Issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam

Pursuant to the Law on Quality of Products and Commodities dated November 21, 2007;

On the basis of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP amending Article 3 of Decree No. 01/2008/NĐ-CP of the Government;

On the basis of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use; Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Quality of Products and Commodities;

On the basis of Circular No. 36/2010/TT-BNNPTNT dated June 24, 2010 of the Minister of Agriculture and Rural Development promulgating regulations on fertilizer production, business, and use;

Article 1. Issued together with this Circular

1. The supplementary list of fertilizers permitted for production, business, and use in Vietnam (Annex 01 attached) includes 556 types, divided into:

a) Single fertilizers for basal application: 01 type;

b) Mineral single fertilizers: 01 type;

c) Organic fertilizers: 03 types;

d) Microbial fertilizers: 20 types;

đ) Organic microbial fertilizers: 38 types;

e) Biological organic fertilizers: 44 types;

g) Organic mineral fertilizers: 60 types;

h) Foliar fertilizers: 385 types;

i) Fertilizers with added substances to enhance fertilizer efficiency: 02 types;

k) Soil conditioners: 01 type;

l) Raw materials for fertilizer production: 01 type.

2. The list of fertilizers replacing existing types in the list of fertilizers permitted for production, business, and use in Vietnam (Annex 02 attached) includes 130 types, divided into:

a) Organic fertilizers: 07 types;

b) Microbial fertilizers: 05 types;

c) Organic microbial fertilizers: 18 types;

d) Biological organic fertilizers: 18 types;

đ) Organic mineral fertilizers: 18 types;

e) Foliar fertilizers: 64 types.

Article 2. This Circular shall take effect forty-five days from the date of issuance and replace Decision No. 77/2005/QĐ-BNN dated November 23, 2005 of the Minister of Agriculture and Rural Development.

Article 3. The Director of the Ministry's Office, the Director of the Crop Production Department, the Director of the Science, Technology, and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally governed cities, and the heads of relevant units are responsible for implementing this Circular.
