Guidelines on staffing norms for public vocational training centers

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;
After receiving the unified opinion of the Ministry of Home Affairs in Circular No. 3181/BNV-TCBC dated September 15, 2010, the Ministry of Labor, Invalids, and Social Affairs issues guidelines on staffing norms for public vocational training centers as follows:
Article 1. Scope of Regulation and Applicability

This Circular guides the staffing norms for public vocational training centers, including: leadership and management; teaching staff and personnel engaged in training activities, organization, administration, management, equipment, accounting, and finance.
Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.
This Circular applies to public vocational training centers directly under the Department of Labor, Invalids, and Social Affairs; public vocational training centers directly under People's Committees at districts, counties, cities, and towns within provinces (hereinafter referred to collectively as People's Committees at district level).
Article 2. Basis for determining staffing norms for public vocational training centers
The staffing norms for public vocational training centers are determined based on the following grounds:
1. Job positions that are appropriate to the functions, tasks, powers, and organizational structure of public vocational training centers as prescribed by the competent authority.
2. The scale of training at public vocational training centers.
3. Teaching hours for leaders, managers, and teachers implemented according to Clause 1, Section III of Circular No. 09/2008/TT-BLDTBXH dated June 27, 2008 of the Minister of Labor, Invalids, and Social Affairs guiding working conditions for vocational teachers.
4. Personnel engaged in training activities, organization, administration, management, equipment, accounting, and finance at the center, as prescribed in this Circular, in addition to performing their duties and responsibilities associated with job titles, must also undertake additional tasks assigned by the Director.
Article 3. Staffing Norms
1. Staffing for leadership and management of the center
Each center shall have a director and not more than two deputy directors.
2. Staffing for vocational teachers
The staffing for teachers at the center is determined at a ratio of one teacher for every twenty equivalent students.
3. Staffing for training activities, organization, administration, management, equipment, accounting, and finance
Each center shall be allocated at least three staff members for training activities, organization, administration, management, equipment, accounting, and finance, distributed as follows:
a) Training activities and equipment: one staff member.
b) Organization, administration, and management: one staff member.
c) Accounting and finance: one staff member.
Based on the tasks, organizational structure, and scale of training of each public vocational training center, the People's Committee of the province shall submit to the Provincial People's Council for decision to supplement staffing for training activities, organization, administration, management, equipment, accounting, and finance, but not exceeding 25% of the total staffing of the center.
Article 4. Effective date
This Circular takes effect 45 days from the date of signature.
Article 5. Responsibilities for Implementation
1. Chairpersons of People's Councils, People's Committees of provinces and centrally-administered cities, relevant agencies, and organizations are responsible for implementing this Circular.
2. In the course of implementation, if there are any difficulties, please report to the Ministry of Labor, Invalids, and Social Affairs for study, consideration, and resolution within its jurisdiction./.
