additional rate of one time the basic food allowance for infantry non-commissioned officers and soldiers per person per day. The subsistence allowance and additional food provision shall be calculated based on the actual days spent on searching and collecting martyrs' remains according to the mobilization plan approved by the competent authority; the additional food mentioned above shall be included in meals and not paid in cash.

Those mobilized who are outside the military shall be implemented according to Clause 3, Article 5 of this Decree.

b) They may allocate funds for the contents stipulated in points b, d, g, h, i, k, and point m of Clause 1, Article 6 of this Decree; ensure funding for purchasing common medicines and treatments up to a maximum of 20,000,000 VND per mobilization period.

3. The systems and policies stipulated in Clauses 1 and 2 of this Article shall be planned by the provincial Steering Committee or division-level units and equivalent units, budgeting for assurance, organizing payments, and settling accounts according to regulations.

4. The Political Department under the General Staff, the General Political Department, various General Departments, military branches, corps, and services; political organs of battalions, academies, and schools in the military; political organs of division-level units and equivalent units (excluding provincial Military Commands) shall be equipped with one desktop computer, one printer, and one file cabinet to serve the work of searching and collecting martyrs' remains and reviewing and completing martyrs' files and lists.

Chapter IV

IMPLEMENTING PROVISIONS

Article 9. Sources of funds

1. The financial resources to implement the systems, policies, and assurance work prescribed in this Decree shall be guaranteed by the state budget in accordance with the laws on the state budget.

2. Annually, the Ministry of National Defense shall base on its tasks and build the budget estimate for implementation in the state budget draft to be submitted to the Ministry of Finance for consolidation and presentation to the Government for decision.

3. In addition to the financial resources guaranteed by the state budget, based on the conditions and capabilities of agencies, units, and localities, local budgets, socialized sources, or other income sources in accordance with the law may be utilized to provide additional financial support, materials, equipment, and means for the work of searching and collecting martyrs' remains.

Article 10. Effective Date

1. This Decree takes effect from January 1, 2026.

2. The systems, policies, and assurance work for individuals and organizations performing the task of searching and collecting martyrs' remains prescribed in this Decree shall be implemented from the date this Decree takes effect.

3. Decision No. 75/2013/QĐ-TTg dated December 6, 2013, of the Prime Minister prescribing the systems, policies, and assurance work for organizations and individuals performing the task of searching and collecting martyrs' remains; Decision No. 35/2017/QĐ-TTg dated July 25, 2017, of the Prime Minister amending and supplementing some articles of Decision No. 75/2013/QĐ-TTg dated December 6, 2013, shall cease to be effective from the date this Decree takes effect.

4. When the referenced documents in this Decree are amended, supplemented, or replaced by other documents, the references shall be implemented according to the new documents.

5. If the base salary used as the basis for calculating the systems and policies in this Decree is abolished, it shall be implemented according to the provisions of the Government.

Article 11. Transitional Provisions

1. Special uniforms provided in kind for individuals performing the task of searching and collecting that have been issued according to the List specified in Appendix I of Decision No. 75/2013/QĐ-TTg, amended and supplemented by Decision No. 35/2017/QĐ-TTg, if they fall within the List specified in Appendix I of this Decree, shall continue to be used until the end of their service life; after the end of their service life, they shall be reissued according to this Decree.

2. Special equipment,后勤保障和生活保障物资对于已经根据第75/2013/QĐ-TTg号决定附件II规定的清单配发的搜寻队和收集队，经第35/2017/QĐ-TTg号决定修改补充后，如果属于本决定附件II规定的清单，则继续使用至使用寿命结束；使用寿命结束后，按本决定规定重新配发。

各单位应对未规定使用年限的装备、器材（汽车、摩托车）和专用设备的技术状况进行审查和评估。保持良好技术状态的可继续使用；若已损坏无法修理，则应向有权限的机关提出报废处理，并按本决定规定重新配发。

3. Equipment and means of ensuring for the Steering Committee, Special Task Force Board, Professional Committees, Office of the Steering Committee, Permanent Agencies, and specialized agencies at all levels that have been provided according to the List prescribed in Appendix III of Decision No. 75/2013/QĐ-TTg, amended and supplemented by Decision No. 35/2017/QĐ-TTg, if they fall within the List prescribed in Appendix III of this Decree, the National Steering Committee Office and the Permanent Agencies of the Steering Committee at all levels shall review and assess their technical condition. If they maintain good technical condition, they shall continue to be used; if they deteriorate, break down, and cannot be repaired, they shall be reported to the competent authority to remove them from the equipment list, dispose of them, and replace them in accordance with this Decree.

Article 12. Responsibility for Implementation

1. The Minister of National Defense shall prescribe the model of the altar for honoring martyrs; the price of carrying poles, glass cases, coffins, and ceramic urns serving the collection, commemoration, and burial of martyrs' remains; and provide guidance and implement this Decree; study and amend or supplement relevant legal documents within his authority or propose to the competent authority to amend or supplement such documents to ensure consistent and timely implementation of policies for individuals and organizations performing the task of searching for and collecting martyrs' remains.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities shall be responsible for implementing this Decree.
