THE MINISTER OF FINANCE
- Pursuant to Decree No. 118/2008/ND-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
- Pursuant to Circular No. 194/2009/TT-BTC dated October 2, 2009 of the Ministry of Finance guiding public tender offers for shares of public companies and investment fund certificates of closed-end public securities investment funds;
- At the proposal of the Chairman of the State Securities Commission,
DECISION:
Article 1. Amend Clause 1, Section III "Organizational Implementation" of Circular No. 194/2009/TT-BTC dated October 2, 2009 of the Ministry of Finance guiding public tender offers for shares of public companies and investment fund certificates of closed-end public securities investment funds, specifically as follows:
Current printed content: This Circular replaces Circular No. 18/2007/TT-BTC dated March 13, 2007 of the Ministry of Finance guiding the purchase and resale of shares and certain additional share issuance cases of public companies.
Amended content: This Circular abolishes the provisions on public tender offers set forth in Section III of Circular No. 18/2007/TT-BTC dated March 13, 2007 of the Ministry of Finance guiding the purchase and resale of shares and certain additional share issuance cases of public companies.
Article 2. This Decision takes effect simultaneously with the effective date of Circular No. 194/2009/TT-BTC dated October 2, 2009 of the Ministry of Finance.
Article 3. The Director of the Ministry's Office, the Chairman of the State Securities Commission, and the Heads of relevant units under the Ministry of Finance are responsible for implementing this Decision.
