Issuing the Regulation on the Organization and Operation of the Conformity Assessment Board
under the General Department of Standardization, Metrology and Quality
THE MINISTER OF SCIENCE AND TECHNOLOGY
Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;
Pursuant to Decision No. 140/2004/QĐ-TTg dated August 5, 2004 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Standardization, Metrology and Quality;
Considering the proposal of the Director of the General Department of Standardization, Metrology and Quality, the Head of the Organization and Cadre Affairs Department,
DECISION:
Article 1. This Decision promulgates the Regulation on the Organization and Operation of the Conformity Assessment Board under the Standardization, Metrology, and Quality Control General Department.
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The Heads of the Office, the Heads of the Cadre and Civil Servant Organization Department, the Directors of the Standardization, Metrology, and Quality Control General Department, the Heads of related units, and the Heads of the Conformity Assessment Board shall be responsible for implementing this Decision.
REGULATIONS
ORGANIZATION AND OPERATIONS OF THE CONFORMITY ASSESSMENT BOARD

PART I
FUNCTIONS, TASKS, AND POWERS
Article 1. The Conformity Assessment Board is an organization under the Standardization, Metrology, and Quality Control General Department with the function of assisting the Director-General in managing conformity assessment activities.
Article 2. The Conformity Assessment Board has the following specific tasks and powers:
1. Proposing and primarily drafting legal normative documents on quality management, guiding and organizing the implementation of such documents after their issuance.
2. Proposing and primarily drafting plans, policies, and regulations on quality management, guiding and organizing the implementation of such documents after their approval.
3. Drafting principles, conditions, and criteria for organizations engaged in certification, recognition, and quality inspection; drafting regulations on the operation of quality certification and recognition.
4. Drafting lists of products and goods subject to state quality inspections, inspection bases, and lists of organizations designated to conduct product and good quality inspections.
5. Cooperating with relevant state agencies in designating technical service organizations to participate in state management of quality for products and goods within the jurisdiction of the Ministry of Science and Technology.
6. Participating in the implementation of bilateral and multilateral mutual recognition agreements (MRAs) in the field of quality management.
7. Summarizing and reporting on the situation and results of conformity assessment activities of ministries, sectors, localities, and establishments.
8. Participating in international cooperation activities, scientific research, organizing training, and disseminating information about quality management activities.
9. Monitoring and proposing the management of associations and non-governmental organizations operating in the field of conformity assessment according to the provisions of the law.
10. Managing civil servants, files, documents, and assets of the Board according to the regulations of the General Department.
11. Performing other tasks assigned by the Director-General.
Chapter II
ORGANIZATIONAL STRUCTURE
Article 3. The Conformity Assessment Board operates under a specialist system combined with a chief executive system. The leadership of the Board consists of the Head and several Deputy Heads.
The Head of the Conformity Assessment Board is responsible before the Director-General and the law for the entire organization and operations of the Board.
The Deputy Heads perform specialized tasks and assist the Head in managing one or more aspects of work as assigned by the Head, and are responsible before the Head and the law for the tasks assigned to them.
Specialists carry out specialized tasks assigned by the Chairman and are responsible to the Chairman for the performance of those tasks.
In the absence of the Chairman, a Deputy Chairman is authorized to manage the Committee's operations and is responsible for decisions made by the authorized Deputy Chairman.
Article 4. The appointment and removal of Committee leadership are carried out according to state regulations, the Ministry of Science and Technology, and the General Department of Standardization, Metrology and Quality.
Chapter III
WORK RELATIONSHIPS
Article 5. The Head of the Conformity Assessment Board directs all activities of the Board based on this Regulation and the working regulations of the Standardization, Metrology, and Quality Control General Department.
Article 6. The Head of the Conformity Assessment Board implements the working system and relationships with heads of subordinate units under the General Department's working regulations and other directives of the Director-General.
Article 7. The Conformity Assessment Board is responsible for closely collaborating with organizations assisting the Director-General and related units to fulfill its tasks.
Chapter IV
IMPLEMENTING PROVISIONS
Article 8. The Head of the Conformity Assessment Board coordinates with the Head of the Cadre and Civil Servant Organization Board to implement this Regulation according to the directives of the Director-General of the Standardization, Metrology, and Quality Control General Department.
Article 9. Any amendments or supplements to this Regulation shall be proposed by the Director of the General Department of Standardization, Metrology and Quality in coordination with the Head of the Organization and Cadre Affairs Department to the Minister of Science and Technology for consideration and decision./.
