Circular No. 29/2009/TT-BLDTBXH guiding the implementation of preferential policies for individuals who were engaged in revolutionary activities before January 1, 1945 and those who were engaged in revolutionary activities from January 1, 1945 to before the August 19 Revolution in 1945.

CIRCULAR

Guidelines for Implementing Preferential Treatment for Individuals Engaged in Revolutionary Activities Before January 1, 1945 and Those Engaged in Revolutionary Activities from January 1, 1945 to Before the August 19 Revolution in 1945

Pursuant to Decree No. 89/2008/NĐ-CP dated August 13, 2008 of the Government guiding the implementation of the Ordinance Amending and Supplementing Certain Provisions of the Ordinance on Preferential Treatment for Individuals with Merit for the Revolution;

The Ministry of Labor, Invalids, and Social Affairs hereby provides specific guidelines as follows:

Article 1. Eligible Subjects

1. Individuals engaged in revolutionary activities before January 1, 1945 have been recognized by competent authorities through decisions.

2. Individuals engaged in revolutionary activities from January 1, 1945 to before the August 19 Revolution in 1945 have been recognized by competent authorities through decisions.

Article 2. Preferential Treatment Regime

Implemented according to the provisions of Articles 1 and 2 of Decree No. 89/2008/NĐ-CP dated August 13, 2008 of the Government.

Article 3. Documentation for Receiving Preferential Treatment

1. For individuals still alive:

a) Decision recognizing revolutionary activists before January 1, 1945 or decision recognizing individuals engaged in revolutionary activities from January 1, 1945 to before the August 19 Revolution in 1945.

b) Decision implementing preferential treatment issued by the Director of the Department of Labor, Invalids, and Social Affairs where the revolutionary activist resides (Form LT1 or Form TKN1).

c) Subsidy certificate issued by the Director of the Department of Labor, Invalids, and Social Affairs (Form LT2 or Form TKN2).

2. For individuals who have died:

a) Decision recognizing revolutionary activists before January 1, 1945 or decision recognizing individuals engaged in revolutionary activities from January 1, 1945 to before the August 19 Revolution in 1945.

b) A copy of the application for one-time subsidy, confirmed by the People's Committee of the commune where the deceased resided, made by one of the relatives such as father, mother, wife, or husband; if there is no father, mother, wife, or husband, then by the child (authorized by other children); if there is no father, mother, wife, husband, or child, then by the person responsible for worship (authorized by the family).

c) Decision on one-time subsidy issued by the Director of the Department of Labor, Invalids, and Social Affairs where the applicant resides (Form LT3 or Form TKN3).

Article 4. Responsibilities of the Department of Labor, Invalids, and Social Affairs

1. Receiving documents:

a) Issue decisions recognizing revolutionary activists before January 1, 1945 or decisions recognizing individuals engaged in revolutionary activities from January 1, 1945 to before the August 19 Revolution in 1945 for living individuals.

b) Issue decisions recognizing revolutionary activists before January 1, 1945 or decisions recognizing individuals engaged in revolutionary activities from January 1, 1945 to before the August 19 Revolution in 1945 and the declaration of relatives or authorized persons for deceased individuals.

2. The Director of the Department of Labor, Invalids, and Social Affairs issues decisions on subsidies and preferential allowances.

3. Prepare preferential subsidy certificates.

4. Send the following documents to the Ministry of Labor, Invalids, and Social Affairs (Department of Persons with Merit):

a) List (Form No. 1) and summary (Form No. 2)

b) Letter requesting funding from the Provincial People's Committee or the People's Committee of a centrally governed city.

5. Documentation for implementing preferential treatment shall be retained by the Department of Labor, Invalids, and Social Affairs.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The People's Committee of provinces and centrally governed cities shall direct the Department of Labor, Invalids, and Social Affairs and relevant agencies to disseminate, publicize, and fully and accurately implement the provisions of this Circular.

2. This Circular takes effect 45 days from the date of issuance and replaces Section I Part I of Circular No. 07/2006/TT-BLDTBXH dated July 26, 2006; Point 1 of Circular No. 02/2007/TT-BLDTBXH dated January 16, 2007 of the Ministry of Labor, Invalids, and Social Affairs.

Any difficulties encountered during the implementation of preferential treatment should be reported to the Ministry of Labor, Invalids, and Social Affairs for consideration and resolution./.
