CIRCULAR

Amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 issued bythe Minister of Science and Technology guiding on the development and application of standards

BASED ON THE LAW ON STANDARDS AND TECHNICAL REGULATIONS dated June 29, 2006;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Considering the proposal of the General Director of the Standardization, Metrology and Quality Control Department;

The Minister of Science and Technology stipulates:

Article 1. Amending and supplementing certain Articles of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 issued by the Minister of Science and Technology guiding on the development and application of standards as follows:

1. Amending and supplementing Point 3.1 Clause 3 Section II as follows:

1.1. Amending and supplementing Item 4 Step 2 of Point 3.1 as follows:

"- The lead agency designated in accordance with Clause 2 Article 21 Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government (hereinafter referred to as the Lead Agency) organizes the review of the draft TCVN submission file to examine the completeness and validity of the draft TCVN submission file in accordance with Clause 1 Article 5 Decree No. 127/2007/NĐ-CP dated August 1, 2007. - The results of the review are recorded in a review report and attached to the draft TCVN submission file for transfer to the Ministry of Science and Technology to organize the examination."

1.2. Supplementing Item 6 Step 2 of Point 3.1 with the following content:

"- The organization compiling shall: + Request the draft TCVN drafting board to perfect the draft TCVN and the submission file based on the review report; + Submit the perfected draft TCVN submission file to the competent ministry or sector (through the Lead Agency) for consideration and decision on transferring the draft TCVN submission file to the General Department of Standardization, Metrology and Quality Control for examination. The draft TCVN submission file for examination may be prepared for one or several draft TCVNs within the same standard field."

1.3. Amending and supplementing Step 4 of Point 3.1 as follows:

" - The General Department of Standardization, Metrology and Quality Control shall organize the examination of the examination results and carry out the procedure for announcing the TCVN as follows: + The General Department of Standardization, Metrology and Quality Control shall notify the examination results to the competent ministry or sector (through the Lead Agency) to transfer the draft national standard compilation organization to complete the draft TCVN according to the conclusion of the examination committee; + After completing the draft national standard, the compilation organization shall submit the draft TCVN submission file to the competent ministry or sector (through the Lead Agency) for transfer to the Ministry of Science and Technology (through the General Department of Standardization, Metrology and Quality Control); + The General Department of Standardization, Metrology and Quality Control shall prepare the draft TCVN submission file for the Minister of Science and Technology to announce. - The Ministry of Science and Technology shall report

2. Amending the last two paragraphs of Point 6.2 Clause 6 Section II as follows:

"In special cases, when a national standard is developed based on the acceptance of an international management system standard (ISO 9000, ISO 14000, ISO 18000, ISO/IEC 27000,...), the national standard code is sequentially expressed from left to right as follows: the abbreviated term TCVN, followed by a space (auto space), the accepted international standard abbreviation, a space, the accepted international standard number, a colon (:), the year of publication of the national standard and the full code of the accepted international standard enclosed in parentheses.

Example: TCVN ISO/IEC 17011:2007 (ISO/IEC 17011:2004) is the code of the national standard developed based on the complete acceptance of the international standard ISO/IEC 17011:2004 and published in 2007. When displayed on the cover page of the national standard, the code is shown as follows: TCVN ISO/IEC 17011:2007 ISO/IEC 17011:2004".

3. Supplementing Appendix V "Basic Requirements for Compilation Organizations" accompanying this Circular.

Article 2.The General Department of Standardization, Metrology and Quality Control is responsible for guiding and organizing the implementation of this Circular.

Article 3

1. This Circular takes effect from January 1, 2012.

2. In case the legal normative documents cited in Circular No. 21/2007/TT-BKHCN dated September 28, 2007 issued by the Minister of Science and Technology and this Circular are amended, supplemented or replaced, they shall be implemented according to the new documents.

3. The Director of the General Department of Standardization, Metrology and Quality Control, the Head of the Legal Affairs Department and relevant organizations and individuals are responsible for implementing this Circular.
