THE MINISTER OF POSTS AND TELECOMMUNICATIONS

Pursuant to Decree No. 90/2002/ND-CP dated November 11, 2002 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decision No. 217/2003/QĐ-TTg dated October 27, 2003 of the Prime Minister on managing service charge prices for postal and telecommunications services;

Considering the proposal of Vietnam Post and Telecommunications Corporation at Document No. 3536/GCTT dated June 18, 2004 regarding mobile phone service rates;

At the proposal of the Director of the Department of Planning and Finance;

DECISION:

Article 1. Issuing prepaid GSM mobile phone service rates of Vietnam Post and Telecommunications Corporation as follows:

1.1. Rates for outgoing calls from prepaid mobile subscribers shall be determined by the enterprise subject to the following conditions:

+ The maximum rate shall not exceed 3,000 VND/minute (1,500 VND/block of 30 seconds).

+ The minimum rate shall not be less than 2,364 VND/minute (1,182 VND/block of 30 seconds).

1.2. The billing unit is a block of 30 seconds; any remainder of the last block of the call that is less than 30 seconds shall be rounded up to 30 seconds. A call shorter than 30 seconds shall be charged for one block of 30 seconds.

1.3. International call rates for prepaid mobile services shall be calculated by adding domestic mobile information rates to international telephone call rates according to the current international telephone rate table. Calculation method as follows:

1.4. No connection fee or monthly subscription fee shall be charged for prepaid mobile phone subscribers.

1.5. Information call rates from postpaid mobile subscribers on GSM networks of the Corporation, from fixed network subscribers, from mobile subscribers on Callink, Mobilenet networks, from mobile subscribers using CDMA technology of the Corporation, and from mobile end-user terminal subscribers in local radio networks calling prepaid mobile phone subscribers shall be applied according to the current postpaid GSM mobile information rates of the Corporation.

1.6. Information call rates from mobile subscribers of other networks calling prepaid GSM mobile subscribers of the Corporation shall be applied according to the rates of those mobile networks.

1.7. Information rates and service call rates from public points (post offices, agents, commune post and culture centers, card phone stations) to prepaid GSM mobile phones shall be applied according to the information rates and service call rates from public points to postpaid GSM mobile phones.

1.8. After adding value-added tax, prepaid mobile call rates in cases specified in Points 1.1, 1.2, 1.3, 1.5, 1.6, and 1.7 above shall be rounded off according to the following principles:

+ Any fraction greater than or equal to 50 VND shall be rounded up to 100 VND.

+ Any fraction less than 50 VND shall be rounded down to 0 VND.

1.9. Mobile information rates for prepaid services shall be collected from the calling subscriber.

Article 2. The rates specified in this Decision do not include value-added tax.

Article 3. Vietnam Post and Telecommunications Corporation:

- Specifying specific rate levels within the rate framework stipulated in Article 1. When issuing the rate table within its authority, the Corporation shall notify the Ministry of Posts and Telecommunications before the decision takes effect.

- Specifying the issuance of various card denominations, card usage periods, and reporting to the Ministry of Posts and Telecommunications.

- Specifying a reduction in mobile information rates for outgoing calls from prepaid mobile phone subscribers during holidays, compensatory days for holidays, Saturdays, Sundays, from midnight until 7 AM on weekdays from Monday to Friday, but the maximum reduction shall not exceed 30% of the rates stipulated in Article 1.

Article 4. These provisions in this Decision apply to users of prepaid mobile information services of Vietnam Post and Telecommunications Corporation.

Article 5. This Decision shall take effect 15 days after publication in the Official Gazette. Previous regulations contrary to this Decision are hereby abolished.

Article 6. The Director of the Office, the Head of the Planning and Finance Department, the Management Board, the General Director of Vietnam Post and Telecommunications Corporation, and the heads of related units are responsible for implementing this Decision./.
