Article 24stipulates the contents of the Preliminary Safety Analysis Reportin the application dossier for approval of the nuclear power plant site

Pursuant to the Atomic Energy Law dated June 3, 2008;

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 70/2010/ND-CP dated June 22, 2010 of the Government detailing and guiding the implementation of certain provisions of the Atomic Energy Law regarding nuclear power plants;

On the proposal of the Director of the Radiation and Nuclear Safety Agency;

The Minister of Science and Technology issues this Circular stipulating the contents of the Preliminary Safety Analysis Report in the application dossier for approval of the nuclear power plant site as follows:

Article 1. Scope of Regulation

This Circular stipulates the contents of the Preliminary Safety Analysis Report in the application dossier for approval of the nuclear power plant site; the dossier, procedures, formalities, time limit for review, and reporting the results of the review.

Article 2. Applicability

This Circular applies to the project proponent and agencies and organizations participating in the preparation, review, and approval of the Preliminary Safety Analysis Report; related consulting organizations.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Location Nuclear power plant includes the entire area with reactor building, turbine house, important safety systems of the nuclear power plant, and other auxiliary facilities, typically covering an area of about 1 to 2 square kilometers, surrounded by protective fences.

2. Vicinity of the nuclear power plant is the surrounding area around the nuclear power plant site, typically a circular area with a radius of 8 kilometers from the nuclear reactor; if necessary, the vicinity of the nuclear power plant may be expanded to cover all phenomena and processes that need to be surveyed and studied for the purpose of evaluating the site's safety.

3. Sub-region is the area surrounding the vicinity of the nuclear power plant, typically a circular area with a radius of 40 kilometers from the nuclear reactor; if necessary, the size of the sub-region may be expanded, or an asymmetric sub-region may be selected to cover all phenomena and processes that need to be surveyed and studied for the purpose of evaluating the site's safety.

4. Inter-regional is the area surrounding the sub-region, typically a circular area with a radius of 320 kilometers from the nuclear reactor; the size of the survey region may vary depending on geological and tectonic characteristics; the shape of the survey region may be asymmetric to cover all earthquake sources that need to be considered.

Article 4. Contents of the Preliminary Safety Analysis Report

1. The Preliminary Safety Analysis Report includes five (5) contents: general introduction; general description of the nuclear power plant; site evaluation; accident response; environmental aspects.

2. The contents of the Preliminary Safety Analysis Report are detailed in the Appendix attached to this Circular.

Article 5. Dossier, Procedures, Formalities, Time Limit for Review, and Reporting the Results of the Review of the Preliminary Safety Analysis Report

1. The project proponent submits six (6) sets of dossiers in Vietnamese (one original set, five copies) and five (5) sets of dossiers translated into English of the Preliminary Safety Analysis Report and the document requesting review to the Radiation and Nuclear Safety Administration, Ministry of Science and Technology.

The project proponent commits in writing and is responsible under the law for the accuracy of the English-language dossiers compared to the original Vietnamese-language dossiers.

2. The Radiation and Nuclear Safety Administration checks the validity of the dossier within fifteen (15) days from the date of receipt of the dossier and has the right to request the project proponent to supplement necessary documents.

3. The Radiation and Nuclear Safety Administration organizes the review of the Preliminary Safety Analysis Report within six (6) months from the date of receipt of valid dossiers or the date of receipt of supplementary documents as specified in Clause 2 of this Article.

4. If necessary, the Radiation and Nuclear Safety Administration develops a plan to hire domestic and foreign independent organizations or experts to support the review work, reports to the Minister of Science and Technology for consideration and reporting to the Prime Minister.

5. The Radiation and Nuclear Safety Administration reports the results of the review of the Preliminary Safety Analysis Report to the National Nuclear Safety Council, submits the results of the review of the Preliminary Safety Analysis Report for approval by the Minister of Science and Technology, and simultaneously informs the project proponent of the results of the review.

Article 6. Effectiveness

1. This Circular takes effect forty-five (45) days from the date of issuance.

2. During implementation, if there are difficulties, agencies, organizations, and individuals shall promptly reflect them to the Ministry of Science and Technology for consideration and amendment./.
