DECISION OF THE PRIME MINISTER
Regarding the approval of the adjustment to the Planning for Fishing Vessel Shelter Areas until 2010 and with a vision to 2020

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Fisheries Law on November 26, 2003;
Considering the proposal of the Minister of Fisheries (report No. 1954/TTr-BTS dated August 25, 2005, letter No. 2314/TTr-BTS dated October 4, 2005) and the opinions of relevant ministries and sectors: Planning and Investment (letter No. 6344/BKH-KTNN dated September 16, 2005), Finance (letter No. 11361/BTC-ĐT dated September 9, 2005), Transport (letter No. 5664/BGTVT-KHĐT dated September 14, 2005), National Committee for Search and Rescue (letter No. 67/UB dated September 12, 2005), Central Steering Committee for Flood and Storm Control (letter No. 229/CLBTW dated September 9, 2005),
DECISION:
Article 1. Approve the adjustment to the Planning for Fishing Vessel Shelter Areas until 2010 and with a vision to 2020, with the main contents as follows:
1. Objectives and planning viewpoints:
Fishing vessel shelter areas shall be constructed into a system based on fully utilizing natural conditions that are advantageous, close to fishing grounds and high-frequency storm areas, suitable for fishermen's customs, ensuring safety for people and fishing vessels, minimizing losses caused by storms to the lowest extent possible, and having the ability to combine with service provision for fishing vessels where conditions permit, thereby enhancing efficiency.
2. Scope of planning adjustment:
Adjust the locations of fishing vessel shelter areas in coastal provinces and cities and some islands.
Time frame for planning adjustment: until 2010 and with a vision to 2020.
3. Classification and orientation of criteria for constructing fishing vessel shelter areas:
Based on natural characteristics and fishermen's customs, the system of fishing vessel shelter areas will be classified according to the following selection criteria:
a) Regional-level shelter areas, meeting the following conditions:
- Near key fishing grounds, concentrating fishing vessels from multiple provinces, ensuring the shortest time for fishing vessels to move in to avoid storms.
- High-frequency storm sea area.
- Having favorable natural conditions, ensuring safety for fishing vessels anchoring to avoid storms.
- Capable of accommodating approximately 800 to 1,000 fishing vessels of various types (including those with up to 1,000 CV power and foreign fishing vessels).
b) Provincial-level shelter areas, meeting the following conditions:
- Near traditional fishing grounds of the locality, ensuring the shortest time for fishing vessels to move in to avoid storms.
- Having favorable natural conditions, ensuring safety for fishing vessels anchoring to avoid storms.
- Suitable for all types of local fishing vessels anchoring to avoid storms.
4. Planning the system of fishing vessel shelter areas until 2010 and with a vision to 2020 (attached to this Decision):
a) Planning according to criteria:
- Period 2006-2010: 75 shelter areas. Among them: 13 regional-level shelter areas, 62 provincial-level shelter areas.
- Orientation towards 2020: total of 98 shelter areas. Among them: 13 regional-level shelter areas, 85 provincial-level shelter areas.
b) Planning according to sea regions:
- Northern Gulf Sea Region: 28 shelter areas, including 25 coastal shelter areas and 3 island shelter areas (Cô Tô - Thanh Lân, Cát Bà, and Bạch Long Vỹ).
- Central Sea Region: 39 shelter areas, including 34 coastal shelter areas and 5 island shelter areas (Cồn Cỏ, Cù Lao Chàm, Lý Sơn, Đá Tây, Phú Quý).
- Southeastern Sea Region: 19 shelter areas, including 17 coastal shelter areas and 2 island shelter areas (Côn Đảo and Hòn Khoai).
- Southwest Sea Region: 12 shelter areas, including 7 coastal shelter areas and 5 island shelter areas (Nam Du, Hòn Tre, and 3 areas in Phú Quốc: An Thới, Mũi Gành Dầu, Vũng Trâu Nằm).
5. On investment policies and mechanisms
a) The central budget will support investment in major projects: channel dredging, construction of wave barriers, sand barriers, mooring piles, buoys, and signal light systems.
Central budget funds will be allocated in five-year plans, annually, and according to target programs based on approved investment projects by competent authorities in accordance with the law.
b) Local budgets will allocate annual funds to maintain infrastructure facilities of shelter areas and post-investment management costs.
c) Mobilize capital from various economic sectors to invest in production, business, and service facilities for fisheries as planned.
d) Management and implementation of investments and construction:
- The Ministry of Fisheries will directly manage and implement investments and construction for regional-level shelter areas.
- People's Committees of provinces and centrally-administered cities will directly manage and implement investments and construction for provincial-level shelter areas.
6. Priority projects:
In the period 2006-2010: prioritize investment in construction of regional-level shelter areas and unfinished projects with urgent needs.
Article 2. Implementation
1. The Ministry of Fisheries is responsible for:
a) Directing and guiding the implementation of the plan nationwide; developing and promulgating criteria for selecting, management regulations, and usage of fishing vessel shelter areas.
b) Coordinating with coastal localities to determine specific locations for fishing vessel shelter areas, ensuring compliance with objectives and criteria, avoiding dispersion, and prioritizing completion of each project.
c) Reviewing and approving investment construction projects for regional-level shelter areas, ensuring compliance with objectives, adherence to current laws, and bearing responsibility for their decisions.
d) Cooperating with related ministries, sectors, and coastal localities to organize reviews and draw lessons from the construction of fishing vessel shelter areas at each stage, ensuring effective implementation of the plan.
2. People's Committees of provinces and centrally-administered cities are responsible for:
a) Reviewing and approving investment construction projects for provincial-level fishing vessel shelter areas based on the agreement of the Ministry of Fisheries, ensuring compliance with objectives and adherence to current laws, and bearing responsibility for their decisions.
b) Managing and using shelter areas after construction, ensuring long-term and efficient use.
c) Allocate land use according to planning, balance capital allocation in five-year plans and annually based on the progress of investment and construction projects to implement the planning and ensure funding for maintenance and management of facilities.
d) Direct competent agencies to effectively carry out publicity and notification work regarding the location, scale, and service capacity of storm shelters and guide fishermen in safely deploying fishing vessels during storms; mobilize financial resources from various economic sectors to invest in building logistics service facilities serving fisheries at locations with favorable conditions, thereby increasing the efficiency of storm shelters.
3. The Ministry of Planning and Investment and the Ministry of Finance shall be responsible for balancing and allocating capital according to five-year plans and annually based on the progress of investment and construction projects to implement this planning, ensuring concentration and completion of each project.
Article 3. This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 135/2001/QĐ-TTg dated September 14, 2001.
Article 4. The Ministers of Fisheries, Planning and Investment, and Finance; the Chairpersons of the People's Committees of coastal provinces and cities; the Head of the Central Steering Committee for Flood and Storm Control; and the Chairman of the National Committee for Search and Rescue are responsible for implementing this Decision./.
