DECISION OF THE MINISTER OF AQUATIC RESOURCES

Regarding Strengthening Inspection of Aquatic Products Exported to the United States and Canada

Pursuant to Decree No. 43/2003/NĐ-CP dated May 2, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Fisheries;

Pursuant to Directive No. 37/2005/CT-TTg dated October 28, 2005 of the Prime Minister on certain measures to strengthen management of chemicals and antibiotics used in food production and business;

Based on the quality control and food safety requirements for aquatic products of the markets of the United States and Canada;

At the proposal of the Director of the Quality Management Bureau,

 

DECISION:

 

Article 1. To implement inspection and certification of quality and food safety for 100% of consignments belonging to three product groups: pangasius, tra catfish; shrimp; crab and lobster meat exported to the United States and Canada for the following chemical and antibiotic indices: as follows:

- For export to the United States: inspect the Malachite Green (MG), Leucomalachite Green (LMG), and Fluoroquinolone (Enrofloxacin, Ciprofloxacin, and Flumequine) indices for pangasius and tra catfish; inspect Chloramphenicol (CAP) and Nitrofurans (NTRs) indices for shrimp products; inspect Chloramphenicol index for crab and lobster meat;

- For export to Canada: inspect the Chloramphenicol, Malachite Green, and Leucomalachite Green indices for pangasius and tra catfish products.

Article 2. The Quality Management, Food Safety, and Aquatic Animal Health Bureau shall issue a Certificate of Quality and Food Safety for all consignments subject to inspection under Article 1 if the inspection and analysis results from the laboratories mentioned in Article 3 for exported consignments meet the requirements stipulated by the markets of the United States and Canada.

Article 3. Laboratories recognized as meeting ISO 17025 standards and equivalent for testing residual chemical and antibiotic indices mentioned in Article 1 are permitted to conduct testing samples for issuing quality certificates and food safety certificates for consignments subject to inspection. Enterprises must notify the Quality Management, Food Safety, and Aquatic Animal Health Bureau of the name of the laboratory meeting the standard that the enterprise intends to send samples for testing along with a valid copy of the laboratory's certification.

Article 4. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 5. The Head of the Ministry’s Office, Heads of Departments, Bureaus, Inspectors General of the Ministry, Heads of subordinate units of the Ministry, Directors of Fisheries Departments, Departments of Agriculture and Rural Development managing fisheries, and enterprises processing and exporting aquatic products are responsible for implementing this decision./.
