REGARDING THE ISSUANCE OF REGULATIONS ON THE RECOGNITION OF CAPACITY FOR TESTING AND AUTHORIZATION TO TEST MEASURING INSTRUMENTS
and authorizing the inspection of measuring instruments
MINISTERMINISTRY OF SCIENCE, TECHNOLOGY AND ENVIRONMENT
Pursuant to the Measurement Ordinance dated October 6, 1999;
BASED ON Article 13 of Decree No. 06/2002/ND-CP dated January 14, 2002 of the Government detailing the implementation of the Ordinance on Measurement;
Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government on the tasks, powers, and organizational structure of the Ministry of Science, Technology, and Environment;
AT THE PROPOSAL OF THE Director General of the National Standard Measurement Quality Agency,
DECISION:
Article 1.ATTACHED TO THIS DECISION ARE THE "REGULATIONS ON THE RECOGNITION OF CAPACITY FOR TESTING AND AUTHORIZATION TO TEST MEASURING INSTRUMENTS."
Article 2.The Director General of the National Standard Measurement Quality Agency shall be responsible for guiding and supervising the implementation of this Decision.
Article 3.THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
Article 4.The National Standard Measurement Quality Agency, local standard measurement quality agencies, and related organizations and individuals shall be responsible for implementing this Decision.

1. General Provisions
1.1. ON THE RECOGNITION OF CAPACITY FOR TESTING MEASURING INSTRUMENTS
1.1.1. The recognition of capacity for testing measuring instruments is the act of the competent state management agency on measurement examining and assessing the testing capacity of provincial and central city standard measurement quality agencies and organizations under the National Standard Measurement Quality Agency (hereinafter referred to collectively as the organization) to recognize such organization's ability to test measuring instruments.
Testing of measuring instruments by the aforementioned organizations is considered lawful only after being recognized for testing capacity.
1.1.2. The examination and assessment for recognition of testing capacity must be based on the following conditions:
a) Having sufficient standards and testing equipment, ensuring laboratory temperature, pressure, humidity according to prescribed requirements, necessary facilities and workspace for testing according to current testing procedures;
b) Standards and measuring instruments used for testing must be tested and calibrated;
c) Having qualified metrology testers certified and issued with tester cards;
1.2. ON THE AUTHORIZATION TO TEST MEASURING INSTRUMENTS
1.2.1. The authorization to test measuring instruments is the act of the competent state management agency on measurement examining and assessing the testing capacity of agencies and organizations (hereinafter referred to collectively as the organization) not falling within the scope mentioned in Section 1.1.1 to authorize such organization's ability to test measuring instruments.
1.2.2. The examination for authorization to test is based on the actual testing needs of the industry, locality, facility, and users, and the testing capacity of the authorized organization.
1.2.3. Organizations requesting authorization to test must meet the conditions stipulated in Section 1.1.2 and have legal entity status, organizational structure, management system, and stable operations, ensuring impartiality and objectivity in testing.
1.3. The National Standard Measurement Quality Agency (hereinafter referred to as the Agency) is the competent state management agency on measurement with authority to recognize testing capacity and authorize national testing.
2. PROCEDURES FOR RECOGNITION OF CAPACITY FOR TESTING MEASURING INSTRUMENTS
2.1. RECOGNITION OF CAPACITY FOR TESTING MEASURING INSTRUMENTS
2.1.1. The organization requesting recognition of testing capacity prepares and submits an application dossier to the Agency.
The dossier includes:
a) An application form (in accordance with the model specified in Appendix 1);
b) A report on testing capacity (in accordance with the model specified in Appendix 2).
2.1.2. Receiving and processing the application dossier for recognition of testing capacity:
a) If the dossier does not comply with regulations, within five working days, the Agency will notify the organization requesting recognition of the contents that need to be supplemented and completed;
b) When the dossier complies with regulations, within one month, the Agency will organize an on-site examination and evaluation in accordance with the provisions of Section 4 of these Regulations.
2.1.3. Based on the results of the on-site evaluation, the Agency will examine and decide on recognition.
The decision on recognition of testing capacity must clearly specify the scope of recognition including: name, measurement range, grade/accuracy level, and testing regime for measuring instruments.
The validity period of the decision on recognition of testing capacity is five years.
2.2. RECOGNITION OF TESTING CAPACITY AGAIN
One year before the decision on recognition of testing capacity expires, the organization recognized for testing capacity must prepare and submit a re-recognition dossier to the Agency.
The dossier includes:
a) An application form (in accordance with the model specified in Appendix 3);
b) A report on testing activities during the recognition period (in accordance with the model specified in Appendix 4);
c) Inspection and audit records of the competent authority during the recognition period (if any).
Within ten working days, the Agency will examine the dossier and decide on re-recognition.
In cases where the dossier lacks sufficient grounds for re-recognition, the Agency will organize an on-site examination and evaluation in accordance with the provisions of Section 4 of these Regulations.
2.3. EXPANSION OF TESTING CAPACITY FOR MEASURING INSTRUMENTS
When there is a need to expand testing capacity for new measuring instruments or for recognized testing ranges, the organization recognized for testing capacity will prepare and submit an application dossier to the Agency.
The procedures for examination, evaluation, and decision-making for expanding testing capacity are carried out similarly to those for recognizing testing capacity.
3. PROCEDURES FOR AUTHORIZATION TO TEST MEASURING INSTRUMENTS
3.1. AUTHORIZATION TO TEST MEASURING INSTRUMENTS
3.1.1. The organization requesting authorization to test prepares and submits a dossier to the Agency and the local standard measurement quality agency (hereinafter referred to as the Agency).
The dossier includes:
a) An application form (in accordance with the model specified in Appendix 1);
b) A report on testing capacity (in accordance with the model specified in Appendix 2);
c) A copy of the document on the legal entity status of the organization.
3.1.2. Receiving and processing the dossier:
a) If the dossier does not comply with regulations, within five days, the Agency will notify and guide the organization requesting authorization to test on the contents that need to be supplemented and completed;
b) When the dossier complies with regulations, within ten working days at the latest, the Agency must provide comments on the request for authorization to test and send the comments to the Agency.
3.1.3. Examination and decision-making:
a) Based on the dossier of the organization requesting authorization and referring to the comments of the Agency, within one month, the Agency will organize an on-site examination and evaluation in accordance with the provisions of Section 4 of these Regulations.
b) Based on the results of on-site evaluation, the General Department shall consider and decide on the delegation of verification.
The decision on the delegation of verification must clearly specify the scope of the delegation including: name, measurement range, grade/accuracy level, and verification regime for measuring instruments.
The validity period of the Decision on the Delegation of Verification is three years.
3.2. Extension of the Delegation of Verification for Measuring Instruments
One month before the Decision on the Delegation of Verification expires, if the organization wishes to continue being delegated, it must prepare a request for extension of the delegation and submit it to the General Department.
The extension file includes:
a) An application form (in accordance with the model specified in Appendix 3);
b) Report on verification activities during the delegation period (according to the model prescribed in Appendix 4);
c) Inspection and audit records from competent authorities during the delegation period (if any).
Within ten working days, the General Department shall examine the file and decide on the extension.
In cases where the file does not contain sufficient grounds for deciding on the extension, the General Department shall organize an on-site evaluation on-site in accordance with the provisions of Section 4 of this Regulation.
3.3. Expansion of the Delegation of Verification for Measuring Instruments
When the verification capability is enhanced, the organization that has been delegated may prepare a request to expand the delegation of verification for new measuring instruments or for the already delegated verification ranges.
The procedures for examination, evaluation, and decision on expanding the delegation of verification shall be carried out similarly to those for requesting the delegation of verification.
4. On-Site Examination and Evaluation
4.1. The on-site examination and evaluation shall be conducted according to the following contents:
a) Reviewing the suitability of standards, verification equipment, temperature, pressure, humidity of the laboratory room, facilities, and workspace layout in accordance with the requirements stipulated in the verification process;
b) Reviewing the suitability of certified verification personnel in relation to the requirements of the proposed recognition or delegation of verification scope;
c) Reviewing the organizational structure, management system, and operations of the organization proposing recognition or delegation of verification to ensure objectivity, impartiality, and scientific approach in verification (directly responsible person for verification; responsibility division; record-keeping system, documents...).
4.2. The content of the on-site evaluation report includes:
a) Suitability of standards, verification equipment, temperature, pressure, humidity of the laboratory room, facilities, workspace layout, verification personnel, organizational structure, management system, and operations in accordance with the requirements stipulated for the verification of proposed recognized or delegated measuring instruments;
b) Issues that need to be addressed, supplemented, and improved;
c) List of measuring instruments proposed for recognition or delegation of verification
(specifying the name, measurement range, grade/accuracy level, and verification regime accordingly).
5. Suspension of Effectiveness of Recognition and Delegation of Verification for Measuring Instruments
5.1. When the organization recognized for verification capability or the organization delegated for verification (hereinafter referred to as the verification organization) can no longer maintain the conditions ensuring the recognized (Section 1.1.2) or delegated (Section 1.2.3) verification activities, the General Department of Standardization, Metrology, and Quality Control shall issue a Decision to suspend partially or entirely the verification activities.
5.2. Upon issuance of a partial or full suspension decision, the verification organization must cease the verification activities specified in the Decision and implement corrective actions to meet the required conditions. After completing the corrective actions, the verification organization shall report to the General Department for review and decision regarding the suspended verification activities.
6. Verification Seal, Verification Label, and Verification Certificate for Measuring Instruments
The use and management of verification seals, labels, and certificates by verification organizations must comply with the regulations issued together with Decision No. 59/2001/QĐ-BKHCNMT dated November 13, 2001, of the Minister of Science, Technology, and Environment.
7. Responsibilities of Verification Organizations for Measuring Instruments
7.1. Maintaining the conditions ensuring recognized or delegated verification activities;
7.2. Conducting verification within the recognized or delegated scope in accordance with the current verification procedures, meeting the requirements of registration bodies for verification of measuring instruments;
7.3. Retaining complete verification files;
7.4. Reporting verification activities to the General Department and the local Bureau of Standardization, Metrology, and Quality Control (for delegated verification organizations) once a year before December 15 (according to the model prescribed in Appendix 4);
7.5. Adhering to inspection and audit requirements related to metrology as prescribed.
8. Inspection and Audit of Verification Organizations for Measuring Instruments
8.1. State management agencies at all levels within their functions, tasks, and authority shall conduct inspections to ensure compliance with regulations in verification activities of verification organizations.
8.2. Audits of verification activities of verification organizations shall be carried out in accordance with specialized audit regulations on metrology./.
