Pursuant to Decree No. 86/2003/ND-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 153/2005/ND-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspections;

Pursuant to Decree No. 119/2006/ND-CP dated October 16, 2006 of the Government on the organization and operation of Forest Protection;

Considering the proposal of the Director of the Forest Protection Service, the Head of the Inspection Department of the Ministry, and the Director of the Personnel Department.

DECISION:

Article 1. Position and Functions

The Inspection Department of the Forest Protection Service is an organization under the Forest Protection Service and simultaneously part of the Agricultural and Rural Development Inspection system, with the function of administrative inspection and specialized inspection within the scope of state management of the Forest Protection Service as prescribed by law. The Inspection Department of the Forest Protection Service is directly managed and directed by the Director of the Forest Protection Service; at the same time, it is directed and guided on inspection business by the Inspection Department of the Ministry of Agriculture and Rural Development. The Inspection Department of the Forest Protection Service uses the seal of the Forest Protection Service in its professional activities.

Article 2. Tasks and Powers of the Inspection Department

The Inspection Department of the Forest Protection Service has the tasks and powers as prescribed in Article 9 of Decree No. 153/2005/ND-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspections, as well as other provisions of law, and some additional tasks and powers as follows:

1. Participate in drafting legal regulations on inspections, complaints, and anti-corruption.

2. Advise the Director of the Forest Protection Service on administrative penalties according to the provisions of law.

3. Be responsible for citizen reception work; advise on organizing activities to prevent corruption within the Forest Protection force.

4. Perform other tasks assigned by the Director of the Forest Protection Service.

Article 3. Tasks and Powers of the Head of the Inspection Department

The Head of the Inspection Department of the Forest Protection Service performs tasks and powers as prescribed in Article 10 of Decree No. 153/2005/ND-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspections, as well as other provisions of law, and specific tasks and powers as follows:

1. Recommend the Director of the Forest Protection Service to consider suspending or recommending competent authorities to suspend illegal acts concerning forest management, forest protection, and forestry products when there is sufficient evidence that such acts cause damage to national interests, the rights and legitimate interests of citizens, or hinder inspection work.

2. Monitor, inspect, and urge the implementation of conclusions, recommendations, and decisions on inspections.

3. Recommend the Director of the Forest Protection Service to resolve issues related to inspection work. Report to the Head of the Inspection Department of the Ministry on inspection work, complaint resolution, and anti-corruption within their scope of responsibility.

Article 4. Organizational Structure

1. The Inspection Department of the Forest Protection Service has a Head of the Inspection Department, Deputy Heads of the Inspection Department, and Inspectors.

a) The appointment and removal of the Head and Deputy Heads of the Inspection Department shall be carried out in accordance with Clause 2, Article 8 of Decree No. 153/2005/ND-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspections. The Head of the Inspection Department is responsible to the Director of the Forest Protection Service and to the law for the performance of assigned tasks. The Deputy Heads assist the Head of the Inspection Department, are assigned to oversee specific areas, and are responsible to the Head of the Inspection Department and to the law for the performance of assigned tasks.

b) The appointment and removal of Inspectors of the Forest Protection Service shall be carried out in accordance with the law. Inspectors are responsible to the Head of the Inspection Department and to the law for the performance of assigned tasks; they have obligations and rights as prescribed by law.

2. The Director of the Forest Protection Service arranges civil servants of the Inspection Department within the staffing quota of the Service allocated by the Minister of Agriculture and Rural Development.

Article 5. Work relations of the Inspection Department

1. The Ministry of Agriculture and Rural Development's Inspectorate guides and trains inspection business for the Forest Protection Bureau's Inspectorate.

2. Cooperates with units under the Bureau, with inspection agencies of other sectors and authorities at all levels, and state agencies with competent authority during the inspection process of cases and in preventing and stopping violations of laws.

3. Exchanges professional and business information on forest management, forest protection, and timber management with the Inspectorates of Departments of Agriculture and Rural Development of provinces and centrally governed cities.

Article 6. Effectiveness and Responsibility for Implementation

1. This Decision takes effect fifteen days from the date of publication in the Official Gazette. Abolishes previous regulations of the Ministry of Agriculture and Rural Development that conflict with this Decision.

2. The Director of the Ministry’s Office, the Head of the Ministry’s Inspectorate, the Director of the Personnel Organization Department, the Chief of the Forest Protection Bureau, heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Decision.
