Regarding the issuance of certain support policies for ethnic minority households, policy-targeted households, poor households, near-poor households, and fishermen

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

According to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law;

Pursuant to Resolution No. 02/2008/NQ-CP dated January 9, 2008 of the Government on major measures to guide and implement the socio-economic development plan and state budget estimate for 2008;

Considering the proposal of the Minister of Finance,

DECISION:

Article 1. The Government implements certain support policies, including:

1. Providing cash equivalent to 5 liters of kerosene per year for households that are ethnic minorities, policy-targeted households, and poor households in areas without grid electricity.

2. Adjusting the health insurance purchase subsidy for the poor from VND 80,000/person/year to VND 130,000/person/year.

3. Subsidizing 50% of the value of health insurance cards for members of near-poor households participating in voluntary health insurance.

The implementation period for the provisions in Clause 1, 2, and 3 of this Article shall be applied from 2008.

4. Supporting fishermen in purchasing new or building new fishing vessels with engine power of 90HP or more or service vessels for fishing activities.

a) Conditions for support:

- New or newly built vessels with engine power of 90HP or more, having completed inspection registration procedures, hold fishing permits (for fishing vessels) or business registration certificates (for service vessels), and have completed vessel hull insurance and crew accident insurance purchases;

- New or newly built vessels must have brand new engines at 100% and meet economic-technical standards as prescribed by the Ministry of Agriculture and Rural Development;

- Fishermen must have legal residence addresses and engage in regular fishing activities confirmed by the People's Committee of communes, wards, or towns.

b) Level of support: VND 70,000,000/vessel/year.

5. Supporting fishermen to replace old engines with new fuel-efficient ones for fishing vessels with engine power of 40HP or more or service vessels supporting fishing activities.

a) Conditions for support:

- Fishing vessels and service vessels for fishing activities have completed inspection registration procedures, hold fishing permits, and participate in vessel hull insurance and crew accident insurance purchases;

- The People's Committee of communes, wards, or towns where fishermen reside confirms their regular fishing activities at sea;

- Installed engines must be brand new at 100% and meet economic-technical standards as prescribed by the Ministry of Agriculture and Rural Development.

b) Level of support:

- For engines of vessels with power from 40HP to less than 90HP: subsidize VND 10,000,000/engine/year;

- For engines of vessels with power of 90HP or more: subsidize VND 18,000,000/engine/year.

6. Supporting the cost of vessel hull insurance for fishing vessels with engine power of 40HP or more, service vessels for fishing activities, and crew accident insurance for workers under labor contracts on fishing vessels and service vessels.

a) Conditions for support:

- Fishing vessels with engine power of 40HP or more and service vessels for fishing activities have completed inspection registration procedures, hold fishing permits, and participate in vessel hull insurance and crew accident insurance purchases;

- Vessels currently engaged in fishing activities and hiring crew members under labor contracts of at least one year.

b) Level of support: The State will subsidize 30% of the cost of vessel hull insurance and 100% of the cost of crew accident insurance annually.

The implementation period for the provisions in Clause 4, 5, and 6 of this Article shall be applied from 2008 to 2010.

7. Supporting oil for fishermen who are owners of fishing vessels or service vessels for fishing activities.

a) Conditions for support:

- Owners of fishing vessels and service vessels operating for at least six months in a year, having completed vessel hull insurance and crew accident insurance purchases, and completed inspection and registration procedures for fishing vessels according to the law;

- Hold fishing permits; have legal residence addresses confirmed by the People's Committee of communes, wards, or towns;

- Must have confirmation from local authorities and border guards after each sea trip.

b) Level of support:

For vessels with engine power of 90HP or more: provide VND 8 million for each fishing trip. Support three times per year;

- For vessels with engine power from 40HP to less than 90HP: provide VND 5 million for each fishing trip. Support four times per year;

- For vessels with engine power less than 40HP: provide VND 3 million for each fishing trip. Support five times per year.

c) Implementation period: carried out in 2008.

Article 2. The source of funds to implement the support as stipulated in this Decision:

1. Central budget supports funding for localities that cannot balance their budgets independently.

2. Other localities allocate from their local budgets.

Article 3. Implement cash support through the State Treasury based on complete documentation and confirmation from relevant agencies as prescribed.

Article 4. Implementation

1. The Chairman of the People's Committee of provinces and centrally-administered cities is responsible for:

a) Directing, organizing, and supervising the implementation of support policies for the aforementioned beneficiaries as prescribed in this Decision;

b) Submitting quarterly reports on the implementation results to the Ministry of Finance and related agencies.

2. Ministry of Finance:

a) Cooperating with the Ministry of Agriculture and Rural Development, the Ministry of Labor, Invalids, and Social Affairs, and related sectors to establish application forms, procedures, and support processes to ensure accurate targeting; guiding provincial and municipal People's Committees to implement these support policies;

b) Timely allocating funds to localities that cannot balance their budgets independently to implement support policies as prescribed in this Decision;

c) Summarizing the implementation status of these support policies quarterly and reporting to the Prime Minister.

3. The Ministry of Agriculture and Rural Development:

a) Issuing economic-technical standards and norms for different types of fishing vessels according to their respective power levels for localities, organizations, and individuals to follow;

b) Leading and coordinating with the Ministry of Finance to establish application forms, procedures, and support processes for fishermen.

4. The Ministry of Health organizes and guides healthcare facilities to provide good medical services for the poor and near-poor with health insurance.

5. The Ministry of Labor, Invalids, and Social Affairs guides the identification of poor and near-poor households eligible for health insurance card purchase subsidies.

6. Other relevant ministries and sectors shall be responsible for guiding the implementation of this Decision.

Article 5. In case organizations or individuals commit violations in receiving State support, they shall have such support funds recovered and be subject to legal proceedings in accordance with the law.

Article 6. This Decision shall take effect from the date of signing.

Article 7. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
