Pursuant to Decree No. 65/2008/ND-CP dated May 20, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Pursuant to Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government on the application of information technology in state agency activities;

Pursuant to Decree No. 43/2011/ND-CP dated June 13, 2011 of the Government on the provision of information and online public services on the websites or portals of state agencies;

Pursuant to Circular No. 26/2009/TT-BTTTT dated July 31, 2009 of the Ministry of Information and Communications on the provision of information and ensuring convenient access to the websites of state agencies;

Considering the proposal of the Director of the Information Center,

DECISION:

Article 1. The Regulation on Management and Provision of Information on the Government Inspectorate Portal is hereby issued together with this Decision

Article 2. This Decision takes effect from the date of issuance.

Article 3. The Head of the Office, the Director of the Information Center, the Heads of all Departments, Bureaus, and Units under the Government Inspectorate shall be responsible for implementing this Decision./.

REGULATIONS

ON THE MANAGEMENT AND PROVISION OF INFORMATION ON THE GOVERNMENT INSPECTORATE PORTAL
(Issued together with Decision No.: 2818/QD-TTCP dated October 30, 2012 of the Chief Inspector General)

Chapter I.

GENERAL PROVISIONS

Article 1. Government Inspectorate Portal

The Government Inspectorate Portal (referred to as the Portal) is a means for disseminating information of the Government Inspectorate and the inspection sector, performing the function of promoting and disseminating the Party's guidelines, policies, and State laws on inspections, complaints, accusations, and anti-corruption; providing information on the activities of the Government Inspectorate and the inspection sector to the public; receiving feedback from agencies, organizations, and individuals on various fields of activity of the Government Inspectorate and the inspection sector; serving leadership, guidance, and management work of the Government Inspectorate Leadership over the entire inspection sector to fulfill the State management function on inspections, complaint resolution, and anti-corruption.

The Portal must comply with all current legal provisions regarding the management and provision of information on the Portal and the websites of state agencies.

Article 2. Scope of regulation, applicable subjects

Clause 1. This Regulation stipulates the management and maintenance of the operation of the Portal and the component information pages of units integrated on the Portal.

Clause 2. This Regulation applies to agencies, organizations, and individuals participating in the management, maintenance of the operation of the Portal, and the provision of information for publication on the Portal.

Chapter II.

MANAGEMENT OF THE GOVERNMENT INSPECTORATE PORTAL

Article 3. Management of the Government Inspectorate Portal

Clause 1. The Information Center is the unit entrusted with managing the infrastructure, ensuring technical conditions for the operation and continuous maintenance of the Portal. The Information Center is the Standing Unit of the Editorial Board, directly managed by the Editor-in-Chief.

Clause 2. The Government Inspectorate Portal Editorial Board is established by the Chief Inspector General to assist the Chief Inspector General in organizing the collection, provision, and approval of articles before their publication on the Portal.

Article 4. Ensuring Information Security on the Portal

1. The Information Center shall be responsible for implementing technical measures to ensure the safe operation of the Portal, regularly backing up data (at least eight times per month) to ensure rapid restoration of system operations in case of incidents; developing contingency plans to ensure continuous operation of the Portal.

2. Individuals and units granted access accounts and passwords to the Portal must ensure the security of their accounts and passwords in accordance with current laws and regulations of the Government Inspectorate; passwords must be changed before use and again every three months; passwords must contain at least seven characters including uppercase letters and special characters such as: @, *, #, &, $, and other special characters.

Article 5. Maintenance, Repair, Operation, Upgrade, and Modification of the Electronic Portal

1. The Portal must be subject to regular inspection, maintenance, repair, and monitoring of its activities to ensure continuous operation 24 hours a day, every day.

2. The Information Center shall review and propose upgrade and modification plans for the Portal to meet actual needs. At the same time, it shall develop plans to equip necessary devices for information collection, processing, and updating on the Portal.

Article 6. Training Human Resources

Annually, individuals involved in managing, operating, and maintaining the Portal's activities will be trained and provided with specialized knowledge appropriate to their fields to ensure service to the Portal's operations.

Article 7. Information Pages of Units Integrated on the Electronic Portal of the Government Inspectorate

1. Heads of units with integrated information pages on the Government Inspectorate’s Electronic Portal shall be responsible to the Government Inspectorate Leadership for the information on those pages regarding management activities in compliance with current laws. They also bear responsibility for the quality and content of their unit's information page.

2. Units that established information pages prior to the issuance of this Regulation must adjust them to comply with this Regulation. In cases where existing operational information pages do not meet the necessary conditions for independent operation as stipulated in this Regulation, heads of these units must report to the Government Inspectorate Leadership for guidance on handling or request to integrate into the Government Inspectorate’s Electronic Portal.

3. Units under the Government Inspectorate preparing to establish new information pages must comply with the provisions of this Regulation, and obtain approval from the Editorial Board and consent from the Government Inspectorate Leadership.

Chapter III

INFORMATION ON THE ELECTRONIC PORTAL

Article 8. Principles of Information

1. Requirements for information: Ensuring alignment with the Party's policies, State laws, directives of the Government Inspectorate Leadership; being truthful, accurate, objective, timely, serving positively in State administration, inspection work, complaint resolution, anti-corruption efforts within the inspection sector, and public information needs; conforming to the objectives and requirements of the Portal as prescribed in Decree No. 43/2011/ND-CP and this Regulation; adhering to legal provisions concerning state secrets, press, intellectual property rights, and internet information management; when posting, quoting, or reusing information on the Portal, the author and source of the information must be clearly stated.

2. Agencies, organizations, and individuals providing information must ensure the accuracy and truthfulness of the information they provide; strictly comply with current copyright regulations; for information quoted or compiled from other sources, the author, source, and date of provision of the quoted information must be clearly indicated.

Article 9. Scope and Content of Information

1. Introduction Information: Information on the functions, tasks, authorities, and organizational structure of the Government Inspectorate and its subordinate units; summary of the formation and development process of the Vietnamese Inspectorate; contact information: address, phone number, fax number, official email address for contact and information reception; brief biography and assignment of Government Inspectorate leaders.

2. News and Events: News and articles about activities and issues within the scope of state management of the Government Inspectorate.

3. Directive and Administrative Information: Includes the system of regulatory legal documents issued by Government Inspectorate leaders and administrative management documents serving directive and administrative work; opinions on handling and responding to suggestions and requests from organizations and individuals; information on rewards and penalties for organizations and businesses operating within the scope of state management of the agency; schedule of meetings of Government Inspectorate leaders.

4. Propaganda, Dissemination, and Guidance on Legal Implementation: Propaganda, dissemination, and guidance on the implementation of laws and policies within the scope of state management of the Government Inspectorate.

5. Information on Strategies, Planning, and Development Programs: Information on industry and sector development strategies, plans, programs, projects, and cooperation initiatives in the field of state management by the Government Inspectorate.

6. Specialized Regulatory Legal Documents and Related Administrative Management Documents.

7. Investment Project and Procurement Information: List of investment projects under preparation, ongoing, and completed; each project must include information such as project name, main objectives, specialized field, type of project, implementation period, project budget, type of funding, sponsor, project status.

8. Public Opinion Solicitation Section: Reception of feedback and suggestions from organizations and individuals regarding administrative regulations within the scope of state management of the Government Inspectorate; draft regulatory legal documents prepared by the Government Inspectorate requiring public opinion contributions; information on the deadline for receiving opinions, addresses, and email addresses of the agencies and units responsible for receiving opinions; opinions contributed by agencies, organizations, and individuals as stipulated by law.

9. Other Information within the Scope of State Management of the Government Inspectorate: Information on specialized statistics (data, statistical reports, statistical methods, data analysis reports, time of statistical implementation); business guidance, specialized electronic forms systems; legal consultation and answers within the authority of the Government Inspectorate; information on recruitment, selection, training, and further education both domestically and internationally of the Government Inspectorate as required by law; research articles, topics, and scientific programs in fields managed by the Government Inspectorate; introduction of publications, journals, and books of the Government Inspectorate or its subordinate units.

10. Contact Information for Staff and Officials: Directory of telephone numbers and email addresses of units, staff, officials of the Government Inspectorate, provincial inspectors, ministries, sectors, and localities.

11. Transaction Information of the Portal: Official address, phone number, fax number, and email address for transactions with organizations and individuals.

12. Information on Specialized Inspections and Wide-Scale Inspections.

13. Information on Special Reports; Industry Information Search; Statistical Report Information.

14. Information on Project 137: Incorporating anti-corruption education into schools; information on continuing to strengthen the dissemination and education of laws related to complaints and appeals at commune, ward, and town levels during the 2012-2016 period.

15. Information on ISO 9001:2008 of the Government Inspectorate: Activities of the ISO 9001:2008 Steering Committee; Plan for building and implementing ISO 9001:2008; updating and disseminating information on ISO 9001:2008.

16. Seeking Suggestions for Administrative Reform Initiatives.

17. Reader Opinion Poll Section on Portal Content.

18. Video Clips and Images Section on Activities of the Government Inspectorate.

19. Q&A Section.

20. Other Information as Directed or Agreed Upon by Government Inspectorate Leaders.

21. Information on Online Public Services: Administrative procedures within the scope of the Government Inspectorate's management; list of administrative services and online public services provided by the Government Inspectorate and its subordinate units, specifying the level of service provision for each service.

22. Foreign Language Information: Information in foreign languages on the functions, tasks, authorities, and organizational structure of the Government Inspectorate and its subordinate units; summary of the formation and development process of the Vietnamese Inspectorate; contact information: address, phone number, fax number, official email address for contact and information reception; brief biography and assignment of Government Inspectorate leaders; news and events: news and articles about activities and issues within the scope of state management of the Government Inspectorate that need to be translated into foreign languages; administrative procedures involving foreign elements, and online public services that foreigners can use must provide an English version for reference. Depending on capacity and conditions, other information may be selected to be provided in the English version of the portal.

Article 10. Provision of Information

1. Method of providing information: Information sent for publication on the Government Inspectorate Portal shall be submitted via email or other suitable means (USB, CD, DVD, fax, paper document...) to the Editorial Board of the Government Inspectorate Portal: Information Center - Government Inspectorate, Lot D29, New Urban Area, Tran Thai Tong, Yen Hoa, Cau Giay, Hanoi; Telephone: 080 44430; Fax: 080 44430; Email: [email protected].

2. Agencies, organizations, and individuals providing information must include complete details about the unit or organization, the sender's full name, position (if applicable), email address, telephone number, or contact address.

3. For normative legal documents, documents serving directive and management functions, and specialized statistical information within the approval and issuance authority of the Government Inspectorate Leadership, in addition to sending via email, the drafting units must also send the approved and issued paper documents to the Information Center for publication on the Portal.

4. Information format: Information to be published on the Portal shall be formatted according to commonly used standards as specified in Decision No. 20/QD-BTTTT dated April 9, 2008, of the Minister of Information and Communications regarding the list of standards for information technology applications in state agencies, specifically: Documents: *.doc, *.txt, *.rtf, *.pdf, *.odt; spreadsheets: *.csv, *.xls, *.ods; presentations: *.htm, *.pdf, *.ppt, *.odp; graphic images: *.jpg, *.gif, *.png; video and audio: *.mpg *.mp3, *.aac, *.asf, *.wma, *.wmv, *.ra, *.ram, *.rm, *.rmm, *.avi, *.mov, *.qt; data compression: *.zip; text, spreadsheet, and presentation information using Unicode fonts according to standard TCVN 6909:2001.

5. Publication time on the Portal: For news and events: not exceeding 12 hours of administrative time for domestic news; not exceeding 24 hours for foreign news from the time the activity or event occurs; for normative legal documents and state management documents issued by the Government Inspectorate: not exceeding five working days from the date of issuance; for information on strategies, plans, sectoral development projects, investment items, bidding, and public procurement: not exceeding five working days from the date of approval of the strategy, plan, project, item, or bid; for information on research projects and scientific topics: not exceeding twenty working days from the date of approval and after the completion and acceptance of the project or topic; for information and statistical reports: not exceeding ten working days from the date the statistical information is decided to be published by the Government Inspectorate Leadership; for monthly, quarterly, six-monthly summary reports, and annual work summary reports: within the first week of the following month for monthly reports; within the first fifteen days of the following quarter or month for quarterly and six-monthly reports; within fifteen days from the date of the annual work summary conference for annual work summary reports; for program, project, and proposal summary reports: within fifteen days from the end date of the program, project, or proposal.

Article 11. Receiving and Processing Information

1. The Standing Board of the Editorial Board shall be the point of contact for receiving information sent to the Portal. Such information will be classified, its origin, content, and purpose clearly identified, and then forwarded to relevant agencies, units, organizations, or individuals. Units with integrated component web pages on the Portal shall proactively collect and receive information for publication on their own web pages.

2. Information sent for publication on the Portal shall be transferred to members of the Editorial Board for approval (if necessary) before being published on the Portal in accordance with regulations.

3. Feedback information sent to the Government Inspectorate through the Portal shall be forwarded to relevant units or seek directives from the Government Inspectorate's leadership when necessary; within one working day from receipt of feedback information, the Standing Board of the Editorial Board shall notify readers that the feedback has been received; heads of related units shall be responsible for receiving feedback information, organizing the collection of information, and providing results or reporting on the processing of information to the Editorial Board within no more than fifteen working days from receipt of the information.

4. Questions sent to the Portal regarding the Q&A and legal advisory sections within the scope of the Government Inspectorate’s administrative management shall be compiled and periodically transferred to relevant agencies, organizations, and individuals inside and outside the sector, or seek directives and assignments from the Government Inspectorate's leadership when necessary. Depending on the quantity and nature of the questions, the Editorial Board will specify the response deadline when sending the questions.

5. Information exchange between the Editorial Board and agencies, organizations, and individuals shall be conducted via email. In cases where feedback information consists of legal questions or complex issues or those involving two or more units under their jurisdiction, the opinions of these units may be sought at the request of the Government Inspectorate's leadership; in cases where responses are provided according to the leadership's request, the main unit shall be responsible for sending the response information via email to the Editorial Board.

6. The Editorial Board shall be responsible for responding to readers by sending emails or publishing responses on the Portal in the Q&A section.

Article 12. Editing and Approving Information

1. Information must be evaluated for quality before being published on the Portal; in cases requiring verification, supplementation, or clarification of content by the supplying unit, individual, or specialized management unit, such actions shall be taken; the Editorial Board shall be responsible for approving information prior to its publication on the Portal; special cases requiring approval from the Government Inspectorate's leadership.

2. Documents concerning Party policies and State guidelines, and legal regulations in the Judicial field shall be published in full text.

3. The following types of information shall be refused publication:

a) Information containing content inconsistent with Party policies, State guidelines, or State laws;

b) Information containing content classified as state secrets; information decided by competent authorities not to be publicly disclosed or only disclosed within specified limits;

c) Information that is not true;

d) Information that does not meet quality standards;

đ) Other types of information prohibited from being posted on the Portal as stipulated by law.

Article 13. Updating and retaining information

1. Information updates shall be conducted at least three times on working days, with encouragement for updates during non-working days. Timely updates of posted information that has changed or been supplemented shall be made according to the directives of the Editorial Board.

2. Information posted on the Portal shall be stored in accordance with the provisions of the law on archiving.

Article 14. Reviewing information

The review of posted information on the Portal shall be carried out when there is a change in the information or upon request of the Editorial Board. In necessary cases, the Editorial Board may request relevant units under the Government Inspectorate to cooperate in reviewing information on the Portal.

Article 15. Royalty and remuneration system

The royalty system applies to authors and owners of information published on the Government Inspectorate Portal; the remuneration system applies to individuals performing tasks related to information for posting on the Portal, in accordance with current state regulations on the royalty and remuneration system for works and information published on the Portal.

Chapter IV.

RESPONSIBILITIES OF UNITS

Article 16. Responsibilities of the Information Center

1. Uniformly manage infrastructure, ensuring technical conditions for the operation and maintenance of the Portal's continuous activities as stipulated in Clause 1 of Article 3, Clause 1 of Article 4, and Article 5 of this Regulation; study and propose plans for equipping, upgrading infrastructure and technology to improve the quality and efficiency of the Portal's operations, gradually aligning with the plan for applying information technology in the activities of state agencies and developing an electronic government.

2. Serve as the Secretariat of the Editorial Board.

3. Take the lead and coordinate with the Office of the Government Inspectorate to study and propose plans to ensure material conditions for the Portal's activities.

4. Coordinate with the Office to prepare annual budget estimates from the state budget to maintain and develop the Portal.

Article 17. Responsibilities of units under the Government Inspectorate

1. Responsibility for providing and processing information:

a) Proactively provide complete, accurate, and timely information and data on areas within the scope of the unit's functions and tasks as stipulated in Articles 8, 9, and 10 of this Regulation or as requested by the Editorial Board.

b) Organize the collection of information and send responses to readers' feedback or information about the process of handling feedback within the time limit specified in Clause 3 of Article 11 of this Regulation.

c) Coordinate in answering questions and requests for legal advice sent to the Portal for legal consultation and advice within the scope of the unit's management as stipulated in Clause 4 of Article 11 of this Regulation.

d) Proactively or upon request of the Editorial Board, review legal normative documents, administrative procedures, guidance information, electronic forms, specialized statistical data, and other information within the scope of assigned functions and tasks.

e) Regularly review information introducing the unit on the Government Inspectorate Introduction Page, telephone directory, unit address, and officials who have been posted on the Portal to promptly provide to the Editorial Board Secretariat when changes occur.

f) Coordinate with the Information Center to integrate or link online public services within the unit's authority to the Portal in accordance with the law.

g) For legal normative documents drafted by the Government Inspectorate to submit to competent authorities for issuance or issued by the Government Inspectorate within its authority, the drafting unit is responsible for providing draft document files for publication on the Portal and providing the document after issuance for updating into the database of legal normative documents.

h) Project management units are responsible for providing project content (project name, main objectives, field of expertise, type of project, implementation period, funding model, sponsor), investment items, and project progress; investment decisions, tender plan approval decisions, tender invitation announcements, and tender results in accordance with state regulations on bidding.

2. Assign the role of primary information provider to the unit's primary information provider officer (in cases where the unit does not have a department responsible for general administrative work, it shall be assigned to the individual responsible for general administrative work of the unit); monitor and inspect the performance of the primary information provider role in accordance with this Regulation.

3. Unit heads are responsible to the Chief Inspector General for the contents of information and data provided by the unit's primary information provider officers to the Portal.

Article 18. Responsibilities of the Information Officer

1. Proactively collect and provide information within the unit's responsibility; in cases where necessary, proactively report to the head of the unit on the provision of information for publication on the Portal in accordance with this Regulation.

2. Summarize and promptly report to the head of the unit readers' feedback; coordinate with the unit's department assigned to respond to readers' feedback and legal inquiries; coordinate with the Editorial Board in responding to readers' feedback and inquiries.

3. Proactively review the information introducing the unit on the Inspectorate General of Vietnam section, the unit's telephone directory, and promptly notify the Editorial Board upon discovering errors or changes.

4. Coordinate with the Editorial Board in verifying information related to news articles within the scope of the unit's management.

5. Bear responsibility before the head of the unit for ensuring the provision of the unit's information to the Portal.

Article 19. Responsibilities of the Office of the Inspectorate General of Vietnam

Within its functions and tasks, ensure financial resources and physical infrastructure according to the proposal of the Information Center approved by the Inspectorate General of Vietnam's leadership to maintain, repair, upgrade, and sustain the Portal's regular operation, ensuring smooth and secure functioning.

Chapter V.

IMPLEMENTATION

Article 20. Rewards and Handling of Violations

1. Organizations and individuals performing well in the task of providing information and maintaining the Portal's operation will be considered for annual rewards in accordance with regulations.

2. Organizations and individuals violating information regulations on the Portal, obstructing the provision of information as prescribed, or affecting the Portal's operation, depending on the severity of the violation, will be subject to handling in accordance with the law.

Article 21. Organization of Implementation

1. The Information Center takes the lead and coordinates with the heads of bureaus, departments, and units under the Inspectorate General of Vietnam to implement this Regulation; annually summarize, evaluate, and report to the Chief Inspectorate General of Vietnam.

2. During implementation, if issues arise or difficulties occur, relevant units should promptly reflect them to the Information Center and the Inspectorate General of Vietnam for the Chief Inspectorate General of Vietnam to consider, supplement, and amend.
