Regarding the settlement of seniority allowances for
civil servants and employees of the Customs sector retiring
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Considering the proposal of the Minister of Labor, Invalids and Social Affairs.
DECISION:
Article 1.
1. Settlement the Customs seniority allowance system to calculate the retirement pension level for civil servants and employees of the Customs sector retiring from April 1, 1993 to November 30, 2007 who have worked before December 1, 2002 and have not yet enjoyed the Customs seniority allowance according to Clause 7, Article 3 of Decree No. 96/2002/NĐ-CP dated November 19, 2002 of the Government on the functions, tasks, powers, and organizational structure of the General Department of Vietnam Customs.
2. The Customs seniority allowance system stipulated in Clause 1 of this Article shall only be applied to calculate the retirement pension.
Article 2. The retirement pension of the subjects specified in Clause 1 of Article 1 of this Decision shall be calculated based on the average monthly social insurance contribution salary of the last five years including the Customs seniority allowance.
Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette.
The recalculated retirement pension for civil servants and employees of the Customs sector retiring from April 1, 1993 to December 31, 2006 according to this Decision shall be effective from January 1, 2007.
Article 4.
1. The Ministry of Labor, Invalids and Social Affairs shall be responsible for guiding the implementation of this Decision.
2. The Vietnam Social Security shall be responsible for calculating and implementing the monthly payment of the retirement pension benefit for civil servants and employees of the Customs sector retiring as stipulated in Clause 1 of Article 1 of this Decision.
