Based on Circular Joint Circular No. 61/2008/TTLT-BNN-BNV dated May 15, 2008, issued by the Ministry of Agriculture and Rural Development and the Ministry of Home Affairs guiding the functions, tasks, authorities, and organizational structure of specialized agencies under provincial and district people's committees, and the management responsibilities of commune people's committees regarding agriculture and rural development;

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

This Decision hereby promulgates the "Model Regulation on Management, Coordination of Work, and Reporting System for Agricultural and Rural Development Organizations at the Provincial Level Located in District Administrative Areas with District People's Committees; Technical Staff Working in Commune Administrative Areas with Commune People's Committees" (hereinafter referred to as the Model Regulation);

At the proposal of the Director of the Cadre and Civil Servant Department,

DECISION:

Article 1. Based on the Model Regulation and the specific characteristics of each locality, the People's Committees of provinces and centrally governed cities shall instruct the Directors of Departments of Agriculture and Rural Development to develop specific regulations, which shall be submitted to the Chairpersons of provincial people's committees for consideration and decision;

Article 2. The Heads of the Ministry's Office, the Director of the Cadre and Civil Servant Department, the Heads of relevant agencies and units are responsible for implementing this Decision./.

Article 3. This Decision takes effect from the date of signing.

Article 4. MODEL REGULATION

This Regulation stipulates the responsibilities and authorities in management, coordination of work, and reporting system for agricultural and rural development organizations at the provincial level located in district administrative areas with district people's committees (hereinafter referred to as district people's committees); technical staff working in commune administrative areas with commune people's committees (hereinafter referred to as commune people's committees) in directing and implementing state management tasks and providing public services in the fields of agriculture and rural development within their respective districts and communes.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

The Directors of Departments of Agriculture and Rural Development, the Chairpersons of district people's committees, the Chairpersons of commune people's committees, the Heads of agricultural and rural development organizations, the Departments of Agriculture and Rural Development or Economic Departments under district people's committees, technical staff working in commune administrative areas, and other organizations and individuals involved in the implementation of state management tasks in agriculture and rural development at the district and commune levels are subject to this Regulation.

Article 2. Applicability

Agricultural and rural development organizations at the provincial level located in district administrative areas

Article 3. Explanation of Terms

In this Regulation, the following terms shall be understood as follows:

1. “refer to organizations subordinate to vertical provincial-level organizations (Departments of Agriculture and Rural Development): Animal Health Service, Plant Protection Service, Forest Inspection Service, Flood Control and Prevention Service, and Agricultural Extension Centers placed in district administrative areas, including: Animal Health Stations, Plant Protection Stations, Forest Inspection Units, Flood Control Units, and Agricultural Extension Stations.Technical staff

2. “refer to professional and technical staff in agriculture and rural development hired or transferred by competent authorities to work in commune administrative areas, including veterinary, plant protection, irrigation, agricultural extension, fishery extension, and forest rangers.Relevant organizations in district and commune administrative areas

Chapter II

CONTENT, PRINCIPLES, METHODS OF MANAGEMENT AND COORDINATION OF WORK

Article 4. Content of management and coordination

1. Implement the Party's guidelines and policies, state laws, regulations of the Government, the Ministry of Agriculture and Rural Development, and higher-level state management agencies.

2. Develop and implement plans for industry development that are consistent with economic and social development plans at the district and commune levels.

3. Carry out specific tasks of agriculture and rural development within the jurisdiction of the district and commune levels.

Article 5. Principles of management and coordination work

1. Ensure consistency between sectoral and functional management from the provincial level to the grassroots level and territorial management based on the functions, duties, powers, and authorities prescribed by law for relevant organizations.

2. Procedures for handling matters shall be carried out in accordance with legal provisions, work programs, plans, and working regulations of the People's Committee at the district level, the People's Committee at the commune level, provincial agricultural and rural development organizations located in the district, and technical staff working in the commune.

3. Create conditions for organizations and individuals to fulfill assigned tasks.

4. Coordination of work, exchange of information, and reporting must comply with the scope, functions, duties, and powers prescribed by law.

Article 6. Methods of coordination when handling specific tasks

1. When it is necessary to resolve issues related to the implementation of tasks under the responsibility of provincial agricultural and rural development organizations located in the district but directly related to the administrative management authority and responsibilities of local authorities, the People's Committee at the district and commune levels shall convene meetings with these organizations. If the matter exceeds their authority, the People's Committee at the district and commune levels shall report to higher-level People's Committees for them to convene meetings with representatives from the Department of Agriculture and Rural Development or heads of provincial agricultural and rural development organizations located in the district.

2. When it is necessary to coordinate to resolve areas of work directly related to the management functions and responsibilities of provincial agricultural and rural development organizations located in the district, the heads of these organizations shall convene meetings with related organizations to discuss and resolve the issues. If the matter exceeds their authority, they have the responsibility to report to the Department of Agriculture and Rural Development for them to convene meetings to consider and resolve the issue.

3. In cases where it is necessary to resolve matters without holding meetings, or where meetings are not required, communication can be conducted through reporting and exchanging information via communication means, and consensus can be reached through written documentation.

Chapter III

MANAGEMENT AND COORDINATION IN SPECIFIC AREAS OF WORK ON THE JURISDICTION OF THE DISTRICT AND COMMUNE LEVELS

Article 7. Responsibilities and Authorities of Relevant Organizations and Individuals

1. The People's Committee at the district and commune levels is responsible for unified state administration in the field of agriculture and rural development within their jurisdictions; directing specialized agencies subordinate to them or related organizations in the district and commune to closely cooperate with provincial agricultural and rural development organizations located in the district in activities of management and professional operations in the field of agriculture and rural development.

2. Provincial agricultural and rural development organizations located in the district have the responsibility to propose to the People's Committee at the district and commune levels and to closely cooperate with related organizations in the district and commune in management, guidance, and professional instruction according to their assigned functions and duties.

3. Technical staff working in the commune shall perform tasks as stipulated in Circular No. 04/2009/TT-BNN dated January 21, 2009, issued by the Ministry of Agriculture and Rural Development, guiding the responsibilities of agricultural and rural development professionals and technical staff working in the commune.

Article 8. Specific responsibilities and authorities in various fields of work

The provisions regarding management and coordination in each field of work must ensure clarity on the responsibilities and authorities of each leading agency, coordinating agencies, and related agencies in the management and coordination activities of relevant organizations and individuals (District People's Committees, sectoral organizations, Agricultural and Rural Development Departments, technical staff, etc.); at the same time, it is necessary to clearly define:

- Which tasks must be proposed or coordinated with the Agricultural and Rural Development Department or the Economic Department under the District People's Committee.

- Which tasks must be reported to the Agricultural and Rural Development Department/Economic Department or the Chairman of the District People's Committee before organizing implementation or completing implementation.

- Which tasks require coordination with related organizations within the district or commune.

- Which tasks, when necessary, must be subject to the direction, inspection, and mobilization by the Chairman of the District People's Committee or Commune People's Committee according to the law.

Based on the functions, tasks, organizational structure, and number of provincial agricultural and rural development sector organizations located in the district and technical staff working in the commune, as well as specific characteristics of the locality, the content of management and coordination at the district and commune levels shall be specified for implementation in the following areas:

1. Management and coordination in veterinary work

2. Management and coordination in plant protection work

3. Management and coordination in forest protection and development work

4. Management and coordination in water resources management and dike management

5. Management and coordination in agricultural extension/lumber extension/fishery extension work

Chapter IV

INFORMATION REPORTING, MEETING, INTERIM REVIEW, AND FINAL REVIEW REGIME

Article 9. Information Reporting

1. Monthly, provincial agricultural and rural development sector organizations located in the district shall compile results of specialized work implementation and coordinated work implementation, report to provincial sectoral organizations; simultaneously send to the District Agricultural and Rural Development Department or the District Economic Department.

2. The District Agricultural and Rural Development Department or the District Economic Department shall compile results of specialized work implementation and coordinated work implementation of provincial agricultural and rural development sector organizations located in the district, report to the Provincial Department of Agriculture and Rural Development and the District People's Committee.

3. Weekly, monthly, or ad hoc, technical staff in the commune have the responsibility to report to the Commune People's Committee and provincial agricultural and rural development sector organizations located in the district about the situation and results of assigned tasks.

Article 10. Meeting

Quarterly, the District People's Committee shall organize meetings chaired to review experiences in implementing management and coordination activities, information reporting according to the Regulation, with participants including: the District People's Committee, the District Agricultural and Rural Development Department or the District Economic Department, provincial agricultural and rural development sector organizations located in the district; Commune People's Committees; related organizations within the district (if there are management and coordination activities involved).

Article 11. Review and Summary

1. Annually, the Provincial Department of Agriculture and Rural Development shall chair and coordinate with the District People's Committee to organize interim reviews to assess the implementation results of the Regulation; simultaneously collect opinions to supplement and improve the Regulation to suit practical needs. The Provincial Department of Agriculture and Rural Development has the responsibility to compile opinions and submit to the Chairman of the Provincial People's Committee for consideration and decision to adjust and supplement the Regulation.

2. Every three years or five years, the Provincial Department of Agriculture and Rural Development shall chair the organization of final reviews to assess the implementation of the Regulation in the province.

Chapter V

IMPLEMENTATION

Article 12. Responsibilities of the Department of Agriculture and Rural Development

The Department of Agriculture and Rural Development shall take the lead in drafting, soliciting opinions from relevant agencies and units, and finalizing the Regulation on cooperation among provincial-level organizations located in district areas with the People's Committee of the district; among technical staff in commune areas with the People's Committee of the commune; and submitting it to the Chairman of the People's Committee of the province for approval.

Article 13. Responsibility for Implementation

1. The Chairmen of the People's Committees at the district and commune levels, the Heads of agricultural and rural development sector organizations, the Departments of Agriculture and Rural Development or Economic Departments under the People's Committee at the district level, technical staff working in commune areas, and other organizations and individuals involved in the implementation of state management tasks related to agriculture and rural development at the district and commune levels shall be responsible for implementing the Regulation after it has been approved by the competent authority.

2. The Department of Agriculture and Rural Development shall be responsible for leading, directing, guiding, and supervising provincial-level agricultural and rural development sector organizations located in district areas, coordinating with relevant departments and organizations, the People's Committees at the district and commune levels, and technical staff working in commune areas to implement the Regulation after it has been approved by the competent authority.

3. During the implementation of the Regulation, if there are any difficulties, the Heads of agricultural and rural development sector organizations, the People's Committees at the district and commune levels shall report in writing to the Department of Agriculture and Rural Development for consolidation and submission to the Chairman of the People's Committee of the province for consideration and decision./.
